<section id="HB3170552FA0D415DA8F948B17389E212" section-type="section-one"><enum>1.</enum><header>Biological attribution strategy</header> 
<subsection id="HBCC7295F8BCA413BA7F05BCAD04E37CB"><enum>(a)</enum><header>Preparedness goal</header><text display-inline="yes-display-inline">Section 2802(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-1">42 U.S.C. 300hh–1(b)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H01AF55A6367A4DC0A4BB5FEDE5878827" display-inline="no-display-inline"> <paragraph id="HD0EFC6F154EC4830BDB0039E6EE527FC"><enum>(11)</enum><header>Biological attribution strategy</header><text display-inline="yes-display-inline">Developing a biological attribution strategy to improve Federal coordination of duties and activities related to biological attribution of biological hazards and pathogens of pandemic potential, which shall include developing a strategy in accordance with subsection (c).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H79DD43D54E5D4B4DB0E417FE2870FA38"><enum>(b)</enum><header>Details of strategy</header><text display-inline="yes-display-inline">Section 2802 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-1">42 U.S.C. 300hh–1</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H8CF641E308A84F04BC3B5DD5DB82FB91" style="OLC"> <subsection id="HFE5A4415AA4A48F9839259AD6568F360"><enum>(c)</enum><header>Biological attribution strategy</header> <paragraph id="HB78A110CB82C4F3B8499F50F3F88C22E"><enum>(1)</enum><header>Contents</header><text>The biological attribution strategy under subsection (b)(11) shall include the following:</text> 
<subparagraph id="H3FF14560530541C1B6B07A3B58FEDE39"><enum>(A)</enum><text>A description of the biological attribution duties of each appropriate Federal agency, including—</text> <clause id="H96360F529B6C428988B364E0C0DF20AA"><enum>(i)</enum><text>the nature of routine bioattribution activities;</text></clause> 
<clause id="HF226BB19E45146EAAF0CD5FE10AAC62B"><enum>(ii)</enum><text>the level and type of biological events that may trigger an attribution determination by the appropriate Federal agencies regarding the source, cause, or origin of such events; and</text></clause> <clause id="HB5076D40C63E493994578F3BBFE3E80A"><enum>(iii)</enum><text display-inline="yes-display-inline">the Federal agency’s routine exercise of the capabilities to perform bioattribution activities.</text></clause></subparagraph> 
<subparagraph id="HB96E3E3EF2C444F2B58FE2A34B66F9E1"><enum>(B)</enum><text>The process by which a bioattribution determination is made by each such Federal agency, including how such process may address national security considerations.</text></subparagraph> <subparagraph id="H8984B14CB18146ACB586B12DBD1CDC1A"><enum>(C)</enum><text>Development of assignments, milestones, and timelines necessary to establish the strongest possible national capacity for bioattribution.</text></subparagraph> 
<subparagraph id="HFED564B64DDC43F7BC61320DAF556F5B"><enum>(D)</enum><text display-inline="yes-display-inline">A plan for the identification, development, and implementation of new technologies, through both internal and public-private initiatives, with an emphasis on diagnostic, sequencing, and safe collection capabilities.</text></subparagraph></paragraph> <paragraph id="HC6EAA9E91FD6412D92D267C99703153B"><enum>(2)</enum><header>Coordination</header><text display-inline="yes-display-inline">In developing the biological attribution strategy under subsection (b)(11), the Secretary shall coordinate with the relevant Federal agencies, including the Administration for Strategic Preparedness and Response, the Office of Science and Technology Policy, and the Office of the Director of National Intelligence.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H43AB3867D8004B408A121B3A398EB9D9" section-type="subsequent-section"><enum>2.</enum><header>Early warning strategy and implementation plan</header> 
