<section id="H46075421F5A247889FAAB94DB3471BDB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transportation for Reentry Act</short-title></quote>.</text></section> <section id="H46AB6E277A96472692C155A55BAD289B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HB355555B7A1A4674BC74E9FFF5CEB70D"><enum>(1)</enum><text display-inline="yes-display-inline">Access to free public transportation services increases the access that an individual recently released from prison has to a reliable mode of transportation. </text></paragraph> <paragraph id="HC00B686E7CBB481D8E558E3D2555A7D5"><enum>(2)</enum><text>Access to a reliable mode of transportation—</text> 
<subparagraph id="H9D279A7C5FB34FAEA8EB8D58D85013B4"><enum>(A)</enum><text>promotes the successful reintegration of a returning individual into the community;</text></subparagraph> <subparagraph id="H21CCAEBDE4764453AD74273F9FEF7563"><enum>(B)</enum><text>reduces the likelihood of recidivism;</text></subparagraph> 
<subparagraph id="HB23BD2D3FEEF4406BD79EC088E3E32A7"><enum>(C)</enum><text>increases the ability of a returning individual to access community services; and</text></subparagraph> <subparagraph id="HDEFAFCC1D3EB40CCA22AC6BFA5689CB5"><enum>(D)</enum><text>helps a returning individual to follow up on referrals from their release plans and to meet initial parole requirements (if applicable).</text></subparagraph></paragraph> </section> 
<section id="H94217717535346FB99FD83095B3AC809"><enum>3.</enum><header>Public transportation reentry service</header> 
<subsection id="H7E3F7A0E5CD64BF68DB0580FDF51843B"><enum>(a)</enum><header>Public transportation reentry service</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H5A82C801BB4F446F9C6C94C79526D3ED" display-inline="no-display-inline"> <section id="HA14E29D21A0848C583D87B284C1B015C"><enum>5341.</enum><header>Public transportation reentry service</header> <subsection id="H3ED80E4C4B8446759D25D2AF9FF6A9D2"><enum>(a)</enum><header>In general</header> <paragraph id="H3A1556A26A2A4C09A75B4662882A7078"><enum>(1)</enum><header>Reentry service</header><text display-inline="yes-display-inline">To be eligible for financial assistance under section 5307 or 5311, a covered recipient shall carry out a reentry service program to provide free public transportation to returning individuals.</text></paragraph> 
<paragraph id="H886827772342428F84A1DD9CD8BA908C"><enum>(2)</enum><header>Duration</header><text>A covered recipient shall provide the reentry service described in paragraph (1) to a returning individual for a 1-year period beginning on the release date of the returning individual.</text></paragraph> </subsection> <subsection id="H4357A52932734DEF867F03E67D5D35A4"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this section, a covered recipient shall—</text> 
<paragraph id="H756930FB7D9940FD82BF3961F0A36787"><enum>(1)</enum><text display-inline="yes-display-inline">create a system for returning individuals to enroll in the reentry service under this section;</text></paragraph> <paragraph id="H894A7CD113D54E668CE053C753B50674" display-inline="no-display-inline"><enum>(2)</enum><text>instruct transportation staff on the operation of the reentry service;</text></paragraph> 
<paragraph id="H2BC554D1E0D44E988132B4560618CD06"><enum>(3)</enum><text display-inline="yes-display-inline">collect data on the number of returning individuals who use the reentry service and the frequency of use; and</text></paragraph> <paragraph id="H94F3F20B68354BD7A312CD111EC1E675"><enum>(4)</enum><text>develop a system to ensure compliance with the 1-year period described in section (a)(2).</text></paragraph> </subsection> 
<subsection id="H93F87CB6DF9945D3BC12D18FBBEE550B"><enum>(c)</enum><header>Reimbursement</header> 
<paragraph id="H95BC66F5F41344769DFE611B1989CB98"><enum>(1)</enum><header>Direct costs</header><text display-inline="yes-display-inline">The Secretary may reimburse a covered recipient for the cost of providing to returning individuals the reentry service under this section.</text></paragraph> <paragraph id="H42875BE4190547478B2685ADD172B192"><enum>(2)</enum><header>Indirect costs</header><text>The reimbursement that a covered recipient receives may include the costs incurred from the following:</text> 
<subparagraph id="HE7A2DFA7D38A49F9A91346D8E8BC99ED"><enum>(A)</enum><text>Development of the reentry service.</text></subparagraph> <subparagraph id="HD70EB44869624DB3A92A116D6D619236"><enum>(B)</enum><text display-inline="yes-display-inline">Implementation of the reentry service.</text></subparagraph> 
