which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Increasing Land, Capital, and Market Access Program within the Farm Service Agency Office of Outreach and Education.</official-title></form><legis-body id="H69B9A6E25E584747B420AE2C5D8144F7" style="OLC"><section id="H4838AAA318BF464BA93301E7E4FF9D42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Land Access, Security, and Opportunities Act</short-title></quote>.</text></section><section id="H3B5337FDD6BA4B9790310B84FB1DC3F2" commented="no" display-inline="no-display-inline"><enum>2.</enum><header>Increasing Land, Capital, and Market Access Program</header><subsection id="HB324165168DF41F3B90A11D422C1D4C3" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph id="H09911EDA485F4EBFB0D3582BDFB41412" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Covered project</header><text>The term <term>covered project</term> means a project described in subsection (e).</text></paragraph><paragraph id="H937B586C02184C5E905BA5B7B7632A80" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entity</header><subparagraph id="HA1CEAB40ABBA4A749D67C30394F97A09" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><clause id="H6C9AB8F61E7D4AE298C2D7C658F7CF21"><enum>(i)</enum><text>a State, local, or territorial government;</text></clause><clause id="H127CF70143DB461F92AFF51E2BFC5785"><enum>(ii)</enum><text display-inline="yes-display-inline">Indian Tribes and Tribal organizations, as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>);</text></clause><clause id="HD4302BDB795C46DF80B45708F73D44C1"><enum>(iii)</enum><text display-inline="yes-display-inline">a Native community development financial institution certified by the Secretary of the Treasury;</text></clause><clause id="H96FADF974FB84DC59787A88BC6DB905E"><enum>(iv)</enum><text display-inline="yes-display-inline">a community development financial institution (as defined in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>)) certified by the Secretary of the Treasury, acting through the Community Development Financial Institutions Fund;</text></clause><clause id="H9FC284D09F29466E8F0CA47A29304D84"><enum>(v)</enum><text display-inline="yes-display-inline">an organization described in paragraph (2) or (3) of <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code;</text></clause><clause id="H84C25A0837BE4A8FA000897106F73C5A"><enum>(vi)</enum><text>a foundation;</text></clause><clause id="HD75B6501401B4B9CB7A84D9FA1A3C408"><enum>(vii)</enum><text display-inline="yes-display-inline">a cooperative entity;</text></clause><clause id="H498E619EA03543E8A39C24052F09BE0B"><enum>(viii)</enum><text display-inline="yes-display-inline">an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); and</text></clause><clause id="H09792FDD86104C55A66F92007083A0A7"><enum>(ix)</enum><text display-inline="yes-display-inline">any other appropriate partner, as determined by the Secretary.</text></clause></subparagraph><subparagraph id="HD796AAA98C0B4A56BC8968CE2B48406A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> does not include a corporation foreign-based or foreign-owned.</text></subparagraph></paragraph><paragraph id="H8589FC376A2E4B67B4592CC10EF7D504"><enum>(3)</enum><header>Eligible land</header><subparagraph id="HAA50587DD5594FA98F134D2C2F7FB403" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible land</term> means—</text><clause id="H1DD26AC0958A4B278B1D3D9AB5A89469"><enum>(i)</enum><text>agricultural land;</text></clause><clause id="HB3E86073B4F14127A22F29B992D7883C"><enum>(ii)</enum><text>private land;</text></clause><clause id="HD2A0875522EE4D0284B16762E267ED62"><enum>(iii)</enum><text>urban land;</text></clause><clause id="H83D6647B3CCD4D80A1F912F724AC60DA"><enum>(iv)</enum><text>public land, including Federal, State, and municipally owned or managed land;</text></clause><clause id="HCB36E2E984A849DEBA94CDF523280FEE"><enum>(v)</enum><text display-inline="yes-display-inline">lands held in common that are controlled and managed by groups of individuals;</text></clause><clause id="H1AA305F6458F4C91B0D7A8B6AF342D00"><enum>(vi)</enum><text>lands held in trust;</text></clause><clause id="H2E849668DD3A40448C61D01C7535F9D3"><enum>(vii)</enum><text>multiple parcels of land described in any of clauses (i) through (v) that are noncontiguous; and</text></clause><clause id="H73C4ACA155F042869F1DFADC6A4A19DC"><enum>(viii)</enum><text>public or private shoreline or intertidal zone areas, which may be wholly or partially underwater.