<official-title display="yes">To provide an individual with an eligible medical condition access to employee restroom facilities of a retail establishment under certain conditions, and for other purposes.</official-title>

<section id="HFDD3725FA0424109B20F65FA1C1C9B43" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restroom Access Act of 2023</short-title></quote> .</text></section> <section id="H889EE637BA7746F8AD5F2680B9C992BE"><enum>2.</enum><header>Medically necessary restroom access</header> <subsection id="H430B527C5B3B45E0AD9F653DDECBA693"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any retail establishment that has a restroom facility that is not usually accessible to the public shall allow a customer to use that facility during business hours of such retail establishment if—</text> 
<paragraph id="HCEF91D3F5824425EB0201E8ECD4717C6"><enum>(1)</enum><text display-inline="yes-display-inline">the customer suffers from an eligible medical condition; </text></paragraph> <paragraph id="HCF9A105FB23749E58A606B0DF212BF88"><enum>(2)</enum><text>the customer presents an identification card as described by subsection (b); </text></paragraph> 
<paragraph id="H387DC9082BF44050B1660946A5F07C74"><enum>(3)</enum><text>two or more employees of the retail establishment are working at the time the customer requests use of the restroom facility; </text></paragraph> <paragraph id="HAF55DEB44D434E3C8DEDBB517C33F3E5"><enum>(4)</enum><text>the restroom facility is not located in an area where providing access would create an obvious health or safety risk to the customer; and</text></paragraph> 
<paragraph id="HBF80B961C34B4754831AAB0E05084135"><enum>(5)</enum><text>a public restroom is not available to the customer at the time at which they seek to use such restroom.</text></paragraph></subsection> <subsection id="H3B06C633EBD5490EB99019ED888CAC3F"><enum>(b)</enum><header>Identification card</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Labor shall establish a system to create and distribute an identification card to an individual for whom a medical professional has certified has an eligible medical condition. </text></subsection> 
<subsection id="HF4D875095448499B87553CE4F7AFADB4"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H3EFE62DA87194B11AA154B4C7641AAA8"><enum>(1)</enum><header>Customer</header><text display-inline="yes-display-inline">The term <term>customer</term> means an individual who is lawfully on the premises of a retail establishment.</text></paragraph> 
<paragraph id="HB62A5A7949CE41088C5D88866026DB1A"><enum>(2)</enum><header>Eligible medical condition</header><text display-inline="yes-display-inline">The term <term>eligible medical condition</term> means—</text> <subparagraph id="H48D9324FF6A04AFC9584C2BB00486CD5"><enum>(A)</enum><text>any inflammatory bowel disease, including Crohn’s disease, ulcerative colitis or irritable bowel syndrome;</text></subparagraph> 
<subparagraph id="H1272D17403734FBFBC0FBD4BFF2221D4"><enum>(B)</enum><text>the use of an ostomy device; or</text></subparagraph> <subparagraph id="H7F970FA212974640B6767EC75907FF23"><enum>(C)</enum><text>any other diagnosed medical condition, including pregnancy, that would require immediate access to a restroom facility.</text></subparagraph></paragraph> 
<paragraph id="H71A408A4C68B4A1AA2B9DDAEB4B48DC9"><enum>(3)</enum><header>Medical professional</header><text display-inline="yes-display-inline">The term <term>medical professional</term> means a physician, naturopathic physician, physician assistant, nurse, or nurse practitioner qualified to diagnose an eligible medical condition.</text></paragraph> <paragraph id="H7AC2B7F9AB314B838FA2D82F5C77A1B1"><enum>(4)</enum><header>Retail establishment</header><text display-inline="yes-display-inline">The term <term>retail establishment</term> means a place of business open to the public for the sale of goods or services moving in or affecting interstate commerce.</text></paragraph></subsection></section>
