<section id="H98D752DF106242308245078C6DCACAA8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemember Employment Protection Act of 2023</short-title></quote>.</text></section> <section id="H2AC2580D255F4ADD84236592084777B9"><enum>2.</enum><header>Improvements to reemployment rights of members of the Armed Forces</header> <subsection id="HC4CCE6E782174E79932E7E73C2B7991F"><enum>(a)</enum><header>Expansion of injunctive relief</header><text display-inline="yes-display-inline">Subsection (e) of section 4323 of title 38, United States Code, is amended—</text> 
<paragraph id="HD4F82AEA05C043D0A20B58B3F0F4E094"><enum>(1)</enum><text>by striking <quote>The court shall use</quote> and inserting <quote>(1) The court shall use</quote>; and</text></paragraph> <paragraph id="H5BF1738C583E4A54985B84DA548CFBFB"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H6026B8423AB14D00B0D8FF290900E8D6"> 
<paragraph id="H34B70E2A20064EB9B9F2DEBE3D5742F4" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A person bringing an action to enforce a provision of this chapter pursuant to subsection (a) shall be entitled to an injunction under paragraph (1) if such person demonstrates—</text> <subparagraph id="HD3A3715080AE47F5BA6E98B91F7E55D4" indent="up1"><enum>(A)</enum><text>a violation—</text> 
<clause id="H90C088C2117A482FA5D3B61DBF0537F7"><enum>(i)</enum><text>of the provisions of this chapter; or</text></clause> <clause id="H90C92EEF476D4F539423B4E17477B3C0"><enum>(ii)</enum><text>of the provisions of this chapter is threatened or is imminent; and</text></clause></subparagraph> 
<subparagraph id="H709719D511E842298C6963E245892DD9" indent="up1"><enum>(B)</enum><text>a likelihood of success on the merits of such action.</text></subparagraph></paragraph> <paragraph id="H891E70DF2437425296C84E61AD1F259A" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The court may not deny a motion for injunctive relief on the basis that a party bringing an action to enforce a provision of this chapter may be awarded wages unearned due to an unlawful termination of employment at the conclusion of such action.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2C6040B80C054A249CF84617DCEADD9D"><enum>(b)</enum><header>Expansion of liquidated damages</header> 
<paragraph id="HAB1648CC170E4328ACF51C0004043349"><enum>(1)</enum><header>Damages against a State or private employer</header><text display-inline="yes-display-inline">Such section is further amended in paragraph (1) of subsection (d), by striking subparagraph (C) and inserting the following new subparagraphs:</text> <quoted-block style="USC" id="H92DA610E8E7F4DABAE6336B85C72E172" display-inline="no-display-inline"> <subparagraph id="H117A560655414A71918C875B2319C5B3" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The court may require the employer to pay the person the amount referred to in subparagraph (B) and interest on such amount, calculated at a rate of 3 percent per year.</text></subparagraph> 
<subparagraph id="H8E53AB6D2E7040F29368ED79638C5B25" indent="up1"><enum>(D)</enum><text>The court may require the employer to pay the person the greater of $50,000 or the amount equal to the amounts referred to in subparagraphs (B) and (C) as liquidated damages, if the court determines that the employer knowingly failed to comply with the provisions of this chapter.</text></subparagraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H60A50BB6FF344F26A6BC0FDC3FB4573C"><enum>(2)</enum><header>Damages against Federal executive agencies</header><text>Subsection (c) of section 4324 of such title is amended—</text> 
<subparagraph id="H6685288CC8324B2F93EF30DE1147987C"><enum>(A)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></subparagraph> <subparagraph id="H976F99A17F4045D982002602C05E8BE7"><enum>(B)</enum><text>by inserting after paragraph (2) the following new paragraph:</text> 
<quoted-block style="USC" id="HA8F9441655EE450998C8CA9213270ACA" display-inline="no-display-inline"> 
<paragraph id="H01F30EA89C7B47BD986DE7272E016C5C" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the Board determines that a Federal executive agency or the Office of Personnel Management has violated the requirement under subsection (a) of section 4334 of this title, such violation shall constitute prima facie evidence that such Federal executive agency or the Office of Personnel Management knowingly failed to comply with the provisions of this chapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HF5B09C4A91EF417BBB4444942297092B"><enum>(c)</enum><header>Mandatory attorney fees award in successful actions for reemployment</header> <paragraph id="H8DD2530A58F2492DA44DECDC9C7FDA5A"><enum>(1)</enum><header>MSPB actions</header><text>Paragraph (5) of subsection (c) of such section (as redesignated by subsection (b)(2)) is amended by striking <quote>the Board may, in its discretion, award such person reasonable attorney fees</quote> and inserting <quote>the Board shall award such person reasonable attorney fees</quote>.</text> </paragraph> 
<paragraph id="HFD82480E3F34420C86EAF32C599686F6"><enum>(2)</enum><header>Federal circuit actions</header><text display-inline="yes-display-inline">Subsection (d) of such section is amended by adding at the end the following new paragraph:</text> <quoted-block style="USC" id="H8681477017D343D6A231F84408C0F924" display-inline="no-display-inline"> <paragraph id="H12731CFF41D7464C8AB79C5A74223EBC" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In such Federal Circuit proceeding, the court shall award such person reasonable attorney fees, expert witness fees, and other litigation expenses if such person—</text> 
