which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to improve oversight of private charter management organizations, and for other purposes.</official-title></form><legis-body id="HE51C2FD5B47A413298280C5BFBAC74EB" style="OLC"><section id="HC394FFD3B7ED40DC90621B2787E2D5F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Charter Oversight, Accountability, and Transparency Act</short-title></quote> or the <quote>COAT Act</quote>.</text></section><section id="H616EC6050AF04166B8774B418C94C7B0"><enum>2.</enum><header>Oversight of private charter management organizations</header><subsection id="H99BCF7D188384674B53E74C3857A217B"><enum>(a)</enum><header>State plan assurance</header><text display-inline="yes-display-inline">Section 1111(g) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(g)</external-xref>) is amended—</text><paragraph id="HC3A5C6FF2414401DBC9399A062ACF70D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="H6D8E7CCD58BD405B9CF82A9F1B940884"><enum>(A)</enum><text>in subparagraph (M), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H78CB00FF08BC4AD18D8B14F74C93B663"><enum>(B)</enum><text>in subparagraph (N), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H69BEE5A437804ADEBFB9508EAC1135C8"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H79C9925074C54908AE5CFC2BBB3DD88C" display-inline="no-display-inline"><subparagraph id="H890E428874D64BEDB1519E1CBD6AC19F"><enum>(O)</enum><text display-inline="yes-display-inline">the State educational agency will ensure that each contract between a charter school located in the State and a private charter management organization for the operation or management of the charter school satisfies the requirements described in paragraph (5).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H706925EA11E54D9DBCD6B6E9A344EBE7"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H78DC0815EC3044A09063E2801AC4DA31" display-inline="no-display-inline"><paragraph id="H1515708040CD4E7F9C77DC2FA99CD4E1"><enum>(5)</enum><header>Private charter management organization oversight</header><subparagraph id="HBF4729AAE4274B31B9384A3E82AF5B2B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A contract described in paragraph (2)(O) shall require a private charter management organization to comply, while under contract, with the following:</text><clause id="H91199C9BC6764DA7B80B89771A49DB9E"><enum>(i)</enum><header>Annual disclosures</header><text>The private charter management organization shall disclose annually to the Secretary, for the most recently completed fiscal year, the following information:</text><subclause id="HE2B961AD5ACB405391F3F95D8D65B864" commented="no"><enum>(I)</enum><text>The identity of each charter school operated or managed by the private charter management organization.</text></subclause><subclause id="HE263DBF1014C48D6A8AD4BA3673DCAD5"><enum>(II)</enum><text>The identity of each executive, including the chief executive officer, chief operating officer, chief financial officer, and general counsel, of the private charter management organization (with updates provided to the Secretary not later than one month after a change with respect to any such executive).</text></subclause><subclause id="H4CC5AE82D92E4732BC77D68F4B5566DE"><enum>(III)</enum><text>The salary of each such executive.</text></subclause><subclause id="H0374ED074A5F4F68BD5EA8BE93A5F18B"><enum>(IV)</enum><text>The amount earned in excess of salary by each such executive.</text></subclause><subclause id="H5EA5C23304A94C379EB4A8F8CAA96027"><enum>(V)</enum><text>The amount expended by the private charter management organization on the following:</text><item id="H670DEA29A1E54817AD2ED7C5B42CBB88"><enum>(aa)</enum><text>The operations of each charter school that is served by the private charter management organization.</text></item><item id="H0FD09B40B5BF4FCA8A446512877ECF56" commented="no"><enum>(bb)</enum><text>The administration of the private charter management organization, excluding amounts accounted for under item (aa).</text></item></subclause><subclause id="HC9EBEC75F2034FDFB049365593C85275"><enum>(VI)</enum><text>An audited income statement and balance sheet demonstrating revenue, costs, and profit margin (prepared in accordance with generally accepted accounting principles).