which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Energy Policy and Conservation Act to modify standards for water heaters, furnaces, boilers, and kitchen cooktops, ranges, and ovens, and for other purposes.</official-title></form><legis-body id="H07DD63718AF6481C853F28CE0051C10C" style="OLC"><section id="H3E9FB8C47DED4104A590D518A40494E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Natural Gas Appliances Standards Act of 2023</short-title></quote> or the <quote><short-title>Natural GAS Act of 2023</short-title></quote>.</text></section><section id="H6996A406F15C48D4A23D8068C099DBDF"><enum>2.</enum><header>Rule requirements for water heaters</header><text display-inline="no-display-inline">Section 325(e) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H9842D17845C6483B900A774430F7C712" display-inline="no-display-inline" style="OLC"><paragraph id="HE242C31185194623BAA7A5D28AE03EB7"><enum>(7)</enum><header>Requirements</header><subparagraph id="H67C2B5034B3D4D13A925EF77F535A7E8"><enum>(A)</enum><header>Rulemaking process</header><text>For any rule relating to water heaters under this section that is finalized after the date of enactment of this paragraph, the Secretary shall—</text><clause id="H105B02B405184D90B0E47B8AB76E9187"><enum>(i)</enum><text>require as part of the rulemaking process the performance of a full fuel cycle analysis for energy efficiency standards and a full fuel cycle energy descriptor, as described in a letter report of the National Academies entitled <quote>Review of Site (Point-of-Use) and Full-Fuel-Cycle Measurement Approaches to DOE/EERE Building Appliance Energy-Efficiency Standards</quote> and dated 2009; and</text></clause><clause id="H8923705EA5B746978A468E3164DF0D86"><enum>(ii)</enum><text>certify that the rule is not likely to result in a significant shift from gas water heaters to electric water heaters with respect to residential construction, commercial construction, or water heater replacement.</text></clause></subparagraph><subparagraph id="H856F96E9AF604D0A9BC89918DCBA3B91"><enum>(B)</enum><header>Rules</header><text>Any rule relating to water heaters under this section that is finalized after the date of enactment of this paragraph—</text><clause id="HF00BDFAE9E3E45F085C4A6BD06F8591B"><enum>(i)</enum><text>shall not apply to small major household appliance manufacturers (as defined in section 121.201 of title 13, Code of Federal Regulations (or successor regulations)); and</text></clause><clause id="HC8073E5AE62E4D97A1B1924BBB22045C"><enum>(ii)</enum><text>shall require the results of the analysis and resulting energy descriptor described in subparagraph (A)(i) to be prominently disclosed on any label that—</text><subclause id="H0008D7CD9EF44EE681E38F12BCEF579E"><enum>(I)</enum><text>is required by the Federal Trade Commission to provide energy efficiency information of the water heater; and</text></subclause><subclause id="HA9E0E09372CA42489FA3DEBF93B3AF52" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>is visible to consumers at the point of sale.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1BF1BE81B92749629B7EBEA33654737C"><enum>3.</enum><header>Rule requirements for furnaces and boilers</header><text display-inline="no-display-inline">Section 325(f) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(f)</external-xref>) is amended—</text><subsection id="H1021C1B9B3A24A71952777E9E8EFC483"><enum>(a)</enum><text>in paragraph (1)(B)—</text><paragraph commented="no" display-inline="no-display-inline" id="HDBB78AC11C4741F7803C6C87200CACF1"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by adding <quote>and</quote> at the end after the semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H56B15DC2955A496BBAA0E15CFB2602A5"><enum>(2)</enum><text>in clause (ii), by striking <quote>and</quote> at the end and inserting a period; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CAF3D9930E8451B8E71CB42A178E074"><enum>(3)</enum><text>by striking clause (iii); and</text></paragraph></subsection><subsection id="HE21D372A34174B658A7C4CEAA9FD0481"><enum>(b)</enum><text>by adding at the end the following:</text><quoted-block id="HB2A228E0B4934F629C9F08C3F5913A4F" display-inline="no-display-inline" style="OLC"><paragraph id="HC1966E54DEFB415FA1EAD6CFEBE07B7E"><enum>(5)</enum><header>Requirements</header><subparagraph id="H93D505F4FC1946F89E688E36B0FC468D"><enum>(A)</enum><header>Rulemaking process</header><text>For any rule relating to furnaces or boilers under this section that is finalized after the date of enactment of this paragraph, the Secretary shall—</text><clause id="H860A387E822C43B6B88CF1117349FD52"><enum>(i)</enum><text>require as part of the rulemaking process the performance of a full fuel cycle analysis for energy efficiency standards and a full fuel cycle energy descriptor, as described in a letter report of the National Academies entitled <quote>Review of Site (Point-of-Use) and Full-Fuel-Cycle Measurement Approaches to DOE/EERE Building Appliance Energy-Efficiency Standards</quote> and dated 2009; and</text></clause><clause id="H858FDBF2557B420BA107ACF1BAF86FEE"><enum>(ii)</enum><text>certify that the rule is not likely to result in a significant shift from gas furnaces or boilers to electric furnaces or boilers with respect to residential construction, commercial construction, or furnace or boiler replacement.