which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish in the Department of Agriculture an Office of Aquaculture, and for other purposes.</official-title></form><legis-body id="H2B8B55E97BF3472EB9D50080ED8B3B56" style="OLC"><section id="HB757AD94C2E247EAB83BAA1D5B700A4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustaining Healthy Ecosystems, Livelihoods, and Local Seafood Act</short-title></quote> or the <quote>SHELLS Act</quote>.</text></section><section id="H871B974D69F84A368B164DA5CC22C734"><enum>2.</enum><header>Office of Aquaculture</header><subsection commented="no" display-inline="no-display-inline" id="HC2EE4CCE3793409EBA71918BCE0C9CA2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle A of the Department of Agriculture Reorganization Act of 1994 is amended by inserting after section 216 (<external-xref legal-doc="usc" parsable-cite="usc/7/6916">7 U.S.C. 6916</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H34BD793E5E9A43878292E0663A4B7465"><section id="HF12AF0A0E1884BB0B0BD76C5E0695718"><enum>217.</enum><header>Office of Aquaculture</header><subsection id="HC7929C3E8646463596A8B3F66D46DBB8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H2690CBD15E1248BB9B2149D5C7263E63"><enum>(1)</enum><header>Aquaculture</header><text display-inline="yes-display-inline">The term <term>aquaculture</term> has the meaning given that term in section 3 of the National Aquaculture Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/16/2802">16 U.S.C. 2802</external-xref>).</text></paragraph><paragraph id="HF923B715A999435FA9207E09F935E1E3"><enum>(2)</enum><header>Committee</header><text display-inline="yes-display-inline">The term <term>Committee</term> means the Aquaculture Advisory Committee established under subsection (c)(1).</text></paragraph><paragraph id="H915ACAE9425F4B25BDACCE9C4011B4AF"><enum>(3)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office appointed under subsection (b)(2).</text></paragraph><paragraph id="HAC4A1E5054DC46ADA6B42F086C181E4D"><enum>(4)</enum><header>Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the Office of Aquaculture established under subsection (b)(1).</text></paragraph></subsection><subsection id="H8756ED2AE0F949CABFF98368EF986FD7"><enum>(b)</enum><header>Office</header><paragraph id="H0B81C45337E4493CAE36B25B2AB9B72D"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish in the Department an Office of Aquaculture.</text></paragraph><paragraph id="H7DCC08BA453649B987A10E1E52BA471A"><enum>(2)</enum><header>Director</header><text>The Secretary shall appoint a senior official to serve as the Director of the Office.</text></paragraph><paragraph id="H4EC81C30C7E846369F70B17A2E743188"><enum>(3)</enum><header>Mission</header><text display-inline="yes-display-inline">The mission of the Office, in coordination with any other relevant Federal agency, shall be to encourage and promote aquaculture operations that promote United States food security and limit adverse environmental effects, including—</text><subparagraph id="HDAAF1A10963046E08F91D1FC23FA3948"><enum>(A)</enum><text>shellfish cultivation (including oysters, clams, and mussels);</text></subparagraph><subparagraph id="H4BCF8DCA628A485B847E6061B004DFD0"><enum>(B)</enum><text>micro- and macro-algae cultivation;</text></subparagraph><subparagraph id="H1FC8D9FBC92348F28504A007F728A927"><enum>(C)</enum><text display-inline="yes-display-inline">aquaculture production within land-based systems; and</text></subparagraph><subparagraph id="H68E21DA80B0B4C0CADB6B3EC674603FF"><enum>(D)</enum><text>other forms of aquaculture production, as determined by the Secretary, in consultation with the Secretary of Commerce and the heads of other Federal agencies, as applicable.