R. 3798</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230605">June 5, 2023</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to inform employers of flexible health insurance benefits.</official-title></form><legis-body id="HC1F4A047B3984EFB900927D16D1CB197" style="OLC"><section id="H642D247805E64AC89DB7563A11CF0F4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Flexibility Act</short-title></quote>. </text></section><section id="H147F9AD17D774BF99C1F46D98D201E31"><enum>2.</enum><header>Notification of flexible health insurance benefits</header><subsection id="HB01F627EFAE5451B8011424F37340828"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter C of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H8E8979B73A66416CA1DD0283DD9D7287" display-inline="no-display-inline"><section id="HDADB69BC031A40C8BB349F7B0E44B5C2"><enum>9835.</enum><header>Notification of flexible health insurance benefits</header><subsection id="H2F20F1D6509542628ADD027F178562E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall notify employers of the availability of tax-advantaged flexible health insurance benefits, with an initial focus on small businesses.</text></subsection><subsection id="H34955B64CFDD41BF98EA41B5AF04CB04"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD70B44E1BFB04B388DADCC3AEA2F5C21"><enum>(1)</enum><header>Employer</header><text>The term <quote>employer</quote> has the meaning given such term in section 3(5) of the Employee Retirement Income Security Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(5)</external-xref>).</text></paragraph><paragraph id="H5E5BF9BC1BE946218A2E86810651C63B"><enum>(2)</enum><header>Flexible health insurance benefits</header><text display-inline="yes-display-inline">The term <quote>flexible health insurance benefits</quote> means—</text><subparagraph id="HDA82FD7FB9874F1C96026AA20DD9E042"><enum>(A)</enum><text>an individual contribution health reimbursement arrangement (as described in the rule entitled <quote>Health Reimbursement Arrangements and Other Account-Based Group Health Plans</quote> (84 Fed. Reg. 28888 (June 20, 2019)));</text></subparagraph><subparagraph id="HE7A71C615BEF484C83D213DD6B9D0498"><enum>(B)</enum><text display-inline="yes-display-inline">a qualified small employer health reimbursement arrangement (as defined in section 9831(d)(2)); or</text></subparagraph><subparagraph id="HAFD65F47FCF84C0C994FDB33B4C0DCE0"><enum>(C)</enum><text>the small employer health insurance credit.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H38907745E42843E3A30D8C9B88A49F45"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter C of chapter 100 of such Code is amended by adding at the end the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1B8002BFBA0F4D92AE901527937464A3"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9835.
