<section id="HC0AD1E7C7F8340078099E0C70F060971" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing American Future from Exploitative Communist Autonomous Research Act</short-title></quote> or the <quote>SAFE CAR Act</quote>. </text></section> <section id="H9867FFBCA9EF493899EA5957192F381D"><enum>2.</enum><header>Additional safety measures for motor vehicles</header> <subsection id="H05039BD98F404DC39CCD2BA8BE569395"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 30102(a) of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H329A7B677808414A907A8C500DED4173" display-inline="no-display-inline"> 
<paragraph id="H6F28469D5B60421A9669D25AE0A4990B"><enum>(14)</enum><header>Control</header><text display-inline="yes-display-inline">The term <quote>control</quote> means the power, direct or indirect, whether exercised or not exercised, to determine, direct, or decide important matters affecting a manufacturer.</text></paragraph> <paragraph id="HC8B458931D6240288BE8EEAD762C5F53"><enum>(15)</enum><header>Foreign adversary</header><text display-inline="yes-display-inline">The term <quote>foreign adversary</quote> has the meaning given that term in part 7.4 of title 15, Code of Federal Regulations. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFCD9029AC620495080822CA566EA336E"><enum>(b)</enum><header>Prohibitions on manufacturing, selling, and importing noncomplying motor vehicles and equipment</header><text>Section 30112 of title 49, United States Code, is amended—</text> <paragraph id="H27469D4B7E8042F9A51939A196FB5FCA"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text> 
<quoted-block style="OLC" id="H307E53FB56D74F6DA8717026DF8668BB" display-inline="no-display-inline"> 
<paragraph id="H8167744847444C1AB3BCE48873DAD8B6"><enum>(4)</enum><text display-inline="yes-display-inline">A person who is domiciled in the People’s Republic of China, or a manufacturer who is under the control of the Chinese Communist Party or the Government of the People’s Republic of China, may not manufacture for sale, sell, offer for sale, introduce or deliver for introduction in interstate commerce, or import into the United States any motor vehicle or motor vehicle equipment if the Secretary, in coordination with the Secretary of Commerce, determines that such vehicle or equipment poses a risk to United States security.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HA0099B9AEBD54B0C9D460F33CD9D7B4F"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="USC" id="HAC82097AFAFA4D59942408096A5236DC" display-inline="no-display-inline"> 
<subsection id="H0FF44598E6F74BACA1A7F0441B0BC90F"><enum>(c)</enum><header>Determination regarding security</header><text display-inline="yes-display-inline">For purposes of this section, the Secretary, in coordination with the Secretary of Commerce, shall determine whether any motor vehicle or motor vehicle equipment poses a risk to United States security.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2B885EB45FF94A5B8DFF47A9229A5CED"><enum>(c)</enum><header>General exemptions</header><text>Section 30113 of title 49, United States Code, is amended—</text> 
<paragraph id="H92334399B67D42CF9D7A2EA91A883E8E"><enum>(1)</enum><text>in subsection (b)(3)—</text> <subparagraph id="H9C95C7419C274B2A90D3A32434F57E1D"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H1FFE83DC416B42A59BA6C312F34FFECF"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph> <subparagraph id="H4A5222D8B62A448E8D0A1E4F2A68AF47"><enum>(C)</enum><text>by inserting before subparagraph (C) (as so redesignated) the following:</text> 
<quoted-block style="USC" id="HA8890B13C53C464C8F419E122476ED89" display-inline="no-display-inline"> 
<subparagraph id="HE2F1B66341204BDF82F119C1D87A85B7"><enum>(B)</enum><text display-inline="yes-display-inline">an exemption applied for by a manufacturer who is domiciled in the People’s Republic of China or who is under the control of the Chinese Communist Party or the Government of the People’s Republic of China would not pose a risk to United States security; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H3662E810181140C6BDF31BBFED2A423B"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="USC" id="H281CC0B067E04CE59EEC1836D36B0EA2" display-inline="no-display-inline"> 
<subsection id="H1639651F43694F0DA9060889764CD134" commented="no"><enum>(i)</enum><header>Prohibition on harmful motor vehicles testing in the United States</header><text display-inline="yes-display-inline">A motor vehicle may not be granted an exemption under this section if the manufacturer of such vehicle—</text> <paragraph id="H5930FDDD0B5D44F5A1E06A3ED7763B31" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">is under the control of the Chinese Communist Party or the Government of the People’s Republic of China; or</text></paragraph> 
