<subsection id="H197D7C73840F473C9F422BE19DE7B47E"><enum>(e)</enum><header>Appropriation for Department of Commerce Nonrecurring Expenses Fund</header> 
<paragraph id="HECBBD680E98E42B9900404411BDBCE53"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to amounts otherwise available, there is appropriated to the Department of Commerce Nonrecurring Expenses Fund for fiscal year 2023, out of any money in the Treasury not otherwise appropriated, $22,000,000,000, to remain available until expended, of which—</text> <subparagraph id="HE5952382F66B499EBAC784AAD37CFB13"><enum>(A)</enum><text display-inline="yes-display-inline">$11,000,000,000 is to carry out programs related to Government efficiencies in fiscal year 2024; and</text></subparagraph> 
<subparagraph id="H02E59634CEEE40ADAAFD01AED149C4B1"><enum>(B)</enum><text display-inline="yes-display-inline">$11,000,000,000 is to carry out programs related to Government efficiencies in fiscal year 2025.</text></subparagraph></paragraph> <paragraph id="H9DA2EB2BF9674C44B1921D6E4AFDACDA"><enum>(2)</enum><header>Limitation on transfer</header><text display-inline="yes-display-inline">Funds provided by paragraph (1) shall not be subject to any transfer authority provided by law.</text></paragraph> 
<paragraph id="HB244AFBA88B340C893EEBDAA51C4E05C"><enum>(3)</enum><header>Report requirements</header><text display-inline="yes-display-inline">Reporting requirements in section 111(a) of division B of <external-xref legal-doc="public-law" parsable-cite="pl/116/93">Public Law 116–93</external-xref> shall apply to funds provided by paragraph (1). </text></paragraph> <paragraph id="HE54F6E71836C430FAFDA1EF8CB344B6D"><enum>(4)</enum><header>Statutory PAYGO scorecards</header><text display-inline="yes-display-inline">The budgetary effects of this subsection shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay As-You-Go Act of 2010.</text></paragraph> 
<paragraph id="H967FEBB0FCF441B5B3B8E22279536368"><enum>(5)</enum><header>Senate PAYGO scorecards</header><text display-inline="yes-display-inline">The budgetary effects of this subsection and each succeeding division shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of H. Con. Res. 71 (115th Congress).</text></paragraph> <paragraph id="H76140A9FEEDB4B74BB405E3AD756B8EF"><enum>(6)</enum><header>Classification of budgetary effects</header><text display-inline="yes-display-inline">Notwithstanding Rule 3 of the Budget Scorekeeping Guidelines set forth in the joint explanatory statement of the committee of conference accompanying Conference Report 105–217 and section 250(c)(7) and (c)(8) of the Balanced Budget and Emergency Deficit Control Act of 1985, the budgetary effects of this subsection shall be estimated for purposes of section 251 of such Act and as appropriations for discretionary accounts for purposes of the allocation to the Committee on Appropriations pursuant to section 302(a) of the Congressional Budget Act of 1974 and the concurrent resolution on the budget.</text></paragraph></subsection>

<subsection id="H2873453ADF9A41ECA51DF0F1B04F7E85"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 905(c) of division J of <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref> and section 23005(c) of division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/159">Public Law 117–159</external-xref>, Rule 3 of the Budget Scorekeeping Guidelines set forth in the joint explanatory statement of the committee of conference accompanying Conference Report 105–217, and sections 250(c)(7) and (c)(8) of the Balanced Budget and Emergency Deficit Control Act of 1985, the budgetary effects for any fiscal year for the amounts specified in subsection (b) shall not count for purposes of section 251 of such Act.</text></subsection> <subsection id="H528451CE229547B09E48DEA0A3031A1F"><enum>(b)</enum><header>Amounts</header><text>The amounts specified in this subsection are—</text>

Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022, in division B of the Bipartisan Safer Communities Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/159">Public Law 117–159</external-xref>);</text></paragraph> <paragraph id="H7B2CAC3CC0634353B3337588611481A4"><enum>(2)</enum><text display-inline="yes-display-inline">amounts designated by the Congress as an emergency requirement pursuant to section 251(b) of the Balanced Budget and Emergency Deficit Control Act of 1985 in division J of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>); and</text></paragraph> 
<paragraph id="HD2FA3AEBAD594ED7AB9AA88E05AEBBBC"><enum>(3)</enum><text>amounts designated by the Congress as being for an emergency requirement pursuant to section 4001(a)(1) and section 4001(b) of S. Res. 1151 (117th Congress) in section 443(b) in division G of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>).</text></paragraph></subsection></section></title> <title id="HCF2713385B364317B50AE132588E1E63"><enum>II</enum><header>Budget Enforcement in the House of Representatives</header> <section id="HA044E74665F4412C96C9378AD24D7E90"><enum>111.</enum><header>Authority for Fiscal Year 2024 Budget Resolution in the House of Representatives</header> <subsection id="H4B959A1B676D4607AC12B7C547916BB8"><enum>(a)</enum><header>Fiscal Year 2024</header><text display-inline="yes-display-inline">For the purpose of enforcing the Congressional Budget Act of 1974 for fiscal year 2024, the allocations, aggregates, and levels provided for in subsection (b) shall apply in the House of Representatives in the same manner as for a concurrent resolution on the budget for fiscal year 2024 with appropriate budgetary levels for fiscal year 2024 and for fiscal years 2025 through 2033. </text></subsection> 
<subsection id="HA2C51DB95CE242D69C7F2C5FAA3B4E4E"><enum>(b)</enum><header>Committee Allocations, Aggregates, and Levels</header><text display-inline="yes-display-inline">In the House of Representatives, the Chair of the Committee on the Budget shall submit a statement for publication in the Congressional Record as soon as practicable containing— </text> <paragraph id="H2CFCDBAA6D1443E7B1B679ABD682E1F0"><enum>(1)</enum><text>for the Committee on Appropriations, committee allocations for fiscal year 2024 consistent with discretionary spending limits set forth in section 251(c)(9) of the Balanced Budget and Emergency Deficit Control Act of 1985, as added by this Act, and the outlays flowing therefrom, and committee allocations for fiscal year 2024 for current law mandatory budget authority and outlays, for the purpose of enforcing section 302 of the Congressional Budget Act of 1974; </text></paragraph> 
<paragraph id="HF538C13FDC904E288450636C00BF7BB2"><enum>(2)</enum><text>for all committees of the House of Representatives other than the Committee on Appropriations, committee allocations for fiscal year 2024 and for the period of fiscal years 2025 through 2033 consistent with the most recent baseline of the Congressional Budget Office, as adjusted, to the extent practicable, for the budgetary effects of any provision of law enacted during the period beginning on the date such baseline is issued and ending on the date of submission of such statement, for the purpose of enforcing section 302 of the Congressional Budget Act of 1974; </text></paragraph> <paragraph id="H351D9BCFFAA54BF7A7D40EA14E764C1E"><enum>(3)</enum><text>aggregate spending levels for fiscal year 2024 in accordance with the allocations established under paragraphs (1) and (2), for the purpose of enforcing section 311 of the Congressional Budget Act of 1974; and </text></paragraph> 