<subparagraph id="HCE1AB16A3BD74DD3814C4E78F9255E90"><enum>(C)</enum><text display-inline="yes-display-inline">Operational costs of the reentry service.</text></subparagraph> <subparagraph id="HCB75F5A2FDC347D895FF81A11E3EC667"><enum>(D)</enum><text>Engagement with technical assistance providers. </text></subparagraph> 
<subparagraph id="HB88438C9741A4B2EBFA261A32B02F158"><enum>(E)</enum><text display-inline="yes-display-inline">Training on the implementation of the reentry service.</text></subparagraph> <subparagraph id="H801B1C7864834F9BBDF6833C698A08E3"><enum>(F)</enum><text>Outreach to prisons and to the returning individual populations.</text></subparagraph> 
<subparagraph id="HFCAA129070F14E9E98AC173321A31DC8"><enum>(G)</enum><text display-inline="yes-display-inline">Other uses integral to the successful implementation of the reentry service.</text></subparagraph></paragraph></subsection> <subsection id="HA6D5CFD8D8CB46A4AA29CBA9182100D4"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall issue regulations necessary to carry out this section, including regulations that—</text> 
<paragraph id="HEE4F8FA3E755401D888DD742FED2D0F8"><enum>(1)</enum><text display-inline="yes-display-inline">promote the coordination of providing technical assistance to a covered recipient;</text></paragraph> <paragraph id="HFF04FB0537AF437D96F0A2CDC770C40B"><enum>(2)</enum><text display-inline="yes-display-inline">promote the marketing of the reentry service to ensure that incarcerated and returning individual populations are aware of the reentry service; and</text></paragraph> 
<paragraph id="HE1CF8945960C4028A55FF9ABCE85A701"><enum>(3)</enum><text>clarify the treatment of a returning individual who resides in different locations, including in different States, during the 1-year period described in subsection (a)(2).</text></paragraph> </subsection> <subsection id="HB70A4FFF92D548A0950BA9846E5EDC35" display-inline="no-display-inline"><enum>(e)</enum><header>Reporting</header> <paragraph id="H7B0B468FBBB346838582FF873FF421B5"><enum>(1)</enum><header>Covered recipient</header><text display-inline="yes-display-inline">For each year in which a covered recipient receives funds under this section, such recipient shall submit to the National Transit Database an annual report that details the following:</text> 
<subparagraph id="H3B56C64C75AF4832ADB985C8B69D2C4A"><enum>(A)</enum><text>The number of returning individuals who used the reentry service.</text></subparagraph> <subparagraph id="H5D8217748348455BADE474C3E3C6AE05"><enum>(B)</enum><text>The number of trips taken.</text></subparagraph> 
<subparagraph id="H90A45A9AF72F4794A8097E8257228012"><enum>(C)</enum><text>An estimate of revenue forgone.</text></subparagraph> <subparagraph id="H2857F9E3D0A344E999506A7DB9239ABE"><enum>(D)</enum><text>Any other information that the Secretary determines appropriate.</text></subparagraph></paragraph> 
<paragraph id="HE1A973C0293E460EA2482240FF49D796"><enum>(2)</enum><header>Federal Transit Administration</header><text>For each such year, the Administrator of the Federal Transit Administration shall summarize the data reported under paragraph (1) and submit to Congress a report on such data.</text></paragraph> </subsection> <subsection id="HAD148463ACEC4416AD5949F67336229A"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HDAEC070DCB0A433E9F59D5817BA24C76"><enum>(1)</enum><header>Returning individual</header><text display-inline="yes-display-inline">The term <quote>returning individual</quote> means an individual who has been incarcerated for a period of not less than 1 year in Federal or State prison.</text></paragraph> <paragraph id="H71FE25D556364FD6A0806DD22B791701"><enum>(2)</enum><header>Covered recipient</header><text display-inline="yes-display-inline">The term <quote>covered recipient</quote> means a recipient of financial assistance under section 5307 or 5311.</text></paragraph> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H740FA804820B447BA66D4FEEA650737D"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H4B1DD74242154A539E822F715D0F23C0" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">5341. Public transportation reentry service.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF77E8E215B9E46C18AD488357D4FEC03"><enum>(c)</enum><header>Authorizations</header><text>Section 5338(a) of title 49, United States Code, is amended—</text> 
<paragraph id="H655F9643F8CB4EC391CB8C51C43C9068"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="H80AD655EFC134848993CA9B9789411CE"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C) by striking <quote>$13,990,000,000</quote> and inserting <quote>$14,030,000,000</quote>; </text></subparagraph> 
