<section id="H1F73368CBAAA41B6A91757455EE9825C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep our Kids Safe Act of 2023</short-title></quote>.</text></section> <section id="H3D82CC68A4984D4AA18F0FAFD0FB0393"><enum>2.</enum><header>Prohibition on use of Federal funds for certain activities in public schools</header> <subsection id="H84243AF69682423FB3028BABE7D6498F"><enum>(a)</enum><header>Prohibition on funding for sexualized performances</header><text display-inline="yes-display-inline">A public elementary or secondary school that receives funds under an applicable program shall not host or facilitate the hosting of sexualized performances.</text> </subsection> 
<subsection id="HDDF9034AE92C4BFABB3BB640D237B8CF"><enum>(b)</enum><header>Age and developmentally appropriate education</header><text display-inline="yes-display-inline">A public elementary or secondary school that receives funds under an applicable program may not use such funds for classroom instruction that is—</text> <paragraph id="H655B6BA84F1F4D18BEE375A9B7491921"><enum>(1)</enum><text>provided by school personnel or a third party;</text></paragraph> 
<paragraph id="H272C683444DF478FA0B7419AD5A1EC04"><enum>(2)</enum><text>for students in pre-kindergarten through grade 12;</text></paragraph> <paragraph id="HF2122FD1E6E84318B26D7A07631C0D6B" commented="no"><enum>(3)</enum><text>related to human sexuality, human sexual behavior and its consequences, or other sexual matters for any educational, social, or other purpose; and</text></paragraph> 
<paragraph id="H3966583B459B484089159871FAB26A2B"><enum>(4)</enum><text>in a manner that is not age or developmentally appropriate for such students.</text></paragraph></subsection> <subsection id="HD36A0EC91FAC48759F5680EF16F9A30F"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HD976105835F54045AFC240D59774906F"><enum>(1)</enum><header>Age or developmentally appropriate</header><text>The term <term>age or developmentally appropriate</term> has the meaning given such term in section 475(11)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(11)(A)</external-xref>).</text></paragraph> <paragraph id="H58AC5C4A242A4FF7BB8EFBA12F8E79C9" commented="no"><enum>(2)</enum><header>Applicable program</header><text>The term <term>applicable program</term> has the meaning given such term in section 400(c) of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1221">20 U.S.C. 1221(c)</external-xref>). </text></paragraph> 
<paragraph id="H16A4D1EFD55842138B8DB3093B196B31"><enum>(3)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="H4A6FDFA8E3FC42DE8208E0413DF9B5CD"><enum>(4)</enum><header>Sexualized performance</header><text display-inline="yes-display-inline">The term <term>sexualized performance</term> means a performance—</text> 
<subparagraph id="H03770569EC8447829043DB754B9EC730"><enum>(A)</enum><text>in which 1 or more individuals—</text> <clause id="H90039B0B8B984999BB2AA0241C0AC4F6"><enum>(i)</enum><text>uses clothing, lack of clothing, make-up, or other accessories to accentuate secondary sexual characteristics; or</text></clause> 
<clause id="HC90618B9FD6F48DF8E8AF7B204380E36"><enum>(ii)</enum><text>reads aloud, sings, lip-synchs, dances, strips, impersonates the opposite sex, simulates sexual activities, performs actual sexual activities, or otherwise performs before an audience of at least 1 individual for entertainment or educational purposes, whether performed for payment or not; and </text></clause></subparagraph> <subparagraph id="HD33A03D0C6F148588E5D9D37E562724B"><enum>(B)</enum><text>that is intended to appeal to the prurient interest.</text></subparagraph></paragraph> 
<paragraph id="H42AC7F3DF6074B4D99E9F1C114DDF9DD"><enum>(5)</enum><header>Third party</header><text display-inline="yes-display-inline">The term <term>third party</term> means a business or entity that enters into a contract with a local educational agency or public elementary or secondary school for purposes of providing classroom instruction.</text></paragraph> </subsection></section> </legis-body></bill>
