R. 4039</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230612">June 12, 2023</action-date><action-desc><sponsor name-id="M001224">Mr. Moran</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the use of funds supporting any activities within the Xinjiang Uyghur Autonomous Region of the People’s Republic of China.</official-title></form><legis-body id="H54BC78FF159E49DB895ED6C235CBB090" style="OLC"><section id="HA350354720224ADA934C6B7987080318" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Dollars To Uyghur Forced Labor</short-title> Act</quote>.</text></section><section id="H99B0AB0396A345D4AC19D07BEFA430E6"><enum>2.</enum><header>Prohibition on use of funds supporting any activities within the Xinjiang Uyghur Autonomous Region of the People’s Republic of China</header><subsection id="HAFFB0ABD15444561AD29B433A1BD2A32"><enum>(a)</enum><header>In general</header><text>No funds available to the Department of State or the United States Agency for International Development may be used to develop, design, plan, promulgate, implement, or execute a policy, program, or contract that uses goods, wares, articles, or merchandise mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China or produced by a covered entity, unless such activity is specifically authorized pursuant to subsection (b). </text></subsection><subsection id="HFE24C671CAD842589FBA01786A34C4D9"><enum>(b)</enum><header>Specific authorization</header><text>The Secretary of State may specifically authorize an activity otherwise prohibited by subsection (a) if—</text><paragraph id="H608B4DB42443419F8F0124D0248C94BB"><enum>(1)</enum><text>the Secretary—</text><subparagraph id="H20BF0D5AC7314AAF8072CCB4DE542A95"><enum>(A)</enum><text>determines, by clear and convincing evidence, that the good, ware, article, or merchandise was not mined, produced, or manufactured wholly or in part by forced labor; and </text></subparagraph><subparagraph id="H26B4B78209534EF9A2CAEB8FE17DEAFC"><enum>(B)</enum><text display-inline="yes-display-inline">provides notice to the Chair and Ranking Member of the Committee on Foreign Affairs of the House of Representatives and the Chair and Ranking Member of the Committee on Foreign Relations of the Senate not later than 15 days before authorizing the activity; and</text></subparagraph></paragraph><paragraph id="HBE0140649A8648ACBC96418E72285BB2"><enum>(2)</enum><text>Congress has not otherwise prohibited the activity pursuant to enactment of a joint resolution.</text></paragraph></subsection><subsection id="HA7C95B4CD0BF4FA1AF309F53F67B37AA"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="HA3E77FECFF0548209B58E11EA888708F"><enum>(1)</enum><text>the term <quote>covered entity</quote> means an entity listed pursuant to clause (i), (ii), (iv), or (v) of section 2(d)(2)(B) of <external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref> (135 Stat. 1527) under the strategy developed by section 2(c) of such <external-xref legal-doc="public-law" parsable-cite="pl/117/78">Public Law 117–78</external-xref>; and</text></paragraph><paragraph id="HF18BB78BFB754FECA44CBE443A0F6805"><enum>(2)</enum><text>the term <quote>forced labor</quote> has the meaning given that term in section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
