provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Power Act to facilitate more expeditious review and permitting of certain electric transmission facilities, and for other purposes.</official-title></form><legis-body id="HE3D10FA44A9F4452858B2E1F542437D9" style="OLC"><section id="HCFDB5EF8407B4880AE81FEEF9318D00C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating America’s Siting of Transmission and Electric Reliability Act of 2023</short-title></quote> or the <quote><short-title>FASTER Act of 2023</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H99BA13B1D89444C2A9D9F0AC129F7204"><enum>2.</enum><header display-inline="yes-display-inline">National interest electric transmission facilities</header><subsection commented="no" display-inline="no-display-inline" id="H9DA2130F5C9047EA857EE065BD211E96"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 216 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H097D6A9388B04DE9B5C588A2CB23FF02"><section commented="no" display-inline="no-display-inline" id="H159EABAB01AA404D8947A6A0B8AEA2A7"><enum>216.</enum><header>Siting of interstate electric transmission facilities</header><subsection commented="no" display-inline="no-display-inline" id="HA4B528F6CEBF4FFA83B40958A4472FC9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HE872CB462B79448BAE0949C1B4621185"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA867CF3A9D424BA888C89E21926FDCFC"><enum>(2)</enum><header>Community benefit agreement</header><subparagraph commented="no" display-inline="no-display-inline" id="HEB50530B1F034AFFBAC3E692BC4F3F9F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>community benefit agreement</term> means an agreement between CBA parties, including, at a minimum, at least 1 entity described in each of subclauses (I) through (IV) of subparagraph (B)(iii), that—</text><clause commented="no" display-inline="no-display-inline" id="HB5DFFFF393734E5586C730C4F98A7F1B"><enum>(i)</enum><text>relates to a project for the construction or modification of a national interest electric transmission facility for which a permit is sought under subsection (c);</text></clause><clause commented="no" display-inline="no-display-inline" id="HEA270D650C4140B18FFDFFB665235450"><enum>(ii)</enum><text>is applicable through the construction (or modification) and operation of that national interest electric transmission facility;</text></clause><clause commented="no" display-inline="no-display-inline" id="H91E4EBE8A4814B2682C67948A0DF4965"><enum>(iii)</enum><text>is negotiated through a process that includes meaningful engagement, by the project sponsor, with—</text><subclause commented="no" display-inline="no-display-inline" id="H8CE91BCFC7C6473DBC50962C2065039F"><enum>(I)</enum><text display-inline="yes-display-inline">the applicable 1 or more agreement entities that are parties to the agreement; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB644383629F046C680DBE02F6A3812EC"><enum>(II)</enum><text display-inline="yes-display-inline">stakeholder groups, including at least 1 entity described in each of subclauses (I) and (II) of subparagraph (B)(v);</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB06585083A9A453AA56A411402171AA5"><enum>(iv)</enum><text>details specific, measurable, and legally enforceable CBA commitments;</text></clause><clause commented="no" display-inline="no-display-inline" id="H8A0EC36A2D3D45E8817EC7900787306D"><enum>(v)</enum><text>includes a detailed plan, with clear metrics, milestones, and timelines, for accomplishing CBA commitments;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0F05F6F335354F21AD7B505A3E18CC48"><enum>(vi)</enum><text>establishes specific roles, responsibilities, and processes for tracking and reporting progress with respect to CBA commitments;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE24C326EA52C4C2A81D31B4EFA42296E"><enum>(vii)</enum><text>establishes clear enforcement processes to address noncompliance, including specific penalties for noncompliance; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HFD7824DC06324D338143EEBF87A3F09C"><enum>(viii)</enum><text>requires the CBA parties to annually submit to the Commission a report that describes, in a transparent manner—</text><subclause commented="no" display-inline="no-display-inline" id="H16A3C5E7835B45748917FCAD11443F83"><enum>(I)</enum><text display-inline="yes-display-inline">the CBA commitments included in the agreement; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0FA99F2E606743749752206CE63AEAE4"><enum>(II)</enum><text display-inline="yes-display-inline">the progress made with respect those CBA commitments.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5BA9C3CC2CCA4673AA2A9F47B0CDB2F5"><enum>(B)</enum><header>Associated definitions</header><text>For purposes of this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="HA372BA9B2C1F4273A1CC50931407C04C"><enum>(i)</enum><header display-inline="yes-display-inline">Agreement entity</header><subclause commented="no" display-inline="no-display-inline" id="HFA6D188F8BA14A01B0E79E060D28EF82"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>agreement entity</term> means an entity described in subclause (II) that will be significantly impacted by project development, construction, or local operations activities relating to the applicable project that is the subject of the agreement described in subparagraph (A).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7365B585080E4DCA9E12A22BB6060B9F"><enum>(II)</enum><header>Entity described</header><text display-inline="yes-display-inline">An entity referred to in subclause (I) is any of the following:</text><item commented="no" display-inline="no-display-inline" id="H0AFBF3D1848E491997F077ADA4412904"><enum>(aa)</enum><text display-inline="yes-display-inline">Any political subdivision of a State, including a county and any subdivision of a county, in which the project will be located.</text></item><item commented="no" display-inline="no-display-inline" id="H7D2D1DB911994523841F6A66BACE6493"><enum>(bb)</enum><text display-inline="yes-display-inline">A Tribal governmental entity of an Indian Tribe that will be affected by the project.</text></item><item commented="no" display-inline="no-display-inline" id="H6F012197CD9044368611CDF5A3FF480D"><enum>(cc)</enum><text display-inline="yes-display-inline">Any other State, Tribal, or local entity, as the Commission or the parties to the applicable agreement determine to be appropriate.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H09B0FF38058047C691B385D24471B009"><enum>(ii)</enum><header>CBA commitment</header><text>The term <term>CBA commitment</term> means a commitment, made by the project sponsor and detailed in an agreement described in subparagraph (A), that benefits stakeholder groups.</text></clause><clause commented="no" display-inline="no-display-inline" id="HA61359CE50F644D5894FC1F964EA7752"><enum>(iii)</enum><header>CBA party</header><text display-inline="yes-display-inline">The term <term>CBA party</term> includes, at a minimum, each of the following:</text><subclause commented="no" display-inline="no-display-inline" id="HBD1F6F934F92456BBD1C077C45159757"><enum>(I)</enum><text>The project sponsor.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H78634A03174B411CBBC6CF07EE0F9403"><enum>(II)</enum><text>An agreement entity.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3776899A4EDA47E0AEC999617B41618E"><enum>(III)</enum><text>A community group.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8FEEB41F30684A44A14DDC7DC8D31138"><enum>(IV)</enum><text>A labor union or equivalent organization, such as a workforce development board, representing workers or trades that will be needed for each of the construction and operation (including, if applicable, production) activities associated with the project that is the subject of the agreement described in subparagraph (A).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H11DFD0AE614E4CB0BA8CF9BF7FF853DA"><enum>(iv)</enum><header>Community group</header><text>The term <term>community group</term> means any of the following:</text><subclause commented="no" display-inline="no-display-inline" id="HC6B96B0823824BD7A5AD8C9C54DDC57B"><enum>(I)</enum><text display-inline="yes-display-inline">An unincorporated association composed of—</text><item commented="no" display-inline="no-display-inline" id="H139662D007E14581826AC4EE1C2F3E4F"><enum>(aa)</enum><text display-inline="yes-display-inline">underserved, overburdened, or disadvantaged communities and members of those communities in the applicable agreement entity; or</text></item><item commented="no" display-inline="no-display-inline" id="H0AF9856C995A4DA2B161552A16EF3390"><enum>(bb)</enum><text>affected landowners or community members in the applicable agreement entity.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H902C218E24BF4CE9998BE06246358072"><enum>(II)</enum><text>A registered organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code that has a history of—</text><item commented="no" display-inline="no-display-inline" id="H51BF2EEB8B1C4C32AF9CF38AACD17813"><enum>(aa)</enum><text display-inline="yes-display-inline">prior work consistent with the goals established by the applicable agreement described in subparagraph (A); or</text></item><item commented="no" display-inline="no-display-inline" id="H2F8AD318AE5C48F993EF75D440282275"><enum>(bb)</enum><text>advocating for community members in the applicable agreement entity.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H7F876A05EB9446349066001A80B48467"><enum>(v)</enum><header>Stakeholder group</header><text display-inline="yes-display-inline">The term <term>stakeholder group</term> means—</text><subclause commented="no" display-inline="no-display-inline" id="HD03B14FFFA3A4C748EA3909889D1B4BB"><enum>(I)</enum><text display-inline="yes-display-inline">a community group; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6F8594F721474EC394443BC2291C5F20"><enum>(II)</enum><text>a CBA party described in clause (iii)(IV).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B5AB23A189C4A79980DF3C5EF6580FF"><enum>(C)</enum><header>Requirement</header><text>The Commission shall make all reports submitted to the Commission in accordance with subparagraph (A)(viii) publicly available on the website of the Commission.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8805E5FFF41B469A863DDC23F3016B96"><enum>(3)</enum><header>Cooperating agency</header><text>The term <term>cooperating agency</term> has the meaning given the term in section 1508.1 of title 40, Code of Federal Regulations (or a successor regulation).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA2C3EF83EA564A86B906D9180BA61F92"><enum>(4)</enum><header>Council</header><text>The term <term>Council</term> means the Federal Permitting Improvement Steering Council established by section 41002(a) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-1">42 U.S.C. 4370m–1(a)</external-xref>). </text></paragraph><paragraph id="H78ED8A2DCCC94A7D8D764FDE6C1A4C12" commented="no"><enum>(5)</enum><header>Environmental review document</header><text>The term <term>environmental review document</term> has the meaning given the term <term>environmental document</term> in section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H27CF1C111E8A484DBCB70AD6B182A13E"><enum>(6)</enum><header>Federal authorization</header><subparagraph commented="no" display-inline="no-display-inline" id="HDE2E2630D79C4393855CF921739F5CC9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Federal authorization</term> means any authorization required under Federal law in order to site a national interest electric transmission facility.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H90E263F67AC34EA38C31CB663ED9615D"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Federal authorization</term> includes such permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law in order to site a national interest electric transmission facility. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F24AF4F87D249D4A070F102CCF8AC42"><enum>(7)</enum><header>National interest electric transmission facility</header><text display-inline="yes-display-inline">The term <term>national interest electric transmission facility</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H32F8C060EA314361B5E838C03063EA36"><enum>(A)</enum><text display-inline="yes-display-inline">an electric transmission facility—</text><clause commented="no" display-inline="no-display-inline" id="HB0C3EEB7AA534AF5925764DFA2B6ED79"><enum>(i)</enum><text display-inline="yes-display-inline">that is located in a national interest electric transmission corridor designated by the Secretary under paragraph (2) or (5) of subsection (b); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HCCD55AF0B113487B94B4A34D27E17322"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to which the Commission finds that the proposed construction or modification of the facility—</text><subclause commented="no" display-inline="no-display-inline" id="H2203CBFDA9D849AE9FE16A091A504D62"><enum>(I)</enum><text>is consistent with the public interest;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3847DA08DE624C4EB7C3DE5CE8A5FBF8"><enum>(II)</enum><text>will significantly reduce transmission congestion in interstate commerce;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD43FB185526F430CA89214111EFD26D3"><enum>(III)</enum><text>will protect or benefit consumers;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD9437D092EBD4E4C8B8D63A09E91D05E"><enum>(IV)</enum><text>is consistent with sound national energy policy;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HFD669B7C0BDE4B4D81675D9453BB448D"><enum>(V)</enum><text>will enhance energy independence; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H21CBDBCFABDB45D49488888E7D95FE28"><enum>(VI)</enum><text>will maximize, to the extent reasonable and economical, the transmission capabilities of existing towers or structures; or</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE0DEB19C3D494247A9D9A393609B95EF"><enum>(B)</enum><text display-inline="yes-display-inline">an electric transmission facility that—</text><clause commented="no" display-inline="no-display-inline" id="HC242B60C91CB433C93E406FFBC34AE35"><enum>(i)</enum><text display-inline="yes-display-inline">has a transmission capacity of not less than—</text><subclause commented="no" display-inline="no-display-inline" id="H6F1035C625074BADAC4B0C23840A11B7"><enum>(I)</enum><text display-inline="yes-display-inline">345 kilovolts; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H632CA69514DB4C9386217DD22FB5F164"><enum>(II)</enum><text display-inline="yes-display-inline">750 megawatts; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HBB584B65B0984CA1AA479ADC32FB1CC0"><enum>(ii)</enum><text display-inline="yes-display-inline">is located in not fewer than 2 States.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H80E21192F29041E28082F7E0FD4A914E"><enum>(8)</enum><header display-inline="yes-display-inline">Participating agency</header><text>The term <term>participating agency</term> has the meaning given the term in section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8DDB1E3D33F2435081C8EE5F5CD97A56"><enum>(9)</enum><header>Prefiling process</header><text>The term <term>prefiling process</term> means the prefiling process established under subsection (h)(7)(C). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H38A7388A022B4D0A982A98FED67C4C79"><enum>(10)</enum><header>Qualifying project</header><text>The term <term>qualifying project</term> means a project—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD3A5BA2559F243C9A30E278413A7D1E2"><enum>(A)</enum><text display-inline="yes-display-inline">for the siting, construction, or modification of a national interest electric transmission facility; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFDAAEBD1E8CA43A29A477E924E592B4D"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to which the project sponsor complies with—</text><clause commented="no" display-inline="no-display-inline" id="H8AB4DB8556F14F2DB22373856790DB5C"><enum>(i)</enum><text display-inline="yes-display-inline">the prefiling regulations described in subsection (h)(7)(C); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC77A14C296C647A0BC8C4D6BB6DD5194"><enum>(ii)</enum><text display-inline="yes-display-inline">all other applicable regulations promulgated by the Commission relating to an application for a permit under subsection (c). </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0822933A2A7B4C418114AF9830CB1814"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71152F9E55004A3E871180463ED969BF"><enum>(12)</enum><header display-inline="yes-display-inline">State or local authorization</header><subparagraph commented="no" display-inline="no-display-inline" id="H64EF4B9F633B4B499F72A1881CC72A7E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>State or local authorization</term> means any authorization required under State or local law in order to site a transmission facility.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H429A132AE43342829648B0E8100096CD"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>State or local authorization</term> includes such permits, special use authorizations, certifications, opinions, or other approvals as may be required under State or local law in order to site a transmission facility. </text></subparagraph></paragraph></subsection><subsection id="HD699EEE313604696A0E1239FE1F2C32B"><enum>(b)</enum><header>Study, report, and designation of National Interest Electric Transmission Corridors</header><paragraph commented="no" display-inline="no-display-inline" id="H5131435F3AE4450C98AEBFAE863AE29C"><enum>(1)</enum><header>Study</header><text>Not later than 1 year after the date of enactment of the <short-title>FASTER Act of 2023</short-title>, and every 3 years thereafter, the Secretary, in consultation with affected States, Indian Tribes, and local governments, shall conduct a study of electric transmission capacity constraints and congestion.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB464F6065CDF4F91951431A06EDFA267"><enum>(2)</enum><header>Report and designation</header><text display-inline="yes-display-inline">Not less frequently than once every 3 years, the Secretary, after considering alternatives and recommendations from interested parties (including an opportunity for comment from affected States, Indian Tribes, and local governments), shall issue a report, based on the study under paragraph (1) or other information relating to electric transmission capacity constraints and congestion, which may designate as a national interest electric transmission corridor any geographic area that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H82DD30B2A93645A492B10A209F4274F7"><enum>(A)</enum><text>is experiencing electric energy transmission capacity constraints or congestion that adversely affects consumers; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H033FE3AA310F4C2385C308ED8077941C"><enum>(B)</enum><text>is expected to experience such energy transmission capacity constraints or congestion.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08B82130D64C45889110594E4A8BDE03"><enum>(3)</enum><header>Consultation</header><text>Not less frequently than once every 3 years, the Secretary, in conducting the study under paragraph (1) and issuing the report under paragraph (2), shall consult with any appropriate regional entity referred to in section 215.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDA1DE13EB1BE4AD199E544190DFBFEB6"><enum>(4)</enum><header>Considerations</header><text>In determining whether to designate a national interest electric transmission corridor under paragraph (2), the Secretary shall consider whether—</text><subparagraph id="H4EB74EC556D64B8EA14956F1A0FF805A"><enum>(A)</enum><text>the economic vitality and development of the corridor, or the end markets served by the corridor, may be constrained by lack of adequate or reasonably priced electricity;</text></subparagraph><subparagraph id="HFBB04DAAEA1C4D54B8A546E7AFD88B9F"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H0EB83C1584484B0483464F5C31998C62"><enum>(i)</enum><text>economic growth in the corridor, or the end markets served by the corridor, may be jeopardized by reliance on limited sources of energy; and</text></clause><clause id="H17C20A8E73F34719B913BD741FC4D075" indent="up1"><enum>(ii)</enum><text>a diversification of supply is warranted;</text></clause></subparagraph><subparagraph id="HDCFEA152C574487B907BCBB91383AD55"><enum>(C)</enum><text>the energy independence or energy security of the United States would be served by the designation;</text></subparagraph><subparagraph id="H156F6AB905D8432A86F75898409AF025"><enum>(D)</enum><text>the designation would be in the interest of national energy policy; </text></subparagraph><subparagraph id="H5CD9C6DA711C4F0B95F449599E9E2082"><enum>(E)</enum><text>the designation would enhance national defense and homeland security;</text></subparagraph><subparagraph commented="no" id="H0AD569B0141E45499BA9E382AFAA8D6C"><enum>(F)</enum><text display-inline="yes-display-inline">the designation would enhance the ability of facilities that generate or transmit firm or intermittent energy to connect to the electric grid;</text></subparagraph><subparagraph commented="no" id="H2A6EB5F0640E43D3BE014CB457E4176B"><enum>(G)</enum><text>the designation—</text><clause commented="no" id="H709EACF313EA43A4B0C242303614BC31"><enum>(i)</enum><text>maximizes and prioritizes existing rights-of-way; and</text></clause><clause commented="no" id="H3CD581858DDB4AE5B1D8B56089182710"><enum>(ii)</enum><text>avoids and minimizes the impact to, to the maximum extent practicable, and offsets to the extent appropriate and practicable, sensitive environmental areas and cultural heritage sites;</text></clause></subparagraph><subparagraph id="HB8B3F8DDB370424BB0CD20EC0E6419D5"><enum>(H)</enum><text display-inline="yes-display-inline">the designation would result in a reduction in the cost to purchase electric energy for consumers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE54DA7B4B5C44ACC88F3BA16507B5E86"><enum>(I)</enum><text>the designation reflects comments received from affected States, Indian Tribes, and local governments under paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD41DB5B756934CFAB9394708FEBAADFE"><enum>(5)</enum><header>Designation by request</header><subparagraph commented="no" display-inline="no-display-inline" id="HF66AD4BCC3A2424EB0F61966F6484E4E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The developer of a project to construct or modify an electric transmission facility may submit to the Secretary an application to designate 1 or more proposed routes associated with the project as a national interest electric transmission corridor.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA6FF5C2559C6430A984CDB65AC4F49C1"><enum>(B)</enum><header>Requirement</header><text>A developer described in subparagraph (A) may submit an application under that subparagraph only if the developer—</text><clause commented="no" display-inline="no-display-inline" id="H12C8427D214E4B0E9A9FAB551E6B366F"><enum>(i)</enum><text display-inline="yes-display-inline">has begun actively routing the applicable project;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0ED6129C9D5149BDA7230B9E2910A938"><enum>(ii)</enum><text>has begun engaging in outreach to—</text><subclause commented="no" display-inline="no-display-inline" id="HCB94845E351144529FF8D3F614482E9B"><enum>(I)</enum><text display-inline="yes-display-inline">the community in which the proposed route is located; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2F21C881A6FE4DE48726B24EF3DFFD6B"><enum>(II)</enum><text display-inline="yes-display-inline">landowners that may be affected by the construction or modification of an electric transmission facility on that proposed route; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HCFB5AC3859B64106AFF9C5D99BDE75A4"><enum>(iii)</enum><text>has—</text><subclause commented="no" display-inline="no-display-inline" id="H30592E3757A24FD7AC00CC53354CA736"><enum>(I)</enum><text display-inline="yes-display-inline">begun engaging in land surveys; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0D78C7B385714BF699C3E92D001D3AE3"><enum>(II)</enum><text display-inline="yes-display-inline">initiated environmental compliance work associated with the project.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF8D0F9ED9A0E47D2ACAF69D6658F9525"><enum>(C)</enum><header>Designation</header><text>The Secretary may designate a route proposed by a developer in an application submitted under subparagraph (A) as a national interest electric transmission corridor if the Secretary determines that—</text><clause commented="no" display-inline="no-display-inline" id="H705F6F3DDB0F4DA1B7C78D07E39D4C05"><enum>(i)</enum><text display-inline="yes-display-inline">the route is in a geographic area described in subparagraph (A) or (B) of paragraph (2); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HDB849FD248A44ABCB1A116FBD93906D7"><enum>(ii)</enum><text display-inline="yes-display-inline">designation of the route is consistent with the purposes of such a designation, taking into consideration the factors described in paragraph (4).