<paragraph id="H683D1CACEA514EAAAA5ADCD80BC91459"><enum>(4)</enum><text>aggregate revenue levels for fiscal year 2024 and for the period of fiscal years 2025 through 2033 consistent with the most recent baseline of the Congressional Budget Office, as adjusted, to the extent practicable, for the budgetary effects of any provision of law enacted during the period beginning on the date such baseline is issued and ending on the date of submission of such statement, for the purpose of enforcing section 311 of the Congressional Budget Act of 1974. </text></paragraph></subsection> <subsection id="H1566ECC0763A42AA8A92A50E82E57910"><enum>(c)</enum><header>Adjustments</header><text>The Chair of the Committee on the Budget of the House of Representatives may adjust the allocations, aggregates, and other budgetary levels included in the statement referred to in subsection (b)— </text> 
<paragraph id="H636074EB933346FDBE82988AB6C7F497"><enum>(1)</enum><text>to reflect changes resulting from the Congressional Budget Office’s updates to its baseline for fiscal years 2024 through 2033; or </text></paragraph> <paragraph id="H4CFF5D93D1D2440987EA65DB6CA5CE6B"><enum>(2)</enum><text>for any bill, joint resolution, amendment, or conference report by the amounts provided in such measure if such measure would not increase the deficit for either of the following time periods: fiscal year 2024 to fiscal year 2028 or fiscal year 2024 to fiscal year 2033. </text></paragraph></subsection> 
<subsection id="HFB3460CDECE04F51B7E59D05F8DD2FAC"><enum>(d)</enum><header>Expiration</header><text>Subsections (a) through (c) shall no longer apply if a concurrent resolution on the budget for fiscal year 2024 is agreed to by the Senate and House of Representatives. </text></subsection></section> <section id="H80F1A222272842C69500649F4A9EB9E8"><enum>112.</enum><header>Limitation on Advance Appropriations in the House of Representatives</header> <subsection id="H19B468079BD7409AA5B6DADBBFCFB93F"><enum>(a)</enum><header>In General</header><text>In the House of Representatives, except as provided in subsection (b), any general appropriation bill or bill or joint resolution continuing appropriations, or amendment thereto or conference report thereon, may not provide an advance appropriation. </text></subsection> 
<subsection id="HF6C9CCD66C9149659964FE4C4555DEBC"><enum>(b)</enum><header>Exceptions</header><text>An advance appropriation may be provided for programs, activities or accounts identified in lists submitted for printing in the Congressional Record by the Chair of the Committee on the Budget— </text> <paragraph id="HDA5BC3AEE2AE4ED480976853D6624B5F"><enum>(1)</enum><text>for fiscal year 2025, under the heading <header-in-text level="section" style="OLC">“Accounts Identified for Advance Appropriations”</header-in-text> in an aggregate amount not to exceed $28,852,000,000 in new budget authority; </text></paragraph> 
<paragraph id="H9C875719353A44FDA5BE2246E4CEB25E"><enum>(2)</enum><text>for fiscal year 2025, under the heading <header-in-text level="section" style="OLC">“Veterans Accounts Identified for Advance Appropriations”</header-in-text>; and</text></paragraph> <paragraph id="H69190796FAA445D5B287F6F3E8354E75"><enum>(3)</enum><text display-inline="yes-display-inline">for fiscal year 2025, under the heading <header-in-text level="section" style="OLC">“Indian Health Accounts Identified for Advance Appropriations”</header-in-text> in an aggregate amount not to exceed the total budget authority provided for such accounts for fiscal year 2024 in bills or joint resolutions making appropriations for fiscal year 2024.</text></paragraph></subsection> 
<subsection id="HD51D2996DFE64FF9946AF87E8883208C"><enum>(c)</enum><header>Definition</header><text>The term <term>advance appropriation</term> means any new discretionary budget authority provided in a general appropriation bill or bill or joint resolution continuing appropriations for fiscal year 2024, or any amendment thereto or conference report thereon, that first becomes available following fiscal year 2024. </text></subsection> <subsection id="H77687FD336944C76A40654AB33E278E8"><enum>(d)</enum><header>Expiration</header><text>The preceding subsections of this section shall expire if a concurrent resolution on the budget for fiscal year 2024 is agreed to by the Senate and the House of Representatives pursuant to section 301 of the Congressional Budget Act of 1974. </text></subsection></section> 
<section id="HA8D4A550552D4307893245D047410D5C"><enum>113.</enum><header>Exercise of rulemaking powers</header><text display-inline="no-display-inline">This title is enacted by the House of Representatives—</text> <paragraph id="H42A049C0C4CB4CC68D999F46FC21BABC"><enum>(1)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the House, and as such shall be considered as part of the rules of the House, and such rules shall supersede other rules only to the extent that it is inconsistent therewith; and</text></paragraph> 
<paragraph id="H88BAAE3CFD6F41888F174097AE26341E"><enum>(2)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional right of the House to change such rules (so far as relating to the House) at any time, in the same manner, and to the same extent as in the case of any other rule of the House. </text></paragraph></section></title> <title id="H5090ED2E265147BAAD779F786F01E64C"><enum>III</enum><header>Budget Enforcement in the Senate</header> <section id="HBC394409E51A4221AE7216769CCFE831"><enum>121.</enum><header>Authority for fiscal year 2024 budget resolution in the Senate</header> <subsection id="H85A8F62C7574496CB6F25EAE34D7CA40"><enum>(a)</enum><header>Fiscal year 2024</header><text display-inline="yes-display-inline">For the purpose of enforcing the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/621">2 U.S.C. 621 et seq.</external-xref>) and enforcing budgetary points of order in prior concurrent resolutions on the budget, the allocations, aggregates, and levels provided for in subsection (b) shall apply in the Senate in the same manner as for a concurrent resolution on the budget for fiscal year 2024 with appropriate budgetary levels for fiscal year 2024 and for fiscal years 2025 through 2033. </text></subsection> 
<subsection id="H8B552BB378434E11B5BD42196817EB28"><enum>(b)</enum><header>Committee allocations, aggregates, and levels</header><text display-inline="yes-display-inline">The Chairman of the Committee on the Budget of the Senate shall submit a statement for publication in the Congressional Record as soon as practicable after the date of enactment of this Act that includes—</text> <paragraph id="H775F6498856F4E389C5266D6DA51DE49"><enum>(1)</enum><text display-inline="yes-display-inline">for the Committee on Appropriations of the Senate, committee allocations for fiscal year 2024 consistent with the discretionary spending limits set forth in section 251(c) of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended by this Act, and the outlays flowing therefrom, for the purpose of enforcing section 302 of the Congressional Budget Act of 1974; </text></paragraph>

<subparagraph id="H5B3F6EBF99EA4A05A1CA41DDD8D16858"><enum>(B)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term “advance appropriation” means any new budget authority provided in a bill or joint resolution making appropriations for fiscal year 2024 that first becomes available for any fiscal year after 2024 or any new budget authority provided in a bill or joint resolution making appropriations for fiscal year 2025 that first becomes available for any fiscal year after 2025.</text></subparagraph></paragraph> <paragraph id="H286A51075F184637842FD41BFEA4ED99"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Advance appropriations may be provided—</text>

