which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to make certain improvements in the administration of the educational assistance programs of the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="HE9031F2BD95B45BFB149B4AC2947691D" style="OLC"><section id="H3115E2C5D6AD4D01B4EDB3D9C13ED664" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Education Assistance Improvement Act</short-title></quote>.</text></section><section id="H41E9750C85E246A0AA0F0E12951A7B90" section-type="subsequent-section"><enum>2.</enum><header>Payment of full monthly housing stipend for veterans enrolled in final semester using educational assistance under Post-9/11 Educational Assistance Program</header><subsection id="H8A9C3AE05C174B3CAF5E2A64CC92D467"><enum>(a)</enum><header>Housing allowance</header><text display-inline="yes-display-inline">Section 3680(a)(3) of title 38, United States Code, is amended—</text><paragraph id="HBD34104DFFFB48EABC085B7F05473408"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively (and by redesignating each subordinate provision and the margins thereof accordingly);</text></paragraph><paragraph id="H0C20629D5ED34D8CA94C6839B3946C21"><enum>(2)</enum><text>by striking <quote>Notwithstanding paragraph (1)</quote> and inserting <quote>(A) Notwithstanding paragraph (1)</quote>;</text></paragraph><paragraph id="H3D2E8481F516497DA0A25EB89C5C0BB1"><enum>(3)</enum><text>by striking <quote>, including a monthly housing stipend described in section 3313(c) of this title,</quote>; and</text></paragraph><paragraph id="HDAB27AFC4761424AA8D8ABA7800A27A2"><enum>(4)</enum><text>by adding at the end the following new subparagraph (B):</text><quoted-block style="USC" id="H065948EC9C494FF593BF02EC2438ADFA" display-inline="no-display-inline"><subparagraph id="H3FD7B71ECDA04DBBADD0A5803D00DE9E" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of providing a monthly housing stipend described in section 3313(c) to an eligible veteran or eligible person for whom the Secretary is providing educational assistance under chapter 33 of this title during a period that is the last semester, term, or academic period pursuant to subparagraph (A), the Secretary shall treat the veteran or person as pursuing a program of education on more than a half-time basis.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H94A9F9E71B7044BC8B01743FE59E4EB9"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect on the date of the enactment of this Act and apply with respect to a quarter, semester, or term, as applicable, commencing on or after August 1, 2023.</text></subsection></section><section id="HA4613CCEF72A482F909BA1AF4F482712" section-type="subsequent-section"><enum>3.</enum><header>Notice of Department of Veterans Affairs rulemakings affecting the educational assistance programs of the Department</header><subsection id="HDAB9C1B00D514CC78FF178BB613CBCB2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/36">chapter 36</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H9D50E5E2BD96421F91055C8ECA1EBDA3" display-inline="no-display-inline"><section id="HC0BE83795E7D42CAAB93B5D9E96A9BF9"><enum>3699C.</enum><header>Notice of rulemakings relating to educational assistance programs</header><text display-inline="no-display-inline">In the case of a rulemaking by the Secretary that is not subject to notice requirements under section 553(b)(A) of title 5, and that relates to any educational assistance program of the Department, the Secretary may not implement the rule before the date that is 180 days after the date on which the Secretary makes available to students, educational institutions, and the Committees on Veterans’ Affairs of the Senate and House of Representatives notice of, and justification for, the rulemaking.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9018CB2F116F437ABD82EE0B168CBB99"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 3699B the following new item:</text><quoted-block style="USC" id="HEE1F64B1FDB7472DBCB2B145B5120878" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3699C. Notice of rulemakings relating to educational assistance programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H49427F96FE8347F19C624D9F4D52C159"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">Section 3699C of title 38, United States Code, as added by subsection (a), shall take effect on the date of the enactment of this Act and apply with respect to a rulemaking on or after August 1, 2024.</text></subsection></section><section id="H7E410356C53F49949C5781CC225E3561"><enum>4.</enum><header>Notice to educational institutions of risk-based surveys</header><text display-inline="no-display-inline">Section 3673A(d) of title 38, United States Code, is amended by striking <quote>one business day</quote> and inserting <quote>two business days</quote>.</text></section><section id="H99057A0D992D49A0BD29FDA918703ADA"><enum>5.</enum><header>Multi-year waivers for educational institutions</header><subsection id="HE4C03CBBDB964073835321C96A184C04"><enum>(a)</enum><header>Accredited courses</header><text display-inline="yes-display-inline">Section 3675(b) of title 38, United States Code, is amended—</text><paragraph id="HD14CD70B0C9A4323B5585A869C724C4A"><enum>(1)</enum><text>by redesignating paragraphs (1) through (4) as subparagraphs (A) through (D);</text></paragraph><paragraph id="HE8685298676646B89DD75004A2D6B1CF"><enum>(2)</enum><text>by inserting <quote>(1)</quote> before <quote>As a condition</quote>; and</text></paragraph><paragraph id="H60FBED2266C6488C8F331B3BB66D0BD9"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HF871D7C00EF54CC78493FCD23BCC8A4E" display-inline="no-display-inline"><paragraph id="HBB1CEEF0CE6E4FF7B708CE61468D9F98" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may waive the requirement under paragraph (1)(D) for an educational institution for multiple years.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H71A9839E36E24B4BBDE15672C949ED0F"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 3672(b)(2)(A) is amended by inserting <quote>(A) and (B)</quote> after <quote>3675(b)(1)</quote>. </text></subsection></section></legis-body></bill>
