which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit discrimination in public accommodations on the basis of sex, gender identity, and sexual orientation, and for other purposes.</official-title></form><legis-body id="H409BD04F88114FF594A1422D9E265E2E" style="OLC"><section id="HAC53F419C6024EEB8A1C2BC5BAADD272" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Customer Non-Discrimination Act</short-title></quote>.</text></section><section id="HFF58BB0843644C78A5D715954E42FF55"><enum>2.</enum><header>Public accommodations</header><subsection id="HC2998AC68A1C485CB111089539F1B14E"><enum>(a)</enum><header>Prohibition on discrimination or segregation in public accommodations</header><text>Section 201 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a</external-xref>) is amended—</text><paragraph id="HE39622568724416B983C84D115A466E3"><enum>(1)</enum><text>in subsection (a), by inserting <quote>sex (including sexual orientation and gender identity),</quote> before <quote>or national origin</quote>; and</text></paragraph><paragraph id="H035D912658E04F51BB34BC59CED3ABFE"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H4F2627C7A09A457F9486FC0BE359603E"><enum>(A)</enum><text>in paragraph (3), by striking <quote>stadium</quote> and all that follows and inserting <quote>stadium or other place of or establishment that provides exhibition, entertainment, recreation, exercise, amusement, gathering, or display;</quote>;</text></subparagraph><subparagraph id="H146CCE18BDEC4794B4CA2FAFAA0F5B4B"><enum>(B)</enum><text>by redesignating paragraph (4) as paragraph (6); and</text></subparagraph><subparagraph id="H20739E65692846629945114F016036A8"><enum>(C)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block id="HD87FBE63A7194F9E97355F47149DEB19" style="OLC"><paragraph id="HFA5CB6231EBB4EF6B1CBBE70B96A907D"><enum>(4)</enum><text>any establishment that provides a good, service, or program, including a store, shopping center, online retailer or service provider, salon, bank, gas station, food bank, service or care center, shelter, travel agency, or funeral parlor, or establishment that provides health care, accounting, or legal services;</text></paragraph><paragraph id="HE86611A1A8CA4B76A8E075541FCB91F6"><enum>(5)</enum><text>any train service, bus service, car service, taxi service, airline service, station, depot, or other place of or establishment that provides transportation service; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H476A0CCE2510452A81B79F2A54D9352C"><enum>(b)</enum><header>Prohibition on discrimination or segregation under law</header><text>Section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a-1">42 U.S.C. 2000a–1</external-xref>) is amended by inserting <quote>sex (including sexual orientation and gender identity),</quote> before <quote>or national origin</quote>.</text></subsection><subsection id="H1981D007867E4B58863E4EFFCF24A4C6"><enum>(c)</enum><header>Definitions and rules of construction</header><text>Title II of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H474CC82F286346409A9368C9B36B2B0B" style="OLC"><section id="H97A24855D4CF4115A04C968773FDC6A2"><enum>208.</enum><header>Definitions and rules</header><subsection id="HF0FE8F57AB2B4AEF8E6936B219851E01"><enum>(a)</enum><header>Definitions</header><paragraph id="HBA25A1A650C24CA6A03991946704DCF1"><enum>(1)</enum><header>Race; color; religion; sex; sexual orientation; gender identity; national origin</header><text>The term <term>race</term>, <term>color</term>, <term>religion</term>, <term>sex (including sexual orientation and gender identity)</term>, or <term>national origin</term>, used with respect to an individual, includes—</text><subparagraph id="H866437B402CA4A178C4D7AA361CD813B"><enum>(A)</enum><text display-inline="yes-display-inline">the race, color, religion, sex (including sexual orientation and gender identity), or national origin, respectively, of another person with whom the individual is associated or has been associated; and</text></subparagraph><subparagraph id="HF1DA978A20EB4CDEBBBB5ADC8480CA22"><enum>(B)</enum><text display-inline="yes-display-inline">a perception or belief, even if inaccurate, concerning the race, color, religion, sex (including sexual orientation and gender identity), or national origin, respectively, of the individual.