</text></subparagraph></paragraph><paragraph id="H7896E6C0A9D84043BA1785D8AE685C7B"><enum>(4)</enum><header>Responsibilities</header><text>The Director shall be responsible for engaging in activities to carry out the mission of the Office described in paragraph (3), including by—</text><subparagraph id="H8729C53398B94429AA5CF573F54186B2"><enum>(A)</enum><text display-inline="yes-display-inline">overseeing programs of the Department to support the development and advancement of aquaculture best practices, using the best available science, in consultation with agricultural producers and industry partners;</text></subparagraph><subparagraph id="HB2ECC360D0CF439F8BC6453F53A906AD"><enum>(B)</enum><text>providing technical assistance on best practices to aquaculture farmers and businesses, including for shellfish, algae, and land-based aquaculture systems, using the best available science;</text></subparagraph><subparagraph id="H8743FFBD849E4BC39873830276744DF7"><enum>(C)</enum><text>advising the Secretary;</text></subparagraph><subparagraph id="HCFEC524627F1446C9F112F94D98F0250"><enum>(D)</enum><text>coordinating with the agencies and officials of the Department to update and ensure support for aquaculture in relevant programs;</text></subparagraph><subparagraph id="H605A7B2D52E943188EB09E530A4531C5"><enum>(E)</enum><text>engaging in stakeholder relations and developing external partnerships;</text></subparagraph><subparagraph id="H6C7D3D13EC5C4D16BE1D4953A513CABC"><enum>(F)</enum><text>identifying common State and municipal best practices for navigating local policies;</text></subparagraph><subparagraph id="H086543E2640A459EA5B4EE958F3D38CB"><enum>(G)</enum><text display-inline="yes-display-inline">oversight of extension and outreach efforts to support aquaculture producers and businesses;</text></subparagraph><subparagraph id="HBA40843EA96A479A9DFFBE838CD4CE3C"><enum>(H)</enum><text display-inline="yes-display-inline">collaborating and coordinating with other Federal agencies, including the National Oceanic and Atmospheric Administration, the United States Fish and Wildlife Service, the Office of Science and Technology Policy, and the Environmental Protection Agency;</text></subparagraph><subparagraph id="HC1B618FE3E6D4A8095164CAD567DBB48"><enum>(I)</enum><text>convening a working group with relevant officials of the Department to coordinate programs and share knowledge;</text></subparagraph><subparagraph id="H190C666B550D4C13B26546312D1B1CAC"><enum>(J)</enum><text display-inline="yes-display-inline">representing the Department on the Subcommittee on Aquaculture of the National Science and Technology Council;</text></subparagraph><subparagraph id="H9B5C5895E5CE41C7A0B2F2E7EA1962E2"><enum>(K)</enum><text display-inline="yes-display-inline">gathering and issuing aquaculture production data, in consultation with the Administrator of the National Oceanic and Atmospheric Administration;</text></subparagraph><subparagraph id="HE3B6DA9C22134C59B87E7776E277D7F6"><enum>(L)</enum><text display-inline="yes-display-inline">applying existing programs for risk mitigation as applicable to aquaculture, including insurance and purchasing programs; and</text></subparagraph><subparagraph id="H67A7B724986A4160A2FF5E3A68CC973E"><enum>(M)</enum><text>promoting aquaculture practices that provide environmental, economic, and social benefits.</text></subparagraph></paragraph></subsection><subsection id="HE7A0C80A1140473CAEDA93D7CDF5D803"><enum>(c)</enum><header>Aquaculture Advisory Committee</header><paragraph id="HFEFA2710D2304C16A2FC1E52FBC4674E"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Sustaining Healthy Ecosystems, Livelihoods, and Local Seafood Act</short-title>, the Secretary shall establish an Aquaculture Advisory Committee to advise the Secretary on—</text><subparagraph id="HE77A563D473E455688043E2F6CD7F19A"><enum>(A)</enum><text>oversight of programs of the Department to support development of, and to advance, aquaculture best practices using the best available science, in consultation with farmers and industry partners;</text></subparagraph><subparagraph id="H8619109941834C66B599BF0730C8240E"><enum>(B)</enum><text>the history, use and preservation of Indigenous and traditional aquaculture practices and ecological knowledge;</text></subparagraph><subparagraph id="HEA46C940697C4C608E2CC87E6DA3CAD8"><enum>(C)</enum><text>providing technical assistance to aquaculture farmers and businesses, including technical assistance that pertains to shellfish, algae, and land-based aquaculture systems, using the best available science; and</text></subparagraph><subparagraph id="HFF01603E4CB348A2ACEBFB2E8280FE76"><enum>(D)</enum><text>any other aspects of the implementation of this section.