Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to authorize the Biomedical Advanced Research and Development Authority to award follow-on production contracts or transactions, procure supplies for experimental or test purposes, and acquire innovative commercial products and commercial services, and for other purposes.</official-title></form><legis-body id="HCCA3ADA6879E404290C992DED29F26A5" style="OLC"><section id="HF8DEC950B84B40BFB092F5E67B1F9299" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fast-track Logistics for Acquiring Supplies in a Hurry Act of 2023</short-title></quote> or the <quote><short-title>FLASH Act of 2023</short-title></quote>. </text></section><section id="H3CE8DEAE25CD448B9554A5E33E774F0C"><enum>2.</enum><header>Authority to award follow-on production contracts or transactions, procure supplies for experimental or test purposes, and acquire innovative commercial products and commercial services</header><text display-inline="no-display-inline">Section 319L of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-7e">42 U.S.C. 247d–7e</external-xref>) is amended—</text><paragraph id="HCC9CC8F04EE042A5B92DC36E15ED069C"><enum>(1)</enum><text>in subsection (a)(6)(B), by amending clause (ii) to read as follows:</text><quoted-block style="OLC" id="H60BA430A27464DEEB5E47BE3E2CAC6AA" display-inline="no-display-inline"><clause id="H77D0A5A21CAD401FB55340EC9B645299"><enum>(ii)</enum><text display-inline="yes-display-inline">design and development of—</text><subclause id="H464BBEC12BE540B7A7DF7C7B82BC5D4B"><enum>(I)</enum><text>tests and prototypes, including obtaining sufficient quantities for evaluation of such tests and prototypes; and</text></subclause><subclause id="H6BE23C0EAB2B44D6B06AF0BEF30006C2"><enum>(II)</enum><text>models, including animal models, for such testing and prototypes;</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HF4B35DDF7812410899C73E1FF696263B"><enum>(2)</enum><text>in subsection (c)(5)—</text><subparagraph id="HB1CE0DE6C44E46A38EF1E2A8B1793DF9"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="HB36F712FF58C459892EA6FB92C6E1D8F"><enum>(i)</enum><text>by redesignating clause (iv) as clause (v); and</text></clause><clause id="H20D64C836F7F4B20B373875C85B4B67E"><enum>(ii)</enum><text>by inserting after clause (iii) the following new clause:</text><quoted-block style="OLC" id="HF1B268F97E5249ED9B7563778F3CB685" display-inline="no-display-inline"><clause id="H17EDCF887FB0427DA8C5012DF00CD738"><enum>(iv)</enum><header>Follow-on production contracts or transactions</header><subclause id="H94F370C091C64A55875FEC854976CC68"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A transaction entered into under this subparagraph for the design or development of a prototype may provide for the award of a follow-on production contract or transaction to the participants in the transaction.</text></subclause><subclause id="HC14DD221663840AEB963437D6469E1B0"><enum>(II)</enum><header>Prototype subprojects</header><text>A transaction entered into under this subparagraph includes all prototype subprojects awarded under the transaction to carry out authorities under this section.</text></subclause><subclause id="H67D39F7EC28D411C8076FBDDA5D70AD0"><enum>(III)</enum><header>Exception to competitive procedures</header><text display-inline="yes-display-inline">Notwithstanding clause (ii), a follow-on production contract or transaction provided for in a transaction under this clause may be awarded to the participants in the transaction without the use of competitive procedures, even if explicit notification was not listed within the request for proposal for the transaction, if competitive procedures were used for the selection of parties for participation in the initial transaction.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HD4D8F02130F14449A669DCC5B097BB55"><enum>(B)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block id="H2D4C985B838D43CBA2B6C45A4FA0A5DB" style="OLC"><subparagraph id="HD2B8ADB7E15B4767A89A3E608288F4BA"><enum>(I)</enum><header>Procurement for experimental or test purposes</header><clause id="H8BF6F9FBFE0F43B2B4BC1F70FFB06D3D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may purchase medical countermeasures, products, and supplies, chemical materials and reagents, manufacturing supplies, protective equipment, and such other supplies, including parts and accessories, and designs thereof, as the Secretary determines necessary for experimental or test purposes in the development of supplies that are necessary for national public health and health security.