which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for a rulemaking on operation of unmanned aircraft beyond visual line of sight, and for other purposes.</official-title></form><legis-body id="H3629A0ED5079489FA803597468FF35B7" style="OLC"><section id="H30232DBABF234552AFF27C2C76FF4B03" section-type="section-one"><enum>1.</enum><header>Beyond visual line of sight rulemaking</header><subsection id="HD81BEC3D292542FCB738E4FE1ED182C0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 4 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall issue a notice of proposed rulemaking establishing airworthiness and operational regulations for unmanned aircraft operated beyond visual line of sight that are intended to operate primarily at or below 400 feet above ground level and the associated elements of such aircraft.</text></subsection><subsection id="H6A175E582E9F4BEEAACD46157F6F6401"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">In carrying out subsection (a), the Administrator shall—</text><paragraph id="H17E493A8082B40FBAC5A13B0C6E68271"><enum>(1)</enum><text display-inline="yes-display-inline">establish a means to accept proposed—</text><subparagraph id="H7D099F13C0CB45BEA66EF0AE30AC3152"><enum>(A)</enum><text>airworthiness standards for unmanned aircraft;</text></subparagraph><subparagraph id="H69671D6648D14059B46D95470189A0BF"><enum>(B)</enum><text>standards for associated elements of unmanned aircraft; and</text></subparagraph><subparagraph id="HB063043652CE4BB4A2974B264B7AB7AC"><enum>(C)</enum><text>qualification standards for remote pilots operating unmanned aircraft;</text></subparagraph></paragraph><paragraph id="H55F13141735A4E28BA4DE6C013694708"><enum>(2)</enum><text>enable the ability for unmanned aircraft to be operated for agricultural purposes; </text></paragraph><paragraph id="HF54D579F721E41DBBF661F192F740691"><enum>(3)</enum><text display-inline="yes-display-inline">establish a process by which the Administrator may approve or accept third-party compliance services in support of the safe integration of unmanned aircraft systems into the national airspace system; and</text></paragraph><paragraph id="HD5518E31F24F46AEB62A0C9B82489051"><enum>(4)</enum><text display-inline="yes-display-inline">establish protocols, as appropriate, for networked information exchange, including network-based remote identification in support of beyond visual line of sight operations.</text></paragraph></subsection><subsection id="HA6572E48AEB841D893AEC83F94F54F80"><enum>(c)</enum><header>Unmanned aircraft airworthiness standards</header><text>In carrying out subsection (b)(1)(A), the Administrator shall—</text><paragraph id="H6E9E7B6E3E0F401396DC5F8087DE9476"><enum>(1)</enum><text>define the operational environments of which an airworthiness certification is needed to ensure aviation safety;</text></paragraph><paragraph id="H560EC324D8E94D50BD4EFB5B9D21FE08"><enum>(2)</enum><text>establish an airworthiness category or categories for unmanned aircraft to be eligible for a special airworthiness certificate; and</text></paragraph><paragraph id="H09C070CFEE57443DBBB38585793BD392"><enum>(3)</enum><text display-inline="yes-display-inline">establish a process to approve standards, means of compliance, and declarations of compliance.</text></paragraph></subsection><subsection id="H452BE4EC599943E8A4D7B538DA23FB5F"><enum>(d)</enum><header>Unmanned aircraft associated elements standards</header><paragraph id="H07ECEAFAE9B74C3EA59D885984F93EEC"><enum>(1)</enum><header>In general</header><text>In carrying out subsection (b)(1)(B), the Administrator shall establish a process to accept or approve the associated elements of an unmanned aircraft that, when considered collectively with other associated elements and an unmanned aircraft, meet an acceptable performance-based safety standard.</text></paragraph><paragraph id="H26E920EE2B314F0A9DAAF1E9A54551A3"><enum>(2)</enum><header>Considerations</header><text>In establishing the process under paragraph (1), the Administrator shall consider the ways associated elements of an unmanned aircraft system interact with other associated elements and unmanned aircraft.</text></paragraph></subsection><subsection id="H38A0DCEC26DB40E585155252649F41DF"><enum>(e)</enum><header>Remote pilot qualifications</header><paragraph id="H3F5AD38FE5D543EEA08CA8FE3762BD6D"><enum>(1)</enum><header>In general</header><text>In carrying out subsection (b)(1)(C), the Administrator shall establish qualifications and standards, or a means to accept proposed qualifications and standards, for remote pilots operating unmanned aircraft systems.</text></paragraph><paragraph id="H33F28EEDCCEF4D7083F7EA73759F3D45"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In carrying out subsection (e)(1), the Administrator shall account for the varying levels of automation of unmanned aircraft systems.</text></paragraph><paragraph id="HB57EE1A5ECA746AFBE2FA44E889B1D8B"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to allow for the establishment of type-ratings that apply specifically and exclusively to an aircraft manufactured by 1 manufacturer.</text></paragraph></subsection><subsection id="H17E4E6CDC21244A7B71E8CE525155E9B" commented="no"><enum>(f)</enum><header>Interim approvals</header><text display-inline="yes-display-inline">Before the date on which the Administrator issues a final rule under this section, the Administrator shall use the process described in section 44807 of title 49, United States Code, to authorize unmanned aircraft system operations conducted beyond visual line of sight.</text></subsection><subsection id="HF76FEEBDA70E44EF8A1C23BA7848FFE9"><enum>(g)</enum><header>Final rule</header><text display-inline="yes-display-inline">Not later than 16 months after the date of enactment of this Act, the Administrator shall issue a final rule establishing the regulations required under this section.