</text></subparagraph></paragraph><paragraph id="HE1B8E524555640F286AF597F690F37DD"><enum>(2)</enum><header>Membership</header><subparagraph id="H140E795677E54A92A4F50D3568BF3B45"><enum>(A)</enum><header>In general</header><text>The Committee shall be composed of 14 members, to be appointed by the Secretary, of whom—</text><clause commented="no" display-inline="no-display-inline" id="H37A470D9EFED4D8BA4969B14C2159123"><enum>(i)</enum><text display-inline="yes-display-inline">1 shall be a representative of the Department, who shall serve as chair of the Committee;</text></clause><clause id="HEE86A89884FE4FB6BA6899C0A006743B"><enum>(ii)</enum><text>4 shall be individuals who are aquaculture producers who employ best practices and limit adverse effects that result from the operations of the aquaculture producers;</text></clause><clause id="H2026BBF8F8C34F33A91E2DA8652F7B66"><enum>(iii)</enum><text>2 shall be representatives from an Indian Tribe or Tribal organization (as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) or from a Native Hawaiian organization (as such term is defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>));</text></clause><clause id="H28CBBEEDFFA746CBB5F320F770557FCE"><enum>(iv)</enum><text>1 shall be a representative from a State or interstate commission;</text></clause><clause id="H1FAA1A830C364A7083BBD30B4CB7A7F8"><enum>(v)</enum><text>1 shall be a representative from an institution of higher education or extension program;</text></clause><clause id="H3C74FFA505C74409B7E8A2EC6558C6AE"><enum>(vi)</enum><text>1 shall be an individual who represents a nonprofit organization, which may include a public health, environmental, or community organization;</text></clause><clause id="H702B7CA429074B6EB6526D9DFC882A4A"><enum>(vii)</enum><text>1 shall be an individual who represents a relevant port, coastal, or working waterfront community;</text></clause><clause id="H2F4C04808D6845CB8B385BDB3B87E104"><enum>(viii)</enum><text>1 shall be an individual with supply chain experience, which may include a food aggregator, wholesale food distributor, food hub, or an individual who has direct-to-consumer market experience;</text></clause><clause id="H496F322ADB2746A5815F303D25C6AA5F"><enum>(ix)</enum><text>1 shall be an individual with related experience or expertise in aquaculture production practices, as determined by the Secretary; and</text></clause><clause id="H252E3B99D1A1429CA8DC2C220FB54021"><enum>(x)</enum><text display-inline="yes-display-inline">1 shall be an individual who represents aquaculture end users, including a chef, member of the food service industry, or grocer.</text></clause></subparagraph><subparagraph id="H20AF28744EDC42AFA8F48D55C423664E"><enum>(B)</enum><header>Initial appointments</header><text>The Secretary shall appoint the members of the Committee not later than 180 days after the date of enactment of this section.</text></subparagraph></paragraph><paragraph id="HD867870126C1424FB34681E104666742"><enum>(3)</enum><header>Period of appointment; vacancies</header><subparagraph id="H49702283FBDF434094427816B60EE4DD"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a member of the Committee shall be appointed for a term of 3 years.</text></subparagraph><subparagraph id="HD94838BEB6BF469E9CC19EEA7E65BCE4"><enum>(B)</enum><header>Initial appointments</header><text>Of the members first appointed to the Committee—</text><clause id="H855BA30E3DEA4BBDA6340A7BC5EF7E85"><enum>(i)</enum><text>5 of the members, as determined by the Secretary, shall be appointed for a term of 3 years;</text></clause><clause id="H8D6FCCD33F8C4367B3DA54EC30B91824"><enum>(ii)</enum><text>5 of the members, as determined by the Secretary, shall be appointed for a term of 2 years; and</text></clause><clause id="H3942A8149BC84E1DACD57FFA6B059E71"><enum>(iii)</enum><text>4 of the members, as determined by the Secretary, shall be appointed for a term of 1 year.</text></clause></subparagraph><subparagraph id="H66D5E1674BED4DD089D819BFAB189A40"><enum>(C)</enum><header>Vacancies</header><text>Any vacancy in the Committee—</text><clause id="H78CA4D0BB1854407BC5C0E586B129599"><enum>(i)</enum><text>shall not affect the powers of the Committee; and</text></clause><clause id="H3AE4175C81E240C889B243692A078324"><enum>(ii)</enum><text>shall be filled as soon as practicable in the same manner as the original appointment.</text></clause></subparagraph><subparagraph id="H5F9394D9324344CC9FD806E0850AFC8E"><enum>(D)</enum><header>Consecutive terms</header><text>An initial appointee of the Committee may serve an additional consecutive term if the member is reappointed by the Secretary.