</text></clause></subparagraph><subparagraph id="H17CDE3B7D8FF48159AE22B6719BDC364"><enum>(B)</enum><header>Rules</header><text>Any rule relating to furnaces or boilers under this section that is finalized after the date of enactment of this paragraph—</text><clause id="H0453FB7299764999AA037E7F8104793E"><enum>(i)</enum><text>shall not apply to small major household appliance manufacturers (as defined in section 121.201 of title 13, Code of Federal Regulations (or successor regulations)); and</text></clause><clause id="H23FA9242ACC14A9DAC50A36FBE2670CB"><enum>(ii)</enum><text>shall require the results of the analysis and resulting energy descriptor described in subparagraph (A)(i) to be prominently disclosed on any label that—</text><subclause id="H95C4D46E1B324E6993A5B4640074DDB3"><enum>(I)</enum><text>is required by the Federal Trade Commission to provide energy efficiency information of the water heater; and</text></subclause><subclause id="HAFEC2D0F6810426584884640BE978910" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>is visible to consumers at the point of sale.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H5BA75AA7E4D8492685D26E996B3787BA"><enum>4.</enum><header>Rule requirements for cooktops, ranges, and ovens</header><text display-inline="no-display-inline">Section 325(h) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(h)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H24D9DCF38CD7475C8E84D146A4241786"><paragraph id="HE92C0734DA2647DEAF42A18FBBFA183B"><enum>(3)</enum><header>Requirements</header><subparagraph id="HECDB0B6D7BCF4F3088AF6E628E034D12"><enum>(A)</enum><header>Rulemaking process</header><text>For any rule relating to kitchen cooktops, ranges, and ovens under this section that is finalized after the date of enactment of this paragraph, the Secretary shall—</text><clause id="H5C0950193B924E0FBBC67FBF7F02CE25"><enum>(i)</enum><text>require as part of the rulemaking process the performance of a full fuel cycle analysis for energy efficiency standards and a full fuel cycle energy descriptor, as described in a letter report of the National Academies entitled <quote>Review of Site (Point-of-Use) and Full-Fuel-Cycle Measurement Approaches to DOE/EERE Building Appliance Energy-Efficiency Standards</quote> and dated 2009; and </text></clause><clause id="H233856B7A62B487185EC4AA294CDA208"><enum>(ii)</enum><text>certify that the rule is not likely to result in a significant shift from gas kitchen cooktops, ranges, and ovens to electric kitchen cooktops, ranges, and ovens with respect to residential construction, commercial construction, or cooktop, range, and oven replacement.</text></clause></subparagraph><subparagraph id="H23B904F1EAC24C22A849DFD754FCD003"><enum>(B)</enum><header>Rules</header><text>Any rule relating to kitchen cooktops, ranges, and ovens under this section that is finalized after the date of enactment of this paragraph—</text><clause id="H31A449D728504FE1BD870CECF22D7DD3"><enum>(i)</enum><text>shall not limit the features and functionality available on residential gas kitchen cooktops, ranges, and ovens, including—</text><subclause id="H23E4F29616AC4086A7E6A83F227FC60E"><enum>(I)</enum><text>quick-to-boil times;</text></subclause><subclause id="HE024E8D92FB84433B8530CC9852B0C4E"><enum>(II)</enum><text>the number and size of burners, including burners designed for simmering and high input rate burners; and</text></subclause><subclause id="H8183862D8C8D49F1B0AEC0A5A9E2A5B5"><enum>(III)</enum><text>the design of grates, including continuous grates; </text></subclause></clause><clause id="HF6A3556FFDD2484686D7C48B1DFA19DA"><enum>(ii)</enum><text>shall not apply to small major household appliance manufacturers (as defined in section 121.201 of title 13, Code of Federal Regulations (or successor regulations)); and</text></clause><clause id="HAC647FD7E6BF46DAAD7DB2E44262531A"><enum>(iii)</enum><text>shall require the results of the analysis and resulting energy descriptor described in subparagraph (A)(i) to be prominently disclosed on any label that—</text><subclause id="HE04A821E6B724D3785D0ED1D5012B7F1"><enum>(I)</enum><text>is required by the Federal Trade Commission to provide energy efficiency information of the kitchen cooktop, range, or oven; and</text></subclause><subclause id="HD80267576C6441DEBB3381862E5E378B"><enum>(II)</enum><text>is visible to consumers at the point of sale.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
