R. 4484</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230706">July 6, 2023</action-date><action-desc><sponsor name-id="F000466">Mr. Fitzpatrick</sponsor> (for himself and <cosponsor name-id="G000592">Mr. Golden of Maine</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit foreign nationals from making contributions in connection with a State or local ballot initiative or referendum.</official-title></form><legis-body id="HF0744675C23D415DB321BD0A7F4BF49C" style="OLC"><section id="HD614D2EA1E8A4B7EB6D7539DC0170F2D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Foreign Money out of Ballot Measures Act of 2023</short-title></quote>. </text></section><section display-inline="no-display-inline" id="HCFB10445E641435F92F6AD5F42B2DAA8" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on contributions and donations by foreign nationals in connection with ballot initiatives and referenda</header><subsection id="H00634ED854CA4BADB9D678BA47FA9A06"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/29">Chapter 29</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H90908B4F05F94E9E84401CAF8D390A75" style="USC"><section id="HB0089984F84A442EA89B53836F98134F"><enum>612.</enum><header>Foreign nationals making certain political contributions</header><subsection id="H22A27E10F26C4FF3B97286B52DD7E74B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">It shall be unlawful for a foreign national, directly or indirectly, to make a contribution as such term is defined in section 301(8)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)(A)</external-xref>) or donation of money or other thing of value, or to make an express or implied promise to make a contribution or donation, in connection with a State or local ballot initiative or referendum.</text></subsection><subsection id="H2F2A094306FB46F3854FB79B607C1A0C"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (a) shall be fined not more than the greater of $10,000 or 300 percent of the amount of the contribution or value of the donation of money or other thing of value made by the person, imprisoned for not more than 1 year, or both.</text></subsection><subsection id="H90C45B0C889B4B30B1BD0F962A9942AB"><enum>(c)</enum><header>Foreign national defined</header><text display-inline="yes-display-inline">In this section, the term <term>foreign national</term> has the meaning given such term in section 319(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(b)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0CFEF9960A4C4A448282F131024F3361"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/29">chapter 29</external-xref> of title 18, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H67C07DEBD7914CBC94B1D42B359801DF" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">612. Foreign nationals making certain political contributions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEB10BE922DBC4C4597CC3DD7090C3958"><enum>(c)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply with respect to contributions and donations made on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