</text></subsection><subsection id="H03C4415440C044BDAB32C88A55AE1FAB"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC5B27CFCD058408592EEBB04736E5269"><enum>(1)</enum><header>Associated elements</header><text display-inline="yes-display-inline">The term <term>associated elements</term> means any component of an unmanned aircraft system, not permanently affixed to the unmanned aircraft, required for the remote pilot to operate such aircraft safely and efficiently in the national airspace system.</text></paragraph><paragraph id="H125871F807E544E5A100AAAC752837C5"><enum>(2)</enum><header>Beyond visual line of sight</header><text display-inline="yes-display-inline">The term <term>beyond visual line of sight</term> means a distance at which the remote pilot in command of an unmanned aircraft system cannot see the unmanned aircraft with vision unaided by any device other than corrective lenses.</text></paragraph><paragraph id="H6F922D59A2934417A34FB1723DE09D36"><enum>(3)</enum><header>Unmanned aircraft; unmanned aircraft system</header><text>The terms <term>unmanned aircraft</term> and <term>unmanned aircraft system</term> have the meaning given such terms in section 44801 of title 49, United States Code.</text></paragraph></subsection></section><section id="H36AC33AF6A9047A99E299DF44BBA218F" section-type="subsequent-section" commented="no"><enum>2.</enum><header>Special authority for unmanned aircraft systems</header><text display-inline="no-display-inline">Section 44807 of title 49, United States Code, is amended—</text><paragraph id="H41EB8CFB23EC41C094CD09AD6A65DC3C" commented="no"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H4E605351111C46A1AE1C029994BB445C" commented="no"><enum>(A)</enum><text>by inserting <quote>or chapter 447</quote> after <quote>this chapter</quote>;</text></subparagraph><subparagraph id="HDBB1A0F9B3E249A985CDCBC310DED513" commented="no"><enum>(B)</enum><text>by striking <quote>the Secretary of Transportation</quote> and inserting <quote>the Administrator of the Federal Aviation Administration</quote>; and</text></subparagraph><subparagraph id="HDF5953B2CF2447C28E4EC7D992358E8C" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>if certain</quote> and inserting <quote>how</quote>;</text></subparagraph></paragraph><paragraph id="H536860DE5A3C4E1699C4B3F7F217FF4A" commented="no"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HE57F9B57CBD241C9885F52BF66E7B811" commented="no"><enum>(A)</enum><text>by striking <quote>the Secretary</quote> and inserting <quote>the Administrator</quote>; and </text></subparagraph><subparagraph id="H18EC47FA7D5042E88BD7D702939C5953" commented="no"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H545A4E69DBF34E73815E0BDBE1CF8860" display-inline="no-display-inline" commented="no"><enum>(i)</enum><text>by striking <quote>which types of unmanned aircraft systems, if any, as a result of their size</quote> and inserting <quote>how the unmanned aircraft, as a result of such aircraft’s size</quote>; and </text></clause><clause id="HEE183F56D49646E0802FF8038FD9A3C3" commented="no"><enum>(ii)</enum><text>by striking <quote>do not create</quote> and inserting <quote>does not create</quote>;</text></clause></subparagraph></paragraph><paragraph id="H02B313B7C6E84DEFB21AE896EC0DFBB7" commented="no"><enum>(3)</enum><text>in subsection (c) to read as follows:</text><quoted-block style="USC" id="H21BC4DB79F614AADA0E4E5168DEC88AF" display-inline="no-display-inline"><subsection id="H0E4C311DB3C44F3C9938249C062BF72F" commented="no"><enum>(c)</enum><header>Requirements for safe operation</header><paragraph id="H6E2312A1ECEB42CE95B3132B259C7CB1" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For unmanned aircraft systems that the Administrator determines under this section may operate safely in the national airspace system, the Administrator shall establish requirements, or a process to accept proposed requirements, for the safe operation of such aircraft systems in the national airspace system, including operation related to testing and evaluation of proprietary systems.</text></paragraph><paragraph id="H6AC856FF9D8840BCADC2CFE9EB147CE5" commented="no"><enum>(2)</enum><header>Treatment of mitigation measures</header><text display-inline="yes-display-inline">To the extent that a proposed operation will be conducted exclusively within the airspace of a Mode C Veil during the entirety of the operation, such operation shall be treated as satisfying the requirements of section 91.113(b) of title 14, Code of Federal Regulations, so long as the operation employs—</text><subparagraph id="H7A9C67208B2A4F7193BC445F9C438240" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">ADS–B In-based detect and avoid capabilities;</text></subparagraph><subparagraph id="H8EC8CDE13A234FCE8B7E0FDC7CD84E75" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">air traffic control communication and coordination; and</text></subparagraph><subparagraph id="HE3FF723A34B84F9894B8459AC0A2EB3C" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">aeronautical information management systems to notify other aircraft operators of such operations.</text></subparagraph></paragraph><paragraph id="H004D8943385D42D1B9BA581B10D015D8" commented="no"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to give an unmanned aircraft operating pursuant to this section the right of way over a manned aircraft.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HF1F597D6017E4DBDA5012296D88BDB9E" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (d) by striking <quote>2023</quote> and inserting <quote>2033</quote>; and</text></paragraph><paragraph id="HD20E5AFAD9D34768BEF209AE11DF2592"><enum>(5)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H83EA8A7438A54CB380B2ADF3356E9239" display-inline="no-display-inline"><subsection id="H6710E3BE20984934BD3510D4DADC2E3B"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">In making determinations under this section, the Administrator may not consider unmanned aircraft systems to the extent that such systems may meet the requirements of established regulations applicable to the proposed operation of a system.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