</text></clause></subparagraph><subparagraph id="HD3612A4869EB42ECBDF7692A71874F4B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Exclusion</header><text>The term <term>eligible land</term> does not include parcels of land described in subparagraph (A) that are fully forested. </text></subparagraph></paragraph><paragraph id="HB9A639068C304BD597346F2EC13A0D7A"><enum>(4)</enum><header>Intended beneficiaries</header><text>The term <term>intended beneficiaries</term> means—</text><subparagraph id="H6012D74D94554D61BD19AED3449A62F2"><enum>(A)</enum><text display-inline="yes-display-inline">historically underserved farmers, ranchers, and forest owners; and</text></subparagraph><subparagraph id="HE3A428FAD22E4EA3BE2F474C388F9063"><enum>(B)</enum><text>farmers, ranchers, and forest owners operating in high-poverty areas.</text></subparagraph></paragraph><paragraph id="H94BC3F73F079458F812E38D0B9D209A9"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the Increasing Land, Capital, and Market Access Program established under subsection (b).</text></paragraph><paragraph id="H7BE7722553354AD495B245D531CFCC85"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture. </text></paragraph></subsection><subsection id="HD8D3AE19A1024AC1BE1D4CED76561295"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a competitive program to be known as the <quote>Increasing Land, Capital, and Market Access Program</quote> within the Farm Service Agency to make grants, enter into cooperative agreements, or provide other capital support to eligible entities to carry out covered projects in accordance with subsection (e).</text></subsection><subsection id="H9FF912B6CCAE4E07923400B2AE221529"><enum>(c)</enum><header>Purpose</header><text>The purpose of the program is—</text><paragraph id="H03C88DA8FD0E4EA3B2F13B73BAE85855"><enum>(1)</enum><text>to strengthen land, capital, and market access for the intended beneficiaries, with the majority of funds directly reaching the intended beneficiaries; and</text></paragraph><paragraph id="HBF3D46B6CE824388AF8D601A42574837"><enum>(2)</enum><text>support projects designed to—</text><subparagraph id="H7CC9C4CC71E6479FBE16DFEB534A0857"><enum>(A)</enum><text>increase land access;</text></subparagraph><subparagraph id="H996EF00D2BE6492BA95D2D0F0BA0DE63"><enum>(B)</enum><text>prevent land loss;</text></subparagraph><subparagraph id="H0DA7B733E4A641BE8627F38F52BC457A"><enum>(C)</enum><text>establish innovative ways to connect available land to intended beneficiaries;</text></subparagraph><subparagraph id="H03A4A5C664BF41B59A2ED8A7DDEBF5DF"><enum>(D)</enum><text>transition farmland from existing landowners to the next generation;</text></subparagraph><subparagraph id="H79D7BF3ED5444037843B31413D48D320"><enum>(E)</enum><text>restore lands into the hands of those who have been underserved;</text></subparagraph><subparagraph id="H773E8127D69041689BDC78A739D002EE"><enum>(F)</enum><text>support farm establishment and long-term viability; and</text></subparagraph><subparagraph id="HC5AD2DA53A024B55AC1B747F837876F9"><enum>(G)</enum><text>provide appropriate technical assistance related to land, capital, or market access.</text></subparagraph></paragraph></subsection><subsection id="H5AE2EF25EBFD4F04ADE5478C07DC4F63"><enum>(d)</enum><header>Selection</header><paragraph id="HC3B10F38C3804DA49A4D46E2686229D1" display-inline="no-display-inline"><enum>(1)</enum><header>Application requirements</header><text display-inline="yes-display-inline">To be eligible to receive a grant or other capital support or enter into a cooperative agreement under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text><subparagraph id="HE76C57BEA6F243D085DD75A9BCB35254"><enum>(A)</enum><text>information demonstrating that the covered project the eligible entity seeks to carry out is designed to—</text><clause id="HBB37C872E48548A0BF255195EF873CE0"><enum>(i)</enum><text>serve the intended beneficiaries;</text></clause><clause id="H18FEB86FAD754F15967702AAB441A109"><enum>(ii)</enum><text>meet the program purpose; </text></clause></subparagraph><subparagraph id="H26CD43DFAFB34858AAC29D656102D79C"><enum>(B)</enum><text>a description of how project activities will