</text></clause><clause id="HDD65298AB23A4B3AB4B6A67BAB14AE5D"><enum>(ii)</enum><header>Procedures</header><text>Notwithstanding subparagraph (A)(ii), the Secretary may make purchases under this subparagraph by contract, or by entering into a transaction other than a contract, using noncompetitive procedures.</text></clause></subparagraph><subparagraph id="HD5EAD28BAF9744ACA1D8599528A83781"><enum>(J)</enum><header>Acquisition of innovative commercial products and commercial services using general solicitation competitive procedures</header><clause id="HE2903790C9BD4DE78A5BA88751AF8004"><enum>(i)</enum><header>In general</header><text>Notwithstanding subparagraph (A)(ii), the Secretary may acquire innovative commercial products and commercial services through a competitive selection of proposals resulting from a general solicitation and the peer review of such proposals.</text></clause><clause id="H3378F205CCDB453A9592AF339C2A8427"><enum>(ii)</enum><header>Treatment as competitive procedures</header><text>Use of general solicitation competitive procedures under clause (i) shall be considered to be use of competitive procedures for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">chapter 33</external-xref> of title 41, United States Code.</text></clause><clause id="H4EDD1B8698BD4402922D7A202D80F1D0"><enum>(iii)</enum><header>Limitations</header><subclause id="H660F877BCEDE4EA2849194EE6F3CDF22"><enum>(I)</enum><header>Transactions in excess of $100,000,000</header><text>The Secretary may not enter into a contract or agreement in excess of $100,000,000 using the authority under clause (i), unless the Secretary makes a written determination of the efficacy of the effort to meet mission needs of the Department of Health and Human Services.</text></subclause><subclause id="H224FB91DB4E844E68E0E389E79E3F8F2"><enum>(II)</enum><header>Fixed-price</header><text>Contracts or agreements entered into using the authority under clause (i) shall be fixed-price, including fixed-price incentive contracts.</text></subclause></clause><clause id="H10DED033FBDF4406B437C422843155C2"><enum>(iv)</enum><header>Congressional notification required</header><subclause id="H018D2FF9478146648BB47F26389CF9EF"><enum>(I)</enum><header>Submission</header><text>Not later than 45 days after the award of a contract for an amount exceeding $100,000,000 using the authority under clause (i), the Secretary shall provide notification of such award to the Committee on Energy and Commerce and the Committee on Appropriations of the House of Representatives, and the Committee on Health, Education, Labor, and Pensions and the Committee on Appropriations of the Senate.</text></subclause><subclause id="H36BCA995C15141079CF765F5F8B869B4"><enum>(II)</enum><header>Contents</header><text>Notification of an award under subclause (I) shall include the following:</text><item id="HEB84DB94118443A2B10D0D89D3DE6888"><enum>(aa)</enum><text>Description of the innovative commercial product or commercial service acquired.</text></item><item id="HCAA76E680BA448BEAADF71DE93800F67"><enum>(bb)</enum><text display-inline="yes-display-inline">Description of the requirement, capability gap, or potential technological advancement with respect to which the innovative commercial product or commercial service acquired provides a solution or a potential new capability.</text></item><item id="H58329C52F2174B01A905C5C1E0AF4758"><enum>(cc)</enum><text display-inline="yes-display-inline">Amount of the contract awarded.</text></item><item id="H8C65505CDBC442A8AB2C8E95F14E759E"><enum>(dd)</enum><text>Identification of the contractor awarded the contract.</text></item></subclause></clause><clause id="H654E214455254E15ADD24BABDC1E541B"><enum>(v)</enum><header>Innovative defined</header><text>In this subparagraph, the term <term>innovative</term>, with respect to a commercial product or commercial service, means—</text><subclause id="H91AC5B890C4D4F6A9390EB7869797935"><enum>(I)</enum><text>any technology, process, or method, including research and development, that is new as of the date of submission of a proposal; or</text></subclause><subclause id="H737BBE8585EA44FAA9516829ADF72E6A"><enum>(II)</enum><text>with respect to a technology, process, or method, including research and development, existing as of the date of submission of a proposal, any application of such technology, process, or method that is new to the Federal Government as of such date.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
