<section id="HA68B93B9DFC2494192A06B3C854A4C4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Halting Academic Liaisons To Our Adversaries Act</short-title></quote> or the <quote><short-title>HALT Our Adversaries Act</short-title></quote>.</text></section> <section id="H0A1BA6E0BFD74B38B41357BB35B7B0E5" section-type="subsequent-section"><enum>2.</enum><header>Modification to initiative to support protection of national security academic researchers from undue influence and other security threats</header> <subsection id="H9DE966B3E2FF433DA5A04A2BACFAFD87"><enum>(a)</enum><header>In general</header><text>Clause (iii) of section 1286(c)(8)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/4001">10 U.S.C. 4001</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>) is amended—</text> 
<paragraph id="H8F9A7BCA78E34BDEBADB657B58B4B4E4"><enum>(1)</enum><text>in subclause (I), by striking <quote>or</quote> at the end; and</text></paragraph> <paragraph id="HF7FE2D7E6F9A4405BD44A090A015E563"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H32C8E89063E14B3695AAA72C4CE1593C" style="OLC"> 
<subclause id="H6AE1D7A2B058417984BDAE4A6A3393AC" indent="up1"><enum>(III)</enum><text>to provide support to the People’s Liberation Army or the Armed Forces of the Russian Federation; or</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE79387AC1BF040ECA42CDACAB6903B42"><enum>(b)</enum><header>Prohibition on availability of funds</header><text display-inline="yes-display-inline">An institution of higher education that maintains a contract or other agreement between the institution and an academic institution of the People's Republic of China or the Russian Federation identified on the list published under section 1286(c)(8)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/10/4001">10 U.S.C. 4001</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>) (as amended by subsection (a) of this section) shall not be eligible to receive Federal funds.</text> </subsection></section> 
<section id="HD150640887D54DFEB7DCB714DFE3AD80" commented="no"><enum>3.</enum><header>Prohibition on availability of intelligence community funds for certain institutions of higher education</header> 
<subsection id="H6A37039733B141F88BA2EB1266070CA2" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">None of the funds authorized to be appropriated or otherwise made available for fiscal year 2024 or any subsequent fiscal year for an element of the intelligence community for research, development, testing, and evaluation, may be provided to an institution of higher education that maintains a contract or other agreement with—</text> <paragraph id="HD5617A092ABE46FBA54C2B84A50EC7FB" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">any entity identified as a Chinese military company operating in the United States in accordance with section 1260H of the National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note); or</text></paragraph> 
<paragraph id="H6BE42A3FB4124E7599EF694E4523810D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">an academic institution of the People’s Republic of China that maintains a relationship with such an entity.</text></paragraph></subsection></section> <section id="H372428D6E4FA4D0BBEBD26EC7DB03E81"><enum>4.</enum><header>Restrictions on institutions partnering with the People’s Republic of China</header> <subsection id="HE048C8667C354ECC9EACEF3AE9501A79"><enum>(a)</enum><header>Funding restricted</header><text>An institution of higher education or other postsecondary educational institution shall not be eligible to receive Federal funds (except funds under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>) or other Department of Education funds that are provided directly to students) if such institution has a contractual partnership in effect with an entity that is—</text>
<paragraph id="H77D1F4D5DB9F442FA010F4EE3ACA65BC"><enum>(1)</enum><text>owned or controlled, directly or indirectly, by the Government of the People’s Republic of China; or</text></paragraph> <paragraph id="H9F2A0F141E324AF8B5152E02CB336851"><enum>(2)</enum><text>organized under the laws of the People’s Republic of China.</text></paragraph></subsection>
<subsection id="HE5E2B8280477480C92CEFFD5BC34EFC6"><enum>(b)</enum><header>Restoring eligibility</header><text>An institution ineligible to receive Federal funds under subsection (a) may reestablish eligibility by—</text> <paragraph id="H25D7D70EC8964703ABDA07FF5B341C38"><enum>(1)</enum><text>disclosing to the Secretary of Education all contractual partnerships with an entity described in subsection (a) from the previous 10 years; and</text></paragraph>
<paragraph id="HAED4EF07B1B24D59B24673C9E1FCB2A6"><enum>(2)</enum><text>providing to the Secretary of Education sufficient evidence that such partnerships have been terminated.</text></paragraph></subsection></section> <section id="H216A96279A18456C8BB1F522823EA58A" commented="no"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this section:</text> 
<paragraph id="H4D7718DC6DE44DFEBC30296E7BA338E8"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph> <paragraph id="H72DD9B66253D4CB9B64A4ACD9855C658"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>intelligence community</term> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph></section>
