<official-title display="yes">To amend the Food Security Act of 1985 to optimize the sequestration of carbon and the reduction of net emissions through agricultural practices, and for other purposes.</official-title>

<section id="H59E6A8C2D2354BEB8637592BC186EFAE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Naturally Offsetting Emissions by Managing and Implementing Tillage Strategies Act of 2023</short-title></quote> or the <quote>NO EMITS Act of 2023</quote>.</text></section> <section id="H74447D4D5807495294493CED3CE51477" section-type="subsequent-section"><enum>2.</enum><header>Soil health transition incentive program</header><text display-inline="no-display-inline">Section 1240B of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HE30476D9A944478E9212A00D5F9E909B"><enum>(k)</enum><header>Soil health transition incentive program</header> 
<paragraph id="HCBD89020BAA049B98C4BDF03E4DB18A4"><enum>(1)</enum><header>Establishment and purposes</header><text>The Secretary shall establish a soil health transition incentive program to assist producers in transitioning to soil health cropping systems by—</text> <subparagraph id="H06D2704D141645A4ACFFEACC12B09FA4"><enum>(A)</enum><text>providing incentives to adopt soil health cropping systems, including by addressing the economic risk during a transition to a new soil health cropping system; and</text></subparagraph> 
<subparagraph id="H81FCA36AF9A84D9FAD005E33588D7B0B"><enum>(B)</enum><text>providing technical assistance for such a transition.</text></subparagraph></paragraph> <paragraph id="HB230B2D8A55040758592E600A983AC6E"><enum>(2)</enum><header>Contracts</header> <subparagraph id="H320C98C76E2846C39E84761C40FAA250"><enum>(A)</enum><header>In general</header><text>The Secretary shall enter into soil health transition incentive contracts with producers under this subsection to provide payments for—</text> 
<clause id="H95065E418CD44139AFDFE9E3722670F1"><enum>(i)</enum><text>the adoption and installation of soil health practices (including cover cropping, no till, and minimum till) or cropping systems; and</text></clause> <clause id="H3412372D98D0404FAB689C2E5781F587"><enum>(ii)</enum><text>completing, managing, maintaining, and improving the soil health practices or cropping systems for the duration of the contract, as determined appropriate by the Secretary.</text></clause></subparagraph> 
<subparagraph id="HFFBC797C17C646E38741A59CF28198E9"><enum>(B)</enum><header>Payment amounts</header><text>In determining the amount of payments under subparagraph (A), the Secretary shall consider, to the extent practicable—</text> <clause id="H53286C2D48D94C73846EA78FDD669646"><enum>(i)</enum><text>the level and extent of the soil health practice or cropping system to be adopted, installed, completed, managed, maintained, or improved;</text></clause> 
<clause id="HD837AF9A43834DAA8B14592F5DFE08D6"><enum>(ii)</enum><text display-inline="yes-display-inline">the cost of the adoption, installation, completion, management, maintenance, or improvement of the soil health practice or cropping system;</text></clause> <clause id="H7C35213F025A479BB7F1DC00C84CEBDF"><enum>(iii)</enum><text>income foregone by the producer, including payments, as appropriate, to address—</text> 
<subclause id="HAA188052C5ED4034AC5E09F91E8345B3"><enum>(I)</enum><text>increased economic risk;</text></subclause> <subclause id="HB02FF7A707514CC694F05D0D5BA2FEF7"><enum>(II)</enum><text>loss in revenue due to anticipated reductions in yield; and</text></subclause> 
<subclause id="HF6D6CC15E3CF475883BF95BF1698A826"><enum>(III)</enum><text>economic losses during transition to new cropping systems; and</text></subclause></clause> <clause id="HE009FF1DF19D4311BF6B22DCDA4D1565"><enum>(iv)</enum><text display-inline="yes-display-inline">the extent to which compensation would ensure long-term continued management, maintenance, and improvement of the soil health practice or cropping system.</text></clause></subparagraph> 