<clause id="H05E0D19C44B54F5DA0BBF24EF08C070A"><enum>(i)</enum><text display-inline="yes-display-inline">for fiscal year 2025, in an amount that is not more than the amount provided for fiscal year 2024 in a bill or joint resolution making appropriations for fiscal year 2023 or 2024 for programs, projects, and activities that are not prohibited from using amounts provided for fiscal year 2024 in a bill or joint resolution making appropriations for fiscal year 2023; and </text></clause> <clause id="HAC88F7FB65F04B9EA3EA4BAEDF836055"><enum>(ii)</enum><text display-inline="yes-display-inline">for fiscal year 2026, in an amount that is not more than the amount provided for fiscal year 2025 in a bill or joint resolution making appropriations for fiscal year 2024 or 2025 for programs, projects, and activities that are not prohibited from using amounts provided for fiscal year 2025 in a bill or joint resolution making appropriations for fiscal year 2024. </text></clause></subparagraph></paragraph> 
<paragraph id="H7B2CCBCF397D42088C578610A090A5FA"><enum>(3)</enum><header>Supermajority waiver and appeal</header> 
<subparagraph id="H111AC16C469943C7A8456384A961AD81"><enum>(A)</enum><header>Waiver</header><text display-inline="yes-display-inline">In the Senate, paragraph (1) may be waived or suspended only by an affirmative vote of three-fifths of the Members, duly chosen and sworn. </text></subparagraph> <subparagraph id="H1C5186F8D28F479FAF5074CEF20BE776"><enum>(B)</enum><header>Appeal</header><text display-inline="yes-display-inline">An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="HE97786D04C06472EB92A9987C35EC0BF"><enum>(4)</enum><header>Form of point of order</header><text display-inline="yes-display-inline">A point of order under paragraph (1) may be raised by a Senator as provided in section 313(e) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/644">2 U.S.C. 644(e)</external-xref>). </text></paragraph> <paragraph id="H31DC78789B5849BCA47B753B1629D32E"><enum>(5)</enum><header>Conference reports</header><text display-inline="yes-display-inline">When the Senate is considering a conference report on, or an amendment between the Houses in relation to, a bill or joint resolution, upon a point of order being made by any Senator pursuant to this subsection, and such point of order being sustained, such material contained in such conference report or amendment between the Houses shall be stricken, and the Senate shall proceed to consider the question of whether the Senate shall recede from its amendment and concur with a further amendment, or concur in the House amendment with a further amendment, as the case may be, which further amendment shall consist of only that portion of the conference report or House amendment, as the case may be, not so stricken. Any such motion in the Senate shall be debatable. In any case in which such point of order is sustained against a conference report (or Senate amendment derived from such conference report by operation of this paragraph), no further amendment shall be in order. </text></paragraph></subsection> 
<subsection id="HB6C0645A7AA54345824F8D810A6D8E7D"><enum>(b)</enum><header>Expiration</header><text display-inline="yes-display-inline">Subsection (a) shall terminate on the date on which a concurrent resolution on the budget for fiscal year 2024 or for fiscal year 2025 is agreed to by the Senate and House of Representatives pursuant to section 301 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632</external-xref>). </text></subsection></section> <section id="HB83746C735C44357904EE26068FCF851"><enum>124.</enum><header>Exercise of rulemaking powers</header><text display-inline="no-display-inline">This title is enacted by the Senate—</text>

<title id="HAA68C0D2A1724417B116144A8F8C8E8D" style="traditional"><enum>I</enum><header>Rescission of unobligated funds</header> 
<section id="H70CDEC2869224489AA2B494E2BD4F559"><enum>1.</enum><text display-inline="yes-display-inline">Each rescission made by this title shall be applied to the unobligated balances for each applicable appropriation as of the date of enactment of this title.</text></section> <section id="HB5AE0DFBB1B74C32B404DF7E8FB5CFF4"><enum>2.</enum><text display-inline="yes-display-inline">The unobligated balances from the following appropriations, in the following amounts and subject to the conditions specified below, are hereby permanently rescinded:</text>

<section id="H4AED043D042242E9B61DCE1BB6D1EED1"><enum>262.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title—</text> <paragraph id="H9B16D264F9AE48B197B438EB66948842"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>administrative action</term> means a <quote>rule</quote> as defined in section 804(3) of title 5, United States Code;</text></paragraph> 
<paragraph id="HEDF577F9C6154A6A9B338545373307C3"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means any authority of the United States that is an <quote>agency</quote> under section 3502(1) of title 44, United States Code, other than those considered to be independent regulatory agencies, as defined in section 3502(5) of such title;</text></paragraph> <paragraph id="H38DA0D611CA3488EB88C622DDA85E470"><enum>(3)</enum><text>the term <term>covered discretionary administrative action</term> means a discretionary administrative action that would affect direct spending;</text></paragraph> 
<paragraph id="H9C376B9452A447D3BB208AA4A1E5E2AE"><enum>(4)</enum><text>the term <term>direct spending</term> has the meaning given that term in section 250(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900(c)</external-xref>);</text></paragraph> <paragraph id="HD275E02DE3D644B2A1B18CD4DA19A3D6"><enum>(5)</enum><text>the term <term>Director</term> means the Director of the Office of Management and Budget;</text></paragraph> 
<paragraph id="HC1C02FEFF2F04939828E0E325D15FCEB"><enum>(6)</enum><text>the term <term>discretionary administrative action</term>—</text> <subparagraph id="H23496003FB7B428E943BF5D987EB61EA"><enum>(A)</enum><text>means any administrative action that is not required by law; and</text></subparagraph> 
<subparagraph id="H100A07962FBA4F51BE23E5A8B25F080D"><enum>(B)</enum><text>includes an administrative action required by law for which an agency has discretion in the manner in which to implement the administrative action; and</text></subparagraph></paragraph> <paragraph id="HDC6DBCD3470749A1BDAFD8CA67EF2EAB"><enum>(7)</enum><text>the term <term>increase direct spending</term> means that the amount of direct spending would increase relative to—</text> 
<subparagraph id="HACE09BCF0DB64A8BBDD78A1E81ADA820"><enum>(A)</enum><text>the most recently submitted projection of the amount of direct spending presented in baseline estimates as defined in section 257 of the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, under—</text> <clause id="H029B393869524DF28B6FAAC7BD17FC2F"><enum>(i)</enum><text>the budget of the President submitted under section 1105 of title 31, United States Code; or</text></clause> 
<clause id="HF2E7BEF79C154E9D897C5E0B53D0621F"><enum>(ii)</enum><text>the supplemental summary of the budget submitted under section 1106 of title 31, United States Code;</text></clause></subparagraph> <subparagraph id="HD7E5B39E44DB4A0290A1D59BF93E9579" commented="no"><enum>(B)</enum><text>with respect to a discretionary administrative action that is incorporated into the applicable projection described in subparagraph (A) and for which a proposal has not been submitted under section 263(a)(2)(A), a projection of the amount of direct spending if no administrative action were taken; or</text></subparagraph> 
