which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><action display="yes"><action-date date="20240417">April 17, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on July 11, 2023</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to allow the use of requirements payments to conduct a post-election audit with respect to an election for Federal office in a State.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HHA00" reported-display-style="italic" id="HCEAE34B9FD33435A857D3F3CD2C74209"><section id="H5497B3F267604790BD180E32F41B10E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Election Audit Act</short-title></quote>. </text></section><section id="H360449647BE64FF29B30693328A0D50D"><enum>2.</enum><header>Use of requirements payments for post-election audits</header><subsection id="H4C2A71B08B02452E8BEEB3E66AB0317C"><enum>(a)</enum><header>Permitting use of payments for audits</header><text display-inline="yes-display-inline">Section 251(b)(1) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21001">52 U.S.C. 21001(b)(1)</external-xref>) is amended by inserting <quote>, including to conduct and publish an audit of the effectiveness and accuracy of the voting systems, nonvoting election technology (as defined in paragraph (4)(B)), election procedures, and outcomes used to carry out an election for Federal office in the State and the performance of the State and local election officials who carried out the election, but only if the audit meets the requirements of paragraph (4)(A)</quote> after <quote>requirements of title III</quote>.</text></subsection><subsection id="HFF649459355A441BA1CF4348F4F786E3"><enum>(b)</enum><header>Requirements for audits; nonvoting election technology defined</header><text>Section 251(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21001">52 U.S.C. 21001(b)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HFE05740507C6403EA548EA27609E79A7" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HHA00"><paragraph id="HBC6B93D1A0D44A479E866C4FCB987B91"><enum>(4)</enum><header>Requirements for audits conducted with requirements payments</header><subparagraph id="HA11785E546D94DA3B95FDEBB1A51F7C8"><enum>(A)</enum><header>In general</header><text>An audit described in paragraph (1) meets the requirements of this paragraph if—</text><clause id="H5FC4F06BA2934A6E92E3F7BC0A4DE149"><enum>(i)</enum><text>no individual who participates in conducting the audit is an employee or contractor of an office of the State or local government which is responsible for the administration of elections for Federal office or of a subsidiary or affiliate of such an office; and</text></clause><clause id="HC353CF1D84A142BA9542F82D224D7FB1"><enum>(ii)</enum><text display-inline="yes-display-inline">the audit includes an examination of compliance with established processes for voter registration, voter check-in, voting, tabulation, canvassing, post-election proceedings (such as recounts and recanvasses), and reporting of results.</text></clause></subparagraph><subparagraph id="HC01D5F3590BD4A16BEF71994C3E313CD"><enum>(B)</enum><header>Nonvoting election technology defined</header><text>In paragraph (1), the term <term>nonvoting election technology</term> means technology used in the administration of elections for Federal office which is not used directly in the casting, counting, tabulating, or collecting of ballots or votes, including each of the following:</text><clause id="HAE524A3C10404EE6870ECD5ECC4B033E"><enum>(i)</enum><text display-inline="yes-display-inline">Electronic pollbooks or other systems used to check in voters at a polling place or verify a voter’s identification.</text></clause><clause id="HE60F311875B94DD3BF71AB3073673DE7"><enum>(ii)</enum><text>Election result reporting systems.</text></clause><clause id="HDF30A396E8054633A583738323AE1B87"><enum>(iii)</enum><text>Electronic ballot delivery systems.</text></clause><clause id="HECA83D5833794671945F4A8D388EABCE"><enum>(iv)</enum><text>Online voter registration systems.</text></clause><clause id="HCB59DC08DD504F0A84EFB6507049D7CF"><enum>(v)</enum><text>Polling place location search systems.</text></clause><clause id="H74AAB929378B44C78FBA2FB0FF246266"><enum>(vi)</enum><text>Sample ballot portals.</text></clause><clause id="HC583607D841144B18BD59A7F68333B3D"><enum>(vii)</enum><text>Signature systems.</text></clause><clause id="H4B9F9C1C42E94038B01A775B13CAD864"><enum>(viii)</enum><text>Such other technology as may be recommended for treatment as nonvoting election technology as the Standards Board may recommend.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3DB6EF7F871944B1B909EC8D589F9ACD"><enum>(c)</enum><header>Sense of Congress regarding timing of audits</header><text display-inline="yes-display-inline">It is the sense of Congress that post-election audits of the effectiveness and accuracy of the voting systems, election procedures, and outcomes used to carry out an election for Federal office in a State and the performance of the State and local election officials who carried out the election are most effective when the audits are completed before the expiration of the period during which persons are authorized under State law to challenge the results of the election.</text></subsection></section></legis-body><endorsement display="yes"><action-date date="20240417">April 17, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