</text></subparagraph></paragraph><paragraph id="H26FA18762DB3458EB15D544AE2ECD983"><enum>(2)</enum><header>Gender identity</header><text>The term <term>gender identity</term> means the gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual, regardless of the individual’s designated sex at birth.</text></paragraph><paragraph id="H7A18AFC3446B4836BC47F6BFE5F580C1"><enum>(3)</enum><header>Including</header><text>The term <term>including</term> means including, but not limited to, consistent with the term’s standard meaning in Federal law.</text></paragraph><paragraph id="HE34C984465D944C3978978B19DEDC3A7"><enum>(4)</enum><header>Sex</header><text>The term <term>sex</term> includes—</text><subparagraph id="HC082B4D6D0D945D0AC659F0D563C78B7"><enum>(A)</enum><text>a sex stereotype;</text></subparagraph><subparagraph id="H9CFA576DB7F0402F90B69266AC2FDFC4"><enum>(B)</enum><text>pregnancy, childbirth, or a related medical condition; </text></subparagraph><subparagraph id="H0CC01F1F2A9249A79966FBADD33AF8E5"><enum>(C)</enum><text>sexual orientation or gender identity; and</text></subparagraph><subparagraph id="H38D5FD2F2F0646BCABC7A05460B6DA25"><enum>(D)</enum><text display-inline="yes-display-inline">sex characteristics, including intersex traits.</text></subparagraph></paragraph><paragraph id="H2C504EFC76E746F2A16E1A4C56C041AB" commented="no"><enum>(5)</enum><header>Sexual orientation</header><text>The term <term>sexual orientation</term> means homosexuality, heterosexuality, or bisexuality.</text></paragraph></subsection><subsection id="H177F102BA7D048A88F79A540CC6ECD8F"><enum>(b)</enum><header>Rules</header><text display-inline="yes-display-inline">In this title—</text><paragraph id="H1AA23CC7903C4ABDBDC2927EA66290A6"><enum>(1)</enum><text>(with respect to sex) pregnancy, childbirth, or a related medical condition shall not receive less favorable treatment than other physical conditions; and</text></paragraph><paragraph id="H2262A47EE54D4B898238CFD425477036"><enum>(2)</enum><text>(with respect to gender identity) an individual shall not be denied access to a shared facility, including a restroom, a locker room, and a dressing room, that is in accordance with the individual’s gender identity.</text></paragraph></subsection></section><section id="H435CDD5012B4454C9AE9632F3FC3130F"><enum>209.</enum><header>Rules of construction</header><subsection id="H5CC29A53993B4EBB823F6FEB3CF54BBB"><enum>(a)</enum><header>Claims and remedies not precluded</header><text display-inline="yes-display-inline">Nothing in this title shall be construed to limit the claims or remedies available to any individual for an unlawful practice on the basis of race, color, religion, sex (including sexual orientation and gender identity), or national origin including claims brought pursuant to section 1979 or 1980 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>, 1985) or any other law, including the Federal law amended by the Customer Non-Discrimination Act, regulation, or policy.</text></subsection><subsection id="H6150C4EEBC2946E2A38BA5EF0844AE9C"><enum>(b)</enum><header>No negative inference</header><text>Nothing in this title shall be construed to support any inference that any Federal law prohibiting a practice on the basis of sex does not prohibit discrimination on the basis of pregnancy, childbirth, or a related medical condition, sexual orientation, gender identity, or a sex stereotype.</text></subsection><subsection id="H2B23844C0411414496679EF57F0FEDEF"><enum>(c)</enum><header>Scope of an establishment</header><text>A reference in this title to an establishment—</text><paragraph id="H6A30B8107D8E44E394070E0E60DC11D0"><enum>(1)</enum><text>shall be construed to include an individual whose operations affect commerce and who is a provider of a good, service, or program; and</text></paragraph><paragraph id="HCFCF747F0BCD426988D5BA98D0E7CC24"><enum>(2)</enum><text>shall not be construed to be limited to a physical facility or place.</text></paragraph></subsection></section><section id="H8E992EA1469C4F2FB1DBC70FBB80CF3D"><enum>210.</enum><header>Claims</header><text display-inline="no-display-inline">The Religious Freedom Restoration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000bb">42 U.S.C. 2000bb et seq.</external-xref>) shall not provide a claim concerning, or a defense to a claim under this title or provide a basis for challenging the application or enforcement of this title.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
