<section id="H738767EF26454998BD114FE9D762451E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Dillon’s Law</short-title></quote>.</text></section> <section id="H33CCED528539406187BBC49826205FB8"><enum>2.</enum><header>Preference for States that allow all trained individuals to carry and administer epinephrine</header><text display-inline="no-display-inline">Section 317 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H52A416BB7EA149BAA7F4440EE3C32191" display-inline="no-display-inline"> 
<subsection id="HD87525A69DFE4108AAE71418BA3798E9"><enum>(o)</enum><header>Preference</header> 
<paragraph id="HB2206E57768C42C4B8738057E51A83E9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give preference to any State that—</text> <subparagraph id="HCC30C7066B654511BB79C1AB782216AA"><enum>(A)</enum><text>permits all trained individuals to carry and administer epinephrine to any individual reasonably believed to be having an anaphylactic reaction; and</text></subparagraph> 
<subparagraph id="HA68F7D6DA61147ED83A3F775BF3CF56E"><enum>(B)</enum><text>provides to the Secretary the certification described in paragraph (2).</text></subparagraph></paragraph> <paragraph id="H320647DAAA8A48DA8AA89C498AE02E88"><enum>(2)</enum><header>Civil liability protection law</header><text>The certification described in this paragraph is a certification made by the attorney general of the State that the State—</text> 
<subparagraph id="HDC608A5F1B4E44CAB0B08E7C2C8AACB1"><enum>(A)</enum><text>has a civil liability protection law;</text></subparagraph> <subparagraph id="H2E4D0EAFF9114F41A62BBFF5FB7715AF"><enum>(B)</enum><text>has reviewed such law to determine the application of such law with regard to a trained individual who may administer epinephrine to another individual reasonably believed to be having an anaphylactic reaction; and</text></subparagraph> 
<subparagraph id="HC39C9A9BEB6F4A98BF36A3BD25C23B74"><enum>(C)</enum><text>has concluded that such law provides adequate civil liability protection applicable to such a trained individual.</text></subparagraph></paragraph> <paragraph id="H1BA4FA50EEAA4DF8ACDC3F5CC8828F09"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection creates a cause of action or in any other way increases or diminishes the liability of any person under any other law.</text></paragraph> 
<paragraph id="H4891BFBCAF354151826222A41E4978E6"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection:</text> <subparagraph id="H15AFA3C6F23E4DFC98F33A4128FCD68A"><enum>(A)</enum><text>The term <term>civil liability protection law</term> means a State law offering liability protection to individuals who give aid on a voluntary basis in an emergency to an individual who is ill, in peril, or otherwise incapacitated.</text></subparagraph> 
<subparagraph id="H762A3B47FB08429C88E0FB2EC850BE7D"><enum>(B)</enum><text>The term <term>trained individual</term> means an individual—</text> <clause id="H9441E53896D244C9801A97B2B0B70693"><enum>(i)</enum><text>who has received training in the administration of epinephrine; and</text></clause> 
<clause id="H9C8C2AE16686418EAE2BAF8A4977A7F0"><enum>(ii)</enum><text>whose training in the administration of epinephrine meets appropriate medical standards and has been approved by the State.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