support overall farm viability;</text></subparagraph><subparagraph id="H78CE975FF8D3486F8E7AD4D07CFCE3D8"><enum>(C)</enum><text>a description of how project activities will support farmer behavioral and mental health; </text></subparagraph><subparagraph id="H54924D3C5F3C4149A0F15EFE0177A0A4"><enum>(D)</enum><text>a plan for notification and consultation with local Tribal governments for future sale of land, if applicable;</text></subparagraph><subparagraph id="H3E06FA33C53D4DB6BFADB6F11405FA30"><enum>(E)</enum><text>an analysis of anticipated benefits to the community and the agricultural economy within the project area; and</text></subparagraph><subparagraph id="H664180B75BC140CE864D58DF188218AA"><enum>(F)</enum><text>a plan for evaluation, data management, communication, and reporting of project findings and results.</text></subparagraph></paragraph><paragraph id="H9C44958048EF4751A3C4E967405CBBE1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Evaluation of applications</header><subparagraph id="HFFA41CC7D5134298AB32020A840F6440"><enum>(A)</enum><header>Evaluation process</header><text>The Secretary shall develop a process for evaluating proposals and distributing funds in collaboration with a stakeholder committee, which the Secretary shall establish and convene not later than 6 months after the date of the enactment of this Act.</text></subparagraph><subparagraph id="HE6E1EC02925443308F546571B49FC032"><enum>(B)</enum><header>Consideration</header><text>In developing the process under subparagraph (A), the Secretary shall consider perspectives from diverse stakeholders, diverse geographic distribution, and diverse farming models, practices, and purposes.</text></subparagraph></paragraph><paragraph id="HC2A1303360F04F9598FF01D2065BB218"><enum>(3)</enum><header>Priority</header><text>In carrying out this section, the Secretary shall give priority to covered projects that—</text><subparagraph id="HD586B5D5DB724FDF8095D0E4157F8530"><enum>(A)</enum><text>provide direct financial assistance to intended beneficiaries;</text></subparagraph><subparagraph id="HC0EB75977D544A549BDAC3BD2F6A4735"><enum>(B)</enum><text>involve a substantial and effective collaborative network or partnership of public or private entities;</text></subparagraph><subparagraph id="HDA7FA391DAD545479EE7EA23EF7E2D9D"><enum>(C)</enum><text>increase access to municipal, State, and federally owned or managed land;</text></subparagraph><subparagraph id="H759CCD8E140443CBBEDD88D5C706CE4B"><enum>(D)</enum><text>include a right of first refusal for Tribal citizens or governments when land becomes available on or near Tribal communities;</text></subparagraph><subparagraph id="H82A699DA419448349232B68F7A4DF293"><enum>(E)</enum><text>involve mechanisms, such as a deed restriction or conservation easement, that restrict the resale value of eligible land to protect the land for agricultural use;</text></subparagraph><subparagraph id="HF9E85FF7A9C44E29B1DA00EFAFF41508"><enum>(F)</enum><text>support the transition of agricultural land from existing producers to the next generation;</text></subparagraph><subparagraph id="H80598BBC1A2C4BF184BDAB0CAC3E3771"><enum>(G)</enum><text>include assistance to non-English speaking intended beneficiaries in their own language;</text></subparagraph><subparagraph id="HC743DA4C795E45349A703AC8CC5E20F0"><enum>(H)</enum><text>include activities under subsection (e) designed to support farmworkers; and</text></subparagraph><subparagraph id="H44760086E55A4FDEA76078911EE592DE"><enum>(I)</enum><text>support best-practices, as determined by the Secretary, for long-term adoption of consistent, science-based, site-specific practices designed to achieve conservation objectives.