<section id="H242BC103C03D48A5A733ABD9B47BEFE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Infrastructure Enhancement Act of 2023</short-title></quote>.</text></section> <section id="H681026E32C794865B8A6AAB5D0B02CD1" section-type="subsequent-section"><enum>2.</enum><header>Water Infrastructure Enhancement</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H353BA9718C7B4869A8265D8B44E0B827"><enum>1459H.</enum><header>Water Infrastructure Enhancement</header> 
<subsection id="H32DBFB6C3E964FDF8B58B111F1F19A77"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H8978B70046804B00AFC4545E6FE7F99A"><enum>(1)</enum><header>Area of persistent poverty</header><text>The term <term>area of persistent poverty</term> means—</text> 
<subparagraph id="HEE55B068C0B242939968348F9DD324D0"><enum>(A)</enum><text>any county (or equivalent jurisdiction) in which, during the 30-year period ending on the date of enactment of this section, 20 percent or more of the population continually lived in poverty, as measured by—</text> <clause id="H6C1F31C3B81E4E9D9F1AC2E65000A15A"><enum>(i)</enum><text>the 1990 decennial census;</text></clause> 
<clause id="H0379F722497842749CF3BA5D9390341E"><enum>(ii)</enum><text>the 2000 decennial census; and</text></clause> <clause id="H41100131D2304F17B4754776FC06EFAC"><enum>(iii)</enum><text>the most recent annual small area income and poverty estimate of the Bureau of the Census;</text></clause></subparagraph> 
<subparagraph id="H4423F00F58F64BC5BF5052A18B3917A0"><enum>(B)</enum><text>any census tract with a poverty rate of not less than 20 percent, as measured by the 5-year data series available from the American Community Survey of the Bureau of the Census for the period of 2014 through 2018; and</text></subparagraph> <subparagraph id="HB4DBA18BF0984FA9917A495862388C3B"><enum>(C)</enum><text>any territory or possession of the United States.</text></subparagraph></paragraph> 
<paragraph id="H9558F7B0376246A79FFA9C6C1F975E2F"><enum>(2)</enum><header>Eligible activity</header><text>The term <term>eligible activity</term> means one of the following activities with respect to a public water system:</text> <subparagraph id="H0E8A48A34FDC4EC3B8346163D1D8BEAB"><enum>(A)</enum><text>Installing or upgrading water treatment facilities.</text></subparagraph> 
<subparagraph id="H82B355D7EC524213B928A2698FF926CA"><enum>(B)</enum><text>Constructing or rehabilitating storage tanks.</text></subparagraph> <subparagraph id="H9AD8F502B1094B6EBA86890D090ABACF"><enum>(C)</enum><text>Installing or replacing water transmission and distribution pipes.</text></subparagraph> 
<subparagraph id="H6577AD93F8204E84AEB8A7E087280962"><enum>(D)</enum><text>Installing or upgrading pump stations.</text></subparagraph> <subparagraph id="H90BB2EB2B32A49D699DD7B55151F5FFA"><enum>(E)</enum><text>Installing emergency generators.</text></subparagraph> 
<subparagraph id="H5C8D631CA24B4B7EBD496E5E74093CF6"><enum>(F)</enum><text>Upgrading supervisory control and data acquisition systems.</text></subparagraph> <subparagraph id="H91BE2538B4364513B806BC4B44C9F0CB"><enum>(G)</enum><text>Installing advanced metering infrastructure.</text></subparagraph> 
<subparagraph id="HFA9C3F6627724A1B92CC869B01665C2F"><enum>(H)</enum><text>Installing or upgrading wells.</text></subparagraph> <subparagraph id="HF9381052DF6C44C0B1E81BA3CDC140C9"><enum>(I)</enum><text>Facilitating compliance with any primary or secondary drinking water regulation promulgated under this Act.</text></subparagraph> 
<subparagraph id="H92880566C0B4426A9B733809CD6DF714"><enum>(J)</enum><text>Any other activity determined appropriate by the Administrator.</text></subparagraph></paragraph> <paragraph id="H21291EB5B378491D8AA2093122D7A974"><enum>(3)</enum><header>Rural area</header><text>The term <term>rural area</term> means an area with a population of 20,000 or fewer inhabitants.</text></paragraph></subsection> 
<subsection id="H1B373F19FDB547F5BE078054773FB777"><enum>(b)</enum><header>Water infrastructure enhancement grant program</header> 
<paragraph id="H24C6B2BBB2FF4A3D89DDE20E3E68DFDE"><enum>(1)</enum><header>In general</header><text>The Administrator shall establish a program to provide grants to suppliers of water to carry out eligible activities for the purpose of making infrastructure improvements to public water systems in accordance with this section.</text></paragraph> <paragraph id="H94945E02DAEE4F699DC13D86D93F245F"><enum>(2)</enum><header>Other considerations</header><text display-inline="yes-display-inline">Of the total amounts made available to carry out the grant program established under paragraph (1)—</text> 
<subparagraph id="HED9BC8FFF52049A191F2E3FBBC575AFA"><enum>(A)</enum><text>not less than 50 percent shall be for eligible activities carried out in rural areas; and</text></subparagraph> <subparagraph id="H5B72E797DA49491881BC7A5CA7471CC3"><enum>(B)</enum><text>not less than 15 percent shall be awarded to eligible activities carried out in historically disadvantaged communities or areas of persistent poverty.</text> </subparagraph> </paragraph> 
<paragraph id="H476A00D4DCE04B849D75A9A14BC1649A"><enum>(3)</enum><header>Cost-sharing</header><text>The Federal share of the cost of an eligible activity carried out using a grant under this section shall be not more than 90 percent.</text></paragraph> <paragraph id="HEC27F60D8C744B1892D85317CD8BA394"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $800,000,000 for each of the fiscal years 2024 through 2029.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
