<section id="H1E06ECDE5C004BE1B138D349BDBEEACB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness in Social Security Act of 2023</short-title></quote>.</text></section> <section id="HB0E848FD3B684BB5A48B2EC63F928038" section-type="subsequent-section"><enum>2.</enum><header>Treatment of lump-sum social security benefits in determining household income</header> <subsection id="H355CA9DECDB14A2A9002A4EC2AC9A04F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H3036CC35ED1842A5A5EE9335471162A9"><enum>(C)</enum><header>Exclusion of portion of lump-sum social security benefits</header> 
<clause id="HE4669C62F25C40DDBFAB3D7A8AD2343B"><enum>(i)</enum><header>In general</header><text>The term <quote>modified adjusted gross income</quote> shall not include so much of any lump-sum social security benefit payment as is attributable to months ending before the beginning of the taxable year.</text></clause> <clause id="H2E8A73B95E7D445EA4B646A16A660767"><enum>(ii)</enum><header>Lump-sum social security benefit payment</header><text>For purposes of this subparagraph, the term <quote>lump-sum social security benefit payment</quote> means any payment of social security benefits (as defined in section 86(d)(1)) which constitutes more than 1 month of such benefits.</text></clause> 
<clause id="HFB81726790AD45E6BBA0E41A39215C80"><enum>(iii)</enum><header>Election to include excludable amount</header><text>A taxpayer may elect (at such time and in such manner as the Secretary may provide) to have this subparagraph not apply for any taxable year.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA537F689B3DD44068B9F7371A4BB9DC2"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2013.</text></subsection> 
<subsection id="H716A4F553B574D749EB311F34EC35FE2"><enum>(c)</enum><header>Waiver of statute of limitation on credit or refund</header><text display-inline="yes-display-inline">If the period of limitation on a credit or refund resulting from the amendment made by subsection (a) expires before the end of the 1-year period beginning on the date of the enactment of this Act, refund or credit of such overpayment (to the extent attributable to such amendment) may, nevertheless, be made or allowed if claim therefor is filed before the close of such 1-year period. </text></subsection></section> </legis-body></bill>