<subparagraph id="HD2F3F06C2A864C6DA60009AB9EDDF37D"><enum>(A)</enum><text>prevails in such Federal Circuit proceeding; and</text></subparagraph> <subparagraph id="H024FC6FDD41140D9883A6A3C2B6C08AC"><enum>(B)</enum><text>is not represented by the Special Counsel in such Federal Circuit proceeding.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H175E469253C7413E83BB8684C98339F6"><enum>(3)</enum><header>Actions against a State or private employer</header><text>Paragraph (2) of section 4323(h) of such title is amended by striking <quote>the court may award any such person who prevails in such action or proceeding reasonable attorney fees</quote> and inserting <quote>the court shall award any such person who prevails in such action or proceeding reasonable attorney fees</quote>.</text></paragraph> </subsection> <subsection id="H40BAEE3F1D6C4ABA8C25ADDE2DAFB279"><enum>(d)</enum><header>Repeal of immunity for certain Federal intelligence agencies</header> <paragraph id="HD0862026C9B947F796C305E9DAD1C3E8"><enum>(1)</enum><header>USERRA immunity repealed</header><text display-inline="yes-display-inline">Sections 4315 and 4325 of such title are repealed.</text> </paragraph> 
<paragraph id="H1DB081DFCC2B4AF1BC16024FAE4F27CF"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 4313(a) of such title is amended by striking <quote>sections 4314 and 4315</quote> and inserting <quote>section 4314</quote>.</text> </paragraph></subsection> <subsection id="H455624A871454B65B095D4F09AA6F9A7"><enum>(e)</enum><header>Maintenance of performance review ratings</header><text>Section 4312 of such title is amended—</text> 
<paragraph id="H6F51D2412653481ABDEFCD426A7300C5"><enum>(1)</enum><text>by resdesignating subsections (g) and (h) as subsections (h) and (i); and</text></paragraph> <paragraph id="H6D344D2531AF4450A837CA0E0F9FDE72"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsection:</text> 
<quoted-block style="USC" id="HC8E88D4BC8B94800B2152BD0E6B485FB" display-inline="no-display-inline"> 
<subsection id="HC2043F1DFA564FC7BBF01B04379E29C2"><enum>(g)</enum><text display-inline="yes-display-inline">On any performance review that an employer administers while an employee is absent from a position of employment by reason of service in the uniformed services, such employer shall give such employee a performance score that is equal to the average of the sum of each performance score such employee received on any performance review such employer administered during the period beginning on the date that is three years before the date the absence of such employee began and ending on the date the absence of such employee began.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6821729D652D4A37992FBA9929B421D1"><enum>(f)</enum><header>Expansion of eligible time away from civilian employment</header><text display-inline="yes-display-inline">Section 4303(13) of such title is amended by inserting <quote>, a period for which a person is absent from a position of employment for the purpose of medical or dental treatment for a condition, illness, or injury sustained or aggravated during any such duty</quote> after <quote>any such duty</quote>.</text></subsection> 
<subsection id="HB4CF43CECDC240E4A1077ACFD3D90FB0"><enum>(g)</enum><header>Limitation on USERRA purposes</header><text>Section 4301(a)(1) of such title is amended by striking <quote>encourage noncareer service in the uniformed services</quote> and inserting <quote>encourage service in the uniformed services</quote>.</text></subsection> <subsection id="HB373EBD180CD4CD4A9B4AC2874276400" commented="no"><enum>(h)</enum><header>Review and report</header> <paragraph id="HD3836307A2F941CDA49CD9A082ED6F5D" commented="no"><enum>(1)</enum><header>Review</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall review the methods through which the Secretary of Labor, acting through the Veterans’ Employment and Training Service, processes actions for relief under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="H9E91C4DF997241B998578DCA126F3B62" commented="no"><enum>(2)</enum><header>Elements</header><text>Not later than one year after the date of the enactment of this Act, the Comptroller General shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report that includes—</text> <subparagraph id="H386655A47E944AB2B2CDEB412E9810A2"><enum>(A)</enum><text>the findings of the review required under paragraph (1);</text></subparagraph> 
<subparagraph id="HD4EF092D9E6E4985BAA3B06B7618CDE6"><enum>(B)</enum><text>an identification of the number of actions for relief under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">chapter 43</external-xref> of title 38, United States Code, initiated during the period covered by the report, disaggregated by size of employer and geographic region;</text></subparagraph> <subparagraph id="H0FB1873E437849DCB912718A026EEA4C" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">an identification of the number of such actions for relief that were erroneously dismissed, as determined by the Comptroller General;</text></subparagraph> 
<subparagraph id="HFF7E88D8CAC940D2B5100B156553DEB9"><enum>(D)</enum><text display-inline="yes-display-inline">an identification of the number of such actions for relief that were referred to the Department of Justice; and</text> </subparagraph> <subparagraph id="H28CA4D40C3B1424D811DE9F882735A20"><enum>(E)</enum><text>an assessment of trends, if any, in such actions for relief initiated during such period.</text></subparagraph></paragraph></subsection></section> 
<section id="H00EBCDC59BF5459FB44E327EC6D703B9"><enum>3.</enum><header>Review of investigations manual of Veterans’ Employment and Training Service</header> 
<subsection id="H97311F8946C34B0E953F981D885F8D08"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and biennially thereafter, the Secretary of Labor, shall review the manual of the Department of Labor titled <quote>Veterans’ Employment and Training Service Investigations Manual: USERRA, VEOA, and VP</quote> (or a successor manual) and make such revisions to such manual as the Secretary determines appropriate. </text></subsection> <subsection id="HA8287313521A470C99F41FEC8010EE51"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after any date on which the Secretary completes a review required under subsection (a), the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate—</text> 
<paragraph id="HF63CFAF962124BF785A0B1C3AEF4C65E"><enum>(1)</enum><text>a report that includes a description of any revision to such manual made pursuant to such review; and </text></paragraph> <paragraph id="H43F48A95F20B4FEA8BBA06096AAE1F42"><enum>(2)</enum><text>a copy of such manual, in unredacted form.</text></paragraph></subsection></section>
