<section id="HB0BD21A4EECF403D8D960520D0787D96" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Defense Overdose Data Act of 2023</short-title></quote>.</text></section> <section id="HDBE7A61033F24218BE87AB12D27FD014"><enum>2.</enum><header>Annual report on military overdoses</header> <subsection commented="no" display-inline="no-display-inline" id="HE6B68DC16C2444878468B7C4C3AA3A65"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense shall submit to the appropriate congressional committees a report on the number of annual overdoses among servicemembers.</text></subsection>
<subsection id="H61CAD13104894D2F819ECB8A86AE1768"><enum>(b)</enum><header>Contents</header><text>The report required by subsection (a) shall include the following:</text> <paragraph id="HF7F1911BC4A044949B0EA6382A5695C2"><enum>(1)</enum><text>The total number of servicemembers who suffered a fatal overdose during the previous calendar year, including—</text>
<subparagraph id="H283608A6A03B475EBA2B0A03779195D7"><enum>(A)</enum><text>demographic information, including gender, race, age, military department, military rank, pay grade, station, number of previous deployments, and whether such member was a victim of military sexual assault;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H3B35E25B314A4D71AF86DE62868FD4BA"><enum>(B)</enum><text>the location of the fatal overdose, including whether the overdose was on a military base; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H89FBA87A92B94FA0863A1FC556CB6C5E"><enum>(C)</enum><text>a list of the substances involved in the fatal overdose.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5A56CCA47A0941FCA7D5BA762A0A523E"><enum>(2)</enum><text>Of the servicemembers identified in paragraph (1)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HC501C616F212460AA7DB5856BA4B49DB"><enum>(A)</enum><text>the number of servicemembers who previously had a non-fatal overdose;</text></subparagraph> <subparagraph id="HD6A01CAF623C4C1DA5AF7B53BC818B53"><enum>(B)</enum><text>the number of servicemembers who received mental health or substance use disorder services prior to a fatal or non-fatal overdose, including a description of whether such services were received from a private sector provider;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1DF572F8514842B9A2AC891849E2995A"><enum>(C)</enum><text>the number of servicemembers with co-morbid mental health diagnoses;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE13A9DAE713344A1AD810E1F586769BC"><enum>(D)</enum><text>the number of servicemembers who had been prescribed opioids, benzodiazepines, or stimulants;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H258AC57401BA47549B59801261843E01"><enum>(E)</enum><text>the number of servicemembers who were previously prescribed or provided naloxone; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H32F653E9E8D44C77B9E27054B2ACC1F4"><enum>(F)</enum><text display-inline="yes-display-inline">the number of servicemembers who had a positive drug test prior to the fatal overdose, including any substance identified in such test; </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H16ABE073FE1E4DE693E2BEC7B260FF68"><enum>(G)</enum><text display-inline="yes-display-inline">the number of servicemembers referred, including by self-referral, to medical treatment, including medication treatment for opioid use disorder;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6CD20D20D0834F2FA17185DE381F4B49"><enum>(H)</enum><text display-inline="yes-display-inline">with respect to each servicemember identified in subparagraph (G), whether the servicemember was referred after a positive drug test and the source of such referral;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H95D9EB881A6E4C43BF0BF6E29D0AD5E6"><enum>(I)</enum><text>of the servicemembers identified in subparagraph (G), the number of servicemembers who engaged in such medical treatment;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H20951A13DF554E49AB87AAD1D9CFD758"><enum>(J)</enum><text>the number of servicemembers who suffered a fatal overdose in which a bystander was present; and</text></subparagraph>
<subparagraph id="HE080E8A9C40D4CF38BF30C2934CF35DC"><enum>(K)</enum><text>the number of fatal overdoses.</text></subparagraph></paragraph> <paragraph id="H63CADF8D44F44A0F91B0FA26B26A1127"><enum>(3)</enum><text>The total number of servicemembers who suffered a non-fatal overdose during the previous calendar year, including—</text>
<subparagraph id="HFA56C636D9074E50AEA7B4202C7514D7"><enum>(A)</enum><text>demographic information, including gender, race, age, military department, military rank, pay grade, station, number of previous deployments, and whether such member was a victim of military sexual assault;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA16FB7CD7A574F9FBA33BB88069D724B"><enum>(B)</enum><text>a list of the substances involved in the non-fatal overdose; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H29FFCAF6C9B449A1B66BC6D391C2BAA6"><enum>(C)</enum><text>a determination of whether the non-fatal overdose was intentional.