R. 4112</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230614">June 14, 2023</action-date><action-desc><sponsor name-id="D000032">Mr. Donalds</sponsor> (for himself and <cosponsor name-id="B001316">Mr. Burlison</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Securities Exchange Act of 1934 to prohibit the Securities and Exchange Commission from issuing conflicting proposed or final rules, to require the Commission to consider industry-specific costs, and for other purposes.</official-title></form><legis-body id="H2155574E2D034CA58B43C5658C768B5D" style="OLC"><section id="H9209E5FE1AE24EC28237C96E1133CFC4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Symmetry in Rules Act</short-title></quote>. </text></section><section id="HC79A7401741945FF97B146DE89170457"><enum>2.</enum><header>Additional rulemaking requirements</header><subsection id="H292D479796034DE3ACE40298CA4861C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 23 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78w">15 U.S.C. 78w</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H38294F5480C9435184149B5F15EE79A9" display-inline="no-display-inline"><subsection id="H765E545F1B464FD799BEEC629B60C312"><enum>(e)</enum><header>Prohibition on conflicting rules</header><text>The Commission may not issue any proposed rule, or finalize any such rule, that conflicts with—</text><paragraph id="H8E5E9DA255714D078C205F8C0B40A5E7"><enum>(1)</enum><text>any existing rule; or</text></paragraph><paragraph id="HC22A88962D4D4A108DC54ACAFFB18036"><enum>(2)</enum><text>any other proposed rule.</text></paragraph></subsection><subsection id="H72C7E435D2C84FE8ADE55EF048BA0FB8"><enum>(f)</enum><header>Consideration of industry-Specific costs</header><text display-inline="yes-display-inline">The Commission shall, before issuing any proposed or final rule, take into account the estimated cost to specific industries of complying with multiple rules.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0D20E10C07E942E6A8AAE7B057BCA5B3"><enum>(b)</enum><header>Rule of application</header><text display-inline="yes-display-inline">Any proposed rule of the Securities and Exchange Commission that, on the date of enactment of this Act, violates section 23(e) of the Securities Exchange Act of 1934 shall be withdrawn or revised to be in compliance with such prohibition as soon as practicable after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