<subparagraph id="H9379FE61799A422185A1D8C772F3B764"><enum>(C)</enum><text>with respect to a discretionary administrative action described in paragraph (6)(B), a projection of the amount of direct spending under the least costly implementation option reasonably identifiable by the agency that meets the requirements under the statute.</text></subparagraph></paragraph></section> <section id="HD94BDF63D7334130935D127EE7075D44"><enum>263.</enum><header>Requirements for administrative actions that affect direct spending</header> <subsection id="HAAFC125E01F34EF3B51CA471787D5A85"><enum>(a)</enum><header>Discretionary administrative actions</header> <paragraph id="HEA2C34D9A58147989DA7F322162D79AA"><enum>(1)</enum><header>In general</header><text>Before an agency may finalize any covered discretionary administrative action, the head of the agency shall submit to the Director for review written notice regarding the covered discretionary administrative action, which shall include an estimate of the budgetary effects of the covered discretionary administrative action.</text></paragraph> 
<paragraph id="HE3774668DF4A4AFA9FAD5A036553726E"><enum>(2)</enum><header>Increasing direct spending</header> 
<subparagraph id="H296EF3F3682B44CB93E009634879FD17"><enum>(A)</enum><header>In general</header><text>If the covered discretionary administrative action would increase direct spending, the written notice submitted by the head of the agency under paragraph (1) shall include a proposal to undertake 1 or more other administrative actions that would provide a reduction in direct spending greater than or equal to the increase in direct spending attributable to the covered discretionary administrative action.</text></subparagraph> <subparagraph id="HBDF8194CB5894495B92732A19EFE21B3"><enum>(B)</enum><header>Review</header> <clause id="H1A0DB456E31044F8832CB8424AC3583A"><enum>(i)</enum><header>In general</header><text>The Director shall determine whether the reduction in direct spending in a proposal in a written notice from an agency under subparagraph (A) is greater than or equal to the increase in direct spending attributable to the covered discretionary administrative action to which the written notice relates.</text></clause> 
<clause id="H48EE5E3343B14D1387826CC2569C7FAE"><enum>(ii)</enum><header>No offset</header><text>If the written notice regarding a proposed covered discretionary administrative action that would increase direct spending does not include a proposal to offset the increased direct spending as determined in clause (i), the Director shall return the written notice to the agency for resubmission in accordance with this title.</text></clause></subparagraph></paragraph></subsection> <subsection id="HA9BCB3252DB84053ACFB3F4809099353"><enum>(b)</enum><header>Nondiscretionary actions</header><text>If an agency determines that an administrative action that would increase direct spending is required by law and therefore is not a covered discretionary administrative action, before the agency finalizes that administrative action, the head of the agency shall—</text> 
<paragraph id="H5D05C30597FD48D7BE2504F0213F43B3"><enum>(1)</enum><text>submit to the Director a written opinion by the general counsel of the agency, or the equivalent employee of the agency, explaining that legal conclusion;</text></paragraph> <paragraph id="HC81F80D88EFA433D96B3B92C37580B55"><enum>(2)</enum><text>submit to the Director a projection of the amount of direct spending under the least costly implementation option reasonably identifiable by the agency that meets the requirements under the statute; and</text></paragraph> 
<paragraph id="HA00D11B20E944603907E68C85B24986F"><enum>(3)</enum><text>consult with the Director regarding implementation of the administrative action.</text></paragraph></subsection> <subsection id="H70B364705E06403091B7A70D125689BF"><enum>(c)</enum><header>Projections</header><text>Any projection for purposes of this title shall be conducted in accordance with Office of Management and Budget Circular A–11, or any successor thereto.</text></subsection></section> 
<section id="HCA56A9F6D2A3410E9471CF23BDC95218"><enum>264.</enum><header>Issuance of administrative guidance</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Director shall issue instructions regarding the implementation of this title, including how covered discretionary administrative actions that increase direct spending and nontax receipts will be evaluated.</text></section> <section id="H84CA8EB7B9214969A83371684475C2BF"><enum>265.</enum><header>Waiver</header> <subsection id="HEA6279E777954ED98446A33956994401" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director may waive the requirements of section 263 if the Director concludes that the waiver—</text> 
<paragraph id="HE2B7A54BAC82491385B7DAAD32666C92" commented="no"><enum>(1)</enum><text>is necessary for the delivery of essential services; or</text></paragraph> <paragraph id="HE6C3EB36EBA440509A6AEEFD47F31AC8" commented="no"><enum>(2)</enum><text>is necessary for effective program delivery.</text></paragraph></subsection> 
<subsection id="HAB5366E3325645E6AFBA46234AA4158B"><enum>(b)</enum><header>Publication</header><text display-inline="yes-display-inline">Any waiver determination under subsection (a) shall be published in the Federal Register.</text></subsection></section> <section id="HEE3DBE5FA5894870BAEE0A85E65E8C41"><enum>266.</enum><header>Exemption</header><text display-inline="no-display-inline">This title shall not apply to administrative actions with direct spending cost of less than—</text> 
<paragraph id="H04033F8A227740C8A7C4C020F6C58134"><enum>(1)</enum><text>$1,000,000,000 over the 10-year period beginning with the current year; or</text></paragraph> <paragraph id="H96EB270F767845D5AA53A14622290B8F"><enum>(2)</enum><text display-inline="yes-display-inline">$100,000,000 in any given year during such 10-year period.</text></paragraph></section> 
<section id="H737048FA904F4411B36291C6BCFA6FC2"><enum>267.</enum><header>Judicial review</header><text display-inline="no-display-inline">No determination, finding, action, or omission under this title shall be subject to judicial review.</text></section> <section id="HFCC97C86ACA24C599E0974D0A2099BC4"><enum>268.</enum><header>Sunset</header><text display-inline="no-display-inline">This title shall expire on December 31, 2024.</text></section> 
<section id="H0AC56D91375F4EBC9C2C9E91449A3416"><enum>269.</enum><header>GAO report</header><text display-inline="no-display-inline">Within 180 days of the date of enactment of this Act, the Comptroller General shall issue a report on the implementation of this title.</text></section> <section id="HF2D1BE86F46A4FEDBBD0FD6D9C23EECB"><enum>270.</enum><header>Congressional Review Act compliance assessment</header><text display-inline="no-display-inline">Section 801(a)(2)(A) of title 5, United States Code, is amended by inserting after <quote>compliance with procedural steps required by paragraph (1)(B)</quote> the following: <quote>, and shall in addition include an assessment of the agency’s compliance with such requirements of the Administrative Pay-As-You-Go Act of 2023 as may be applicable</quote>.</text></section></title>

<subsection id="H4C444C4F70C141419AFED3086A298180"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Sixty days after June 30, 2023, the waivers and modifications described in subsection (c) shall cease to be effective.</text></subsection> <subsection id="HCDBD7B538B324C86951CF2E37DA85A1C"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Except as expressly authorized by an Act of Congress enacted after the date of enactment of this Act, the Secretary of Education may not use any authority to implement an extension of any executive action or rule specified in subsection (c).</text></subsection>

