<section id="H9FDE3D9897A8449C98D69DE009BB5F3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>General Aviation Airport Access Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HA8F2EDBA59F64126ACAAAD2FAD783A67"><enum>2.</enum><header>Public airport apron access for transient general aviation aircraft</header> <subsection commented="no" display-inline="no-display-inline" id="H30AFDBDD13C440C7900388378CF612C7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/401">Chapter 401</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="H55E238D6DB644A6D865E4EBD82F06D17"><enum>40131.</enum><header>Apron access for transient general aviation aircraft</header>
<subsection id="HA7E47C1E96AA4E3AA3EDD1AE7516BE69"><enum>(a)</enum><header>Transient apron</header><text>A covered airport shall provide transient general aviation aircraft parking on or near the existing apron when the pilot or owner of that aircraft does not need or request fuel or use other related services from the covered airport or a fixed-base operator at the covered airport.</text></subsection> <subsection id="H8A7F5FDA7C044D67ACBEFC9DDABFB397"><enum>(b)</enum><header>Transient fees</header><text>A covered airport may assess a fee on a transient general aviation aircraft for using the transient apron described in subsection (a) and, if it does assess such a fee, the fee shall be fair, reasonable, transparent, publicly available (including on the website of the entity that imposes such fee), and exclude any extraneous or hidden costs. </text></subsection>
<subsection id="H8BC106E5464B413CB7B2A18C1ED9538E"><enum>(c)</enum><header>Access to transient apron</header><text>A controlled access airport, or a fixed-base operator at a controlled access airport, may not charge a fee for a pilot or passengers to transit between their transient general aviation aircraft parked on the transient apron described in subsection (a) and a place outside the airport’s perimeter fence, whether or not such transit requires passing through a building. </text></subsection> <subsection id="HE5CBDEECA4F1405D8A3378C5B76BCC74"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HA847CF8944DB41C6B649058A78FD1D14"><enum>(1)</enum><header>Controlled access airport</header><text>The term <term>controlled access airport</term> means an airport that is a public use airport and—</text> <subparagraph id="HEF34F49B43514C7CA1D7FE1439255217"><enum>(A)</enum><text>is required to have an airport security program under part 1542 of title 49, Code of Federal Regulations; or</text></subparagraph>
<subparagraph id="HA2565DDDAE3842B29AF201F99F49D754"><enum>(B)</enum><text>the airport or a fixed-base operator at the airport does not allow a pilot unescorted access to the pilot's transient general aviation aircraft that is parked on the transient apron described in subsection (a).</text></subparagraph></paragraph> <paragraph id="H48E169AAD2D94B3C8055DBC412EAD0F6"><enum>(2)</enum><header>Covered airport</header><text>The term <term>covered airport</term> means an airport that is a public use airport and has—</text>
<subparagraph id="HCB6CB9E8A3EC4CB9B6CD594B4D165CB5"><enum>(A)</enum><text>received a grant under section 48103 or chapter 471 at any time during the most recent 20-year period; or</text></subparagraph> <subparagraph id="H4CD847D218384B029DA98807E58474BE"><enum>(B)</enum><text>been the recipient of a Federal property conveyance.</text></subparagraph></paragraph>
<paragraph id="H93ED5D01C8CB46948FE457584AB1986D"><enum>(3)</enum><header>Fixed-base operator</header><text>The term <term>fixed-base operator</term> means a business granted the right by an airport sponsor or heliport sponsor to operate on an airport or heliport and provide aeronautical services, including fueling and charging, aircraft hangaring, tiedown and parking, aircraft rental, aircraft maintenance, and flight instruction.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HAE70FB6AFC944DBD908605EC3D970A0F"><enum>(4)</enum><header>Public use airport</header><text>The term <term>public use airport</term> has the meaning given that term in section 47102.</text></paragraph>
<paragraph id="HB3C3BEBB99FB45F1B3A3BC0D5489492B"><enum>(5)</enum><header>Transient general aviation aircraft</header><text>The term <term>transient general aviation aircraft</term> means an aircraft, not owned or operated by an air carrier or foreign air carrier, that is seeking to park temporarily at an airport.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H1A8D6581E105426BB7C41439CAF5A7CC"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/401">chapter 401</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/40130">section 40130</external-xref> the following:</text>
