<section commented="no" display-inline="no-display-inline" section-type="section-one" id="H2B30C2EF838848219D8683F680DBD2DF" changed="not-changed"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No CCP Financial Apps on Government Devices Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H38F78DBC97D8472E8F5DF77E652A6352" changed="not-changed"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on the use of certain financial service applications on Government phones</header> <subsection commented="no" display-inline="no-display-inline" id="HDC2F7FA9D38D40338D1881424C02AD98" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Prohibition</header> <paragraph commented="no" display-inline="no-display-inline" id="HEEE05988790A40878E7192BDA514467E" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget, in consultation with the Administrator of General Services, the Director of the Cybersecurity and Infrastructure Security Agency, the Director of National Intelligence, and the Secretary of Defense, and consistent with the information security requirements under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, shall develop standards and guidelines for executive agencies requiring the removal of any covered application from information technology.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD6CC657891964B27A69771577B22D6B5" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">The standards and guidelines developed under paragraph (1) shall include the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7F847AB5022D40A88F42107635B1A8B1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">Exceptions for law enforcement activities, national security interests and activities, and security researchers.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3E7BF6AC1C07413FBF6D4FA0FE08A61D" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">For any authorized use of a covered application under an exception, requirements for agencies to develop and document risk mitigation actions for such use.</text></subparagraph> <subparagraph id="HA2E20031474E4BF8A82AA91B233BCBA6"><enum>(C)</enum><text>An exception that allows financial regulators to test the covered application for compliance or other purposes in accordance with any requirement from the national security agencies, including the Department of Homeland Security, the Department of Defense, and the Central Intelligence Agency, that ensures the covered application is not able to access information from the financial regulator.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H6F566BA901894A92A6C831A483DDAB51" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H6382469A0150472587A2336B9E96ED1B" changed="not-changed"><enum>(1)</enum><header>Covered application</header> <subparagraph id="H8BB320385CCB4AA59D5659D39F88FFF9"><enum>(A)</enum><header>In general</header><text>The term <term>covered application</term> means any financial service application domiciled in a jurisdiction controlled by the Chinese Communist Party or controlled by an entity domiciled in a jurisdiction controlled by the Chinese Communist Party.</text></subparagraph> 
<subparagraph id="HA35ADB6015724089876B5EB834108996"><enum>(B)</enum><header>Controlled defined</header><text>In this paragraph, <quote>controlled</quote> means any entity with at least a 10 percent voting interest.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H42AFF14E15EE4C009C5E366DE35495A9" changed="not-changed"><enum>(2)</enum><header>Executive agency</header><text display-inline="yes-display-inline">The term <term>executive agency</term> has the meaning given that term in section 133 of title 41, United States Code.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC549ADAD956642A39F294F7BDC85B49B" changed="not-changed"><enum>(3)</enum><header>Information technology</header><text display-inline="yes-display-inline">The term <term>information technology</term> has the meaning given that term in section 11101 of title 40, United States Code.</text></paragraph></subsection> </section> </legis-body></bill>
