<section id="HF36266378F594DDFB7B9238F312EB196" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Shipping for Non-Contiguous Areas Act of 2023</short-title></quote>.</text></section> <section id="H73B89873A40549A08A87E5FA4D3532DB"><enum>2.</enum><header>Prohibition on higher shipping fees</header> <text display-inline="no-display-inline">No private shipping service may exceed the shipping charge for the same product to and from a location in the contiguous United States as charged to a consumer product or producer good to the non-contiguous area of the United States. </text></section> 
<section id="HBECAE87C98EF4926B726E9D569CD60A4"><enum>3.</enum><header>Prohibition on excluding non-contiguous areas</header><text display-inline="no-display-inline">No private shipping service may exclude—</text> <paragraph id="H89FA39B3D9F541F291D790278DCE7F2E"><enum>(1)</enum><text>a non-contiguous area of the United States from its shipping polices; or</text></paragraph> 
<paragraph id="HA8CAF8138E384C0BB48C972AB27FB820"><enum>(2)</enum><text>a non-contiguous area of the United States from shipping to its location.</text></paragraph></section> <section id="H130C647A5A9A478EB62215E5FD225359"><enum>4.</enum><header>Exemptions</header> <subsection id="H931CB91E17EF45DFB7F7591F650A0560"><enum>(a)</enum><header>USPS exempted</header><text>The United States Postal Service shall be exempt from the requirements of this Act.</text></subsection> 
<subsection id="H8D83EF54F9084465A3303F10E70124F3"><enum>(b)</enum><header>Other exemptions</header><text>Any consumer product or producer good valued at more than $10,000 shall be exempt from the requirements of this Act.</text></subsection></section> <section id="HC27670C9625F4C70A15B552809570F3D"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H9349809FB2A74482B29B0B7E4C428700"><enum>(1)</enum><header>Non-contiguous area</header><text>The term <term>non-contiguous area</term> means any part of the United States not physically connected to the contiguous United States, including Alaska and Hawaii and any territory or possession of the United States.</text></paragraph> <paragraph id="H3C5B95B79B5242CB84EA5FDB1B1FB4A6"><enum>(2)</enum><header>Contiguous United States</header><text>The term <term>contiguous United States</term> shall refer to the 48 contiguous States and the District of Columbia.</text></paragraph> 
<paragraph id="H4D44C141E6C74E81B78B6EE1E990B5B2"><enum>(3)</enum><header>Private shipping services</header><text>The term <term>private shipping services</term> means shipping services carried out by private companies whose primary business model is the transporting of products for retailers.</text></paragraph> <paragraph id="H2954C91110C644C99568DFDB8F6F114C"><enum>(4)</enum><header>Consumer products</header><text>The term <term>consumer products</term> means the finished commodities for end-user use that will go directly to the consumer.</text></paragraph> 
<paragraph id="H35D1C71E11FE4AF8B5206D73A9572EBA"><enum>(5)</enum><header>Producer goods</header><text>The term <term>producer goods</term> means raw materials used to produce other products.</text></paragraph></section> </legis-body> </bill>