</text></clause></subparagraph><subparagraph id="H2E494D9FA8BA4C81B1BE7DC8A4D29161"><enum>(D)</enum><header>Rulemaking</header><clause commented="no" display-inline="no-display-inline" id="H5FE70B80DEAF4F069301A643865562EC"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 1 year after the date of enactment of the <short-title>FASTER Act of 2023</short-title>, the Secretary shall promulgate regulations to carry out this paragraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="H58D361A6BFCB4246BC5F4D8E6BD591F7"><enum>(ii)</enum><header>Other applicants</header><text>In carrying out clause (i), the Secretary—</text><subclause commented="no" display-inline="no-display-inline" id="H548BB3A351934575A07C8A8D6B3650C1"><enum>(I)</enum><text display-inline="yes-display-inline">shall consider whether it would be appropriate to allow an entity other than the developer of a transmission project, such as a Tribal authority, a State, a non-transmission-owning utility (such as a transmission-dependent utility), a local government, a generation developer, or any other appropriate entity, to submit an application for the designation of a particular route as a national interest electric transmission corridor; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H25B5323917054B70A328B0D96D8C7BC7"><enum>(II)</enum><text>may promulgate regulations to allow 1 or more entities described in subclause (I) to submit an application for a designation described in that subclause, as the Secretary determines to be appropriate, subject to the requirements described in clauses (i) and (ii) of subparagraph (C).</text></subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6B255C1A0D4D421ABE9E3AD431B87A4F"><enum>(c)</enum><header display-inline="yes-display-inline">Permit for construction or modification of national interest electric transmission facilities</header><paragraph commented="no" display-inline="no-display-inline" id="H8A1B09F95279425B91E6BA490DCFBA20"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (i), and subject to paragraph (2), the Commission may issue 1 or more permits for the construction or modification of national interest electric transmission facilities if the Commission finds that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCAA93863A69C478597EA586662135721"><enum>(A)</enum><text display-inline="yes-display-inline">a State in which the transmission facilities are to be constructed or modified does not have authority—</text><clause commented="no" display-inline="no-display-inline" id="HAC1B7072E72342919F73A69E9B831D85"><enum>(i)</enum><text display-inline="yes-display-inline">to approve the siting of the facilities; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H933BCF7EFCAC450B8E37DA1CDC864114"><enum>(ii)</enum><text display-inline="yes-display-inline">to consider the interstate benefits or interregional benefits expected to be achieved by the proposed construction or modification of transmission facilities in the State;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H920FE3DED4E14AF5810B6D3012C23F65"><enum>(B)</enum><text display-inline="yes-display-inline">the applicant for a permit is a transmitting utility under this Act but does not qualify to apply for a permit or siting approval for the proposed project in a State because the applicant does not serve end-use customers in the State; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB8435BE606F949ECB09849B65FB613CD"><enum>(C)</enum><text display-inline="yes-display-inline">a State commission or other entity that has authority to approve the siting of the facilities—</text><clause commented="no" display-inline="no-display-inline" id="H5E1E655F103D458AB6931F551A1DA10D"><enum>(i)</enum><text display-inline="yes-display-inline">has not made a determination on an application seeking approval pursuant to applicable law by the date that is 1 year after the date on which the application was filed with the State commission or other entity;</text></clause><clause commented="no" display-inline="no-display-inline" id="H635DDD2B52E54925BF62B68E631D9D38"><enum>(ii)</enum><text display-inline="yes-display-inline">has conditioned its approval in such a manner that the proposed construction or modification will not significantly reduce transmission capacity constraints or congestion in interstate commerce or is not economically feasible; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HD7DBC01C677F493B8BD8961D778B6F71"><enum>(iii)</enum><text display-inline="yes-display-inline">has denied an application seeking approval pursuant to applicable law.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H19AE352B47944ABBA1DFD0F2F91BF4E0"><enum>(2)</enum><header>Requirement</header><text>The Commission may issue a permit under paragraph (1) only—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0EA8DF7533A24A3798BB68A01CF358F9"><enum>(A)</enum><text display-inline="yes-display-inline">after the Commission—</text><clause commented="no" display-inline="no-display-inline" id="H9245DE120A5F4C5883FE276A76FDC5E0"><enum>(i)</enum><text display-inline="yes-display-inline">makes a finding described in subparagraph (A), (B), or (C) of paragraph (1);</text></clause><clause commented="no" display-inline="no-display-inline" id="H1097201147774EA3A09652A3A8798ABF"><enum>(ii)</enum><text display-inline="yes-display-inline">makes all applicable findings and determinations necessary to establish that the applicable facility is a national interest electric transmission facility described in subparagraph (A) or (B) of subsection (a)(7); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H6E7A6158F2ED4EE6BBAA011AA04F6A94"><enum>(iii)</enum><text>provides notice and an opportunity for hearing with respect to the permit; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H15423AF69458422085A7ADB021347D4B"><enum>(B)</enum><text display-inline="yes-display-inline">if the applicant engages in the prefiling process with respect to the applicable facility.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16052891AEE94FDDA278105B39E9213F"><enum>(3)</enum><header>Applications</header><subparagraph commented="no" display-inline="no-display-inline" id="H70B338E43BF04AB8A888F56711B4157B"><enum>(A)</enum><header>In general</header><text>An application for a permit under this subsection shall be made in writing to the Commission. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H73EF381954C94DB894501F3D9E3AB319"><enum>(B)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">The Commission shall issue rules specifying—</text><clause commented="no" display-inline="no-display-inline" id="HA05ED44CDD154E92A8AC22F78F80B111"><enum>(i)</enum><text display-inline="yes-display-inline">the form of an application for a permit under this subsection;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE83CCD71684B41EEB50A9750F8A08ED5"><enum>(ii)</enum><text display-inline="yes-display-inline">the information to be contained in the application; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB361D0FB7A794824964A1BF603045736"><enum>(iii)</enum><text display-inline="yes-display-inline">the manner of service of notice of the application on interested persons.</text></clause></subparagraph></paragraph><paragraph id="HA17AB93E6ED44866812EFF4F506F23F0" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Simultaneous proceedings</header><text display-inline="yes-display-inline">In order to ensure that an applicant for a permit under this subsection receives the most timely decision possible with respect to that application, the prefiling process relating to that application may be initiated simultaneously with, or at any time after, an application is submitted to, or any relevant process is initiated with, the applicable State commission or other State entity that has authority to approve the siting of the applicable facility.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H138C1A10DB8D44B6AEFDA8F75342285A"><enum>(d)</enum><header display-inline="yes-display-inline">Comments</header><text display-inline="yes-display-inline">In any proceeding before the Commission under subsection (c), the Commission shall afford each State and local government in which a transmission facility covered by the permit is or will be located, each affected Federal agency and Indian Tribe, private property owners, and other interested persons, a reasonable opportunity to present their views and recommendations with respect to the need for and impact of a facility covered by the permit.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H0EB9C409CC3E406C993DD613F5516527"><enum>(e)</enum><header>Rights-of-Way</header><paragraph commented="no" display-inline="no-display-inline" id="H0E9D3D57622447369E8F6B156EE35548"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>In the case of a permit under subsection (c) for electric transmission facilities to be located on property other than property owned by the United States or a State, if the permit holder cannot acquire by contract, or is unable to agree with the owner of the property to the compensation to be paid for, the necessary right-of-way to construct or modify, and operate and maintain, the transmission facilities and, in the determination of the Commission, the permit holder has made good faith efforts to engage with affected landowners and other stakeholders early in the applicable permitting process, the permit holder may acquire the right-of-way by the exercise of the right of eminent domain in the district court of the United States for the district in which the property concerned is located, or in the appropriate court of the State in which the property is located.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1BFE5CE473564BE4AD9F860E0D8132C3"><enum>(2)</enum><header>Good faith efforts to engage with affected landowners and other stakeholders</header><subparagraph commented="no" display-inline="no-display-inline" id="H429355FF44684852BE55D6E444777B8A"><enum>(A)</enum><header>Community benefit agreements</header><clause commented="no" display-inline="no-display-inline" id="H2F8CBA748B7949D5846F4397822C1B63"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), for purposes of paragraph (1), a permit holder may establish that the permit holder has made good faith efforts to engage with affected landowners and other stakeholders early in the applicable permitting process by demonstrating to the Commission that the permit holder—</text><subclause commented="no" display-inline="no-display-inline" id="HF66E9634DD784D7EBAF769F3C8484541"><enum>(I)</enum><text display-inline="yes-display-inline">engaged, during the prefiling process, and continues to be engaged in a meaningful process to develop and negotiate a community benefit agreement with applicable CBA parties (as defined in subsection (a)(2)(B)) in the community in which the affected landowners or other stakeholders are located; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H198D8BF0918448EBB94B591BE31D1666"><enum>(II)</enum><text>entered into a community benefit agreement with applicable CBA parties (as defined in that subsection) in that community.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H0B0AC87388B04D95B9BE30AF49FE7BB5"><enum>(ii)</enum><header>Technical assistance</header><subclause commented="no" display-inline="no-display-inline" id="H1F96790F6ECA470BAF8F6774B5752192"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">On the request of a project sponsor, affected local government, or a community engaged in the process of developing and negotiating a community benefit agreement, the Secretary shall provide technical assistance, including, as the Secretary determines to be appropriate, legal counsel, mediation, and guidance, to help the community develop and negotiate a community benefit agreement with the project sponsor.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA1CB2E769AC04546983BA0D1296635A8"><enum>(II)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this clause.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA9B9CF9E567248A9864FA87FBBA49764"><enum>(B)</enum><header>Applicant code of conduct for engagement with affected landowners</header><clause commented="no" display-inline="no-display-inline" id="HD7A10236F9AA4A5E9ABC13104B1EB40D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>FASTER Act of 2023</short-title>, the Commission shall promulgate a final rule to establish an applicant code of conduct for engagement with affected landowners.</text></clause><clause commented="no" display-inline="no-display-inline" id="H8D5E80E367614911972CC480D21526A8"><enum>(ii)</enum><header>Effect of compliance</header><text>For purposes of paragraph (1), the Commission shall consider a permit holder to have made good faith efforts to engage with affected landowners if the Commission determines that the permit holder complied with the applicant code of conduct for engagement with affected landowners established under clause (i).