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDFDCF2647C38493FB46554882CD87083"><enum>(4)</enum><text>Of the servicemembers identified in paragraph (3)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H0CF91FB43456496DA1E31B268AC082AC"><enum>(A)</enum><text>the number of servicemembers who previously had a non-fatal overdose;</text></subparagraph> <subparagraph id="HA1A89885083D4E779C963FBA5411D83E"><enum>(B)</enum><text>the number of servicemembers who received mental health or substance use disorder services prior to a non-fatal overdose;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7DC45227CBA849C99775A77DE49A29E3"><enum>(C)</enum><text>the number of servicemembers with co-morbid mental health diagnoses prior to a non-fatal overdose;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5AA9DB3A59DD44ACB0D8855135377F41"><enum>(D)</enum><text>the number of servicemembers who had been prescribed opioids, benzodiazepines, or stimulants prior to a non-fatal overdose;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H791CB225D4594F6484BE5CF5DF17FFF7"><enum>(E)</enum><text display-inline="yes-display-inline">the number of servicemembers who had a positive drug test prior to the non-fatal overdose, including any substance identified in such test; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H59147558542D489D801151E2F392FE61"><enum>(F)</enum><text>the number of servicemembers who suffered a non-fatal overdose in which a bystander was present;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB5E9B26BFC474B5A9A94932989E96C17"><enum>(G)</enum><text>the number of servicemembers who had been categorized as high risk and prescribed or provided naloxone prior to a non-fatal overdose; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H803C2A615F7142F7B6B33559D07A9C40"><enum>(H)</enum><text>the number of servicemembers who suffered a non-fatal overdose in which naloxone was administered;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2BCD1640A099469A804080F1FDBF5B2B"><enum>(I)</enum><text display-inline="yes-display-inline">the number of servicemembers referred to medical treatment, including medication treatment for opioid use disorder, following a non-fatal overdose;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA325556901AF4EB697F290C4E68F615E"><enum>(J)</enum><text>of the servicemembers identified in subparagraph (I), the number of servicemembers who engaged in such medical treatment;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H22535006452D4314A5E08C71B9131FF7"><enum>(K)</enum><text display-inline="yes-display-inline">the number of servicemembers referred, including by self-referral, to medical treatment, including medication treatment for opioid use disorder;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1170A39BCEC044AC88036B1C2EB6C252"><enum>(L)</enum><text display-inline="yes-display-inline">with respect to each servicemember identified in subparagraph (K), whether the servicemember was referred after a positive drug test and the source of such referral; </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0804217C0F054458BC3A5463ABB13DFB"><enum>(M)</enum><text>of the servicemembers identified in subparagraph (K), the number of servicemembers who engaged in such medical treatment; and</text></subparagraph> <subparagraph id="H55A24F73C0DB41DFB96E97D91E2C35ED"><enum>(N)</enum><text>the number of intentional overdoses.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1E053912A4D14C4082AFE54334D25F8C"><enum>(5)</enum><text>An analysis of discernable patterns in fatal and non-fatal overdoses of servicemembers, and existing or anticipated responses to such patterns by the Secretary of Defense.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5A4416BAE73541E6AA3704C0EF1029A1"><enum>(6)</enum><text>A description of existing or anticipated response efforts to fatal and non-fatal overdoses at military bases that have rates of fatal overdoses that exceed the average rate of fatal overdoses in the United States.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H36026B5108244ABE871112F82BA9F14E"><enum>(7)</enum><text>The number of servicemembers who are in recovery or currently taking a prescription medication for opioid use disorder.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HADBE46AADC4C42B0A85EC9BB0D462823"><enum>(8)</enum><text>The number of military family members of servicemembers who receive substance use disorder treatment at a medical facility of the Department of Defense.</text></paragraph>
<paragraph id="H9D0654F24C5C424382AA95AE14F47493"><enum>(9)</enum><text>An assessment of the availability of substance use disorder treatment for servicemembers who—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HFFCB9F536DB84AA2B7A714F51F12B70E"><enum>(A)</enum><text>transferred military bases; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H00D51324A9754328AA48BE3471B1B93C"><enum>(B)</enum><text>returned to the United States following an overseas tour.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H130C2AF9F86A40C88B8E0C8F192FF45E"><enum>(10)</enum><text>The number of medical facilities of, or affiliated with, the Department of Defense that have opioid treatment programs.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF593BB76F15C49689E3BE9A174D82B10"><enum>(11)</enum><text>A description of punitive measures taken by the Secretary of Defense in response to substance misuse, substance use disorder, or overdose by servicemembers.