<subparagraph id="HEFE6FF9CB42F41C0A6915252058171DD"><enum>(C)</enum><header>Term</header><text>A contract under this subsection shall have a term of not fewer than 5 years and not more than 7 years.</text></subparagraph></paragraph> <paragraph id="HC19F4EF7BEC645A8935C9BF1ECC19F02"><enum>(3)</enum><header>Individualized agronomic technical assistance</header><text>To assist producers in making a successful transition to a soil health cropping system, the Secretary shall provide individualized and multiyear agronomic technical assistance, at the option of the producer, through—</text> 
<subparagraph id="H53D52DD525804EDFA01CF2846242BD88"><enum>(A)</enum><text>the Secretary;</text></subparagraph> <subparagraph id="H61CE4A01A4824DEEACAC68C01F10E4BE"><enum>(B)</enum><text>a third-party provider;</text></subparagraph> 
<subparagraph id="H6A3E81AC11F848FAAFA158B498CD6524"><enum>(C)</enum><text>a commercial entity (including a farmer cooperative or agriculture retailer);</text></subparagraph> <subparagraph id="HFA5B9641C03B42F3B89FE83B95FDB943"><enum>(D)</enum><text>a nonprofit entity with agronomic expertise; or</text></subparagraph> 
<subparagraph id="H2E11918DE2C746D685034B801C672F21"><enum>(E)</enum><text>a State or local government (including a conservation district).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H4F78FA58DE4C495A82040EE44B78ECFC" section-type="subsequent-section"><enum>3.</enum><header>On-farm conservation innovation trials</header><text display-inline="no-display-inline">Section 1240H(c) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-8">16 U.S.C. 3839aa–8(c)</external-xref>) is amended—</text> 
<paragraph id="H5C73D1AA0DC3464F9F54CDB7FE989DFF"><enum>(1)</enum><text>in paragraph (1)(B)(i)—</text> <subparagraph id="H47553ADD003844BE8A708BE15C6264AF"><enum>(A)</enum><text>in subclause (VI), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph> 
<subparagraph id="H1037D6ED05454153B85199B545B8FAA0"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HB64B3B153C394651BBAF20F054C565CD" display-inline="no-display-inline"> <subclause id="H5BE3FA7567B6411184A333B891943B07"><enum>(VIII)</enum><text display-inline="yes-display-inline">practices related to livestock production; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H4EF0DB7993DC4E22BCE14941EC6245D4"><enum>(2)</enum><text>in paragraph (2), by striking <quote>$25,000,000</quote> and inserting <quote>$50,000,000</quote>.</text></paragraph></section> <section id="H740E29E827E94795B9DEBA4DBD73C0EF" section-type="subsequent-section"><enum>4.</enum><header>State assistance for soil health</header><text display-inline="no-display-inline">Subchapter B of chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-21">16 U.S.C. 3839aa–21 et seq.</external-xref>) is amended by adding at the end the following: </text>

<section id="H7E802F3A6C124D089FDFED264DF88BBE"><enum>1240L–2.</enum><header>State assistance for soil health</header> 
<subsection id="H5C178AFC60E4483B9A56E218C805F6E2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H1BBACB1720BA4648821B7FB6A510C7C9"><enum>(1)</enum><header>Eligible Indian tribe</header><text>The term <term>eligible Indian tribe</term> means an Indian tribe that is—</text> 
<subparagraph id="H2DE9B6585B7847ABA2AD9F5C0D19EF17"><enum>(A)</enum><text>implementing a soil health program for the area over which the Indian tribe has jurisdiction; and</text></subparagraph> <subparagraph id="H1DD4C3BBBAC347CC8909A46BCC787FB4"><enum>(B)</enum><text display-inline="yes-display-inline">meeting or exceeding performance measures established by the Indian tribe for the soil health program.</text></subparagraph></paragraph> 
<paragraph id="H7E1934B15A7D4F409E23F62585A411E4"><enum>(2)</enum><header>Eligible State</header><text display-inline="yes-display-inline">The term <term>eligible State</term> means a State that is—</text> <subparagraph id="H42F3AB87E84340C48BBB81473A6D0C9B"><enum>(A)</enum><text>implementing a soil health program for the State; and</text></subparagraph> 
<subparagraph id="HF777428FDE9940A7955D9CAB79DF2A71"><enum>(B)</enum><text>meeting or exceeding performance measures established by the State for the soil health program.</text></subparagraph></paragraph> <paragraph id="HF257E1A43CAF4EFCADE99A897626E31A"><enum>(3)</enum><header>Soil health program</header><text display-inline="yes-display-inline">The term <term>soil health program</term> means a program to improve soil health on agricultural land that—</text> 
