id="H2AE20DC01B4E4E07BC7CE16A66DD41DB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="H304616657A7E440AB82D28DC7EB49B94"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>consumer product</term> has the meaning given such term in section 3(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)</external-xref>); </text></paragraph><paragraph id="H63FB5ED8D8B841B6A86C762DC14DBE97" commented="no"><enum>(2)</enum><text>the term <term>Secretary</term> means the Secretary of Commerce; and</text></paragraph><paragraph id="H1E6F3D66D5A34A17A85637B30C621CA9"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>token</term> means a transferrable, digital representation of information recorded on a blockchain or other distributed ledger technology.</text></paragraph></section><title id="H897BA32E5E57413DACA81C56E5DCA41F"><enum>I</enum><header>Artificial Intelligence and Consumer Product Safety</header><section id="H089824A5FFF24164A9416693105AE6FD"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>AI for Consumer Product Safety Act</short-title></quote>.</text></section><section id="H1BD1D0D7F3324238B7E323185590FB82"><enum>102.</enum><header>Pilot program for use of artificial intelligence by Consumer Product Safety Commission</header><subsection id="H12577D636D4B49A2BE08A5968810B088"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Consumer Product Safety Commission shall establish a pilot program to explore the use of artificial intelligence by the Commission in support of the consumer product safety mission of the Commission, as described in section 2(b) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2051">15 U.S.C. 2051(b)</external-xref>). </text></subsection><subsection id="HD2828894739A42EB83924CA61DA217CC"><enum>(b)</enum><header>Requirements</header><text>In conducting the pilot program established under subsection (a), the Commission shall do the following:</text><paragraph id="HFD0D46496B0B468E91455B229407EEB4"><enum>(1)</enum><text>Use artificial intelligence for at least 1 of the following purposes:</text><subparagraph id="H91917F0EFD23446BA7F8AEF1E8702BFD"><enum>(A)</enum><text>Tracking trends with respect to injuries involving consumer products.</text></subparagraph><subparagraph id="HEB215C9223E441C18AAC70EA13AEC3E6"><enum>(B)</enum><text>Identifying consumer product hazards.</text></subparagraph><subparagraph id="H21ACA8C7425E459A8B8996DC042A7D6F"><enum>(C)</enum><text>Monitoring the retail marketplace (including internet websites) for the sale of recalled consumer products (including both new and used products).</text></subparagraph><subparagraph id="H400D827611F0464BBF5F7A8EDE42E57C"><enum>(D)</enum><text>Identifying consumer products required by section 17(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2066">15 U.S.C. 2066(a)</external-xref>) to be refused admission into the customs territory of the United States.</text></subparagraph></paragraph><paragraph id="H6745CBE82A264F3CB98A766E8B9A70CC"><enum>(2)</enum><text display-inline="yes-display-inline">Consistent with section 6 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2055">15 U.S.C. 2055</external-xref>), consult with the following:</text><subparagraph id="HFD120C730ABD4A09A6134A9106B014DB"><enum>(A)</enum><text>Technologists, data scientists, and experts in artificial intelligence and machine learning.</text></subparagraph><subparagraph id="HFEDD958374FD425E9A6F5E00F5C75D07"><enum>(B)</enum><text>Cybersecurity experts.</text></subparagraph><subparagraph id="HF1BED95AE2C04C7680D9C0D4C51C7AB6"><enum>(C)</enum><text>Members of the retail industry.</text></subparagraph><subparagraph id="H275A26827D9B4A42A665BC4251DD667C"><enum>(D)</enum><text>Consumer product manufacturers.</text></subparagraph><subparagraph id="H7FC53E3F0E3341BFB428CAAC56E69BFD"><enum>(E)</enum><text>Consumer product safety organizations.</text></subparagraph><subparagraph id="H50A98B98079744B2B305098CD74784B8"><enum>(F)</enum><text>Any other person the Commission considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="HF008D290AFB546C7806A429749007D8D"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 1 year after the conclusion of the pilot program established under subsection (a), the Consumer Product Safety Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Commission, a report on the findings and data derived from such program, including the extent to which the use of artificial intelligence improved the ability of the Commission to advance the consumer product safety mission of the Commission.</text></subsection></section></title><title id="H138E3536B1544F4DA654E1892472C0D8"><enum>II</enum><header>Blockchain Technology Innovation</header><section id="HE2248CD5375E4420A1AED0769B007D71"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Blockchain Innovation Act</short-title></quote>.</text></section><section id="H420EE6229C1F450183113A20A6E783C4"><enum>202.