</text></paragraph> <paragraph id="HC8C0447D95C2492CACB24A5A4C6F19BE"><enum>(12)</enum><text>The number of military family members who live on a military base who suffered a fatal or non-fatal overdose during the previous calendar year, including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H8C534E447CBB44EB8D0D8CB86EE211F6"><enum>(A)</enum><text>demographic information, including gender, race, age, and relationship to a servicemember;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HEB9227AEF6404C4CA2D653803DE5EBAB"><enum>(B)</enum><text>the location of the overdose;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3506DEFD459E4EFDAAF02476F143E1CE"><enum>(C)</enum><text>a list of the substances involved in the overdose; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H98FA4F7FB35249D6B2E44091832B4ABD"><enum>(D)</enum><text display-inline="yes-display-inline">a determination of whether the overdose was intentional.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC9BA0FCBB2B84946B246EFE7FC4373CE"><enum>(13)</enum><text>Of the military family members identified in paragraph (12)—</text> <subparagraph id="HA5BBE3AAB70F44398EC68C9D54FA6581"><enum>(A)</enum><text>of military family members who suffered a fatal overdose, the numbers of military family members who had a previous non-fatal overdose;</text></subparagraph>
<subparagraph id="H69E752E9BEB940CAB20B29C9C78ED9F8"><enum>(B)</enum><text>the number of military family members who received mental health services prior to an overdose;</text></subparagraph> <subparagraph id="H6412D26BFCC944D2A360EF5D355D5031"><enum>(C)</enum><text>the number of military family members who have co-morbid mental health diagnoses;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H57454BC5EFDD49BABF76DEA2FE6AF443"><enum>(D)</enum><text display-inline="yes-display-inline">the number of military family members who had been prescribed opioids, benzodiazepines, or stimulants prior to an overdose;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1BC97B0EDE9348E6A7F8788657A2F8F8"><enum>(E)</enum><text>the number of military family members who suffered an overdose in which a bystander was present; </text></subparagraph>
<subparagraph id="H6E38F9EA0A29478C8668EA3739E394EB" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>the number of military family members who suffered an overdose in which naloxone was administered; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFDAAD52A78084C4196251474A967CA28"><enum>(G)</enum><text>the number of intentional overdoses.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H0072EEE6ADD24E4F9921AEBA2F1793BF"><enum>(c)</enum><header>Reporting on fewer than 5 servicemembers</header><text>If the number of servicemembers or military family members identified under any paragraph or subparagraph of subsection (b) is fewer than 5, the Secretary of Defense shall for such paragraph or subparagraph—</text> <paragraph commented="no" display-inline="no-display-inline" id="H2ED12C1ED44F4F67AEFA088A2A7E2F1D"><enum>(1)</enum><text display-inline="yes-display-inline">not report the exact number of servicemembers or military family members identified; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5F320AB43302488089B7DE7A030D2327"><enum>(2)</enum><text>report that fewer than 5 servicemembers or military family members were identified.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6D42370000694D09A4DD722F71D33D5A"><enum>(d)</enum><header display-inline="yes-display-inline">Privacy</header> <paragraph commented="no" display-inline="no-display-inline" id="HA5B0EF867C7847719A5327F7B3F7A185"><enum>(1)</enum><header>In general</header><text>Nothing in this section shall be construed to authorize the disclosure by the Secretary of Defense of personally identifiable information of servicemembers or military family members, including anonymized personal information that could be used to re-identify servicemembers or military family members.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBE08386347C6437683DE178030AE8579"><enum>(2)</enum><header display-inline="yes-display-inline">Application of HIPAA</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary of Defense shall take steps to protect the privacy of servicemembers and military family members pursuant to regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1320d-2">42 U.S.C. 1320d–2</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/191">Public Law 104–191</external-xref>).</text></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="HC1228515C7FB434C8BBAE9FA0C90007D"><enum>3.</enum><header>Report on improved access to data, treatment, and overdose prevention</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Defense shall contract with a federally funded research and development center to prepare a report that includes—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H3E44EB6EC0234A6BA70CFFE802DE0906"><enum>(1)</enum><text>an assessment of current barriers to determining the information required under section 2 and recommendations for improved tracking and reporting of substance misuse, substance use disorders, overdoses, and treatment within the Department of Defense;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF8E0BF3E871D4190BC0F1C2747151C32"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations for—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H2E774B4194664A31933A3FE79CC0ECC6"><enum>(A)</enum><text>legislative and administrative actions to increase access to mental and behavioral health care for servicemembers who—</text> <clause commented="no" display-inline="no-display-inline" id="H4B535632D8F145AC87953786022EFA3E"><enum>(i)</enum><text display-inline="yes-display-inline">are at risk of overdose or substance use disorder; </text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA7EE2CBC8F114351863DAB9CE0DBFE62"><enum>(ii)</enum><text display-inline="yes-display-inline">have experienced a non-fatal overdose; or </text></clause> <clause commented="no" display-inline="no-display-inline" id="HA6993710E5CB4B949822624CA50ECD37"><enum>(iii)</enum><text display-inline="yes-display-inline">have been diagnosed with a substance use disorder;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3A7D32D733FF405FAFCB0FFBFA41D397"><enum>(B)</enum><text>expanding non-opioid pain management treatment and physical therapy at medical facilities of the Department of Defense;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA65100E58D524C0DB1E2F84BB26D511D"><enum>(C)</enum><text>organizing interagency coordination—</text>
