<section id="H5317F032A02D46908373D1F7753F4BA6" section-type="section-one"><enum>1.</enum><header>Environmental review relating to unmanned aircraft systems</header> 
<subsection id="H3E5A3BF3CD744A2CA44971676719D3A3"><enum>(a)</enum><header>Guidance updates</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall publish unmanned aircraft system-specific guidance and implementation procedures. Such guidance and implementation procedures shall—</text> <paragraph id="HE98B197DDA4E491FAF6B89D664F0CAC9"><enum>(1)</enum><text>provide guidance to streamline environmental assessments at a programmatic level, as the Administrator considers appropriate, for an unmanned aircraft system operator’s network of operations within a defined geographical region, including within and over approved commercial or industrial sites closed or restricted to the public;</text></paragraph> 
<paragraph id="H23A6E75C277B47D59DAB4D1991EC20B8"><enum>(2)</enum><text>provide guidance for nationwide programmatic approaches for large scale distributed unmanned aircraft system operations whereby a Programmatic Environmental Assessment or Environmental Impact Statement can be leveraged for subsequent related actions to ensure efficient environmental review;</text></paragraph> <paragraph id="HF4CF792AD77844CCA994B432B7E28318"><enum>(3)</enum><text>consider additional Categorical Exclusions based on previously prepared and finalized Environmental Assessments or in consultation with the Council on Environmental Quality;</text></paragraph> 
<paragraph id="H214D71504B984D34B3266A8C07DDF101"><enum>(4)</enum><text>prioritize proposed projects or activities that can be shown to—</text> <subparagraph id="H389E6FD7063746639679AB127B272E33"><enum>(A)</enum><text>offset or limit the impacts of non-zero emission activities;</text></subparagraph> 
<subparagraph id="H69A441CB87DD46F89CF9F4C254515583"><enum>(B)</enum><text>offset or limit the release of environmental pollutants to soil or water; or</text></subparagraph> <subparagraph id="HC55696C50A3A454B90E697BEB0FB99D7"><enum>(C)</enum><text>contain other factors to the benefit of the environment as determined by the Administrator;</text></subparagraph></paragraph> 
<paragraph id="H9A9011AD51E84B17AB9396BDA4CEA9CE"><enum>(5)</enum><text>contain intra-agency process improvements to avoid providing conflicting safety and environmental feedback to operators;</text></paragraph> <paragraph id="HBC1B9C4042164961861A314B2BABCA11"><enum>(6)</enum><text display-inline="yes-display-inline">contain standards and criteria for engaging specialized third parties to support the Administration’s preparation and review of documentation relating to the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) to ensure streamlined timelines for complex reviews; and</text></paragraph> 
<paragraph id="HB81419EF109C40349707D2DABDA2D765"><enum>(7)</enum><text display-inline="yes-display-inline">any other modifications the Administrator considers necessary within the stated environmental objectives of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and the Federal priority to maintain global leadership in aviation innovation.</text></paragraph></subsection> <subsection id="HC6B3A5C331484ED5B38FB137B33B22FB"><enum>(b)</enum><header>Briefing</header><text display-inline="yes-display-inline">No later than 90 days after the date of enactment of this Act, the Administrator shall brief the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the plan of the Administration to implement subsection (b), including each of the considerations specified in the subsection, and an explanation for any consideration the Administrator does not intend to implement.</text></subsection> 
<subsection id="HFFE5C2CB19594F51B7A12D84995E7541"><enum>(c)</enum><header>Concurrent reviews</header><text>If the Administrator determines that the review of an unmanned aircraft system’s design, construction, maintenance and operational sustainability, airworthiness approval, or operational approval requires environmental assessment, including requirements under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Administrator shall, to the maximum extent practicable, conduct such reviews and analyses concurrent with one another.</text></subsection> <subsection id="HCA18295CF37E4D2DB4A5995F8B026324"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as prohibiting, restricting or otherwise limiting the authority of the Secretary of Transportation or the Administrator from implementing or complying with the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and any related requirements to ensure the protection of the environment and aviation safety.</text></subsection> 
<subsection id="H307919051275485E9F727FB45D4B2730"><enum>(e)</enum><header>Associated UAS certification standards</header> 
<paragraph id="H40066CC7FAC74D16B88F15CB213696E6"><enum>(1)</enum><header>In general</header><text>The Administrator shall develop and establish substantive criteria and standards metrics used by the Administrator to determine whether to approve or disapprove the airworthiness of an unmanned aircraft pursuant to part 36 of title 14, Code of Federal Regulations.</text></paragraph> <paragraph id="HEF199D222A17492DAEE4E5F428CD85B2"><enum>(2)</enum><header>Substantive criteria and standards metrics</header><text>In establishing the substantive criteria and standards metrics as required under paragraph (1), the Administrator shall include such criteria and metrics related to the airworthiness of unmanned aircraft for the following:</text> 
<subparagraph id="H4287810BCE9F42B39594B9727E5D3985"><enum>(A)</enum><text>Noise impacts.</text></subparagraph> <subparagraph id="HDEB98B68D8E7472D90FD149D57855474"><enum>(B)</enum><text>Visual impacts.</text></subparagraph></paragraph> 
<paragraph id="H83B4F2DC208445569131EE1E2F08E362"><enum>(3)</enum><header>Publication</header><text>The Administrator shall publish in the Federal Register and post on a website of the Federal Aviation Administration the criteria and metrics established pursuant to paragraph (1).</text></paragraph></subsection> <subsection id="H5A8032B9EADD4E2D84D635D662BA0523" commented="no"><enum>(f)</enum><header>Definition of unmanned aircraft system</header><text>In this section, the term <term>unmanned aircraft system</term> has the meaning given such term in section 44801 of title 49, United States Code.</text> </subsection></section>