<paragraph id="H7D5889F309564C0990FF08EA461D4722" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">shares information with the Chinese Communist Party or the Government of the People’s Republic of China.</text></paragraph></subsection> <subsection id="H5034DDA5CF454BF5838C806B7C5E9363"><enum>(j)</enum><header>Determination regarding security</header><text display-inline="yes-display-inline">For purposes of this section, the Secretary, in coordination with the Secretary of Commerce, shall determine whether any motor vehicle or motor vehicle equipment poses a risk to United States security.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5B5A4D7CE9AA4B898FF7797700F5B47D"><enum>(d)</enum><header>Special exemptions</header><text display-inline="yes-display-inline">Section 30114 of title 49, United States Code, is amended—</text> <paragraph id="H2A9A65F6C7E94A198C63363D09833831"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(5), by striking <quote>significant safety risk.</quote> and inserting <quote>significant safety risk or that such registration has been filed by a manufacturer that is domiciled in a country that is a foreign adversary, owned wholly or partially by a foreign adversary, or located in a country that is a foreign adversary, and such manufacturer poses a risk to United States security. For purposes of this paragraph, the Secretary shall coordinate with the Secretary of Commerce to determine whether such a manufacturer poses a risk to United States security.</quote>; and</text></paragraph> 
<paragraph id="H7947BE1BCA134AA8B4E6DF5360AB5DB2"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" id="HFFDE64A0BC4740E9BA36EBEA3CA63BBC" display-inline="no-display-inline"> <subsection id="H9187B82B6A304325ABCB186ADD2C5432" commented="no"><enum>(c)</enum><header>Prohibition on harmful motor vehicles testing in the United States</header><text display-inline="yes-display-inline">A motor vehicle may not be granted an exemption under this section if the manufacturer of such vehicle—</text> 
<paragraph id="HAED4644D3C054F6EB94B2B95999C99E9" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">is under the control of the Chinese Communist Party or the Government of the People’s Republic of China; or</text></paragraph> <paragraph id="H26217E8B5AB94EF3B5389E5233622F4D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">shares information with the Chinese Communist Party or the Government of the People’s Republic of China.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H79648D4FD34D447D91DE0D7EF468DF8B"><enum>(e)</enum><header>Certification of compliance</header><text display-inline="yes-display-inline">Section 30115(b) of title 49, United States Code, is amended to read as follows:</text> <quoted-block style="USC" id="H49ADBD40A4B741D08184171F1782D146" display-inline="no-display-inline"> <subsection id="HC531EDD412A54BD3B0277F8527C4694D"><enum>(b)</enum><header>Certification label</header><text display-inline="yes-display-inline">In the case of the certification label affixed by an intermediate or final stage manufacturer of a motor vehicle built in more than 1 stage, each intermediate or final stage manufacturer shall certify with respect to each applicable Federal motor vehicle safety standard—</text> 
<paragraph id="H5A1C4EFBAA98479CAFE660CBDEE6C89B"><enum>(1)</enum><text>that it—</text> <subparagraph id="HD14ED74F128749ADB72775E1BA0D39C4"><enum>(A)</enum><text display-inline="yes-display-inline">has complied with the specifications set forth in the compliance documentation provided by the incomplete motor vehicle manufacturer in accordance with regulations prescribed by the Secretary; or </text></subparagraph> 
<subparagraph id="HC9EE60BE28A24192B1C784C394645074"><enum>(B)</enum><text>has elected to assume responsibility for compliance with that standard;</text></subparagraph></paragraph> <paragraph id="HDD8EB1FBA90D4B398B082B7AAA9F89A6"><enum>(2)</enum><text display-inline="yes-display-inline">that the Secretary has determined it is not a threat to security;</text></paragraph> 
<paragraph id="H7589EBBF34424444BC095532393E938A"><enum>(3)</enum><text display-inline="yes-display-inline">that it is not under the control of the Chinese Communist Party or the Government of the People’s Republic of China; and</text></paragraph> <paragraph id="H5C3674F90BD84BA2989FFA17007CFD81"><enum>(4)</enum><text display-inline="yes-display-inline">that it does not share information with the Chinese Communist Party or the Government of the People’s Republic of China.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
