<official-title display="yes">To amend the Public Health Service Act with respect to the determination, termination, and renewal of public health emergencies, and for other purposes.</official-title>

<section id="H4A8D00C1EB9F494F836D8EDE4DC7D773" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PHE Congressional Review Act</short-title></quote>.</text></section> <section id="HA5C0AA3DF6A541DA825D60AF20FB45B6"><enum>2.</enum><header>Public health emergencies</header><text display-inline="no-display-inline">Subsection (a) of section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H9BEC5F01A2284BE48CC0128DB6E2081E" display-inline="no-display-inline"> 
<subsection id="H677E6D4B7517406EB0D4156FCCD5C8EE"><enum>(a)</enum><header>Emergencies</header> 
<paragraph id="H2397D82A4FEA4739B784FEA339C8D6E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary determines, after consultation with such public health officials as may be necessary, that—</text> <subparagraph id="H84135DA3AD3D43A593843184DD03F443"><enum>(A)</enum><text>a disease or disorder presents a public health emergency; or</text></subparagraph> 
<subparagraph id="H8248168C399D4A71809D9C319F733DF8"><enum>(B)</enum><text>a public health emergency, including significant outbreaks of infectious diseases or bioterrorist attacks, otherwise exists,</text></subparagraph><continuation-text continuation-text-level="paragraph">the Secretary may take such action as may be appropriate to respond to the public health emergency, including making grants, providing awards for expenses, and entering into contracts and conducting and supporting investigations into the cause, treatment, or prevention of a disease or disorder as described in subparagraphs (A) and (B).</continuation-text></paragraph> <paragraph id="H68BAC1A129F049B4A9B07B1E4ECB2B7D"><enum>(2)</enum><header>Congressional review of nationwide emergencies</header><text display-inline="yes-display-inline">Not later than 6 months after the date on which a determination of a nationwide public health emergency is made, and every 6 months thereafter until the termination of such nationwide public health emergency, each House of Congress shall meet to consider a vote on a joint resolution to determine whether that emergency shall be terminated.</text></paragraph> 
<paragraph id="H45A9E007F48142D38E4AA3115308BA25"><enum>(3)</enum><header>Duration</header> 
<subparagraph id="H2527D4D7578B401AA9BEDCB69AAE22F6"><enum>(A)</enum><header>Termination</header><text>Any determination of a public health emergency under paragraph (1) terminates upon the earlier of—</text> <clause id="H5A25BCE1EDE44EA89B7AA98A97E5EC60"><enum>(i)</enum><text>the Secretary declaring that the emergency no longer exists;</text></clause> 
<clause id="H64821A3B7EDF496AA74C15FA318E27B7"><enum>(ii)</enum><text>the expiration of the 90-day period beginning on the date on which the determination is made by the Secretary; or</text></clause> <clause id="HB857AAE84FB54DA48231B9CE8C0E2D04"><enum>(iii)</enum><text display-inline="yes-display-inline">upon the enactment of a joint resolution to terminate the emergency.</text></clause></subparagraph> 
<subparagraph id="H0C30662F93FA4DEA8DBA1F1F4D7125BF"><enum>(B)</enum><header>Renewal</header><text>Determinations that terminate under clause (i) or (ii) of subparagraph (A) may be renewed by the Secretary (on the basis of the same or additional facts), and subparagraph (A) applies to each such renewal.</text></subparagraph> <subparagraph id="H62F96CBDA3AF411B98ECC8ADF0B173F5"><enum>(C)</enum><header>Notification to Congress of renewal</header><text>Not later than 48 hours after making a determination under this subsection of a public health emergency (including a renewal), the Secretary shall submit to the Congress written notification of the determination.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