<subparagraph id="H544D61D5525240629BCE97E08FA78C78"><enum>(A)</enum><text>is broadly consistent with the soil health principles of the Natural Resources Conservation Service, as determined by the Secretary; and</text></subparagraph> <subparagraph id="H7ED16DB52AC6483DA8240BD5398DF255"><enum>(B)</enum><text>may include—</text> 
<clause id="HA11C3C4E5D2542DA9E52E3947B8BD616"><enum>(i)</enum><text>technical assistance;</text></clause> <clause id="H29184577A7A548EB899AEE7FA18C6798"><enum>(ii)</enum><text>financial assistance;</text></clause> 
<clause id="H8196EFBD38A7474DB137DA24B9EACC55"><enum>(iii)</enum><text>on-farm research and demonstration;</text></clause> <clause id="H04F720ABDCFC41948469415BFCDC5F0B"><enum>(iv)</enum><text>education, outreach, and training;</text></clause> 
<clause id="H2FFE7538B00B4B96BB0EAA8B71B17CA9"><enum>(v)</enum><text>monitoring and evaluation; or</text></clause> <clause id="HF3EE7377DC384F598A7DF88CA95EEAFC"><enum>(vi)</enum><text>such other components as the Secretary determines appropriate.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H27A5ACDD91AB4951A2E725CA278474CD"><enum>(b)</enum><header>Availability and purpose of grants</header><text>For fiscal years 2024 through 2028, the Secretary shall make grants to eligible States and eligible Indian tribes for the purpose of improving soil health on agricultural lands through the implementation of State and Tribal soil health programs.</text></subsection> <subsection id="H81C69011042D4F95A579EC6C3F3E8740"><enum>(c)</enum><header>Applications</header> <paragraph id="HB3C57355B04349B9957D13A89EB71E81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To receive a grant under this section, an eligible State or eligible Indian tribe shall submit to the Secretary an application at such time, in such a manner, and containing such information as the Secretary shall require, which shall include—</text> 
<subparagraph id="HBF3E96EFF57F47618E198C2A5CD24BC0"><enum>(A)</enum><text>a description of performance measures to be used to evaluate the State or Tribal soil health program and the results of any activities carried out using grant funds received under this section; and</text></subparagraph> <subparagraph id="H63B496388BE64F778F4B20152D1137AD"><enum>(B)</enum><text>an assurance that grant funds received under this section will supplement the expenditure of State or Tribal funds in support of soil health, rather than replace such funds.</text></subparagraph></paragraph> 
<paragraph id="HF156E5A2E1F34EEE8282FD2841C7D2C8"><enum>(2)</enum><header>Tribal option</header><text>An Indian tribe shall have the option, at the sole discretion of the Indian tribe, to be incorporated into the application of an eligible State.</text></paragraph></subsection> <subsection id="H1110FFA48ABB4358B8BE7DC18AEE385C"><enum>(d)</enum><header>Priority</header><text>In making grants under this section, the Secretary shall give priority to eligible States and eligible Indian tribes with a climate action plan that includes soil health, as determined by the Secretary.</text></subsection> 
<subsection id="H4EEB4FF11CF443BD97E6FA41E80F8DD5"><enum>(e)</enum><header>Grants</header> 
<paragraph id="H0F263AD198534D2F9CEAEBB9E60C6AA2"><enum>(1)</enum><header>Amount</header><text>The amount of a grant to an eligible State or eligible Indian tribe under this section for a fiscal year may not exceed the lower of—</text> <subparagraph id="HC2DB454A4C0C44B993BAB6475C91EA46"><enum>(A)</enum><text>$5,000,000; or</text></subparagraph> 
<subparagraph id="H920F3FCEBDDD413FAC79915C1441D4A8"><enum>(B)</enum><text>as applicable—</text> <clause id="H104271C00C4142AA9CD90AC188252E9F"><enum>(i)</enum><text>50 percent of the cost of implementing the State soil health program in the fiscal year; or</text></clause> 
<clause id="H755D6B754D6B4A66B880C1537AF62DE5"><enum>(ii)</enum><text>75 percent of the cost of implementing the Tribal soil health program in the fiscal year.</text></clause></subparagraph></paragraph> <paragraph id="HCD70D3F0CF7440AFBE8EB482D25AE295"><enum>(2)</enum><header>Term</header><text>A grant under this section shall be for 1 year, and may be renewed annually.</text></paragraph></subsection> 