<subsection id="H957CD55A358047DD9E6619FF9A7937CC"><enum>(a)</enum><header>Preparedness goal</header><text display-inline="yes-display-inline">Section 2802(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-1">42 U.S.C. 300hh–1(b)</external-xref>), as amended by section 1, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="H7F36C03E6BAF4C749507D5F57E36B4D6" display-inline="no-display-inline"> <paragraph id="H9CDA3EEBD2DE4222A795E5FFF9F6B413"><enum>(12)</enum><header>Early warning strategy and implementation plan</header><text display-inline="yes-display-inline">Developing and implementing an early warning strategy and implementation plan for biological, chemical, and radiological threats, in accordance with subsection (d).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAA36610E963A41EF9F5D98B611F8334E"><enum>(b)</enum><header>Details of strategy and plan</header><text display-inline="yes-display-inline">Section 2802 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-1">42 U.S.C. 300hh–1</external-xref>), as amended by section 1, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="H6235E4468ECD42BEA5A7E50CE5D4F5C1" display-inline="no-display-inline"> <subsection id="H8621B0725AFC4C2486A751E608392965"><enum>(d)</enum><header>Early Warning Strategy and Implementation Plan</header> <paragraph id="HFFD91CED1A7A47B8B706FA1C784F2C2E"><enum>(1)</enum><header>Objectives</header><text display-inline="yes-display-inline">The objectives of the early warning strategy and implementation plan under subsection (b)(12) shall include—</text> 
<subparagraph id="H14BACE8103CF4AC9991998D70E6ED0D2"><enum>(A)</enum><text>development of a robust early warning function for the United States which incorporates new technologies, with an emphasis on diagnostic, sequencing, and safe collection capabilities;</text></subparagraph> <subparagraph id="HD7848388FCB5418F9ACBEB03AD5FEA69"><enum>(B)</enum><text>identification of new biological threats at the earliest time to inform response strategies;</text></subparagraph> 
<subparagraph id="H44C03EB22D4E4051A1339886BFE50C4F"><enum>(C)</enum><text>understanding of the prevalence of current and recurring threats;</text></subparagraph> <subparagraph id="H762AC25F441044879C40940A5179D0EA"><enum>(D)</enum><text>the ability to adapt technologies to emerging chemical and radiological threats, including synthetic drugs and fentanyl;</text></subparagraph> 
<subparagraph id="HE48F4328EA3942EBACF6521EFFED0595"><enum>(E)</enum><text display-inline="yes-display-inline">ongoing detection from broad sources including wastewater, airports, and transportation hubs; and</text></subparagraph> <subparagraph id="HB175ED0116EF40798E0B25BAA03C3AB8"><enum>(F)</enum><text display-inline="yes-display-inline">the ability to rapidly deploy technologies at scale during a public health event.</text></subparagraph></paragraph> 
<paragraph id="H6C1F7C437D2A4A35A7B6B9D3AC8F0B53"><enum>(2)</enum><header>Coordination and eliminating duplication</header><text display-inline="yes-display-inline"></text> <subparagraph id="H718E6F60A99941279AA116A5C32E86FE"><enum>(A)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the early warning strategy and implementation plan under subsection (b)(12), the Secretary shall consult with—</text> 
<clause id="HCA2650624C464274A19A8C61C40A1150"><enum>(i)</enum><text display-inline="yes-display-inline">State and local public health entities;</text></clause> <clause id="HA204FD9624494DC3A2AD857F5FA2003D"><enum>(ii)</enum><text>private sector and academic partners; and</text></clause> 
<clause id="H9EB3243C2A9B4996AB5CAABF66F9779D"><enum>(iii)</enum><text>Federal officials as appropriate, including—</text> <subclause id="H44D7F210717B430C8E17954063371B0B"><enum>(I)</enum><text>the Assistant Secretary for Strategic Preparedness and Response; and</text></subclause> 
<subclause id="H69B200DDF806461F8F81E65E22406F76"><enum>(II)</enum><text>the Director of the Centers for Disease Control and Prevention.</text></subclause> </clause></subparagraph> <subparagraph id="HCF7EA9F678B842F8A19D08E52953ADE2"><enum>(B)</enum><header>Purposes</header><text>The purposes of consultation under paragraph (1) shall be to coordinate activities, streamline Federal programs, and eliminate waste and duplication.</text></subparagraph> 
<subparagraph id="HF88847BC74CD4267B13151B68C0E57B0"><enum>(C)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Secretary, on a periodic basis as applicable and appropriate, shall meet with the Director of National Intelligence to inform the development and capabilities of the early warning strategy and implementation plan under subsection (b)(12) for foreign and cross-border threats.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