</text></subclause><subclause id="HAF97DE1B48B34D2BA65F943910F24AC9"><enum>(VII)</enum><text>The amount expended by the private charter management organization, and the percentage of the annual budget of the private charter management organization that each such amount comprises, for the following:</text><item id="HAEE23DBDC47544F2AF2F8B98DE2593B5"><enum>(aa)</enum><text display-inline="yes-display-inline">Administrative costs.</text></item><item id="HE058C645C43A4D928C9C02A8020FE39F"><enum>(bb)</enum><text>Costs of advertising and marketing.</text></item><item id="HC30C1B7B936941B0B098C0B9E4F1E66F"><enum>(cc)</enum><text>Salary and benefits for teachers, support staff, school leaders (including the principal and vice principal), and special education instructional support staff.</text></item><item id="H9D9313B7C5EE4CE49CFB48EFAD361427"><enum>(dd)</enum><text>Costs of instructional supplies, including books, writing material, and curriculum material.</text></item><item id="HA050A38D375041838A1F213EC3E7EB2B"><enum>(ee)</enum><text>Any other cost exceeding one percent of the annual budget of the private charter management organization.</text></item></subclause><subclause id="HD9353B61EA684BB4A58C9DE60906ED03"><enum>(VIII)</enum><text>Whether the private charter management organization is a for-profit or nonprofit organization.</text></subclause><subclause id="H04806B137AA84C92880CA23E2D6B861E" commented="no"><enum>(IX)</enum><text>The identity of any entity that has entered into a contract with the private charter management organization and with respect to which the private charter management organization—</text><item id="H9833A55854E64B11988CBB49E9ACE428" commented="no"><enum>(aa)</enum><text>owns a security;</text></item><item id="H941E37A0BCC84F77BE0FE3218270D2EC" commented="no"><enum>(bb)</enum><text>extends credit;</text></item><item id="H9CD45B4565BA471C91F494FC6567EA44" commented="no"><enum>(cc)</enum><text>is a parent, subsidiary, or sibling company; or</text></item><item id="H60A01C2DD6CC4B44BAECAA995CE72BBE" commented="no"><enum>(dd)</enum><text>is under common control.</text></item></subclause></clause><clause id="H556FFB4995FD485C85FE164B00AAB4FF"><enum>(ii)</enum><header>Board meetings</header><text>The private charter management organization shall—</text><subclause id="H4BACB6DB8B5249F0AD8E1AA7B76C0386"><enum>(I)</enum><text>hold board meetings that are open to the public;</text></subclause><subclause id="H1600A4F219494CC79BCF2BA6F84B416C"><enum>(II)</enum><text>one week prior to the date of a board meeting, issue a public notice of the meeting; and</text></subclause><subclause id="H2FD605691E53443DA624208C18DA9FFB"><enum>(III)</enum><text>ensure that board meetings are reasonably accessible to the community by holding the meetings during a time of day that is reasonably convenient for the parents of children enrolled in a charter school served by the private charter management organization.</text></subclause></clause></subparagraph><subparagraph id="H2D4EB452EBA94D869EA2C8AD05A0E05D"><enum>(B)</enum><header>Private charter management organization defined</header><text>For purposes of this subsection, the term <term>private charter management organization</term> means a private organization that operates or manages a charter school or a network of charter schools linked by centralized support, operations, and oversight, without regard to whether such organization is a for-profit or nonprofit organization.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF10908683D1C470FB6E4ECC1F0BAE4B2" commented="no"><enum>(b)</enum><header>Public availability and report to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after receiving information disclosed pursuant to section 1111(g)(5) of the Elementary and Secondary Education Act of 1965, as added by subsection (a), the Secretary of Education shall—</text><paragraph id="H3EA88CE657054BC3A1633A765BD13DF0"><enum>(1)</enum><text>make available the information on a public website of the Department of Education; and</text></paragraph><paragraph id="HC702F07F85D74558A721D6608DF1CE72"><enum>(2)</enum><text>submit to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report containing the information.</text></paragraph></subsection><subsection id="H398057A35C714AF292B4D02631C4BA2F"><enum>(c)</enum><header>Effective date</header><text>The amendment made in subsection (a) shall apply with respect to contracts entered into, renewed, or modified on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