</text></clause><clause commented="no" display-inline="no-display-inline" id="HAE64D03A60F649D88A8B3426B5CC81EB"><enum>(iii)</enum><header>Effect of noncompliance</header><text display-inline="yes-display-inline">Beginning on the effective date of the final rule promulgated under clause (i), the Commission may not make a determination that a permit holder has made good faith efforts to engage with affected landowners if the Commission determines that the permit holder substantially violated the applicant code of conduct for engagement with affected landowners established under that clause.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2363A6EDAFA49F4B0C5D890F21FE627"><enum>(C)</enum><header>Good faith efforts determination</header><clause commented="no" display-inline="no-display-inline" id="H087BBF1DF606439481DD2536CC07FE70"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the Commission shall consider a permit holder to have made good faith efforts to engage with affected landowners and other stakeholders early in the applicable permitting process if the Commission determines that the permit holder—</text><subclause commented="no" display-inline="no-display-inline" id="HB1001342CEB7423D980E9487599DDC02"><enum>(I)</enum><text display-inline="yes-display-inline">engaged, in good faith, in a meaningful process described in subparagraph (A)(i)(I); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H9AA9E9755DEC413695E562808019E7CA"><enum>(II)</enum><text display-inline="yes-display-inline">complied with the applicant code of conduct for engagement with affected landowners established pursuant to subparagraph (B)(i). </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HECB4CF8F57A74ACFB75678E6C3D178C4"><enum>(ii)</enum><header>Requirement</header><text>A permit holder that enters into a community benefit agreement described in subparagraph (A)(i)(II) shall be presumed to have complied with clause (i)(I).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCA24C835A9FC48BFBF33217D66A29E6E"><enum>(D)</enum><header>Effect of community benefit agreement on eligibility for certain grants</header><clause commented="no" display-inline="no-display-inline" id="H396CE3DCA27B4CBD90883D40C057A2F7"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of section 50152 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a</external-xref>), if the sponsor of a project for which a permit is sought under subsection (c) has entered into a community benefit agreement—</text><subclause commented="no" display-inline="no-display-inline" id="H320BD4687906439883EE4CE5ABA77404"><enum>(I)</enum><text display-inline="yes-display-inline">the sponsor and any applicable agreement entity (as defined in subsection (a)(2)(B)) that is eligible to apply for a grant under that section may jointly apply for such a grant; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8C71977701F04FF590399B8E25B05B47"><enum>(II)</enum><text>the sponsor may receive and use amounts made available pursuant to such a grant in accordance with—</text><item commented="no" display-inline="no-display-inline" id="H9798DB9C9AC04B7F86DE2260E4D8B7A4"><enum>(aa)</enum><text display-inline="yes-display-inline">any applicable provisions of the applicable community benefit agreement; and</text></item><item commented="no" display-inline="no-display-inline" id="H077C7DE20AB347B8A5C3E5D0C02B8256"><enum>(bb)</enum><text>any applicable rules or conditions established by the Secretary.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HD59DCE7A6D6F4AC2AC2818003BE2E9A4"><enum>(ii)</enum><header>Negotiated provisions</header><text>A community benefit agreement may include provisions requiring the project sponsor—</text><subclause commented="no" display-inline="no-display-inline" id="H2BCD515A517449B49CB094789384EE36"><enum>(I)</enum><text display-inline="yes-display-inline">to submit an application for a grant under section 50152 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a</external-xref>) on behalf of, or jointly with, the applicable agreement entity or any other entity eligible to apply for a grant under that section; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB367A9A29C6E47219000B27FCC4D72D0"><enum>(II)</enum><text display-inline="yes-display-inline">to take any other actions necessary to secure a grant under that section.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCA1B293DF1BA477094643206560988F7"><enum>(3)</enum><header>Use of right-of-way</header><text>Any right-of-way acquired under paragraph (1) shall be used exclusively for the construction or modification of electric transmission facilities within a reasonable period of time after the acquisition.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3DEEB111528342D99626222C885E4EA3"><enum>(4)</enum><header>Practice and procedure</header><text>The practice and procedure in any action or proceeding under this subsection in the district court of the United States shall conform as nearly as practicable to the practice and procedure in a similar action or proceeding in the courts of the State in which the property is located.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD4357C978E64DD799CA0DB1E59D6C4A"><enum>(5)</enum><header>Savings clause</header><subparagraph commented="no" display-inline="no-display-inline" id="H5FA94D3585FA4E48BF1B18F434BE5A8B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to authorize the use of eminent domain to acquire a right-of-way for any purpose other than the construction, modification, operation, or maintenance of electric transmission facilities and related facilities. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9FCF6302BAB244F2B908AE4169C6623C"><enum>(B)</enum><header>Restriction; termination</header><text display-inline="yes-display-inline">A right-of-way acquired under paragraph (1) shall not be used for any other purpose, and the right-of-way shall terminate on the termination of the use for which the right-of-way was acquired.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H98C9AADA003049F8A0DB344201691D65"><enum>(f)</enum><header>Compensation</header><paragraph commented="no" display-inline="no-display-inline" id="H28FD46A20F8641D48E465CDA05297D1C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Any right-of-way acquired pursuant to subsection (e) shall be considered a taking of private property for which just compensation is due.</text></paragraph><paragraph id="HE123F9A80E7149519B3C612A189B27CF"><enum>(2)</enum><header>Amount</header><text>Just compensation shall be an amount equal to the fair market value (including applicable severance damages) of the property taken on the date of the exercise of eminent domain authority.</text></paragraph></subsection><subsection id="H7AA4546A4DE9430087DAAA6D837B9CDD"><enum>(g)</enum><header>State law</header><text>Nothing in this section precludes any person from constructing or modifying any transmission facility in accordance with State law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H1A6B95B64E2B4B1787844B51B2DAFD8E"><enum>(h)</enum><header>Coordination of Federal authorizations for national interest electric transmission facilities</header><paragraph commented="no" display-inline="no-display-inline" id="H1BCA11A52D9449E7A80E0326E002F77A"><enum>(1)</enum><header display-inline="yes-display-inline">Lead agency</header><text display-inline="yes-display-inline">With respect to a qualifying project, the Commission shall act as the lead agency for purposes of coordinating—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5D6037A431224A3F82EABAD73A122807"><enum>(A)</enum><text display-inline="yes-display-inline">all applicable Federal authorizations;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H087BF1D9EBDB44439D1B8D17F4C6767A"><enum>(B)</enum><text display-inline="yes-display-inline">all applicable State or local authorizations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9ABB7842B8A14EF88093DE20E4E4A6B8"><enum>(C)</enum><text display-inline="yes-display-inline">all related environmental reviews.</text></subparagraph></paragraph><paragraph id="H778F3484C8214BF5AF58336E9A1616E6"><enum>(2)</enum><header>Coordination</header><subparagraph commented="no" display-inline="no-display-inline" id="H931C258FBFB945DEAF0A68CD159D032D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To the maximum extent practicable under applicable Federal law, the Commission shall coordinate the Federal authorization and review process under this subsection with any Indian Tribes, multistate entities, local governments, and State agencies that are responsible for conducting any separate permitting and environmental reviews of the facility, to ensure timely and efficient review and permit decisions.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDE152BEBB40B4F5FA41B916BC2B66D15"><enum>(B)</enum><header>Deadlines and milestones</header><clause commented="no" display-inline="no-display-inline" id="HDF82414EE1DB43B198C019FE100AA317"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">As the lead agency, the Commission, in consultation with agencies responsible for Federal authorizations and, as appropriate, with Indian Tribes, multistate entities, local governments, and State agencies that are willing to coordinate their own separate permitting and environmental reviews with the Federal authorization and environmental reviews, shall establish prompt and binding intermediate milestones and ultimate deadlines for the review of, and Federal authorization decisions relating to, the proposed facility, to ensure, to the maximum extent practicable, that the period described in clause (ii) does not exceed 5 years.</text></clause><clause commented="no" display-inline="no-display-inline" id="H22FEE25F944A43139D5071EAC6B88E6C"><enum>(ii)</enum><header>Period described</header><text>The period referred to in clause (i) is the period beginning on the date on which the prefiling process is initiated with respect to a proposed facility and ending on, as applicable—</text><subclause commented="no" display-inline="no-display-inline" id="H9A6B45C21F954D609750FA03E10A7379"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which a notice to proceed is issued with respect to that facility; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HC3E2B8339088493192B0A67E975E0034"><enum>(II)</enum><text display-inline="yes-display-inline">the date on which an application for a permit under subsection (c) with respect to that facility is denied.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H16A449C5E15E48D5B459CD721855D7FA"><enum>(iii)</enum><header>Certain deadlines</header><text>The Commission shall ensure that, once an application has been submitted with such data as the Commission considers necessary, all permit decisions and related environmental reviews under all applicable Federal laws shall be completed—</text><subclause commented="no" display-inline="no-display-inline" id="H95613FAD8F584E2ABAA1F171DD918802"><enum>(I)</enum><text>within 1 year; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6BDF52CBFFD84CBBA7F053EAF6900A6A"><enum>(II)</enum><text>if a requirement of another provision of Federal law does not permit compliance with subclause (I), as soon thereafter as is practicable.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD25637B6DCC9477480E00F65466FE636"><enum>(3)</enum><header>Process for prompt disclosure of certain information</header><text>The Commission shall establish a process pursuant to which a prospective applicant for a permit under subsection (c) that has initiated the prefiling process may confer with the agencies involved to have each such agency determine and communicate to the prospective applicant, not later than 60 days after the prospective applicant submits a request—</text><subparagraph commented="no" display-inline="no-display-inline" id="H165AEC2982174AF982530E6410D47E44"><enum>(A)</enum><text>the likelihood of approval for a potential facility; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF61672843A0F4A958944C0A3F225DAC3"><enum>(B)</enum><text>the key issues of concern to the agencies and the public.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H58F0592DD39D4FA1966846BB67427BC2"><enum>(4)</enum><header>Single environmental review document</header><subparagraph commented="no" display-inline="no-display-inline" id="H5CFEF688B51B4904883AEF52907C35FA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>As the lead agency, the Commission, in consultation with the affected agencies, shall prepare a single environmental review document, which shall be used as the basis for all decisions on the qualifying project under Federal law.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB634A86F717E4091950430138DE802CF"><enum>(B)</enum><header>Streamlined review and permitting within certain corridors</header><text>The Commission and the heads of other agencies shall streamline the review and permitting of transmission within corridors designated under section 503 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1763">43 U.S.C. 1763</external-xref>) by fully taking into account prior analyses and decisions relating to the corridors.