<subparagraph id="HAA3894B694154188973227BF7E28E005"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D) by striking <quote>$14,279,000,000</quote> and inserting <quote>$14,319,000,000</quote>; and</text></subparagraph> <subparagraph id="HCBD10903D2AE40F3823321837C98AC0C"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (E) by striking <quote>$14,642,000,000</quote> and inserting <quote>$14,682,000,000</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H985DBB06CB51452ABD28159908352858"><enum>(2)</enum><text>in paragraph (2)—</text> <subparagraph id="H96412DDC358B4E218EBC7DF88162658B"><enum>(A)</enum><text>in subparagraph (C) by striking <quote>$6,712,987,840 for fiscal year 2024, $6,851,662,142 for fiscal year 2025, and $7,025,844,743 for fiscal year 2026</quote> and inserting <quote>$6,742,987,840 for fiscal year 2024, $6,881,662,142 for fiscal year 2025, and $7,055,844,743 for fiscal year 2026</quote>; and</text></subparagraph> 
<subparagraph id="H5D23C601621F4992BAC6D40DEDA24206"><enum>(B)</enum><text>in subparagraph (F) by striking <quote>$916,907,591 for fiscal year 2024, $935,848,712 for fiscal year 2025, and $959,639,810 for fiscal year 2026</quote> and inserting <quote>$926,907,591 for fiscal year 2024, $945,848,712 for fiscal year 2025, and $969,639,810 for fiscal year 2026</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H047F7153A503466F899B95A737D29534"><enum>(d)</enum><header>Eligibility as capital project</header><text>Section 5302(4) of title 49, United States Code, is amended—</text> 
<paragraph id="HE58DBF02A3E144488070D329FDF9A1AA"><enum>(1)</enum><text>in subparagraph (M) by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="H5FCF817A37364780845F86745A36E877"><enum>(2)</enum><text>in subparagraph (N) by striking the period and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HB7C9070566924265A2FC27FB28356EBA"><enum>(3)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="H04B533B5E483445387DDC6EE52130767" display-inline="no-display-inline"> <subparagraph id="H502BD7BEB1E6457A9CACE0DD327EA8E1"><enum>(O)</enum><text display-inline="yes-display-inline">operating, planning, and outreach costs described in section 5341.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8364A0F2488443CD8B50724201E73F40"><enum>(e)</enum><header>Report</header><text>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on implementation of section 5341 of title 49, United States Code, (as added by this section) that includes—</text> <paragraph id="HD52528055FBD4F9988A665BC65C91E2F"><enum>(1)</enum><text>details of the implementation and outcome of the program under such section; and</text></paragraph> 
<paragraph id="H8B49A3E1D6264811A2BE6C79BB8EAC9C"><enum>(2)</enum><text display-inline="yes-display-inline">the impact that providing returning individuals with access to the reentry service under such section has had on recidivism rates of participating returning individuals and on the reentry of such individuals into the community.</text></paragraph></subsection> <subsection id="H0BF44265E6244EB3BF9DE9F738876E0F" display-inline="no-display-inline"><enum>(f)</enum><header>Conforming amendments</header> <paragraph id="H9355A5C45B2C498DAAC9079412FECE62"><enum>(1)</enum><header>Urbanized area formula grant</header><text display-inline="yes-display-inline">Section 5307(c)(1) of title 49, United States Code, is amended—</text> 
<subparagraph id="HE1EC5A35EC924C9BA3C818A63104D55C"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (K), by striking <quote>and</quote> at the end; and</text></subparagraph> <subparagraph id="HB0F0A039ADBE447D801DC8F826938601"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="HDCE40B07071B435E90B34B463DCA0F33"> 
<subparagraph id="H3047BAC3E926446BBFBFEC5A070A54AA"><enum>(M)</enum><text display-inline="yes-display-inline">will comply with section 5341; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> </paragraph> <paragraph id="H4098409768C34A04925171BBE41D088A"><enum>(2)</enum><header>Formula grants for rural areas</header><text display-inline="yes-display-inline">Section 5311 of title 49, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H96B022FD773742D592B61C693A513688"><enum>(k)</enum><header>Grant recipient requirement</header><text display-inline="yes-display-inline">A recipient may receive a grant in a fiscal year only if the recipient certifies to the Secretary that such recipient will comply with section 5341. </text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> </section> </legis-body></bill>
