which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the discharge of a private education loan in the case of death or total and permanent disability of a student obligor, and for other purposes.</official-title></form><legis-body id="HF1B858F665904BE7B5A10D285D81BD97" style="OLC"><section id="H5C83FFA421F64C04B8C7BB8B32A2DC3D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Private Loan Disability Discharge Act of 2023</short-title></quote>.</text></section><section id="HCCB94E624A564BF985E3E7DDC4CA2E5C"><enum>2.</enum><header>Protections for obligors and cosigners in case of death or total and permanent disability</header><subsection id="H7F4268401C144FC9908DCD9309281CF9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 140(g) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650(g)</external-xref>) is amended—</text><paragraph id="HB23B50E16B9E4E62A30E68E627FF46C2"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="HF1F5679699B5412C944B7AE218096E10"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">in case of death of borrower</header-in-text></quote>;</text></subparagraph><subparagraph id="H842C7E2FC85A46079F15769CA296A0A7"><enum>(B)</enum><text>in subparagraph (A), by inserting after <quote>of the death</quote>, the following: <quote>or total and permanent disability</quote>; and</text></subparagraph><subparagraph id="H1EBA22309B0C4197B9039C35C7E117F9"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting after <quote>of the death</quote>, the following: <quote>or total and permanent disability</quote>; and</text></subparagraph></paragraph><paragraph id="H95531F7E0DE8418CAB5AC3D4ED882E56"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7BAFEFF9E99A4876B265BAF2C0DC34E1" style="OLC"><paragraph id="H849042F7698549D19635364E10242C49"><enum>(3)</enum><header>Discharge in case of death or total and permanent disability of borrower</header><text display-inline="yes-display-inline">The holder of a private education loan shall, when notified of the death or total and permanent disability of a student obligor, discharge the liability of the student obligor on the loan and may not, after such notification—</text><subparagraph display-inline="no-display-inline" id="HB56DE7A65FC64C099A5391831E83CACF"><enum>(A)</enum><text>attempt to collect on the outstanding liability of the student obligor; and</text></subparagraph><subparagraph id="H1294B51C71064BBBB8F11432CF1DDA27"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of total and permanent disability, monitor the disability status of the student obligor at any point after the date of discharge.</text></subparagraph></paragraph><paragraph id="HED8AA27E464C413DBDBD2585EB6C65C5"><enum>(4)</enum><header>Total and permanent disability defined</header><text>For the purposes of this subsection and with respect to an individual, the term <quote>total and permanent disability</quote> means the individual is totally and permanently disabled, as such term is defined in section 685.102(b) of title 34 of the Code of Federal Regulations.</text></paragraph><paragraph id="HACC579010D02445495261820E659743D"><enum>(5)</enum><header>Private discharge in cases of certain discharge for death or disability</header><text display-inline="yes-display-inline">The holder of a private education loan shall, when notified of the discharge of liability of a student obligor on a loan described under <external-xref legal-doc="usc" parsable-cite="usc/26/108">section 108(f)(5)(A)</external-xref> of the Internal Revenue Code of 1986, discharge any liability of the student obligor (and any cosigner) on any private education loan which the private education loan holder holds and may not, after such notification—</text><subparagraph id="H94642816FA3F4C2F8C7C9EE6F441F575"><enum>(A)</enum><text>attempt to collect on the outstanding liability of the student obligor; and</text></subparagraph><subparagraph id="H6C2430ED08FF4E7DBD6EE297D129C942"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of total and permanent disability, monitor the disability status of the student obligor at any point after the date of discharge.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAF029D3AED044CE5BABD9C2B0EDE43FE"><enum>(b)</enum><header>Tax liability</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/108">Section 108(f)(5)(A)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/108">26 U.S.C. 108(f)(5)(A)</external-xref>) is amended—</text><paragraph id="H1D36C109C59943A3AC4D7D137096D30C"><enum>(1)</enum><text>by striking <quote>, and before January 1, 2026</quote>;</text></paragraph><paragraph id="H2BF9B35F518644A88230D63742F3931A"><enum>(2)</enum><text>in clause (ii), by striking <quote>or</quote>;</text></paragraph><paragraph id="HE40C3C40AB3347378BC2059801970FBD"><enum>(3)</enum><text>by redesignating clause (iii) as clause (iv); and</text></paragraph><paragraph id="H372EAE20C3E74006A59791562428DD80"><enum>(4)</enum><text>by inserting after clause (ii) the following:</text><quoted-block display-inline="no-display-inline" id="HE21EB1533B5C41539EFFDA078034173E" style="OLC"><clause id="HB2704221E50C4BF8A9C5966152379D07"><enum>(iii)</enum><text display-inline="yes-display-inline">pursuant to paragraph (3) or (5) of section 140(g) of the Truth in Lending Act, or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H091661C2DD58422BBD3645AA0401A012"><enum>(c)</enum><header>Rulemaking</header><text>The Director of the Bureau of Consumer Financial Protection may issue rules to implement the amendments made by subsection (a) as the Director determines appropriate.</text></subsection><subsection id="H2344BC365C0A4435B2FF31E83BA24988"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect 1 year after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