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H05AB237341C34797833FE13633E1F7BA"><enum>(C)</enum><header>Requirement</header><text>The document prepared under subparagraph (A) shall include consideration by the relevant agencies of any applicable criteria or other matters as required under applicable law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8B02F2421BA045749B70E5D485213B0D"><enum>(5)</enum><header>Appeal to the President</header><subparagraph commented="no" display-inline="no-display-inline" id="H12EC9F7FC44D4533AB1274C8C5B21BCF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If any agency has denied a Federal authorization required for a transmission facility, or has failed to act by the deadline established by the Commission pursuant to this section for deciding whether to issue the authorization, the applicant or any State in which the facility would be located may file an appeal with the President, who shall, in consultation with the affected agency, review the denial or failure to take action on the pending application.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H822D63C2CA83425F87F3DF0CC91D8960"><enum>(B)</enum><header>Decision</header><text>Based on the overall record and in consultation with the affected agency, the President may—</text><clause commented="no" display-inline="no-display-inline" id="HA1655280EA244121A43701513F2B1E38"><enum>(i)</enum><text>issue the necessary authorization with any appropriate conditions; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H903AB46BC714428BA577C1C67E767753"><enum>(ii)</enum><text>deny the application.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H45273B14BF4F4A8EA70931422454E786"><enum>(C)</enum><header>Deadline for decision</header><text>The President shall issue a decision not later than 90 days after the date of the filing of the appeal.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40DB77FDC1BA45568FBCFF5B70A6571D"><enum>(D)</enum><header>Requirement</header><text>In making a decision under this paragraph, the President shall comply with applicable requirements of Federal law, including any requirements of—</text><clause id="HEB885860AB6047BBB6A95A885D0ED77D"><enum>(i)</enum><text>the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="H90E41895F8CA4D32AABB2F854616F822"><enum>(ii)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="H31817962AB8A4225A46062CC87668AC1"><enum>(iii)</enum><text display-inline="yes-display-inline">the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="H1958B7861141450A86E84DC58493E004"><enum>(iv)</enum><text display-inline="yes-display-inline">the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1D2952689CF94AC3B98BF6FB8E6FA908"><enum>(v)</enum><text display-inline="yes-display-inline">the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="HB3C1E10376744E0199209C0B0A2638C3" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">This paragraph shall not apply to any unit of the National Park System, the National Wildlife Refuge System, the National Wild and Scenic Rivers System, the National Trails System, the National Wilderness Preservation System, or a National Monument.</text></subparagraph></paragraph><paragraph id="H8F0067891C9646BCBE12C728C91A223E"><enum>(6)</enum><header>Application of FAST–41 procedures</header><subparagraph commented="no" display-inline="no-display-inline" id="H97DC8E8585A84853B9B704CDB4C0F0A0"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, on the submission of an application for a permit under subsection (c) for a qualifying project—</text><clause commented="no" display-inline="no-display-inline" id="H4308284270E8450BAB74D8F2F0BA2756"><enum>(i)</enum><text display-inline="yes-display-inline">the qualifying project shall be considered to be a covered project (as defined in section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>)); and </text></clause><clause commented="no" display-inline="no-display-inline" id="H4D277CC5AD5442B1BC762EF52D299577"><enum>(ii)</enum><text display-inline="yes-display-inline">except as otherwise provided in this section (including paragraphs (1) and (2)), title XLI of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m et seq.</external-xref>) (including section 41007 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-6">42 U.S.C. 4370m–6</external-xref>)) shall apply to the qualifying project in the same manner as any other covered project (as defined in section 41001 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>)).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H112FCC57D6004BE79575F44F0E82636A"><enum>(B)</enum><header>Cooperation of participating agencies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, each Federal participating agency with respect to a qualifying project shall—</text><clause commented="no" display-inline="no-display-inline" id="H48B5F43FA8B6416198430633C7B5E45B"><enum>(i)</enum><text display-inline="yes-display-inline">cooperate with the Commission and the project sponsor with respect to the review and permitting processes carried out under this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HA9BE3177D2A34947A12F5EF4CABB9250"><enum>(ii)</enum><text>fully participate in those processes.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6572AC729DEA4AD9A506ED1FC06286F9"><enum>(C)</enum><header>Use of Environmental Review Improvement Fund</header><clause commented="no" display-inline="no-display-inline" id="HAC233BF517CE4053832EB02603E46E55"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subparagraph:</text><subclause commented="no" display-inline="no-display-inline" id="HD13E8B5D98284D218B114DB36E29103A"><enum>(I)</enum><header>Agency participating in the prefiling process</header><text>The term <term>agency participating in the prefiling process</term> means a participating agency or cooperating agency that participates in the prefiling process with respect to a qualifying project.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HEF64DD36A34C44919074E006606DC114"><enum>(II)</enum><header>Fund</header><text>The term <term>Fund</term> means the Environmental Review Improvement Fund established under section 41009(d) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m-8">42 U.S.C. 4370m–8(d)</external-xref>).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HABD2BB1C283F4A86B94E4119903AAED7"><enum>(ii)</enum><header>General authority</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, with respect to a qualifying project, amounts in the Fund may, in addition to any other use permitted under title XLI of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m et seq.</external-xref>) (or a regulation promulgated under that title), be used—</text><subclause commented="no" display-inline="no-display-inline" id="H85C6A32B8B3844E5B64072661A0788F0"><enum>(I)</enum><text display-inline="yes-display-inline">by the Council, to cover the expenses of the Council relating to the qualifying project;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H4E0A19D5B75E40C1B7A94C04F5C97B48"><enum>(II)</enum><text display-inline="yes-display-inline">by the Commission, as the lead agency, to cover the costs of any environmental review relating to the qualifying project; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6E65AE1E53EE471E879A7CB8720D08AF"><enum>(III)</enum><text display-inline="yes-display-inline">as the Council determines to be appropriate, by any other Federal agency conducting an environmental review relating to the qualifying project, to cover the costs of conducting that environmental review.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H4172E6157E214776A12F2BA7ABFE1CC1"><enum>(iii)</enum><header display-inline="yes-display-inline">Funding for purposes relating to the prefiling process</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Council shall make amounts in the Fund available to agencies participating in the prefiling process for purposes relating to the participation of those agencies in that process, including to compensate those agencies for resources expended during that process for those purposes.</text></clause><clause commented="no" display-inline="no-display-inline" id="H5D02377132364D768AA010B615D5E76E"><enum>(iv)</enum><header>Subsequent consideration of participation in the prefiling process</header><text>To encourage participation in the prefiling process, the Council, in making amounts in the Fund available to participating agencies and cooperating agencies for purposes relating to a qualifying project for which an application has been filed under subsection (c), shall take into consideration whether, and the extent to which, the participating agency or cooperating agency participated in the prefiling process with respect to that project.</text></clause><clause commented="no" display-inline="no-display-inline" id="H4B015ABACA0749F7B798B531113317EC"><enum>(v)</enum><header>Authorization of appropriations to the Fund</header><text display-inline="yes-display-inline">In addition to any amounts authorized to be appropriated to the Fund under any other law, there are authorized to be appropriated to the Fund such sums as are necessary to carry out this subparagraph.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H765B0B537CD0400CB1E1A24D6017A69F"><enum>(7)</enum><header>Prefiling required</header><subparagraph commented="no" display-inline="no-display-inline" id="HB426EBB572C94CDCA4EB83E510EA1022"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>In order to facilitate maximum participation by all stakeholders in the review and permitting processes for qualifying projects, project sponsors shall engage in a prefiling process in accordance with the regulations promulgated under subparagraph (C).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H98C665FD42FC49E0AFBCE2B5500F61F5"><enum>(B)</enum><header>Participation</header><clause commented="no" display-inline="no-display-inline" id="HD175576B05B749AF8CB53DC9BC0CF764"><enum>(i)</enum><header>Mandatory participation</header><text display-inline="yes-display-inline">Any applicant for a permit under subsection (c) and each Federal participating agency with respect to a project for which a permit is sought under that subsection shall participate in the prefiling process.</text></clause><clause commented="no" display-inline="no-display-inline" id="HCB92F4C23E074383B0D7F6FEB68FAAFE"><enum>(ii)</enum><header>State, Tribal, and local agencies</header><text display-inline="yes-display-inline">The Commission shall facilitate and encourage State, Tribal, and local agencies, including any State commission or other entity described in subsection (c)(1), to participate in the prefiling process for a qualifying project.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA47A654458C6445283D2E14D06283BFA"><enum>(C)</enum><header>Rulemaking</header><clause commented="no" display-inline="no-display-inline" id="H7189B0C1636A4F9291342D8FFAEE566B"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>FASTER Act of 2023</short-title>, the Commission shall promulgate a final rule to establish a prefiling process for use in accordance with this section.</text></clause><clause commented="no" display-inline="no-display-inline" id="HA8E36F1944474A1EA61747BF017A103D"><enum>(ii)</enum><header>Updates</header><text>The Commission may revise and update, as the Commission determines to be appropriate, the rules and regulations of the Commission with respect to the prefiling process established under clause (i), subject to the condition that any revision or update is consistent with the making of good faith efforts to engage stakeholders early in the review and permitting processes for national interest electric transmission facilities.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H4D1D864C6525478C948A802FC00252AE"><enum>(8)</enum><header>Expediting application processing</header><subparagraph commented="no" id="H3C153B9B911B483E874E988E465A9044"><enum>(A)</enum><header>In general</header><text>A Federal or State agency may allow an applicant seeking a Federal authorization for a qualifying project to fund a third-party contractor selected by the Federal or State agency to assist in reviewing the application.</text></subparagraph><subparagraph id="HDFE3066CB6AA4246BE5BD69A27CFD7C4"><enum>(B)</enum><header>Direct funding for expedited consideration</header><clause id="HBECA1922EB614B12A1FC54B04A260E95"><enum>(i)</enum><header>In general</header><text>Beginning on the date of enactment of the <short-title>FASTER Act of 2023</short-title>, a Federal or State agency may accept and expend funds contributed by an applicant seeking a Federal authorization for a qualifying project to carry out an activity that directly and meaningfully contributes to expediting the consideration by the agency of the application.