</text></subparagraph></paragraph><paragraph id="H25B86BFE39CE4E69950D547B27A553E7"><enum>(4)</enum><header>Meetings</header><subparagraph id="H402EF16070E24CEFBDF26F63C741B715"><enum>(A)</enum><header>Frequency</header><text>The Committee shall meet not fewer than 3 times per year.</text></subparagraph><subparagraph id="HBF29C90F5C8F41C894568B63A9BFF42C"><enum>(B)</enum><header>Initial meeting</header><text>Not later than 180 days after the date on which the members are appointed under paragraph (2)(B), the Committee shall hold the first meeting of the Committee.</text></subparagraph></paragraph><paragraph id="H7D455C680FD744EC8C32B7D3E2A3920B"><enum>(5)</enum><header>Duties</header><subparagraph id="H572E7527B21C472EBA4F5BA3F429B692"><enum>(A)</enum><header>In general</header><text>The Committee shall—</text><clause id="HC4008C3FE9BF434BB21354F7D67A2C83"><enum>(i)</enum><text>develop recommendations and advise the Director on aquaculture policies, initiatives, and outreach administered by the Office;</text></clause><clause id="H56B2C44D271F4EA9AC05B856EEB55C8D"><enum>(ii)</enum><text>evaluate and review ongoing research and extension activities relating to aquaculture practices;</text></clause><clause id="H032DB10DA1294FD38A0E3EF6DED8D599"><enum>(iii)</enum><text>identify new and existing barriers to successful aquaculture practices; and</text></clause><clause id="HF351694E7C6F45CE8A01AAF84BE5A257"><enum>(iv)</enum><text>provide additional assistance and advice to the Director as appropriate.</text></clause></subparagraph><subparagraph id="HADE719A4D61244858F7CCCFBA4193BFA"><enum>(B)</enum><header>Reports</header><text>Not later than 1 year after the date on which the Committee is established, and every 2 years thereafter through 2028, the Committee shall submit to the Secretary, the Committee on Agriculture, Nutrition, and Forestry and the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Agriculture and the Committee on Natural Resources of the House of Representatives, a report describing the recommendations developed under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HD10F2B09710E488BAFE6DD8C1A34A13B"><enum>(6)</enum><header>Personnel matters</header><subparagraph id="HF4C68D241C6A408DBD40720F47839D58"><enum>(A)</enum><header>Compensation</header><text>A member of the Committee shall serve without compensation.</text></subparagraph><subparagraph id="H70D5E47724954DA08341E9B58EF2220D"><enum>(B)</enum><header>Travel expenses</header><text>A member of the Committee shall be allowed travel expenses, including per diem in lieu of subsistence, in accordance with section 5703 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="H37D16D0839664F6EA2233D8A70EE01DE"><enum>(7)</enum><header>Termination</header><subparagraph id="HC882E47901694DD08BB163C226C5A517"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Committee shall terminate on the date that is 5 years after the date on which the members are appointed under paragraph (2)(B).</text></subparagraph><subparagraph id="H3586E6A63A8D4238AD094ABBA34E1AD8"><enum>(B)</enum><header>Extensions</header><text>Before the date on which the Committee terminates, the Secretary may renew the Committee for 1 or more 2-year periods.</text></subparagraph></paragraph></subsection><subsection id="HF32498F71EC9428B8279AF6C215718B6"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2024 through 2028.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB960BD49E7274AEBB739693C64ED7078"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="H01777998DBBE42C6AA02C12E2837025B"><enum>(1)</enum><text display-inline="yes-display-inline">The Department of Agriculture Reorganization Act of 1994 is amended by redesignating the first section 225 (<external-xref legal-doc="usc" parsable-cite="usc/7/6925">7 U.S.C. 6925</external-xref>) (relating to the Food Access Liaison) as section 224A.</text></paragraph><paragraph id="HA2F8F844945341ED82B82A2A02B2959D"><enum>(2)</enum><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD986852A594C450E96A84AF9C0C71C62"><paragraph id="HC35D621202A14B5382A283668AEFCD5C"><enum>(11)</enum><text>The authority of the Secretary to carry out section 217.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
