R. 4849</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230725">July 25, 2023</action-date><action-desc><sponsor name-id="B000574">Mr. Blumenauer</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow for hemp-derived cannabidiol and hemp-derived cannabidiol containing substances in dietary supplements and food.</official-title></form><legis-body id="HAB512B2279E74B5B92F765F1D34EFA02" style="OLC"><section section-type="section-one" id="H1DDAEE177038490DBF00C8ABFEC91736"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hemp Access and Consumer Safety Act</short-title></quote>.</text></section><section id="HB90ED56B520C45C39D032E70DC79A42E"><enum>2.</enum><header>Regulation of hemp-derived cannabidiol and hemp-derived cannabidiol containing substances</header><subsection id="H84F8D0DDA18F41AC8FAB7F7BF77D1F85"><enum>(a)</enum><header>Inclusion in definition of dietary supplement</header><text>Section 201(ff)(3)(B) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(ff)(3)(B)</external-xref>) is amended in each of clauses (i) and (ii) by inserting <quote>(other than hemp, hemp-derived cannabidiol, or a substance containing any other ingredient derived from hemp)</quote> after <quote>an article</quote>.</text></subsection><subsection id="H61630AF2A6FF4164BA7A4FDAD9BCD908"><enum>(b)</enum><header>Definition</header><text>Section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H441CB8D5B65C4BF09C829309F3DE485B"><subsection id="H175EEEE846734F6FB202EBCC149DD092"><enum>(tt)</enum><text>The term <term>hemp</term> has the meaning given such term in section 297A(1) of the Agricultural Marketing Act of 1946.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8DC25E2FB12B49D393BD7802C2FAB00A"><enum>(c)</enum><header>Prohibited act</header><text>Section 301(ll) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(ll)</external-xref>) is amended, in the matter preceding subparagraph (1), by inserting <quote>(other than hemp, hemp-derived cannabidiol, or a substance containing any other ingredient derived from hemp)</quote> after <quote>made public</quote>.</text></subsection><subsection id="HEFC64169608D4218AE94DBAE2A52F77B"><enum>(d)</enum><header>Labeling</header><text>Consistent with the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>), the Secretary of Health and Human Services may—</text><paragraph id="HC96BB627C29B43AB9E8884124A5355DB"><enum>(1)</enum><text>establish labeling and packaging requirements for dietary supplements and food that contain hemp, hemp-derived cannabidiol, or a substance containing any other ingredient derived from hemp; and</text></paragraph><paragraph id="H7E228B2A6E1A409BA33EA5BB7B338814"><enum>(2)</enum><text>take additional enforcement actions with respect to products labeled as dietary supplements but not meeting the definition of such term in section 201(ff)(3)(B) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(ff)(3)(B)</external-xref>), as amended by subsection (a).</text></paragraph></subsection></section></legis-body></bill>