<clause commented="no" display-inline="no-display-inline" id="H5B1E9CCD11E2409481CCCE9CFF743A48"><enum>(i)</enum><text display-inline="yes-display-inline">to address overdoses and substance use disorders among veterans servicemembers; and </text></clause> <clause commented="no" display-inline="no-display-inline" id="H8A185FDC4A83402DA49FCF46BAF64475"><enum>(ii)</enum><text display-inline="yes-display-inline">to reduce stigma associated with substance use disorders and treatment access among servicemembers and their military family members;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDFC660A1930A481587A70F32C6D790F2"><enum>(D)</enum><text display-inline="yes-display-inline"> addressing concerns among servicemembers regarding the consequences of seeking or receiving care for a substance use disorder or overdose;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1040C17AB2CE4AE592562466DDCA46A6"><enum>(E)</enum><text>educating servicemembers on prevention strategies, tools to reduce or prevent overdose or substance use disorder, available mental and behavioral healthcare and substance use disorder care, including medication treatment for opioid use disorder, recovery support services, psychotherapy, inpatient rehabilitation services, and family support services; </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H00C1153BF8594D9285108AECA1428053"><enum>(F)</enum><text>potential supports for servicemembers in recovery; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H644306317B9B417DB6AEB3F065DB1F96"><enum>(G)</enum><text display-inline="yes-display-inline">improving continuity of care for substance use disorders from during the transition to veteran status; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H804AC3723DE34A7BB6E49E4754C02EC9"><enum>(H)</enum><text>improving access to death investigation occurring outside the jurisdiction of the Armed Forces Medical Examiner System;</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5F8413F547944B968942C639135E46A0"><enum>(3)</enum><text>an identification of causes of fatal and non-fatal overdoses that are unique to servicemembers;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9E102CF4DDAF413B93C8D5D75F105BE9"><enum>(4)</enum><text>an identification of the barriers to care for substance use disorders for military family members of servicemembers and suggestions for additional data elements for the annual report required under section 2;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H051C9596C3864B7785783FC2E8E1B608"><enum>(5)</enum><text>any other information that the Comptroller General of the United States considers appropriate with respect to the reduction of overdoses among servicemembers; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H33B51D53529A4AA287AD6BF260BA10C4"><enum>(6)</enum><text>qualitative data from servicemembers.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H5C1985F5F3194361AEA703567329DFF9"><enum>4.</enum><header>Standards for the use of materials to prevent overdose and substance use disorder</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Defense shall establish standards for the distribution of, and training for the use of, naloxone or other medication for overdose reversal, opioid disposal materials, fentanyl test strips, and other materials to prevent or reverse overdoses, substance use disorder, or impacts related to substance misuse. </text></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H77DEA2FDAB7E4D84B9DAC2E5C0B06039"><enum>5.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="HD7747080B330441AB91476EE2F222B31"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H63214AFB18344977906ED2DC85CAE4CD"><enum>(A)</enum><text display-inline="yes-display-inline">the congressional defense committees;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0FBAEA03138545F790E99E6EBD863878"><enum>(B)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC9B357CCBCA04BEF92753ADE175C8DF3"><enum>(C)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2E62A17ABB744737B35EE0EBA7C17B9D"><enum>(2)</enum><header display-inline="yes-display-inline">Military family member</header><text>The term <term>military family member</term> means a family member of a servicemember, including the spouse, parent, dependent, or child of a servicemember, or anyone who has legal responsibility for the child of a servicemember.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H23AFA7589E644F13940C53B8F07D696A"><enum>(3)</enum><header display-inline="yes-display-inline">Servicemember</header><text>The term <term>servicemember</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7ACAFC6894E6454A9A63B7008C11C590"><enum>(A)</enum><text>a member of the Armed Forces; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCA0DB482D84C4758AD1DA06791C17954"><enum>(B)</enum><text>a member of the National Guard.</text></subparagraph></paragraph></section> </legis-body> </bill>
