<section id="HE88527BD7D1F48129C8918D20DC5166A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Safety Communications Act</short-title></quote>.</text></section> <section id="H73D51B0B457E466E80118C39268AD0D1"><enum>2.</enum><header>Establishment of the Office of Public Safety Communications</header> <text display-inline="no-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HBB4A0A972E804713B95C4CE8271E37C2"><enum>106.</enum><header>Establishment of the Office of Public Safety Communications</header> 
<subsection id="H5CEF8B3C17254733BDD10F3B15B7B8E3"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the NTIA the Office of Public Safety Communications (in this section referred to as <quote>the Office</quote>). </text> </subsection> <subsection id="HDC8A0463B567409FBD619C2B738865E3"><enum>(b)</enum><header>Head of office</header> <paragraph id="H053D1AA47E1F4EEA84F0F9B8DF5A7BD8"><enum>(1)</enum><header>In general</header><text>The head of the Office shall be the Associate Administrator for Public Safety Communications.</text></paragraph> 
<paragraph id="HDED8B7343B2A43CDADC5876B5DB6214F" commented="no"><enum>(2)</enum><header>Career position</header><text display-inline="yes-display-inline">The position of Associate Administrator shall be a career position in the Senior Executive Service occupied by a career appointee (as that term is defined in section 3132(a)(4) of title 5, United States Code).</text></paragraph> <paragraph id="H526BE1015934462AB6A7B5873039496A"><enum>(3)</enum><header>Requirement to report</header><text>The Associate Administrator shall report to the Assistant Secretary. </text></paragraph></subsection> 
<subsection id="H185661E794824B06AA6030F85D8446E6"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Associate Administrator shall—</text> <paragraph id="HBCFD4F503C654E6F9402E05ACEA69A0D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">administer any grant program of the Federal Government related to Next Generation 9–1–1 on behalf of the Assistant Secretary; </text></paragraph> 
<paragraph id="H54AAF37D180F4594A5BBBFD2D324488F" commented="no"><enum>(2)</enum><text>analyze public safety policy communications issues, including by obtaining such analysis;</text></paragraph> <paragraph id="H45BD4EB62B1C431A809CD77326967EEF"><enum>(3)</enum><text display-inline="yes-display-inline">provide to the Assistant Secretary advice and assistance with respect to the Assistant Secretary—</text> 
<subparagraph id="H96D0E0F60B124BFAA64D93EBD7DC7AED"><enum>(A)</enum><text>carrying out the responsibilities of NTIA related to public safety communications policy; and</text></subparagraph> <subparagraph id="H8005D00279B445A5954EDCF4B77C7B48"><enum>(B)</enum><text display-inline="yes-display-inline">evaluating the domestic impact of public safety communications matters pending before the Commission, Congress, or other entities of the executive branch of the Federal Government;</text></subparagraph> </paragraph> 
<paragraph id="HB5E48829A9254AD29F8F8BF6E3915E40"><enum>(4)</enum><text>carrying out any duties established under section 10 of Department Organizational Order 25–7 of the Department of Commerce titled <quote>National Telecommunications and Information Administration</quote>, effective September 17, 2012; and </text></paragraph> <paragraph id="H64E10134C3794185A5F0255CA9490EA2"><enum>(5)</enum><text display-inline="yes-display-inline">be responsible for the oversight of—</text> 
<subparagraph id="H1FDB58B07D1C413EA935FFF5F03CA9FB"><enum>(A)</enum><text>the studies carried out by the Federal Government relating to enhancing public safety communication; and </text></subparagraph> <subparagraph id="H2068ABF2EF924137BE63C38A005674BD"><enum>(B)</enum><text>the prototyping (including leading edge prototyping) and deployment by the Federal Government of advanced communications technologies that enhance public safety communications, including through test-protocol, model, or simulation tool for the testing and validation of such technologies;</text></subparagraph></paragraph> 
<paragraph id="HE0F8C4232C564850A0EF3F792073C2AD" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">manage the First Responder Network Authority established under section 6206 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1426">47 U.S.C. 1426</external-xref>), including by being responsible for the oversight of the duties and responsibilities carried out by the First Responder Network Authority;</text></paragraph> <paragraph id="HCD20618DFDE44C5BA463EC7F8E67B111" commented="no"><enum>(7)</enum><text>at the direction of the Assistant Secretary, communicate public safety communications policies to public entities, including the Commission and Congress, or private entities; and</text> </paragraph> 
<paragraph id="HD3DA35815CC8480DAFABB1DCAEF88F45"><enum>(8)</enum><text>carry out any duties regarding the responsibilities of the NTIA with respect to public safety communications policy as the Assistant Secretary may designate.</text></paragraph> </subsection> <subsection id="H8599B620429B4772A064D2EA8C842EC2"><enum>(d)</enum><header>Audit</header><text display-inline="yes-display-inline">The Associate Administrator—</text> 
<paragraph id="H2E9F3F4870CF474CB3F4D987C882C083"><enum>(1)</enum><text>shall annually conduct an audit of the activities of the First Responder Network Authority in accordance with general accounting principles and procedures; and </text></paragraph> <paragraph id="HBEA1F09D6C094664AB9B3003898E4BA5"><enum>(2)</enum><text>may conduct such audit (or parts thereof) through a contractor whose services were procured in accordance with title 41, United States Code. </text></paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></section>