</text></subparagraph></paragraph></subsection><subsection id="HCF0418FDFB6749B986ED2365289A6041"><enum>(e)</enum><header>Covered projects</header><paragraph id="H4949D54448664C52933EA3B693A974A6"><enum>(1)</enum><header>Required use of funds</header><text>An eligible entity that carries out a covered project shall provide direct assistance to intended beneficiaries in order to facilitate access to land, capital, and markets, which may include payments to—</text><subparagraph id="H7831F4001F95452DA2834990A410848B"><enum>(A)</enum><text>acquire real property (including air rights, water rights, and other interests therein), including closing costs;</text></subparagraph><subparagraph id="HF489855C7EE4429DA9C56E2BA247EDAF"><enum>(B)</enum><text>subsidize interest rates and mortgage principal amounts for intended beneficiaries;</text></subparagraph><subparagraph id="HA0905B1846B1481492D838007443237E"><enum>(C)</enum><text>provide down payment assistance to decrease farm mortgages;</text></subparagraph><subparagraph id="H2ECF40E81AEA49C8BFE56BFD37EF5A9E"><enum>(D)</enum><text>secure clear title on heirs’ property farmland;</text></subparagraph><subparagraph id="H54E6EE4D34AF4958805C45BA71771FDD" display-inline="no-display-inline"><enum>(E)</enum><text>conduct surveys and assessments of agricultural land;</text></subparagraph><subparagraph id="HDBD13A52956A475DA7ED0CD935B0E276"><enum>(F)</enum><text>improve or remediate land, water, and soil;</text></subparagraph><subparagraph id="H5B35D245001C455A9D7B8501A6FCD325"><enum>(G)</enum><text>construct or repair infrastructure;</text></subparagraph><subparagraph id="H2C9A090EBFF04FA692416AF5FFEB4D5B"><enum>(H)</enum><text>support land use planning;</text></subparagraph><subparagraph id="H45BD016FE785432AAA469A6F1CDFCDC4"><enum>(I)</enum><text>acquire legal or financial planning assistance;</text></subparagraph><subparagraph id="HCCC9DA65EFB64C5486468EE2D895DF3E"><enum>(J)</enum><text>carry out Tribal consultation;</text></subparagraph><subparagraph id="H3D2EE75F99404FACBEA31B43AC9DE5B4"><enum>(K)</enum><text>support acquisition of a Department of Agriculture farm number; and</text></subparagraph><subparagraph id="HAC7BA838C92440EA8E3FA73FF86BD803"><enum>(L)</enum><text>any other activities as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="HEF880418DC1840DD951A538EDB5F4327"><enum>(2)</enum><header>Permissible activities</header><text>An eligible entity that receives a grant under this section may use the grant funds—</text><subparagraph id="H42CC9752E561408A8D02FC70EDC59034"><enum>(A)</enum><text>for activities associated with increasing access to markets and capital;</text></subparagraph><subparagraph id="H7147D72FA80449B6B00E206A5D836A38"><enum>(B)</enum><text>to provide direct assistance to intended beneficiaries in assessing, purchasing, acquiring, or retaining, eligible land;</text></subparagraph><subparagraph id="H041050CAFA96478E8B1F90F7302AD353"><enum>(C)</enum><text>for activities designed to support farm establishment and long-term viability;</text></subparagraph><subparagraph id="H5E446042984F404F92EE953B3120C1E8"><enum>(D)</enum><text>to establish a revolving loan fund or other innovative financial mechanism designed for the purpose of increasing land, capital, and market access for intended beneficiaries beyond the initial project timeline; and</text></subparagraph><subparagraph id="H806AC3DE0AF9448594637098DCED126F"><enum>(E)</enum><text>to provide technical assistance that meets the specific needs of, and is accessible to, the intended beneficiaries, and is related to increasing land, capital, or market access including—</text><clause id="HD290709E7FBD4D00815D86CCF96D61AF"><enum>(i)</enum><text>providing services to non-English speaking producers in their own language;</text></clause><clause id="H12D8335AE8FA4BD3B533B37A33ACC5AE"><enum>(ii)</enum><text>developing and carrying out strategies to identify unique needs and gaps in access, knowledge, and services; and</text></clause><clause id="H8C6F2E0A8C7E4628A73216400878E5B9"><enum>(iii)</enum><text>specialized consultation, training, coaching, capacity building, and mentoring focused on—</text><subclause id="HD2C288E151BF4C33BA0FD40A267A8B3F"><enum>(I)</enum><text>accessing and purchasing farmland;</text></subclause><subclause id="H53FC6C9EB7FE44D6AD455702AFD936BF"><enum>(II)</enum><text>understanding Department of Agriculture programs;</text></subclause><subclause id="HC63AF56BCCBC4FDDB18619F735E2F7DB"><enum>(III)</enum><text>succession planning;</text></subclause><subclause id="HB1CB97825CD54E8E832F4F33FBFD0356"><enum>(IV)</enum><text>market planning and risk analysis;</text></subclause><subclause id="H05E98F64C638413BA2AB953DC030B14B"><enum>(V)</enum><text>cooperative development;</text></subclause><subclause id="H2EBE64BE9E0049E5B32125AAC57B0811"><enum>(VI)</enum><text>legal and tax issues;</text></subclause><subclause id="HCE0307837A3E4E9DAB3738E530B3D71D"><enum>(VII)</enum><text>developing business plans and feasibility studies; </text></subclause><subclause id="HFCB064F83B1C43818AD25079802AB54A"><enum>(VIII)</enum><text>financial planning and recordkeeping;</text></subclause><subclause id="H5F97453482AB48D9AB5E259A70618A48"><enum>(IX)</enum><text>enterprise, business, and labor management; and</text></subclause><subclause id="HCF0ED8A30EED44958BC9D35F4B5A394A"><enum>(X)</enum><text>any other activities as determined by the Secretary.