</text></clause><clause id="HA1BD5BE30E874EC1916533604F65D1ED"><enum>(ii)</enum><header>Relation to existing discretionary funds</header><text>Any funds received by an agency under this subparagraph may be used only to carry out activities that would not otherwise occur within the same timeframe using discretionary funds provided in an appropriations Act.</text></clause></subparagraph><subparagraph id="HA4DC8680934C434BB692B2AF4EFF453A"><enum>(C)</enum><header>Effect on application consideration</header><text>In carrying out this paragraph, the Commission or an applicable agency shall ensure that the use of applicant funds under subparagraph (A) or (B) will not impact impartial decisionmaking with respect to the responsibilities of the agency, either substantively or procedurally, under this part or any other Federal law, consistent with the regulations for implementing the procedural provisions of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) under parts 1500 through 1508 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph id="H865ED5AF7E0141068CCCD6825C7EBC91"><enum>(D)</enum><header>Voluntary funding</header><text>Nothing in this paragraph requires or compels an applicant—</text><clause id="H5DBA8FE9FD74441BAD79BAF137EE4AD1"><enum>(i)</enum><text>to fund a third-party contractor under subparagraph (A); or</text></clause><clause id="HA8C207F26D8A47439130DD3C305FB20E"><enum>(ii)</enum><text>to contribute direct funding for expedited consideration under subparagraph (B).</text></clause></subparagraph><subparagraph id="HA54FA06E7D1E461EA625B849FE612013"><enum>(E)</enum><header>Existing third-party contracts</header><text>Nothing in this paragraph affects any third party contract under section 2403 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/797d">16 U.S.C. 797d</external-xref>) that is in effect as of the date of enactment of the <short-title>FASTER Act of 2023</short-title>.</text></subparagraph><subparagraph commented="no" id="HF6487DDD0D414F3D8A093D0234E06C82"><enum>(F)</enum><header>Accountability</header><clause commented="no" id="H4D012797DCD54C12A2A6E29E90019FC2"><enum>(i)</enum><header>Reports</header><text>A Federal or State agency shall submit to the Commission for each fiscal year a report that describes the manner in which the agency used funds under this paragraph during that fiscal year.</text></clause><clause commented="no" id="H9A86ED89EBED4450B7E88D067DF9FF81"><enum>(ii)</enum><header>Audits</header><text>The Comptroller General of the United States shall conduct periodic audits to ensure that Federal and State agencies use funds in accordance with this paragraph. </text></clause></subparagraph></paragraph><paragraph id="H895C873FF5EF40A1A471F20A1E029ED0"><enum>(9)</enum><header>Categorical exclusions</header><subparagraph id="HF6D309A65086415A95BA5627062CFD2A"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>FASTER Act of 2023</short-title>, the Commission shall—</text><clause id="HFCCA5B90F09349BCBC60563A3874FDFC"><enum>(i)</enum><text>evaluate whether 1 or more additional categorical exclusions developed in compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to the activities described in subparagraph (C) would reduce processing times or costs for the issuance of permits under subsection (c) without significantly affecting the human environment; and</text></clause><clause id="H5AFF97AE45444AF59885E318F34E21D7"><enum>(ii)</enum><text>if the Commission determines under clause (i) that 1 or more additional categorical exclusions would reduce processing times or costs for the issuance of permits under subsection (c) without significantly affecting the human environment—</text><subclause id="H8ECE1434D4DC42BFA2C73B78F59A3B2E"><enum>(I)</enum><text>establish those categorical exclusions in compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></subclause><subclause id="H7C28E81060384B94BBDB943AA80948F8"><enum>(II)</enum><text>revise relevant agency regulations and policy statements to implement those categorical exclusions.</text></subclause></clause></subparagraph><subparagraph id="H34C149C65B8442FA8B330310B9994D4C"><enum>(B)</enum><header>Administration</header><clause id="H6B158BAB358744AB862B3D2857FEB4CB"><enum>(i)</enum><header>In general</header><text>In administering a categorical exclusion established under subparagraph (A)(ii), the Commission shall comply with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) (including regulations promulgated pursuant to that Act).</text></clause><clause id="HF77202EA703642D68EEA83E904925F2C"><enum>(ii)</enum><header>Extraordinary circumstances</header><text>In determining whether to use a categorical exclusion established under subparagraph (A)(ii), the Commission shall apply—</text><subclause commented="no" display-inline="no-display-inline" id="HEA3A7A6E54B44328B1BBBA0E12E42298"><enum>(I)</enum><text display-inline="yes-display-inline">section 380.4(b) of title 18, Code of Federal Regulations (or a successor regulation); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE15E6AF950B140968D6700AF97CADDD9"><enum>(II)</enum><text display-inline="yes-display-inline">any other regulation promulgated by the Commission to establish extraordinary circumstances procedures described in section 1507.3(e)(2)(ii) of title 40, Code of Federal Regulations (or a successor regulation).</text></subclause></clause></subparagraph><subparagraph id="HC60AED5C9A4F4C2BAE70BD53A8DB46DC"><enum>(C)</enum><header>Activities described</header><text display-inline="yes-display-inline">The activities referred to in subparagraph (A) include—</text><clause id="HC511FB4F847F49A6A9B4C89EFAF42FB0"><enum>(i)</enum><text>a geotechnical investigation;</text></clause><clause id="HECC1E84590534D6F8F6C1C9EDE2693BF"><enum>(ii)</enum><text>off-road travel in an existing right-of-way;</text></clause><clause id="H2CE9A358C6C0454386A672BD91D1F79A"><enum>(iii)</enum><text display-inline="yes-display-inline">adding a battery or other energy storage device to an existing or planned energy facility, if that storage resource is located within the physical footprint of the existing or planned energy facility;</text></clause><clause id="H54A1A545A01A47DAB0EE1BD3EA81541B"><enum>(iv)</enum><text>any repair, maintenance, upgrade, optimization, or minor addition to existing transmission and distribution infrastructure, including—</text><subclause id="H2B7CCEDE7E85403690910ADF04E10106"><enum>(I)</enum><text display-inline="yes-display-inline">operation, maintenance, or repair of power equipment and structures within existing substations, switching stations, transmission lines, and distribution lines;</text></subclause><subclause id="HE878969695D649E5A20303271187B46F"><enum>(II)</enum><text>the addition, modification, retirement, or replacement of breakers, transmission towers, transformers, bushings, or relays;</text></subclause><subclause id="H7BBC34C82C084DFEB145BE90A41AD61F"><enum>(III)</enum><text display-inline="yes-display-inline">the voltage uprating, modification, reconductoring with conventional or advanced conductors, and clearance resolution of transmission lines;</text></subclause><subclause id="HA7236CCED9644791A0B07EBAC3F737FE"><enum>(IV)</enum><text display-inline="yes-display-inline">an activity to minimize fire risk, including vegetation management, routine fire mitigation, inspection, and maintenance activities, and removal of hazard trees and other hazard vegetation within or adjacent to an existing right-of-way;</text></subclause><subclause id="H87F77BCF52BD4B61B435F6BA1AAFDFE1" commented="no"><enum>(V)</enum><text display-inline="yes-display-inline">an improvement to or construction of 1 or more structure pads for that infrastructure; and</text></subclause><subclause id="HBF0C088467D14304BF09A6E787CD0DFD"><enum>(VI)</enum><text display-inline="yes-display-inline">access and access route maintenance, and any repair, associated with any activity described in subclauses (I) through (V);<italic></italic></text></subclause></clause><clause id="H17DB2F1757CE42ED89FCDD46564EC039"><enum>(v)</enum><text>approval of, and activities conducted in accordance with, operating plans or agreements for transmission and distribution facilities or under a special use authorization for an electric transmission and distribution facility right-of-way; and</text></clause><clause id="HE72F1D91DBFC4689ACB26ADAC0572D43"><enum>(vi)</enum><text>construction, maintenance, realignment, or repair of an existing permanent or temporary access road—</text><subclause id="HAAF2E9B6074D44B3854740301931D006" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">within an existing right-of-way or within a transmission or utility corridor established by Congress or in a land use plan; or</text></subclause><subclause id="H721B2E452EC34ADC9968BA8D2B3EBC2F"><enum>(II)</enum><text>that serves an existing transmission line, distribution line, or energy facility.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB53F633A178C45E79F8820E05FD572AD"><enum>(D)</enum><header>Other categorical exclusions</header><clause commented="no" display-inline="no-display-inline" id="H64D908600B1D4BF5850C422C6E4B2024"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>FASTER Act of 2023</short-title>, the Commission shall—</text><subclause commented="no" display-inline="no-display-inline" id="HA90BFF41A9A7482F83A4398DCE7D51AE"><enum>(I)</enum><text display-inline="yes-display-inline">review section 380.4 of title 18, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>FASTER Act of 2023</short-title>), and the applicable appendices of part 380 of that title; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H9B2A6996CC5B4A7C916BD8B609FC1E09"><enum>(II)</enum><text display-inline="yes-display-inline">as the Commission determines to be appropriate, promulgate comparable regulations pursuant to which the Commission may establish categorical exclusions for, and apply categorical exclusions to, qualifying projects.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HEC5AC7AA90724FDA881F22F32FD780B8"><enum>(ii)</enum><header>Transition period</header><text display-inline="yes-display-inline">Until the date on which the regulations described in clause (i)(II) are promulgated by the Commission, the Commission may apply section 380.4 of title 18, Code of Federal Regulations (or a successor regulation), to qualifying projects.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9FCC200D4F04A338D71CD1F69F1E336"><enum>(10)</enum><header>NEPA processes and compliance</header><subparagraph commented="no" display-inline="no-display-inline" id="HDDB6CFF7812F4532A9300C4AAD83415E"><enum>(A)</enum><header display-inline="yes-display-inline">Purpose</header><text>The purpose of this paragraph is to ensure that there is no duplication of effort or processes with respect to environmental reviews relating to the siting, construction, or modification of national interest electric transmission facilities in national interest electric transmission corridors designated by the Secretary under paragraph (2) or (5) of subsection (b).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAC28895B9B3747EE8F4F92ECE6ED0055"><enum>(B)</enum><header display-inline="yes-display-inline">Review relating to designation</header><text display-inline="yes-display-inline">Unless the Secretary determines that the preparation of an environmental review document with respect to the designation of a national interest electric transmission corridor under paragraph (2) or (5) of subsection (b) is appropriate under the circumstances, the Secretary shall not be required to prepare an environmental review document in connection with the designation of a national interest electric transmission corridor under those paragraphs.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEBA33D46AEDE47FF94E7F21B4872784F"><enum>(C)</enum><header>Effect on siting, construction, or modification of facilities</header><clause commented="no" display-inline="no-display-inline" id="HC6CE735CA701424397A1F6508B954F2D"><enum>(i)</enum><header>No review relating to designation of corridor</header><text display-inline="yes-display-inline">If the Secretary has not prepared an environmental review document with respect to the designation of a national interest electric transmission corridor under paragraph (2) or (5) of subsection (b), the Commission shall prepare an environmental review document, in accordance with this subsection, for any siting, construction, or modification of a national interest electric transmission facility in that national interest electric transmission corridor.