<paragraph id="H51EFDF6D18AE4EDEA57233F711ADF076"><enum>(2)</enum><text>most recently extended in the announcement by the Department of Education on November 22, 2022.</text></paragraph></subsection></section></title></division> <division id="H50BC7ACDB90743169344BABDD00FA11F"><enum>C</enum><header>Grow the Economy</header> <title id="H0A6FACC69CF84EBD967B92582C1686FA"><enum>I</enum><header>Temporary Assistance to Needy Families</header> <section id="H812608847AF644D883B84518D22E89E4"><enum>301.</enum><header>Recalibration of the caseload reduction credit</header><text display-inline="no-display-inline">Section 407(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(b)(3)</external-xref>) is amended in each of subparagraphs (A)(ii) and (B), by striking <quote>2005</quote> and inserting <quote>2015</quote>.</text></section> 
<section id="H19A141A748D64BA6817B136CFA1B6A8F" display-inline="no-display-inline" section-type="subsequent-section"><enum>302.</enum><header>Pilot projects for promoting accountability by measuring work outcomes</header><text display-inline="no-display-inline">Section 411 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H487E3AC8933043479D17E33F06434A5F"> <subsection id="H256A5D9FB7D142DC9C3CB1D863EAACE3"><enum>(e)</enum><header>Pilot projects for promoting accountability by measuring work outcomes</header> <paragraph id="HEF7B7374B1844C36A55586E2576349B5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a pilot program under which the Secretary may select up to 5 States to which a grant is made under section 403(a) for a fiscal year to negotiate performance benchmarks for work and family outcomes for recipients of assistance under the State program funded under this part, and programs funded with qualified State expenditures. The Secretary shall issue guidance on how States apply for participation in the pilot. The benchmarks shall include—</text> 
<subparagraph id="H285C1426BF234445AA7991C7E9519219"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage of work-eligible individuals under the State program funded under this part who are in unsubsidized employment during the 2nd quarter after exiting the program;</text></subparagraph> <subparagraph id="H4D9C0715142C4E44B2A77243FB770766"><enum>(B)</enum><text>the level of earnings of such individuals in the 2nd and 4th quarters after exit; and</text></subparagraph> 
<subparagraph id="H463871F0BB6F4B75981D64D543BCBA59"><enum>(C)</enum><text>other indicators of family stability and well-being as established by the Secretary.</text></subparagraph></paragraph> <paragraph id="HE59D8BC764694AB8AF85250EFD32E745"><enum>(2)</enum><header>Level of performance benchmark</header><text display-inline="yes-display-inline">The Secretary and a State selected under paragraph (1) shall agree to the requisite level of performance on these benchmarks after developing baseline data in the State and comparative data in other States.</text></paragraph> 
<paragraph id="H755C09AA26A547AA8B37AEABBF901B87"><enum>(3)</enum><header>Failure of State to meet benchmark</header><text display-inline="yes-display-inline">If a State fails to meet a measured benchmark standard agreed to under paragraph (2) for 2 successive fiscal years, the State, in order to continue in the pilot shall enter into a plan with the Secretary to achieve the required level of performance or, if mutually agreed to, adjust the benchmark based on new information about the feasibility of meeting such benchmark.</text></paragraph> <paragraph id="H0D9940D9072A4EA99E02D51C8771E1E6"><enum>(4)</enum><header>Duration</header><text display-inline="yes-display-inline">The pilot under this subsection shall be in effect for 6 fiscal years, with one year to establish benchmark data and negotiate targets and five years to measure performance against the targets, and shall supersede the requirements under section 407 for such fiscal years, notwithstanding any other provision of law.</text></paragraph> 
<paragraph id="HE9F1FB63A53A45AD86021AEAB7BCACE4" commented="no"><enum>(5)</enum><header>Application of penalty for failure to reduce assistance for recipients refusing without good cause to work</header><text display-inline="yes-display-inline">For purposes of section 409(a)(14), a State operating a pilot must have a system for reducing the amount of assistance payable to a family if an individual refuses, without good cause (including for reasons described in 407(e)(2)), to engage in any such activities as the State has required of such an individual. A State without such a system shall be considered to have failed to comply with the requirements of section 407(e) for so long as the failure to comply continues.</text></paragraph> <paragraph id="HCF5759370D9A49E5AF9D5144B23CBB83"><enum>(6)</enum><header>Collection of performance data</header><text display-inline="yes-display-inline">Each State selected under paragraph (1), in consultation with the Secretary, shall collect and submit to the Secretary data on the performance of the State operating such a pilot program.</text></paragraph> 
<paragraph id="H702D2F59608B40F3AC538D1A5E5375C8"><enum>(7)</enum><header>Reports</header> 
<subparagraph id="HB428F98EF06C491493A5A72C44BB8F88"><enum>(A)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this subsection the Secretary shall submit a report to Congress on the status of the program under this section.</text></subparagraph> <subparagraph id="H2DE6C4BA24C04152878A594E9EF0292E"><enum>(B)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 12 months after the date on which the programs under this section have terminated, the Secretary shall submit a comprehensive report to Congress on outcomes achieved under such programs.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3F04DB1D3DB244A081EB9A28C5AFB51F"><enum>303.</enum><header>Elimination of small checks scheme</header><text display-inline="no-display-inline">Section 407(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607(b)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7458EBBB491F4DDF85FCBA16FA6AB457"> <paragraph id="HFD80D9787A3D4868B384B84DA8D1FCEB"><enum>(6)</enum><header>Special rule regarding calculation of the minimum participation rate</header><text display-inline="yes-display-inline">The Secretary shall determine participation rates under this section without regard to any individual engaged in work in a family that receives no assistance under this part and less than $35 in assistance funded with qualified State expenditures (as defined in section 409(a)(7)(B)(i)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HCE7113D8A8DF4BBCA0CB123269E87999"><enum>304.</enum><header>Reporting of work outcomes</header><text display-inline="no-display-inline">Section 411 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/611">42 U.S.C. 611</external-xref>), as amended by section 302, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7ED7B29E0F5245E9BF3E68D248ED0755"> <subsection id="H1D678934FC404F19975EF78F0BA66C79"><enum>(f)</enum><header>Reporting performance indicators</header> <paragraph id="H03C7E34D0F474A4F99A24032FFF4E752"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each State, in consultation with the Secretary, shall collect and submit to the Secretary the information necessary for each indicator described in paragraph (2), for fiscal year 2025 and each fiscal year thereafter.</text></paragraph> 
<paragraph id="H04D69653843A4DC186F9394E0CEF70D1"><enum>(2)</enum><header>Indicators of performance</header><text display-inline="yes-display-inline">The indicators described in this paragraph for a fiscal year are the following:</text> <subparagraph id="H325526A15780425E922199FC62610B7E"><enum>(A)</enum><text>The percentage of individuals who were work-eligible individuals as of the time of exit from the program, who are in unsubsidized employment during the second quarter after the exit.</text></subparagraph> 