</enum><header>Study on blockchain technology and its use in consumer protection</header><subsection id="H120ECD85B7CA4838A9719C0230171F3A"><enum>(a)</enum><header>In general</header><paragraph id="HEA92BD06A14B41F0BED08822987C0359"><enum>(1)</enum><header>Study required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Commerce, in consultation with the Federal Trade Commission and any other Federal agency the Secretary determines appropriate, shall complete a study on the possible uses of blockchain technology for consumer protection purposes, including preventing or mitigating fraud and other unfair or deceptive acts or practices. </text></paragraph><paragraph id="H78391F32B43546BC87DB726C63FB5138"><enum>(2)</enum><header>Requirements for study</header><text>In conducting the study required by paragraph (1), the Secretary shall examine—</text><subparagraph id="HA57A51A653D149048135A8F1BB9A8180"><enum>(A)</enum><text>existing and emerging uses of blockchain technology that could help protect consumers, including by preventing or mitigating fraud and other unfair or deceptive acts or practices within the meaning of section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>);</text></subparagraph><subparagraph id="H7EAC31822E774111A682322197A226CF"><enum>(B)</enum><text>trends in the commercial use of and investment in blockchain technology to prevent or mitigate fraud and other unfair or deceptive acts or practices as described in subparagraph (A);</text></subparagraph><subparagraph id="HB6297AE60E1046E699B305A9D77A2CA5"><enum>(C)</enum><text>best practices in facilitating public-private partnerships in blockchain technology to prevent or mitigate fraud and other unfair or deceptive acts or practices as described in subparagraph (A);</text></subparagraph><subparagraph id="HB2468BAC7C0E4CAAB55564BB66F5FB68"><enum>(D)</enum><text>potential benefits and risks related to the use of blockchain technology to prevent or mitigate fraud and other unfair or deceptive acts or practices as described in subparagraph (A);</text></subparagraph><subparagraph id="H498E24DEA2C3419B8FD585CB9BBAB8B7"><enum>(E)</enum><text>possible modifications to Federal regulations that could encourage the use of blockchain technology to prevent or mitigate fraud and other unfair or deceptive acts or practices as described in subparagraph (A); and</text></subparagraph><subparagraph id="HA6466355993C459A806EFDB49382D329"><enum>(F)</enum><text display-inline="yes-display-inline">any other relevant observations or recommendations related to the use of blockchain technology for consumer protection purposes, including preventing or mitigating fraud and other unfair or deceptive acts or practices as described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H0243C168184E486C8BA4DF8A9722E2EE"><enum>(3)</enum><header>Public comment</header><text>In conducting the study required by paragraph (1), the Secretary shall provide opportunity for public comment and advice relevant to conducting the study.</text></paragraph></subsection><subsection id="HB27510DE9C054D47A2C0B9AE725D389F"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after the completion of the study required by subsection (a)(1), the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Department of Commerce, a report that contains the results of such study.</text></subsection></section></title><title id="H9181B08CCC444E9FB84E428D8AC38082"><enum>III</enum><header>Token Taxonomy</header><section id="H1EEE5BB127E3423AAF40C6D39BBD1B8C"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Digital Taxonomy Act</short-title></quote>. </text></section><section id="H78AC677E236446BBAA081E63E5AFC5ED" commented="no"><enum>302.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H1E57ED932C404CEBA0448754DA7E777D" commented="no"><enum>(1)</enum><text>it is important that the United States remains a leader in innovation;</text></paragraph><paragraph id="H239BE8E2B2C14C348269F55729037600" commented="no"><enum>(2)</enum><text>tokens and blockchain technology are driving innovation and providing consumers with increased choice and convenience;</text></paragraph><paragraph id="H9ECD44C96A8F4060A7C59F31375EC966" commented="no"><enum>(3)</enum><text>the use of tokens and blockchain technology is likely to increase in the future;</text></paragraph><paragraph id="HA1B15DE1A1724A5C950C4182133E44E7" commented="no"><enum>(4)</enum><text>the Federal Trade Commission is responsible for protecting consumers from unfair or deceptive acts or practices, including relating to tokens; </text></paragraph><paragraph id="HF21DA477CE164D05A892D04EC9971738" commented="no"><enum>(5)</enum><text>the Commission has previously taken action against unscrupulous companies and individuals that committed unfair or deceptive acts or practices involving tokens; and</text></paragraph><paragraph id="H409399C620BA471B849E1C104BD19FE8" commented="no"><enum>(6)</enum><text>to bolster the Commission’s ability to enforce against unfair or deceptive acts or practices involving tokens, the Commission should ensure staff have appropriate training and resources to identify and pursue such cases.</text></paragraph></section><section id="H59F2DFD6E4CF4E17BC52CE8C7FA4F6C5"><enum>303.</enum><header>Report on unfair or deceptive acts or practices in transactions relating to tokens</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Federal Trade Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Commission, a report on—</text><paragraph id="H0C36510105B846059F55B5F34E3F937B"><enum>(1)</enum><text>any actions taken by the Commission relating to unfair or deceptive acts or practices in transactions relating to tokens;</text></paragraph><paragraph id="H43D1732FB1C6416E8163A565AAA455ED"><enum>(2)</enum><text>any other efforts of the Commission to prevent unfair or deceptive acts or practices relating to tokens; and</text></paragraph><paragraph id="H714E791CAA414E33822D8086FA527CA0"><enum>(3)</enum><text>any recommendations by the Commission for legislation that would improve the ability of the Commission and other relevant Federal agencies to further protect consumers from unfair or deceptive acts or practices in the token marketplace.</text></paragraph></section></title></legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to direct the Consumer Product Safety Commission to establish a pilot program to explore the use of artificial intelligence in support of the mission of the Commission and to direct the Secretary of Commerce and the Federal Trade Commission to study and report on