</text></clause><clause commented="no" display-inline="no-display-inline" id="HD0AB9F270D114333B15D30EFF2F56D7E"><enum>(ii)</enum><header>Review relating to designation of corridor</header><text>If the Secretary has prepared an environmental review document with respect to the designation of a national interest electric transmission corridor under paragraph (2) or (5) of subsection (b)—</text><subclause commented="no" display-inline="no-display-inline" id="H77386D0F968A4111BF784CCC787805D3"><enum>(I)</enum><text display-inline="yes-display-inline">the Commission and any other Federal agency carrying out an environmental review with respect to the siting, construction, or modification of a national interest electric transmission facility in that national interest electric transmission corridor—</text><item commented="no" display-inline="no-display-inline" id="HC7D401C2D52C4EB68372870E116DEFE6"><enum>(aa)</enum><text display-inline="yes-display-inline">shall rely on any findings of the environmental review document prepared by the Secretary in carrying out the environmental review of the Commission or other Federal agency, as applicable; and</text></item><item commented="no" display-inline="no-display-inline" id="H7A736750F34F44368E7BD078214DE2D5"><enum>(bb)</enum><text>shall not duplicate any work of the Secretary relating to the preparation of that environmental review document; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H871BAE601C094C62BDC9665F9C45AA4C"><enum>(II)</enum><text>the Commission shall incorporate the findings of that environmental review document into any environmental review document prepared by the Commission under this subsection.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF3ABD1D7299B4CF48FFA33070B06C925"><enum>(11)</enum><header>Federal land use authorizations</header><subparagraph commented="no" display-inline="no-display-inline" id="H8F222BC5A4754B90B0ED450F29377A04"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Each Federal land use authorization for a national interest electric transmission facility shall be issued—</text><clause commented="no" display-inline="no-display-inline" id="H71BB3795A2764D28AE72F1B5BB890F6B"><enum>(i)</enum><text>for a duration, as determined by the Commission, commensurate with the anticipated use of the facility; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H7BC1D3FFF4684101A67FE0FD44D74045"><enum>(ii)</enum><text>with appropriate authority to manage the right-of-way for reliability and environmental protection.</text></clause></subparagraph><subparagraph id="HC76796F5278B417198BDE259B20DD9C5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Renewal</header><text>On the expiration of the authorization (including an authorization issued before the date of enactment of the <short-title>FASTER Act of 2023</short-title>), the authorization shall be reviewed for renewal taking fully into account reliance on such electricity infrastructure, recognizing the importance of the authorization for public health, safety, and economic welfare and as a legitimate use of Federal land. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1F35511C28344EBBA2F7CE64ED48838"><enum>(12)</enum><header>Consultation</header><text>In exercising the responsibilities under this section, the Commission shall consult regularly with—</text><subparagraph commented="no" display-inline="no-display-inline" id="H28F10E95A58E4FBBB2CEB0E989CE0800"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB298EFB3688F40C2B9742537108E43EF"><enum>(B)</enum><text display-inline="yes-display-inline">electric reliability organizations (including related regional entities) approved by the Commission; and</text></subparagraph><subparagraph id="HD2322C645C5E41DA8C9D2555764807C7" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Transmission Organizations approved by the Commission.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6FE8DC3933F04358982E5DCFA1802DF0"><enum>(i)</enum><header>Interstate compacts</header><paragraph commented="no" display-inline="no-display-inline" id="H311FC86387A64302AEBFC5661D4E50EF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The consent of Congress is given for 3 or more contiguous States to enter into an interstate compact, subject to approval by Congress, establishing regional transmission siting agencies—</text><subparagraph id="HE0E497899F1F43518AF5585EF8EF3F6B"><enum>(A)</enum><text>to facilitate siting of future electric energy transmission facilities within those States; and</text></subparagraph><subparagraph id="H438568DB82E54361B158125BDC817D19"><enum>(B)</enum><text>to carry out the electric energy transmission siting responsibilities of those States.</text></subparagraph></paragraph><paragraph id="H091D0E2F789241DBBB9F83DB0C8F8941"><enum>(2)</enum><header>Technical assistance</header><text>The Commission shall provide technical assistance to regional transmission siting agencies established under this subsection.</text></paragraph><paragraph id="HDA39B301E3D54FB1B3A8AC5A81CB0B98"><enum>(3)</enum><header>Authority</header><text>The regional transmission siting agencies shall have the authority to review, certify, and permit siting of transmission facilities, including facilities in national interest electric transmission corridors (other than facilities on property owned by the United States).</text></paragraph><paragraph id="H9B850146CFA74F43BED1E5AEE9B4C545"><enum>(4)</enum><header>Limitation</header><text>The Commission shall have no authority to issue a permit for the construction or modification of an electric transmission facility within a State that is a party to a compact, unless the Commission determines that the members of the compact are unable to reach an agreement on an application seeking approval by the date that is 1 year after the date on which the application for the facility was filed.</text></paragraph></subsection><subsection id="H70652E45A6784F9AB6EDDAFCCABDC8F5"><enum>(j)</enum><header>Relationship to other laws</header><text>Except as specifically provided, nothing in this section affects any requirement of an environmental law of the United States, including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subsection><subsection id="HAA7ADFAC33734CFCA3A6EFF479753C54"><enum>(k)</enum><header>ERCOT</header><text>This section shall not apply within the area referred to in section 212(k)(2)(A).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H734BCD42CCB4486086E752C501B34852"><enum>(b)</enum><header>Grants To facilitate the siting of interstate electricity transmission lines</header><paragraph commented="no" display-inline="no-display-inline" id="H19AC00070CFB48D98EFB2D45AAA05C2C"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="HDD202EEAE76A4874A12EA850FBA569CD"><enum>(A)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF46D4E29CB1B41548AEA8432F3399767"><enum>(B)</enum><header>Community benefit agreement</header><text>The term <term>community benefit agreement</term> has the meaning given the term in section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H70DEF4A5D2E9440E8DF0D5D8F6553634"><enum>(C)</enum><header>Covered transmission project</header><text>The term <term>covered transmission project</term> has the meaning given the term in section 50152(e) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a(e)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6D0240B6FE3D403AB42C52808E450CA3"><enum>(D)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA233F77EAA6640238AE2409F381DBF75"><enum>(2)</enum><header display-inline="yes-display-inline">Allocation</header><text>In carrying out section 50152 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a</external-xref>), the Secretary shall use, of the amounts appropriated by subsection (a) of that section and used for making grants under that section—</text><subparagraph commented="no" display-inline="no-display-inline" id="H90BE5B0090034466AC62F05B2DA258B5"><enum>(A)</enum><text>30 percent to make grants under subsection (b)(1) of that section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3747FEA22B514A80B1BE01CC4F1D6F9D"><enum>(B)</enum><text display-inline="yes-display-inline">70 percent to make grants under subsection (b)(2) of that section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H330876FE2CC449A7B6379C80FD34AD13"><enum>(3)</enum><header>Priority</header><text>In making grants under subsection (b)(2) of section 50152 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a</external-xref>), the Secretary shall give priority to State, local, or Tribal governmental entities that, in the determination of the Secretary, are among the most significantly impacted by project development, construction, or local operations activities relating to the covered transmission projects for which a grant under that subsection is sought.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB143F7E8CE9A498D83DDF61104DE4A1C"><enum>(4)</enum><header>Additional economic development funding</header><subparagraph commented="no" display-inline="no-display-inline" id="H48F81DF61D2148CFA488226A1A84F31E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), if the Secretary makes a grant under section 50152(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a</external-xref>), the sponsor of the applicable covered transmission project shall be required to contribute, to the recipient of the grant, $1 for every $5 provided by the Secretary to that recipient pursuant to the grant.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0BB732F6F00E4B35ADBCD27167D85E97"><enum>(B)</enum><header>Community benefit agreements</header><text>If the sponsor of the applicable covered transmission project has entered into a community benefit agreement, the sponsor may satisfy the requirement described in subparagraph (A) through contributions or expenditures made pursuant to the terms of the applicable community benefit agreement.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3A2BDCB9C1CB455B89B796909076F3F1"><enum>(c)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="H8F920935E74A4FDAB7E89558893FA6D0"><enum>(1)</enum><text>Section 1222 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16421">42 U.S.C. 16421</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H117DDED47CDF4D68835434D8FAF43637"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(A), by striking <quote>section 216(a) of the Federal Power Act</quote> and <quote>section 216(a) of the Federal Power Act <external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref></quote> and inserting <quote>section 216(b) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(b)</external-xref>)</quote>.</text></paragraph><paragraph id="HE926E19AB1D34DAF948660410754CF04" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>Section 50151(b) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/18715">42 U.S.C. 18715(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2BC96B081EA4417DA00327495F23558E"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>, in consultation with the Federal Energy national interest under section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>)</quote> and inserting <quote>national interest electric transmission facilities (as defined in section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>))</quote>.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H266D9FCC4CB846BC8E7148F43CFD69C5"><enum>3.</enum><header>Support for regional offices of cooperating agencies</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Federal Energy Regulatory Commission such sums as are necessary to provide funding to cooperating agencies (as defined in section 1508.1 of title 40, Code of Federal Regulations (or a successor regulation)) with respect to qualifying projects (as defined in section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>)) to help cover the costs of the staff and resources of the cooperating agency that relate to the qualifying project in order to focus those staff and resources on an expeditious review of the qualifying project.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HDAD19CE959BF4D0D89EF7025E046131A"><enum>4.</enum><header>FERC hiring and compensation authority</header><subsection commented="no" display-inline="no-display-inline" id="HBC666DAEAAA04F38897CB860AC8482B6"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Commission</header><text>In this section, the term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></subsection><subsection id="HCD147A7C3F2047E2ACFF7728A887DBBC" commented="no"><enum>(b)</enum><header>Appointment authority</header><text>Notwithstanding any provision of title 5, United States Code, governing appointments and General Schedule classification and pay rates—</text><paragraph commented="no" display-inline="no-display-inline" id="HAD7ABC2E48194526996147BF6D1B1012"><enum>(1)</enum><text display-inline="yes-display-inline">the Chairman of the Commission may designate positions to which persons may be appointed without regard to the civil service laws; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HECF906EDEEBD4626BC9DC55910A4338E"><enum>(2)</enum><text display-inline="yes-display-inline">the Commission may appoint persons to those positions without regard to the civil service laws.