<section id="H47E3A1FEE523430281276DA8D1540FB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Housing Equity Act of 2023</short-title></quote>.</text></section> <section id="H2943D9E21D3048A1B077E52867D62693" section-type="subsequent-section"><enum>2.</enum><header>Buildings designated to serve extremely low-income households</header> <subsection id="H797816F3398A4953AD039D34A77D45D0"><enum>(a)</enum><header>Reserved State allocation</header> <paragraph id="H4681A298E4D647319F1C9A357169D31B"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/42">Section 42(h)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<subparagraph id="H3786DF8044E94D02B40BCCE3927F90DE"><enum>(A)</enum><text>by redesignating paragraphs (6), (7), and (8) as paragraphs (7), (8), and (9), respectively; and</text></subparagraph> <subparagraph id="H4367A233B88D4A649A84023C83792E1A"><enum>(B)</enum><text>by inserting after paragraph (5) the following new paragraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HBCD2C106DE364CA3847873846D3F57F8"> 
<paragraph id="HF4BD7053DAA844EF8F6E07A63EC76EDA"><enum>(6)</enum><header>Portion of State ceiling set-aside for projects designated to serve extremely low-income households</header> 
<subparagraph id="HB0ED83C070884548956294C70905E9CE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not more than 90 percent of the portion of the State housing credit ceiling amount described in paragraph (3)(C)(ii) for any State for any calendar year shall be allocated to buildings other than buildings described in subparagraph (B).</text></subparagraph> <subparagraph id="H72BAC27B98C04D4B90834F7A29863C71"><enum>(B)</enum><header>Buildings described</header><text>A building is described in this subparagraph if 20 percent or more of the residential units in such building are rent-restricted (determined as if the imputed income limitation applicable to such units were 30 percent of area median gross income) and are designated by the taxpayer for occupancy by households the aggregate household income of which does not exceed the greater of—</text> 
<clause id="H3B33CA49B4574755B28881BAFCE4DB47"><enum>(i)</enum><text>30 percent of area median gross income, or</text></clause> <clause id="H2653DDA6B08D4366ADFEF83E480D3B64"><enum>(ii)</enum><text>100 percent of an amount equal to the Federal poverty line (within the meaning of section 36B(d)(3)).</text></clause></subparagraph> 
<subparagraph id="H92B3F731B41F4900B5102848E58B7204"><enum>(C)</enum><header>State may not override set-aside</header><text>Nothing in subparagraph (F) of paragraph (3) shall be construed to permit a State not to comply with subparagraph (A) of this paragraph.</text></subparagraph> <subparagraph id="HF6B70357101D459E9535451C1C050D43" commented="no"><enum>(D)</enum><header>Termination</header><text>This paragraph shall not apply to allocations after December 31, 2033.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HD7318CD8064E43A1BCE3965281E8D396"><enum>(2)</enum><header>Conforming amendment</header><text>Section 42(b)(4)(C) of such Code is amended by striking <quote>(h)(7)</quote> and inserting <quote>(h)(8)</quote>.</text></paragraph></subsection> <subsection id="HCD0AB65EB3A0437FA7249B93123DAB1F"><enum>(b)</enum><header>Increase in credit</header><text>Section 42(d)(5) of such Code is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H5322848B8BD04144A0BE83B9EF87DB16"><enum>(C)</enum><header>Increase in credit for projects designated to serve extremely low-income households</header> 
<clause id="H7896A82C71334D06BC1C466385141CBA"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any building—</text> <subclause id="HC2BCEA0C10A44FA1954E5C7EA069918C"><enum>(I)</enum><text>which is described in subsection (h)(6)(B), and</text></subclause> 
<subclause id="H1CA6CA9D52374A7A8BF4EC7019388EA5"><enum>(II)</enum><text>which is designated by the housing credit agency as requiring the increase in credit under this subparagraph in order for such building to be financially feasible as part of a qualified low-income housing project,</text></subclause><continuation-text commented="no" continuation-text-level="clause">subparagraph (B) shall not apply to the portion of such building which is comprised of such units, and the eligible basis of such portion of the building shall be 150 percent of such basis determined without regard to this subparagraph.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HEE8BA9B52225447BA814AD396A375BB0" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to allocations, and determinations, of housing credit dollar amount after December 31, 2023. </text></subsection></section>
