which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide coverage of medically necessary home resiliency services under Medicare.</official-title></form><legis-body id="H6C98FEBFF7C34665BC006AFD1F95361A" style="OLC"><section id="HA20B4BDE89424D6DA61ED339EB9FB983" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Survival Aid For Emergencies through Medicare Act</short-title></quote> or the <quote>SAFE through Medicare Act</quote>.</text></section><section id="HA22CF0FEA53C4183A55200C235FCE412"><enum>2.</enum><header>Medicare coverage of medically necessary home resiliency services</header><subsection id="HD137D51A54044A77983E2990B1914905"><enum>(a)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="HA7A895413BF7497584202560606B3AEE"><enum>(1)</enum><text>in subsection (s)(2)—</text><subparagraph id="H9B08AD3E36564F93A1EC0882B618FA70"><enum>(A)</enum><text>in subparagraph (II), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H79ED96B858EB403099E8CD2D808C7D2E"><enum>(B)</enum><text>in subparagraph (JJ), by inserting <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="HA21CD03938BE4046B83C640E787BA729"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H39F105134AFB45B18F6CF0AAB9C3AB84"><subparagraph id="HD3AA4B94FA9842D98A0CC3063368F510" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">in the case of an individual who is medically at-risk in the event of a climate or manmade disaster (as determined by the Secretary in accordance with subsection (nnn)), home resiliency services (as defined in such subsection);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA4AB96E076D1456892C663092917A3FB" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5BF6739CCE174D68BC80A08CE14A6E46"><subsection display-inline="no-display-inline" commented="no" id="HE7A5EAEF2B1B4A04A1754B3E00025F04"><enum>(nnn)</enum><header>Home resiliency services; determination of individuals medically at-Risk</header><paragraph display-inline="no-display-inline" commented="no" id="HF5F5E12E02254999866CF2133701A9B7"><enum>(1)</enum><header>Home resiliency services</header><text>The term <term>home resiliency services</term> means items and services—</text><subparagraph display-inline="no-display-inline" commented="no" id="HE4759E613BF9478AB029E5D09FF59E6E"><enum>(A)</enum><text>furnished on or after January 1, 2024, to an individual described in subsection (s)(2)(KK); and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="HD5F587B15F094051896CB81DB6F11AE3"><enum>(B)</enum><text>that the Secretary determines are medically necessary for such individual in the case of a climate or manmade disaster, such as a heat pump for an individual vulnerable to extreme temperatures, solar batteries for an individual reliant on electrical medical equipment (including home mechanical ventilators), and energy efficient cold-storage for heat-sensitive medical supplies.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H8181A8252EC34CC8AA1E1902DFF2666F"><enum>(2)</enum><header>Determination of individuals medically at-risk</header><text>For purposes of subsection (s)(2)(KK) and this subsection, the Secretary, in consultation with the Office of Climate Change and Health Equity, the National Institutes of Health, the Centers of Medicare &amp; Medicaid Services, and the National Oceanic and Atmospheric Administration, shall establish a process to determine the conditions under which an individual would be determined to be medically at-risk in the event of a disaster or climate hazards, including extreme heat, extreme cold, flooding, and loss of power. Such a process shall consider— </text><subparagraph id="H0A189E72D5FD4B9B8FEEDAD51BEEFA20"><enum>(A)</enum><text>geography-specific climate risks and regional preparedness for different climate risks;</text></subparagraph><subparagraph id="H7757693C0CB84456BB829BC8658F0369"><enum>(B)</enum><text>the regional history of disaster or climate hazards and infrastructure failure in the preceding 20 years or the forward-looking predicted risk of disaster or climate hazards and infrastructure failure in the next 20 years;</text></subparagraph><subparagraph id="H6CF6EEA1AD7B44F7BC42B1CE651C506C"><enum>(C)</enum><text>medical reliance on equipment, pharmaceuticals, mobility aids, and other supplies that are sensitive to exposure to extreme temperatures, poor air quality, flooding and water damage, or dependent on electrical power; and</text></subparagraph><subparagraph id="H10FEBF7C697B482BBDAA3C93EF5E8A23"><enum>(D)</enum><text>chronic medical conditions, disabilities, and comorbidities that increase patient vulnerability during disaster.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="HB418970229CC42D3BF9341A79D0F4946"><enum>(b)</enum><header>Payment</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="H0B1E8F523BF34E09B01FDA59F17CBD60"><enum>(1)</enum><text>by striking <quote>and</quote> before <quote>(HH)</quote>; and</text></paragraph><paragraph id="HBFC0D02F615449A4946E930B6A10979E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>and (II) with respect to home resiliency services described in section 1861(s)(2)(KK), the amount paid shall be an amount equal to 100 percent of the lesser of the actual charge for the services or the amount determined under a fee schedule established by the Secretary</quote>. <italic></italic></text></paragraph></subsection></section></legis-body></bill>