</text></subclause></clause></subparagraph></paragraph><paragraph id="H5F88AA51E5074CCD9B9FE23D750BE61A"><enum>(3)</enum><header>Subcontract</header><text>An eligible entity may subcontract with an organization to carry out an activity under paragraph (1) or (2) if the services of such subcontractor are necessary to carry out such activity. </text></paragraph><paragraph id="HFE513AA7CB20485087A5DF98A76F99E2"><enum>(4)</enum><header>Funding mechanism</header><subparagraph id="H16AD615958FB4EFB9A71D3CCD8289644"><enum>(A)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">The Secretary shall make funding available under this section to eligible entities through—</text><clause id="H565CA2559C774DDF992495ACBE8B1F6F"><enum>(i)</enum><text>grants; </text></clause><clause id="HF4472490B0EE49F2AE1D45E047353E9D"><enum>(ii)</enum><text>cooperative agreements; </text></clause><clause id="H66974378AAE442FE892A457079AB9F24"><enum>(iii)</enum><text>loan capital to finance activities under subsection (e)(2)(D); or</text></clause><clause id="HB715BC44EABD47B5A6212E6E070773E7"><enum>(iv)</enum><text>other means, as determined by the Secretary. </text></clause></subparagraph><subparagraph id="H3161519ED2214E4BBB7768C027EDB68E"><enum>(B)</enum><header>Intended beneficiaries</header><text>In carrying out covered projects, eligible entities shall provide direct assistance to intended beneficiaries through—</text><clause id="H8012773ED9EA431C8566017281A9A042"><enum>(i)</enum><text display-inline="yes-display-inline">grants;</text></clause><clause id="H1C9DDCE14E704244916ED06065D4AF28"><enum>(ii)</enum><text>loans (both long-term and interim); or</text></clause><clause id="H73C090E4B28A4EEB9C0763136D3D1BF8"><enum>(iii)</enum><text>other direct payments or assistance, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="H3A0B90329D8C431E9303B7D3A721A7ED"><enum>(5)</enum><header>Repayment of grant funds in case of noncompliance</header><text>An eligible entity that receives funding pursuant to this Act that violates the terms or conditions of such funding shall reimburse the Secretary of Agriculture for such funds. </text></paragraph></subsection><subsection id="H53A9F6025C604E7587BDFAF30E80711A"><enum>(f)</enum><header>Funding</header><paragraph id="H477602F109184CBDAAFEB1DBB6E59D88"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each fiscal years 2024 through 2028.</text></paragraph><paragraph id="H83E6F4F4DF8C46B293EBC20D9D6511BE"><enum>(2)</enum><header>Administration</header><text>Of the amounts made available and authorized by this section, the Secretary shall allocate necessary funding for implementation of this section and administration of the Land, Capital, and Market Access Program. </text></paragraph><paragraph id="H9A37949ED6DB49BEAC9C30846FE7B8A0"><enum>(3)</enum><header>Distribution of funds</header><subparagraph id="H4D88F42D135941DFA3FE6AB7AFB2843F"><enum>(A)</enum><header>Limitation</header><text display-inline="yes-display-inline">Project funds shall be allocated for eligible activities by eligible entities within 5 years of dispersal unless otherwise indicated by the Secretary.</text></subparagraph><subparagraph id="HA69352F1DCB8420C83E6FE738D3F64BD"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">Funds distributed under the program shall not be subject to section 200.311 of title 2, Code of Federal Regulations, in cases where eligible entities use such funds to increase secure land access opportunities for the intended beneficiaries after the 5-year period described in subparagraph (B).</text></subparagraph><subparagraph id="H0D434E7F4DBA41CF8C7C55DD7FD367B4"><enum>(C)</enum><header>Maximum award</header><text display-inline="yes-display-inline">The maximum award for any eligible entity per fiscal year shall be not more than 15 percent of funds made available for such fiscal year.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
