which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide Nicaraguan political prisoners who arrived in the United States on February 9, 2023, and their immediate family members with certain benefits available to refugees.</official-title></form><legis-body id="HAA6B49DDEBAB483C9C59043401AF88BD" style="OLC"><section id="H730ACD3D8E4740B6836A6C297C584FAB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nicaragua Political Prisoner Support Act</short-title></quote>.</text></section><section id="HE017BCAFB50C4BDBABBDC0F99307BB38"><enum>2.</enum><header>Defined term</header><text display-inline="no-display-inline">In this section, the term <term>eligible Nicaraguan national</term> means an alien—</text><paragraph id="H4A5BF72483AC41299102828FEDFC2194"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HAA2C16B78FE240D4AFA29B944471F6FA"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HCD60462B250D405ABA64FE99EE8DB9C3"><enum>(i)</enum><text>who is a citizen or national of Nicaragua; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H3A763BB94DD44DE48D460DEC7982C918" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an alien having no nationality, whose former or last habitual residence was in Nicaragua; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBABCF9DB78964F32A00A5302E6D7BA9B" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">who arrived in the United States on February 9, 2023, as part of a political prisoner release, and was granted a 2-year humanitarian parole by the United States Government; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H367A59B8B03147388B3DE31F31DDC65F"><enum>(2)</enum><text display-inline="yes-display-inline">who is the parent, spouse, or child of an individual described in paragraph (1). </text></paragraph></section><section id="H5F29ABBE57A343379E1CCEB45929396A"><enum>3.</enum><header>Eligibility requirements</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, an eligible Nicaraguan national is eligible for the benefits described in section 4 if—</text><paragraph id="H2423F2D3B5534D22ACDEB29948A033A2"><enum>(1)</enum><text>such individual has completed security and law enforcement background checks to the satisfaction of the Secretary of Homeland Security; and</text></paragraph><paragraph id="H04E2B92E7C3E4889AF2CA514E5CE561C"><enum>(2)</enum><text>such individual’s parole—</text><subparagraph commented="no" display-inline="no-display-inline" id="H184DA094CCA54D1AB9F9F2A7C050B2A9"><enum>(A)</enum><text display-inline="yes-display-inline">has not been terminated by the Secretary of Homeland Security; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2EFE88DA22A945458D0A33C7A38697A0"><enum>(B)</enum><text display-inline="yes-display-inline">was terminated while a renewal application was pending for such parole and the sole reason for such termination was that the renewal application had not yet been processed.</text></subparagraph></paragraph></section><section id="HA4F73DECA85145CBBD5C235F1849098A"><enum>4.</enum><header>Benefits</header><text display-inline="no-display-inline">An individual described in section 3 is eligible for—</text><paragraph id="H1200AFC4F3784B0DA2418231CD1A2EE5"><enum>(1)</enum><text>resettlement assistance, entitlement programs, and other benefits that are available to refugees admitted under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) to the same extent as such refugees; </text></paragraph><paragraph id="HB3DD191A1EDE4F0E8246FF6F9AD63656"><enum>(2)</enum><text>child welfare services described in section 412(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1522">8 U.S.C. 1522(d)(2)</external-xref>); and</text></paragraph><paragraph id="HF1EA0F0E58B14D32B9CE72EEE366882E"><enum>(3)</enum><text display-inline="yes-display-inline">a driver’s license or identification card under section 202 of the REAL ID Act of 2005 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/109/13">Public Law 109–13</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note), notwithstanding subsection (c)(2)(B) of such Act.</text></paragraph></section><section id="H798ED20802974C6A8F3E2980A4B1F152"><enum>5.</enum><header>Rules of construction</header><subsection commented="no" display-inline="no-display-inline" id="H6F5F1FB4DA7249628B419CC88DF71402"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Nothing in this Act may be construed—</text><paragraph id="HEB02E407F4EF463CBD0B51F9A28AB94B"><enum>(1)</enum><text>to preclude an eligible Nicaraguan national from applying for or receiving any immigration benefits to which such individual is otherwise eligible; or</text></paragraph><paragraph id="H171D1FA1B1CA431D865064A307C11FD5"><enum>(2)</enum><text>to entitle an eligible Nicaraguan national to lawful permanent resident status.</text></paragraph></subsection></section><section id="HCE3135B244894F05AB0E2D85C99BB155"><enum>6.</enum><header>Exemption from the Paperwork Reduction Act</header><text display-inline="no-display-inline">The requirements under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>) shall not apply to any action taken to implement this section involving the translation of an approved collection of information into a new language.</text></section></legis-body></bill>