<subsection id="H35632C1320CF4DEBB08058B39F0A315E"><enum>(f)</enum><header>Audits and reviews</header><text>An eligible State or eligible Indian tribe receiving a grant under this section shall submit to the Secretary—</text> <paragraph id="HBC5DF7BF94E541468FBD660EFEF491C5"><enum>(1)</enum><text>for each year for which the State or Indian tribe receives such a grant, the results of an audit of the expenditures of the grant funds; and</text></paragraph> 
<paragraph id="HFFD8021FE9D947D8ADA961499D8D758B"><enum>(2)</enum><text>at such intervals as the Secretary shall establish, a review and evaluation of the State or Tribal soil health program.</text></paragraph></subsection> <subsection id="H2FD5DEA241DF4CCF80E65E6406E0135D"><enum>(g)</enum><header>Effect of noncompliance</header><text>If the Secretary, after reasonable notice to an eligible State or eligible Indian tribe receiving a grant under this section, finds that the State or Indian tribe has failed to comply with the terms of the grant, the Secretary may disqualify, for 1 or more years, the State or Indian tribe from receipt of future grants under this section.</text></subsection> 
<subsection id="HEBB8CC0B7BB54C23B58C9BCF37625C4D"><enum>(h)</enum><header>Funding</header><text>Of the funds made available to carry out this subchapter, $100,000,000 shall be available in each of fiscal years 2024 through 2028 to carry out this section.</text></subsection> <subsection id="HA83A718B0F384DCB848AB30A1DAD7FAE"><enum>(i)</enum><header>Administration</header> <paragraph id="H7D6D1FCEC92C4C3A8BC6CE3E3000AB24"><enum>(1)</enum><header>Department</header><text>The Secretary may not use more than 3 percent of the funds made available to carry out this section for a fiscal year for administrative expenses.</text></paragraph> 
<paragraph id="H194CC8159A03493B8A91180625861B01"><enum>(2)</enum><header>States or Indian tribes</header><text>An eligible State or eligible Indian tribe receiving a grant under this section may not use more than 7 percent of the granted funds for a fiscal year for administrative expenses.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HF13D8B6FB46B43D7B9BA2CB1F53B6182" section-type="subsequent-section"><enum>5.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Section 1241(c) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(c)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HBCAC69B0A85C401B812DE67D99BC9A0F" display-inline="no-display-inline"> 
<paragraph id="H1884E21BADEE47C5B7AC0F6B07D6554E"><enum>(5)</enum><header>Special initiative</header> 
<subparagraph id="H1A8E6020775A4B4E8EBD133A297A80DF"><enum>(A)</enum><header>In general</header><text>In each of fiscal years 2024 through 2028, the Secretary shall carry out a special technical assistance initiative to assist producers in mitigating and adapting to climate change, using, of the funds of the Commodity Credit Corporation, an amount equal to not less than 1 percent of the amount of funds made available by subsection (a) for the fiscal year.</text></subparagraph> <subparagraph id="H25895E3688E04DA8934B5B8CC37B814B"><enum>(B)</enum><header>Provision of technical assistance</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance under this paragraph to producers—</text> 
<clause id="HA052363AAFF949B69B22EAE28DAB58AD"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with section 1242(c); or</text></clause> <clause id="H7EF01DC22E61494589E7908BB7348254"><enum>(ii)</enum><text>notwithstanding such section, through a cooperative agreement or contract with—</text> 
<subclause id="H0B375D26A69E49EAA7FD85604B5A3136"><enum>(I)</enum><text>a cooperative extension;</text></subclause> <subclause id="H94550CDE408F462286D24A0EE716CFFC"><enum>(II)</enum><text>a nongovernmental organization; or</text></subclause> 
<subclause id="H36C46A9737D3494F873DCC8F24193032"><enum>(III)</enum><text>a State, Tribal, or Federal agency.</text></subclause></clause></subparagraph> <subparagraph id="H60CAE4765981404686518DE6C11590D6"><enum>(C)</enum><header>Underserved producers</header><text>In providing technical assistance under this paragraph the Secretary shall give priority to producers who are persons described in section 1244(a)(2).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