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5216902A22564884B7F6FFA043B062E9"><enum>(c)</enum><header>Compensation authority</header><paragraph id="H49AD6FD39DA94F9CA78A961D48E9F319" commented="no"><enum>(1)</enum><header>In general</header><text>Notwithstanding chapter 51, and subchapter III of chapter 53, of title 5, United States Code, the Commission may fix the rate of basic pay for the positions of individuals described in paragraph (2), subject to the limitation described in paragraph (3), without regard to the civil service laws.</text></paragraph><paragraph id="H0E964E2423AD4A869E1D28A695F5D89B" commented="no"><enum>(2)</enum><header>Individuals described</header><text>An individual referred to in paragraph (1) is—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA88AAA4DA42C4C9E816D6549AA340222"><enum>(A)</enum><text display-inline="yes-display-inline">an individual appointed under subsection (b); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D7E4A54FD654DF9972DBC6D6297E9D5"><enum>(B)</enum><text display-inline="yes-display-inline">any other individual with respect to whom the Chairman of the Commission determines that compensation in accordance with that paragraph is necessary or appropriate to hire or retain that individual.</text></subparagraph></paragraph><paragraph id="HEDC8C1284E854711A535B1D3C763CCED" commented="no"><enum>(3)</enum><header>Limitation</header><text>The annual rate of basic pay for an individual described in paragraph (2) may not exceed the per annum rate of salary payable for level III of the Executive Schedule under section 5314 of title 5, United States Code.</text></paragraph></subsection></section><section id="HD0A5D43853D2477D80E68F1DA189F2F6"><enum>5.</enum><header>Disposition of certain revenues</header><subsection commented="no" display-inline="no-display-inline" id="HC6437928ED654DCA9121482ADABDA000"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="H556B7F0A7FB44572A601D077B57484E0"><enum>(1)</enum><header>Covered land</header><text>The term <term>covered land</term> means land that is—</text><subparagraph id="HBE843BBFAAB54494B49D82DF318B0576"><enum>(A)</enum><text>public land; and</text></subparagraph><subparagraph id="HCC45EBC77C98416FAFB8A5D40F733F87"><enum>(B)</enum><text>not excluded from the siting, construction, or modification of electric transmission facilities under—</text><clause id="H6DB9D5903E73423089CAFA309949B074"><enum>(i)</enum><text>a land use plan established under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); or</text></clause><clause id="H25BAAEE2AC404E5A8870855C319E455A"><enum>(ii)</enum><text>other Federal law.</text></clause></subparagraph></paragraph><paragraph id="H92BDA6055262472F85C73B43AF86B725"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="HDB0239BDD0164293A133B4540C181FF1"><enum>(A)</enum><text>National Forest System land; and</text></subparagraph><subparagraph id="HBAA74CFF9F37467D9B6C3E97A1762A7E"><enum>(B)</enum><text>public land.</text></subparagraph></paragraph><paragraph id="H49354C9DEA9F459BA612BF02B748C5CA"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Federal Land Electric Energy Transmission Conservation Fund established by subsection (d)(1).</text></paragraph><paragraph id="HA27CBCF5C1DB4EC580C5396AB6C07E90"><enum>(4)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H257E5F0BEBD04D1D89B90D8019EF005C"><enum>(5)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <term>public lands</term> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF209960278E1461AB477A81F042C0FB7"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="H336EBE8630A94AAD99E881AAF85459EA"><enum>(b)</enum><header>Disposition of revenues</header><text display-inline="yes-display-inline">Without further appropriation or fiscal year limitation, of the amounts collected as bonus bids, rentals, fees, or other payments under a right-of-way, permit, lease, or other authorization (other than under section 504(g) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1764">43 U.S.C. 1764(g)</external-xref>)) for the siting, construction, or modification of electric transmission facilities on covered land or National Forest System land—</text><paragraph commented="no" display-inline="no-display-inline" id="H4FE2DEC8BADF4A32A95AA8309F74BEE2"><enum>(1)</enum><text>for the period beginning on the date of enactment of this Act and ending on December 31, 2039;</text><subparagraph id="H163A3F2143714E4D96E762A9B0E7C541"><enum>(A)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the State within the boundaries of which the revenue is derived;</text></subparagraph><subparagraph id="H969CF9D5BFB8444399E0BA74C487B708"><enum>(B)</enum><text>30 percent shall be paid by the Secretary of the Treasury to the 1 or more counties within the boundaries of which the revenue is derived, to be allocated among the counties based on the percentage of land from which the revenue is derived;</text></subparagraph><subparagraph id="HD5112B6A3AA14D59B20410BBB6648625"><enum>(C)</enum><text display-inline="yes-display-inline">15 percent shall be deposited in the Treasury and be made available to the Secretary to facilitate, streamline, and improve Federal permit coordination with respect to the siting, construction, or modification of electric transmission facilities on Federal land, including the transfer of the funds by the Bureau of Land Management to other Federal agencies and State agencies to facilitate the processing of permits for the siting, construction, or modification of electric transmission facilities on Federal land, with priority given to using the amounts, to the maximum extent practicable without detrimental impacts to emerging markets, to expediting the issuance of permits required for the siting, construction, or modification of electric transmission facilities in the States from which the revenues are derived; and</text></subparagraph><subparagraph id="HC1969997224A45ECA62B5045DE191B5E"><enum>(D)</enum><text display-inline="yes-display-inline">30 percent shall be deposited in the Fund; and</text></subparagraph></paragraph><paragraph id="H419C111D43734B638233368D752BD6CA"><enum>(2)</enum><text>beginning on January 1, 2040—</text><subparagraph id="H71EC2B727D51456283505A10D6B5B7D1"><enum>(A)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the State within the boundaries of which the revenue is derived;</text></subparagraph><subparagraph id="H18083BF6D6AB48C28BF7C675062CA483"><enum>(B)</enum><text>30 percent shall be paid by the Secretary of the Treasury to the 1 or more counties within the boundaries of which the revenue is derived, to be allocated among the counties based on the percentage of land from which the revenue is derived;</text></subparagraph><subparagraph id="HB41F5CDBBED64D62B18C0CB357B46CF1"><enum>(C)</enum><text display-inline="yes-display-inline">10 percent shall be deposited in the Treasury and be made available to the Secretary to facilitate, streamline, and improve Federal permit coordination with respect to the siting, construction, or modification of electric transmission facilities on Federal land, including the transfer of the funds by the Bureau of Land Management to other Federal agencies and State agencies to facilitate the processing of permits for the siting, construction, or modification of electric transmission facilities on Federal land, with priority given to using the amounts, to the maximum extent practicable without detrimental impacts to emerging markets, to expediting the issuance of permits required for the siting, construction, or modification of electric transmission facilities in the States from which the revenues are derived; and</text></subparagraph><subparagraph id="H2CAB0F7C2A6F41E0BD666B1FEF108D2E" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">35 percent shall be deposited in the Fund. </text></subparagraph></paragraph></subsection><subsection id="HF5BCE4D46F03420182B28446D6FE30B0"><enum>(c)</enum><header>Payments to states and counties</header><paragraph id="H6A7A7061B12C446EB2CCFBC00F2FFF2F"><enum>(1)</enum><header>In general</header><text>Amounts paid to States and counties under subsection (b) shall be used consistent with section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>).</text></paragraph><paragraph id="H11A5CBD075904B82AAD63642B5224EAD"><enum>(2)</enum><header>Payments in lieu of taxes</header><text>A payment to a county under paragraph (1) shall be in addition to a payment in lieu of taxes received by the county under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code.</text></paragraph></subsection><subsection id="HF9F79341AEBB4104B12503979201A349"><enum>(d)</enum><header>Federal Land Electric Energy Transmission Conservation Fund</header><paragraph id="H844ACC618BAF4E33A0D9923AAFE5888D"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury a fund, to be known as the <quote>Federal Land Electric Energy Transmission Conservation Fund</quote>, which shall be administered by the National Fish and Wildlife Foundation (referred to in this subsection as the <term>Foundation</term>).</text></paragraph><paragraph id="H58951476BB8D4D82AF410F5A27BFA48C"><enum>(2)</enum><header>Use of funds</header><text>The Foundation may make amounts in the Fund available to Federal, State, local, and Tribal agencies to be distributed in regions in which projects for the siting, construction, or modification of electric transmission facilities are located on Federal land, for the purposes of—</text><subparagraph id="HA9CB3BA7CBCE49888587D150821E9CCD"><enum>(A)</enum><text>restoring and protecting—</text><clause id="HECC464BF396344AF951DC2E1BB322F22"><enum>(i)</enum><text>fish and wildlife habitat for affected species;</text></clause><clause id="H819D4A4EAD9A4A41BAC9F64B8A7788E7"><enum>(ii)</enum><text>fish and wildlife corridors for affected species; and</text></clause><clause id="H6EFE4E8285C14B5D98AE9E6E899C848E"><enum>(iii)</enum><text>water resources in areas affected by projects for the siting, construction, or modification of electric transmission facilities; and</text></clause></subparagraph><subparagraph id="HA8A814D4C70C43E2BE2D55B1C468FA31"><enum>(B)</enum><text>preserving and improving recreational access to Federal land and water in an affected region through an easement, right-of-way, or other instrument from willing landowners for the purpose of enhancing public access to existing Federal land and water that is inaccessible or restricted.</text></subparagraph></paragraph><paragraph id="H75D5B9B1C0C147CBABF8BC0068E97845"><enum>(3)</enum><header>Partnerships</header><text>The Foundation may enter into cooperative agreements with State, local, and Tribal agencies, nonprofit organizations, and other appropriate entities to carry out the activities described in subparagraphs (A) and (B) of paragraph (2).</text></paragraph><paragraph id="HA72DEF82496B4D169C7D8F86D85DDE39"><enum>(4)</enum><header>Investment of fund</header><subparagraph id="H366983D30CD14C15B6E540AE8C929D2B"><enum>(A)</enum><header>In general</header><text>Any amounts deposited in the Fund shall earn interest in an amount determined by the Secretary of the Treasury on the basis of the current average market yield on outstanding marketable obligations of the United States of comparable maturities.</text></subparagraph><subparagraph id="HB0B5919C48ED40FB9C7D14437C0A3375"><enum>(B)</enum><header>Use</header><text>Any interest earned under subparagraph (A) may be expended in accordance with this subsection.</text></subparagraph></paragraph><paragraph id="H5256C26D3030465A9E053937F24282AC"><enum>(5)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">At the end of each fiscal year, the Foundation shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report identifying—</text><subparagraph id="HDD6DA66685CB4CDCBCCA5E050A4791B8"><enum>(A)</enum><text>the amounts described in subsection (b) that were collected during that fiscal year, organized by source;</text></subparagraph><subparagraph id="HBD37A17E4E094A889FC8500ABC46542A"><enum>(B)</enum><text>the amount and purpose of payments made to each Federal, State, local, and Tribal agency under paragraph (2) during that fiscal year; and</text></subparagraph><subparagraph id="HC79EBC9731B245F9A69DB2F067E037B9"><enum>(C)</enum><text>the amount remaining in the Fund at the end of the fiscal year.</text></subparagraph></paragraph><paragraph id="H716615FEBD144B59A30DB4E267929E14" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Intent of congress</header><text>It is the intent of Congress that the revenues deposited and used in the Fund shall supplement (and not supplant) annual appropriations for activities described in subparagraphs (A) and (B) of paragraph (2).</text></paragraph></subsection></section></legis-body></bill>
