which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, with respect to current and future electric power requirements of airports, and for other purposes.</official-title></form><legis-body id="H98B2E6CC60164DC78BD8B4FB3E18BDC3" style="OLC"><section id="HF4EA2B0655524971A42C0F288246D4D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Future of Aviation Act</short-title></quote>.</text></section><section id="H8BB67947FCD64F8CA125FF53063D0085" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 47102 of title 49, United States Code, is amended—</text><paragraph id="H3E0B8AB2121440388CA7668FDB2A1B54"><enum>(1)</enum><text>in paragraph (3)(P) by striking <quote>improve the reliability and efficiency of the airport’s power supply</quote> and inserting <quote>improve reliability and efficiency of the airport’s power supply or meet current and future electrical power demand.</quote>; and</text></paragraph><paragraph id="H24E29F52AB2E476FA70C8D91F7794DE3"><enum>(2)</enum><text>in paragraph (5) by inserting after subparagraph (C) the following:</text><quoted-block id="H0A2FE8868B7445099ACE10E16F2FC8B1" style="OLC"><subparagraph id="HCF75400B3696483FAECD9E2A3D6AAC05"><enum>(D)</enum><text>assessing current and future electrical power demand.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H248ECFCD3154463E947EE73C9EE18993"><enum>3.</enum><header>Increasing the energy efficiency of airports and meeting current and future electrical power demands</header><subsection id="H47ED2D02320447CBBD74839DA5AB73FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 47140 of title 49, United States Code, is amended to read as follows: </text><quoted-block style="USC" id="H8917FDDF8F6B40FB989C07932487BC39" display-inline="no-display-inline"><section id="HDC5BCBF0B7D341E9A80CEBBF10F9B681"><enum>47140.</enum><header>Meeting current and future electrical power demand</header><subsection id="H9FC32084ABEF40F08A70129D5F226022"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish a program under which the Secretary shall—</text><paragraph id="H2AADF7EE382940D59DC85E9E784C8FFF"><enum>(1)</enum><text>encourage the sponsor of each public-use airport to—</text><subparagraph id="HB64F890153D04DF2BA0CD9238A80F9ED"><enum>(A)</enum><text>conduct airport planning that assesses the airport’s—</text><clause id="H124F2F20A3EF4A1FA80ACED1CA68F7BF"><enum>(i)</enum><text>current and future electrical power requirements, including—</text><subclause id="HB91D886794034639BD9CCF4E6879497B"><enum>(I)</enum><text>heating and cooling;</text></subclause><subclause id="H27A821E45D1D42B2A8D1590066A546FD"><enum>(II)</enum><text>on-road airport vehicles, including ground support equipment;</text></subclause><subclause id="H3548BA90481141DC8607FA1D338B632B"><enum>(III)</enum><text>gate electrification; and</text></subclause><subclause id="HDF64E45A6CCB4551AC2E2C870AA75290"><enum>(IV)</enum><text>electric aircraft charging; and</text></subclause></clause><clause id="H6FB33A65A30142549B646CCA9BE35222"><enum>(ii)</enum><text display-inline="yes-display-inline">existing electrical infrastructure condition, location and capacity, including base load and backup power, to meet the current and future electrical power demand as identified in this subparagraph; and </text></clause></subparagraph><subparagraph id="H28011BD940B64D34984548D3BA15A949"><enum>(B)</enum><text>conduct airport development to increase energy efficiency or meet future electrical power demands as identified in subparagraph (A); and</text></subparagraph></paragraph><paragraph id="H75F8CEE598B545D09D5FBA555B65FF96"><enum>(2)</enum><text>reimburse the airport sponsor for the costs incurred in conducting the assessment under paragraph (1).</text></paragraph></subsection><subsection id="H25681FBA0B314BD4B12A1308CEC7C833"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary may make grants from amounts made available under section 48103 to assist airport sponsors that have completed the assessment described in subsection (a)(1)—</text><paragraph id="H7A76511216CE46FA9E03CA3CFA9278F2"><enum>(1)</enum><text display-inline="yes-display-inline">to acquire or construct equipment that will increase energy efficiency at the airport; and</text></paragraph><paragraph id="H677E9C185BC241D8A883F494DDA3A5F7"><enum>(2)</enum><text display-inline="yes-display-inline">to pursue an airport development project described in subsection (a)(1)(B).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4F128FEC12A24236B0CF9E71ED549077"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/471">chapter 471</external-xref> of title 49, United States Code, is amended by striking the item relating to section 47140 and inserting the following: </text><quoted-block style="USC" id="H10E5084040D147468ABBF0AFFA5E5260" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">47140. Meeting current and future electrical power demand. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H481190656C244D2F832AB1F5CCD5D81E"><enum>4.</enum><header>Electric aircraft infrastructure pilot program</header><subsection id="H6829E28CC4824884BD41B5BEED3B93C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation may establish a pilot program under which the sponsors of public-use airports may use funds made available under chapter 471 or section 48103 of title 49, United States Code, for use at up to 10 airports to carry out—</text><paragraph id="H573014F4795440D195DE278F41DE2851"><enum>(1)</enum><text display-inline="yes-display-inline">activities associated with the acquisition, by purchase or lease, operation, and installation of equipment to support the operations of electric aircraft, including interoperable electric vehicle charging equipment; and</text></paragraph><paragraph id="H3D3EE5EC587E49F1B04A570BF85B5E60"><enum>(2)</enum><text>the construction or modification of infrastructure to facilitate the delivery of power or services necessary for the use of electric aircraft, including—</text><subparagraph id="HF725912EF7AC4E3C87C4967ED9F76BFE"><enum>(A)</enum><text display-inline="yes-display-inline">on airport utility upgrades; and</text></subparagraph><subparagraph id="HAD956A023CB1414FBC30D95A95DCC5C4"><enum>(B)</enum><text>associated design costs.</text></subparagraph></paragraph></subsection><subsection id="H0B37E238CA114A1D8A5F719BFF2A87BA"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A public-use airport is eligible for participation in the pilot program under this section if the Secretary finds that funds made available under subsection (a) would support—</text><paragraph id="H86B93B29A8D74BFFBCF19F74D7DB43AF"><enum>(1)</enum><text>electric aircraft operators at such airport, or using such airport; or</text></paragraph><paragraph id="H12C88FB8EE4A4FE297C11DE3531C0B44"><enum>(2)</enum><text>electric aircraft operators planning to operate at such airport with an associated agreement in place.</text></paragraph></subsection><subsection id="H90FAF14061E9460AA3A19BD16A37F257"><enum>(c)</enum><header>Sunset</header><text>The pilot program established under subsection (a) shall sunset 5 years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