<subparagraph id="HC8F6A714762541ECAE343EA11ADD44EA"><enum>(B)</enum><text>The percentage of individuals who were work-eligible individuals who were in unsubsidized employment in the second quarter after the exit, who are also in unsubsidized employment during the fourth quarter after the exit.</text></subparagraph> <subparagraph id="HD6BBE99A048C4FB39755250E694D007A"><enum>(C)</enum><text>The median earnings of individuals who were work-eligible individuals as of the time of exit from the program, who are in unsubsidized employment during the second quarter after the exit.</text></subparagraph> 
<subparagraph id="HD0D970F5919A4AC0AD92531269F09D5A"><enum>(D)</enum><text>The percentage of individuals who have not attained 24 years of age, are attending high school or enrolled in an equivalency program, and are work-eligible individuals or were work-eligible individuals as of the time of exit from the program, who obtain a high school degree or its recognized equivalent while receiving assistance under the State program funded under this part or within 1 year after the exit.</text></subparagraph></paragraph> <paragraph id="HCDF252247FBA49798F446485DEE56EA8"><enum>(3)</enum><header>Definition of exit</header><text display-inline="yes-display-inline">In paragraph (2), the term ‘exit’ means, with respect to a State program funded under this part, ceases to receive assistance under the program funded by this part.</text></paragraph> 
<paragraph id="H41CDCFE7BC0E4B9CAFCC4E8B9FBF6C0B"><enum>(4)</enum><header>Regulations</header><text display-inline="yes-display-inline">In order to ensure nationwide comparability of data, the Secretary, after consultation with the Secretary of Labor and with States, shall issue regulations governing the reporting of performance indicators under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H53F12161DE8C4B6EB971EB8655D74075"><enum>305.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this title shall take effect on October 1, 2024, except for sections 301 and 303 which shall take effect on October 1, 2025.</text></section></title>

<paragraph id="HD0985D7C5E544773A368A880A00F18D6"><enum>(2)</enum><header>Sunset</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall cease to have effect on October 1, 2030. </text></paragraph></subsection></section> <section id="H653A3ED5C8024CF288DA88D54F7A3AD4" section-type="subsequent-section"><enum>312.</enum><header>Modification of general exemptions</header><text display-inline="no-display-inline">Section 6(o)(6) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(o)(6)</external-xref>) is amended—</text>

<quoted-block-continuation-text quoted-block-continuation-text-level="section">That program includes as a purpose to assist low-income adults in obtaining employment and increasing their earnings. Such employment and earnings, along with program benefits, will permit low-income households to obtain a more nutritious diet through normal channels of trade by increasing food purchasing power for all eligible households who apply for participation.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H498838477C054C8580700D791A5B45BE"><enum>314.</enum><header>Waiver transparency</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary of Agriculture shall make public all available State waiver requests, including all supporting data from the State, and agency approvals of such requests, including relevant documentation on the utilization of waivers authorized under Section 6(o)(4)(A) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(o)(4)(A)</external-xref>).</text></section></title> <title id="H2E793A4C17BA43728F608ECB762216C3"><enum>III</enum><header>Permitting Reform</header> <section id="H854FC96EBF8F4BA8BDDD64A75758512B"><enum>321.</enum><header>Builder Act</header> <subsection id="H2E6409FA7B1D447C9C3C60D9C26B794E"><enum>(a)</enum><header>Paragraph (2) of section 102</header><text>Section 102(2) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)</external-xref>) is amended—</text> 
<paragraph id="H97CC0BE12E7B4B8593858DCC05F341DA"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>insure</quote> and inserting <quote>ensure</quote>;</text></paragraph> <paragraph id="H8727909274014AC88CF615F865A8EA8E"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>insure</quote> and inserting <quote>ensure</quote>;</text></paragraph>

<clause id="H6BC68F9168F249F0AF68BB18942EB56A"><enum>(iv)</enum><text>the relationship between local short-term uses of man’s environment and the maintenance and enhancement of long-term productivity; and</text></clause> <clause id="H3499807712854CD7B77111B2E1451DD7"><enum>(v)</enum><text>any irreversible and irretrievable commitments of Federal resources which would be involved in the proposed agency action should it be implemented.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H6CB9F23871AA46CF96BECC2185CFDC24"><enum>(C)</enum><text>by striking <quote>the responsible Federal official</quote> and inserting <quote>the head of the lead agency</quote>;</text></subparagraph></paragraph> <paragraph id="H7CFBB71AF5514C54AA6E0FD4B759064C"><enum>(4)</enum><text>in subparagraph (D), by striking <quote>Any</quote> and inserting <quote>any</quote>;</text></paragraph>

<subparagraph id="H2E5E76CFF3EE46299EA257D96CAC4EDA" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">consistent with the provisions of this Act, study, develop, and describe technically and economically feasible alternatives;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H67F1045F93D6407FBEFDEE7927F39448"><enum>(7)</enum><text display-inline="yes-display-inline">in subparagraph (I), as amended, by inserting <quote>consistent with the provisions of this Act,</quote> before <quote>recognize</quote>.</text></paragraph></subsection> 
<subsection id="H6D54672697CF48BEBAF4A51738FC5DFF"><enum>(b)</enum><header>New sections</header><text>Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H223BE887322E46FABBB90B3EFB1AC875" display-inline="no-display-inline"> <section id="H78801B2E3C674C73814B9790307696BA"><enum>106.</enum><header>Procedure for determination of level of review</header> <subsection id="H0FFD02237DC444D2803397AF2306B4FB"><enum>(a)</enum><header>Threshold determinations</header><text>An agency is not required to prepare an environmental document with respect to a proposed agency action if—</text> 
<paragraph id="HF5DBE8F145C74C9AB282E6DCE541D1C1"><enum>(1)</enum><text>the proposed agency action is not a final agency action within the meaning of such term in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code;</text></paragraph> <paragraph id="H8D1CC4B86AA747848D82131280BB4B42"><enum>(2)</enum><text>the proposed agency action is excluded pursuant to one of the agency’s categorical exclusions, another agency’s categorical exclusions consistent with section 109 of this Act, or another provision of law;</text></paragraph> 
<paragraph id="H99A88DAE0AEE4AF99BA9CA9DE2BAC247"><enum>(3)</enum><text>the preparation of such document would clearly and fundamentally conflict with the requirements of another provision of law; or</text></paragraph> <paragraph id="HC5AD9732999D4D8686C275E06B3C2F6B"><enum>(4)</enum><text>the proposed agency action is a nondiscretionary action with respect to which such agency does not have authority to take environmental factors into consideration in determining whether to take the proposed action.</text></paragraph></subsection> 
<subsection id="H5649EE35AC3A45DDB9EB0E05FB9FB22C"><enum>(b)</enum><header>Levels of review</header> 
