<section id="H547E5E51CBC54546852840DFDD56C940" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting All Communities Equally Act of 2023</short-title></quote> or as the <quote><short-title>PACE Act of 2023</short-title></quote>.</text></section> <section id="HA9217E3D748C48019A0A451BD724589D"><enum>2.</enum><header>Requirement of availability of cash bail for certain offenders</header><text display-inline="no-display-inline">If monetary bail has been prohibited in a State or any political subdivision thereof, the courts of that State shall have the authority—</text>
<paragraph id="H4B50CCA189D442AD9B9A8D061E01967B"><enum>(1)</enum><text>to determine the dangerousness of individuals before the courts on criminal charges; and</text></paragraph> <paragraph id="HA874D2AE87674FD0967C63371E64BEEC"><enum>(2)</enum><text>to hold on bail individuals who are determined to be violent and/or repeat offenders.</text></paragraph></section>
<section id="H382DE01EB3F94EBBBEA17022B9A3AE6C"><enum>3.</enum><header>Waiver of sovereign immunity</header><text display-inline="no-display-inline">A State or political subdivision thereof that has a prohibition on monetary bail waives sovereign immunity with respect to a cause of action against the local government by an individual for property damages or damages for personal injuries as a result of a dangerous criminal being released without monetary bail.</text></section> <section id="HECFD1465BD774BA1AC3397AB26217A75"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect beginning on the date that is 30 days after the date of enactment of this Act.</text></section>
