R. 4502</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20231003">October 3, 2023</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend title 5, United States Code, to limit the use of educational requirements or qualifications in evaluating candidates for certain cybersecurity positions in the competitive service, and for other purposes.</official-title></form><legis-body id="H77C9E7BE81754D318C2B24EC8E68712A" style="OLC"><pagebreak></pagebreak><section id="HB4244021D49A4344B8B3A4B2B426597E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing the Acquisition of Cybersecurity Experts Act of 2023</short-title></quote>.</text></section><section id="H5544AAEC44D6457A87753D2275B6E47B"><enum>2.</enum><header>Educational requirements for competitive service cybersecurity positions</header><text display-inline="no-display-inline">Section 3308 of title 5, United States Code, is amended—</text><paragraph id="H9E61CE71874B40FEB96838A644E2AA9B"><enum>(1)</enum><text>by striking <quote>The Office of Personnel Management</quote> and inserting <quote>(a) <header-in-text level="subsection" style="USC">In general.—</header-in-text>Consistent with subsection (b), the Office of Personnel Management </quote>; and</text></paragraph><paragraph id="H2891535FAD584635928947A212344256"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H8D5FD9BF63994B87BE9F9B46D10B6E9C" display-inline="no-display-inline"><subsection id="H5CB1D665403D4A22982CD789391B4D32"><enum>(b)</enum><header>Education requirements for cybersecurity positions</header><paragraph id="HF95184A6586B4E758B42F5AFB68409BD"><enum>(1)</enum><header>In general</header><text>With respect to any covered position—</text><subparagraph id="H182B4A3459B646968BFDBA641DAD11E5"><enum>(A)</enum><text display-inline="yes-display-inline">an agency may prescribe a minimum educational requirement for employment in such a position only if a minimum education qualification is required by law to perform the duties of the position in the State or locality where the duties of the position are to be performed; and</text></subparagraph><subparagraph id="H005B030CCF80478AB1F7E2FE8F0CA571"><enum>(B)</enum><text display-inline="yes-display-inline">an agency may consider education in determining a candidate’s satisfaction of any other minimum qualification only if the candidate’s education directly reflects the competencies necessary to satisfy that qualification and perform the duties of the position.</text></subparagraph></paragraph><paragraph id="HBA5FE0F9092B4BBE9920DCDD09AC8EA9"><enum>(2)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of the <short-title>Modernizing the Acquisition of Cybersecurity Experts Act of 2023</short-title> and annually thereafter, the Office of Personnel Management shall publish on the Office’s website—</text><subparagraph id="HC3BE42B8ECA64538979BA215CB8EE68A"><enum>(A)</enum><text display-inline="yes-display-inline">any changes made to minimum qualifications standards concerning education for covered positions; and</text></subparagraph><subparagraph id="H9A62179C7D0C4EDCAE190149CA7D8835"><enum>(B)</enum><text display-inline="yes-display-inline">aggregate data indicating the level of educational attainment, sorted by position classification, of all accessions to covered positions. </text></subparagraph></paragraph><paragraph id="HDC8AF0166300478ABD5AB852B46F612B"><enum>(3)</enum><header>Covered position defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>covered position</quote> means—</text><subparagraph id="H4267C971724E4076AEBD5E080EA85618"><enum>(A)</enum><text>any position in the competitive service classified under the GS–2210 information technology management series, or any successor series; and</text></subparagraph><subparagraph id="H6DB2CF942407442FB87F3AAC8BBFE1C3"><enum>(B)</enum><text display-inline="yes-display-inline">any other position in the competitive service designated as “cybersecurity” under the National Initiative for Cybersecurity Education (NICE) Cybersecurity Workforce Framework (NIST Special Publication 800–181), or successor framework.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20231002" legis-day="20231002" chamber="House">Passed the House of Representatives October 2, 2023.</attestation-date><attestor display="yes">Kevin F.