<paragraph id="HDEB2C71B47674117BE381B68359E0CBB"><enum>(1)</enum><header>Environmental impact statement</header><text display-inline="yes-display-inline">An agency shall issue an environmental impact statement with respect to a proposed agency action requiring an environmental document that has a reasonably foreseeable significant effect on the quality of the human environment.</text></paragraph> <paragraph id="H9DA64F6254A74761AF5036684235987F"><enum>(2)</enum><header>Environmental assessment</header><text display-inline="yes-display-inline">An agency shall prepare an environmental assessment with respect to a proposed agency action that does not have a reasonably foreseeable significant effect on the quality of the human environment, or if the significance of such effect is unknown, unless the agency finds that the proposed agency action is excluded pursuant to one of the agency’s categorical exclusions, another agency’s categorical exclusions consistent with section 109 of this Act, or another provision of law. Such environmental assessment shall be a concise public document prepared by a Federal agency to set forth the basis of such agency’s finding of no significant impact or determination that an environmental impact statement is necessary.</text></paragraph> 
<paragraph id="H261B5AC33FAD44DFB0276D0A904AC53E"><enum>(3)</enum><header>Sources of information</header><text>In making a determination under this subsection, an agency—</text> <subparagraph id="H53B8D87DE8694E92810669270F329D36"><enum>(A)</enum><text>may make use of any reliable data source; and</text></subparagraph> 
<subparagraph id="H7BB02D3091554F30B9476ED5997A4B0A"><enum>(B)</enum><text>is not required to undertake new scientific or technical research unless the new scientific or technical research is essential to a reasoned choice among alternatives, and the overall costs and time frame of obtaining it are not unreasonable.</text></subparagraph></paragraph></subsection></section> <section id="HC46B137C3DA6410C9A6898639F005FCE"><enum>107.</enum><header>Timely and unified federal reviews</header> <subsection id="H2B0DD9C0731042BD893D1A27C2A78C2E"><enum>(a)</enum><header>Lead agency</header> <paragraph id="H54C05C0440B64C2E903A4B71D2544657"><enum>(1)</enum><header>Designation</header> <subparagraph id="HC1911A30E8D146AF81BBB8B70C71BC9D"><enum>(A)</enum><header>In general</header><text>If there are two or more participating Federal agencies, such agencies shall determine, by letter or memorandum, which agency shall be the lead agency based on consideration of the—</text> 
<clause id="HCE1C1684E3C54836AA4A87D6D73A9750"><enum>(i)</enum><text>magnitude of agency’s involvement;</text></clause> <clause id="HBACC63386056419A8EF967A071038423"><enum>(ii)</enum><text>project approval or disapproval authority;</text></clause> 
<clause id="H71FFE433BD034EC2B616A1FFDA9F5ACE"><enum>(iii)</enum><text>expertise concerning the action’s environmental effects;</text></clause> <clause id="HE2EC225465B44163A4B4706C9614E926"><enum>(iv)</enum><text>duration of agency’s involvement; and</text></clause> 
<clause id="H0564ED34FCA44687AAFBDEEA0C5EABF6"><enum>(v)</enum><text>sequence of agency’s involvement.</text></clause></subparagraph> <subparagraph id="H377B8016A146414B8DEC12E36EDFF4D5"><enum>(B)</enum><header>Joint lead agencies</header><text>In making a determination under subparagraph (A), the participating Federal agencies may appoint such State, Tribal, or local agencies as joint lead agencies as the involved Federal agencies shall determine appropriate. Joint lead agencies shall jointly fulfill the role described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="HF2CA8B9B2F2E4D619FDD1C7626729BD2"><enum>(2)</enum><header>Role</header><text>A lead agency shall, with respect to a proposed agency action—</text> <subparagraph id="H7F95851B474A48389E481D0291EFB0A0"><enum>(A)</enum><text>supervise the preparation of an environmental document if, with respect to such proposed agency action, there is more than one participating Federal agency;</text></subparagraph> 
<subparagraph id="H9B25042EDFE8433CB1E627C447391AEE"><enum>(B)</enum><text>request the participation of each cooperating agency at the earliest practicable time;</text></subparagraph> <subparagraph id="HB06F733D10BC4B8BBC6F8690981639CE"><enum>(C)</enum><text>in preparing an environmental document, give consideration to any analysis or proposal created by a cooperating agency;</text></subparagraph> 
<subparagraph id="HFD6A3083B7D24BAC846B97DF22926705"><enum>(D)</enum><text>develop a schedule, in consultation with each cooperating agency, the applicant, and such other entities as the lead agency determines appropriate, for completion of any environmental review, permit, or authorization required to carry out the proposed agency action;</text></subparagraph> <subparagraph id="H926B6430E4874367A706BF151393B5A1"><enum>(E)</enum><text>if the lead agency determines that a review, permit, or authorization will not be completed in accordance with the schedule developed under subparagraph (D), notify the agency responsible for issuing such review, permit, or authorization of the discrepancy and request that such agency take such measures as such agency determines appropriate to comply with such schedule; and</text></subparagraph> 
<subparagraph id="H2C4A9EFFF6C943D09D1D0C11293E9478"><enum>(F)</enum><text>meet with a cooperating agency that requests such a meeting.</text></subparagraph></paragraph> <paragraph id="H9D6BC4E016B14E3DA41CDCF501CFF896"><enum>(3)</enum><header>Cooperating agency</header><text display-inline="yes-display-inline">The lead agency may, with respect to a proposed agency action, designate any Federal, State, Tribal, or local agency that has jurisdiction by law or special expertise with respect to any environmental impact involved in a proposal to serve as a cooperating agency. A cooperating agency may, not later than a date specified in the schedule established by the lead agency, submit comments to the lead agency.</text></paragraph> 
<paragraph id="H5D24407B9D404C3F8AE279401DE06C15"><enum>(4)</enum><header>Request for designation</header><text>Any Federal, State, Tribal, or local agency or person that is substantially affected by the lack of a designation of a lead agency with respect to a proposed agency action under paragraph (1) may submit a written request for such a designation to a participating Federal agency. An agency that receives a request under this paragraph shall transmit such request to each participating Federal agency and to the Council.</text></paragraph> <paragraph id="H83AE2EE91B6A439099C4B72F143A4AA8"><enum>(5)</enum><header>Council designation</header> <subparagraph id="H05684802634D46889CD0869634760830"><enum>(A)</enum><header>Request</header><text>If the participating Federal agencies are unable to agree on the designation of a lead agency within 45 days of the request under paragraph (4), then the Federal, State, Tribal or local agency or person that is substantially affected by the lack or a designation of a lead agency may request that the Council designate a lead agency. Such request shall consist of—</text> 
<clause id="H84D80B7B47854BDE8C42383C3514A740"><enum>(i)</enum><text>a precise description of the nature and extent of the proposed agency action; and</text></clause> <clause id="H34783C534A2844AC99213DFC0516192A"><enum>(ii)</enum><text>a detailed statement with respect to each participating Federal agency and each factor listed in paragraph (1) regarding which agency should serve as lead agency.</text></clause></subparagraph> 
