R. 4841</legis-num><associated-doc role="report" display="yes">[Report No. 118–323]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230725">July 25, 2023</action-date><action-desc><sponsor name-id="D000626">Mr. Davidson</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><action display="yes"><action-date date="20231219">December 19, 2023</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on July 25, 2023</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Federal agencies from restricting the use of convertible virtual currency by a person to purchase goods or services for the person’s own use, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HBA00" reported-display-style="italic" id="HED23A845F7F841D5BE6E1D5FC31B5E28"><section id="H115EBCD226CD46B3A8B85A66E3A97EA9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Your Coins Act of 2023</short-title></quote>.</text></section><section id="HF0D82147029447A8A4629AAEF7A39715"><enum>2.</enum><header>Prohibition on restricting use of convertible virtual currency by a person to retain full control over convertible virtual currency</header><subsection id="H08B00150E69446058A45040A1CE6DB06"><enum>(a)</enum><header>In general</header><text>The head of a Federal agency may not prohibit, restrict, or otherwise impair the ability of a covered user to—</text><paragraph id="H67C55060D7F84822A1A1C3832BE0EA69"><enum>(1)</enum><text>use convertible virtual currency or its equivalent for such user’s own purposes, such as to purchase real or virtual goods and services for the user’s own use; or</text></paragraph><paragraph id="H1CE33DD89C7443389FF5C597D68B1BB6"><enum>(2)</enum><text display-inline="yes-display-inline">self-custody digital assets using a self-hosted wallet or other means to conduct transactions for any lawful purpose.</text></paragraph></subsection><subsection id="H0354A885E1B34A42A7A3098751DB0E78"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H91AE558059254AD280FE2879C266CC6B"><enum>(1)</enum><header>Convertible virtual currencies</header><text>The term <quote>convertible virtual currency</quote> means a medium of exchange that—</text><subparagraph id="H00D91609C55A4DAEAB8700EC3355CB1B"><enum>(A)</enum><text>has an equivalent value as currency (as defined in section 1010.100 of title 31, Code of Federal Regulations (or successor regulations)); or</text></subparagraph><subparagraph id="HD053C5A15D5E440386AF527E4BD078FC"><enum>(B)</enum><text>acts as a substitute for currency but may not possess all the attributes (including legal tender status) specified under such section 1010.100 (or successor regulations).</text></subparagraph></paragraph><paragraph id="H4233B798A8F7420C9415EB262F7FBA63"><enum>(2)</enum><header>Covered user</header><text>The term <quote>covered user</quote> means a person that obtains convertible virtual currency to purchase goods or services on that person’s own behalf, without regard to the method in which such covered user obtained such convertible virtual currency.</text></paragraph><paragraph id="H312FC01D789B432DB30C948D38E24136"><enum>(3)</enum><header>Self-hosted wallet</header><text>The term <quote>self-hosted wallet</quote> means a digital interface—</text><subparagraph id="H91680318FBA7457B8750B8D2949ECA33"><enum>(A)</enum><text>used to secure and transfer convertible virtual currency; and</text></subparagraph><subparagraph id="H98B28779FAE84EDA980BE955AB49FCF9"><enum>(B)</enum><text>under which the owner of convertible virtual currency retains independent control over such convertible virtual currency that is secured by such digital interface.</text></subparagraph></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20231219">December 19, 2023</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
