<official-title display="yes">To establish certain protections for a member of the Armed Forces, or a cadet or midshipman at a military service academy, who refuses to receive a vaccination against COVID–19.</official-title>

<section id="H117F752C1EA84700A427FA9E4140B34A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Service Restoration Act</short-title></quote>.</text></section> <section id="H7A4506A3872341EC86F3BF7765F7F944" section-type="subsequent-section"><enum>2.</enum><header>Certain protections for a member of the Armed Forces, or a cadet or midshipman at a military service academy, who refuses to receive a vaccination against COVID–19</header> <subsection id="H0893808D24C7430BAF4DB9A50190C8E8"><enum>(a)</enum><header>Prohibitions</header> <paragraph id="HC2E51C3C483147A3857EB9205DB0EBF7"><enum>(1)</enum><header>Vaccine mandate</header><text display-inline="yes-display-inline">No Federal funds may be used to require a member of the Armed Forces, or a cadet or midshipman at a military service academy, to receive a vaccination against COVID–19.</text></paragraph>
<paragraph id="H3E53B526EA3840039E94A943DDCDDB63"><enum>(2)</enum><header>Adverse action</header><text display-inline="yes-display-inline">No member of the Armed Forces, or cadet or midshipman at a military service academy, may be subject to adverse action solely on the basis of the refusal of such member, cadet, or midshipman to receive a vaccination against COVID–19.</text></paragraph></subsection> <subsection id="H75DB69064CDE4759BEEB0D5F1EE7B835"><enum>(b)</enum><header>Reinstatement</header><text display-inline="yes-display-inline">At the request of a covered individual, the Secretary concerned shall—</text>
<paragraph id="HEDC8A20FD6A04FD6B73C6A3C731C3110"><enum>(1)</enum><text>reinstate the covered individual as a member of the Armed Force concerned, in the same rank and grade the covered individual held at the time of separation from the Armed Force concerned;</text></paragraph> <paragraph id="H201585958E8741218197346464C4FDE4"><enum>(2)</enum><text display-inline="yes-display-inline">expunge from the military service record of the covered individual any reference to adverse action against the covered individual solely on the basis of the refusal of the covered individual to receive a vaccination against COVID–19; and</text></paragraph>
<paragraph id="HDC199A54D93C41248AE4BDCC4F7B338C"><enum>(3)</enum><text display-inline="yes-display-inline">include, in the computation of the retired or retainer pay of such covered individual, the period between the involuntary separation and the reinstatement, under paragraph (1), of the covered individual.</text></paragraph></subsection> <subsection id="H2F68D1D2A44A4F6F93062989B8AB013A"><enum>(c)</enum><header>Mandatory characterization of discharge</header> <paragraph id="HFF6CAF1157EA4CC4988250E8EABB70A2"><enum>(1)</enum><header>Prospective characterizations</header><text display-inline="yes-display-inline">Subsection (a) of section 736 of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1161">10 U.S.C. 1161</external-xref> note), as amended by section 525 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>), is further amended by striking <quote>shall be—</quote> and all that follows and inserting <quote>shall be an honorable discharge</quote>.</text></paragraph>
<paragraph id="HC680B7FD3B024D348DF503926A9994BC"><enum>(2)</enum><header>Retroactive characterizations</header><text>The Secretary concerned shall ensure that the characterization of the discharge of a covered individual that occurred before the date of the enactment of this Act is characterized as honorable.</text></paragraph></subsection> <subsection id="H06CD9A1C6C0F446C8278890D84B73BBC"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H87DCBA2D8EFC46F3B94BB2B5886431D3"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>adverse action</quote> includes the following:</text> <subparagraph id="H2B2AC83D755248EBA95306059BDCAAEF"><enum>(A)</enum><text>Involuntary separation.</text></subparagraph>
<subparagraph id="H877575866E6F4F11885FEFCD92759B45"><enum>(B)</enum><text>Demotion.</text></subparagraph> <subparagraph id="HF6569F839DBF410AA4CC3AE177ABE774"><enum>(C)</enum><text>Discipline.</text></subparagraph>
<subparagraph id="H78916C795C574FF78969214AC114C8F0"><enum>(D)</enum><text display-inline="yes-display-inline">Retaliation.</text></subparagraph> <subparagraph id="H786ED1486B9D458FB098D649CD150658"><enum>(E)</enum><text>Disparate treatment.</text></subparagraph>
<subparagraph id="H42D57BC2C42848EAAA7FF1EE9897D615"><enum>(F)</enum><text>A requirement to wear a mask, reside in substandard housing, or endure substandard conditions.</text></subparagraph> <subparagraph id="H442D924023A04924B95D37CC6D258081"><enum>(G)</enum><text>Travel restrictions.</text></subparagraph>
<subparagraph id="H656A04E8A61A4D8EAF42A60B4530503A"><enum>(H)</enum><text>Deployment restrictions.</text></subparagraph></paragraph> <paragraph id="H3F545372E6D9463F89384E658B4D6B17"><enum>(2)</enum><text>The term <quote>covered individual</quote> means an individual who was involuntarily separated from an Armed Force solely on the basis of the refusal of such individual to receive a vaccination against COVID–19.</text></paragraph>
<paragraph id="H6140126F5EAC442CAF622589EC73AAF6" display-inline="no-display-inline"><enum>(3)</enum><text>The term <quote>military service academy</quote> means the following:</text> <subparagraph id="H7D5598ADCB5E4CEC807662A45BC4369A"><enum>(A)</enum><text display-inline="yes-display-inline">The United States Military Academy.</text></subparagraph>
<subparagraph id="H7DF1FBBDC40E4C6C86F5108238FEA321"><enum>(B)</enum><text display-inline="yes-display-inline">The United States Naval Academy.</text></subparagraph> <subparagraph id="H1917B3009452445CBB2FE644CEA4640B"><enum>(C)</enum><text display-inline="yes-display-inline">The United States Air Force Academy.</text></subparagraph>
<subparagraph id="HE7D2D2AEB62E4C099F4DF82A38E363E0"><enum>(D)</enum><text display-inline="yes-display-inline">The United States Coast Guard Academy.</text></subparagraph></paragraph> <paragraph id="H6272B3597F2445BEA2CC872155AC60B0"><enum>(4)</enum><text>The term <quote>Secretary concerned</quote> has the meaning given such term in section 101 of title 10, United States Code.</text></paragraph></subsection></section>