<subparagraph id="H21B2EBC190D24928BD59DD5A8E5F2822"><enum>(B)</enum><header>Transmission</header><text>The Council shall transmit a request received under subparagraph (A) to each participating Federal agency.</text></subparagraph> <subparagraph id="H4B0140CA4776466D85B4800BFA0BD2F9"><enum>(C)</enum><header>Response</header><text>A participating Federal agency may, not later than 20 days after the date of the submission of a request under subparagraph (A), submit to the Council a response to such request.</text></subparagraph> 
<subparagraph id="H451B5C0D729B43B6834B67775D5C5517"><enum>(D)</enum><header>Designation</header><text>Not later than 40 days after the date of the submission of a request under subparagraph (A), the Council shall designate the lead agency with respect to the relevant proposed agency action.</text></subparagraph></paragraph></subsection> <subsection id="H54F16E42507C41F7B1880503A5C0ABF3"><enum>(b)</enum><header>One document</header><text>To the extent practicable, if a proposed agency action will require action by more than one Federal agency and the lead agency has determined that it requires preparation of an environmental document, the lead and cooperating agencies shall evaluate the proposal in a single environmental document.</text></subsection> 
<subsection id="H706822FFF5CB4B86B933AEDB6DA60FDE"><enum>(c)</enum><header>Request for public comment</header><text>Each notice of intent to prepare an environmental impact statement under section 102 shall include a request for public comment on alternatives or impacts and on relevant information, studies, or analyses with respect to the proposed agency action.</text></subsection> <subsection id="HEF595F9AC14E427698612F4D7719A27A"><enum>(d)</enum><header>Statement of purpose and need</header><text>Each environmental document shall include a statement of purpose and need that briefly summarizes the underlying purpose and need for the proposed agency action.</text></subsection> 
<subsection id="HDED518C28F1C44E28871B77A77BD7932"><enum>(e)</enum><header>Page limits</header> 
<paragraph id="HDD9F602980A142DEA290BA85D70D1CC6"><enum>(1)</enum><header>Environmental impact statements</header> 
<subparagraph id="H336825ADCB4B436788BE4CE1CAD2ECD4"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an environmental impact statement shall not exceed 150 pages, not including any citations or appendices.</text></subparagraph> <subparagraph id="HE94DB1576A80412EBA2AD993077429FE"><enum>(B)</enum><header>Extraordinary complexity</header><text>An environmental impact statement for a proposed agency action of extraordinary complexity shall not exceed 300 pages, not including any citations or appendices.</text></subparagraph></paragraph> 
<paragraph id="H3954B5CC6459482DA317F5B82DA379D1"><enum>(2)</enum><header>Environmental assessments</header><text>An environmental assessment shall not exceed 75 pages, not including any citations or appendices.</text></paragraph></subsection> <subsection id="H18EE08CF86014136B3EB5D6167423412"><enum>(f)</enum><header>Sponsor preparation</header><text display-inline="yes-display-inline">A lead agency shall prescribe procedures to allow a project sponsor to prepare an environmental assessment or an environmental impact statement under the supervision of the agency. Such agency may provide such sponsor with appropriate guidance and assist in the preparation. The lead agency shall independently evaluate the environmental document and shall take responsibility for the contents.</text></subsection> 
<subsection id="H11428037589748D8874B60E9A78C98E5"><enum>(g)</enum><header>Deadlines</header> 
<paragraph id="HB5F602909FF94ACCB0A780E47DD683FC"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), with respect to a proposed agency action, a lead agency shall complete, as applicable—</text> <subparagraph id="H68CE606CB80E45A29354518AD545068F"><enum>(A)</enum><text>the environmental impact statement not later than the date that is 2 years after the sooner of, as applicable—</text> 
<clause id="H06C8214A59574D28972319FDDBC802DB"><enum>(i)</enum><text>the date on which such agency determines that section 102(2)(C) requires the issuance of an environmental impact statement with respect to such action;</text></clause> <clause id="HC55A23AF831B4490B7FCCD7049735CC1"><enum>(ii)</enum><text>the date on which such agency notifies the applicant that the application to establish a right-of-way for such action is complete; and</text></clause> 
<clause id="HDFA67154E4BE41C39501E65F489A03E0"><enum>(iii)</enum><text>the date on which such agency issues a notice of intent to prepare the environmental impact statement for such action; and</text></clause></subparagraph> <subparagraph id="HDB289032E397428E9FFD10E77C1BA2CD"><enum>(B)</enum><text>the environmental assessment not later than the date that is 1 year after the sooner of, as applicable—</text> 
<clause id="H92856EB17CDE4498AA44B7CA7CE602B2"><enum>(i)</enum><text>the date on which such agency determines that section 106(b)(2) requires the preparation of an environmental assessment with respect to such action;</text></clause> <clause id="HF2418BB4704A46DCADBCC2FC4704558A"><enum>(ii)</enum><text>the date on which such agency notifies the applicant that the application to establish a right-of-way for such action is complete; and</text></clause> 
<clause id="HA685E011B1C5473E8D264B32BA216840"><enum>(iii)</enum><text>the date on which such agency issues a notice of intent to prepare the environmental assessment for such action.</text></clause></subparagraph></paragraph> <paragraph id="H3189DA0E4BBE4181959B783AACFE7CFC"><enum>(2)</enum><header>Delay</header><text>A lead agency that determines it is not able to meet the deadline described in paragraph (1) may extend such deadline, in consultation with the applicant, to establish a new deadline that provides only so much additional time as is necessary to complete such environmental impact statement or environmental assessment.</text></paragraph> 
<paragraph id="H795A2907C01F4D5ABDE486F5423C431A"><enum>(3)</enum><header>Petition to court</header> 
<subparagraph id="H261083470ED04CA2B0AD52E9660DF273"><enum>(A)</enum><header>Right to petition</header><text>A project sponsor may obtain a review of an alleged failure by an agency to act in accordance with an applicable deadline under this section by filing a written petition with a court of competent jurisdiction seeking an order under subparagraph (B).</text></subparagraph> <subparagraph id="H1426C3C9C4AF483386552BE3943294B1"><enum>(B)</enum><header>Court order</header><text>If a court of competent jurisdiction finds that an agency has failed to act in accordance with an applicable deadline, the court shall set a schedule and deadline for the agency to act as soon as practicable, which shall not exceed 90 days from the date on which the order of the court is issued, unless the court determines a longer time period is necessary to comply with applicable law.</text></subparagraph></paragraph></subsection> 
<subsection id="HB6AED31706C54EDA8CBD058AC999D7AE"><enum>(h)</enum><header>Report</header> 
<paragraph id="HB451B2D3D9AF437A8B315E536CF477DE"><enum>(1)</enum><header>In general</header><text>The head of each lead agency shall annually submit to the Committee on Natural Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that—</text> <subparagraph id="H63767D327B534F4BB6074C21157731BD"><enum>(A)</enum><text>identifies any environmental assessment and environmental impact statement that such lead agency did not complete by the deadline described in subsection (g); and</text></subparagraph> 
<subparagraph id="HDED28FFCD7BC45579655C5EA30CF6E1F"><enum>(B)</enum><text>provides an explanation for any failure to meet such deadline.</text></subparagraph></paragraph> <paragraph id="HFE479CC9605242E692A424445C1E8A0E"><enum>(2)</enum><header>Inclusions</header><text>Each report submitted under paragraph (1) shall identify, as applicable—</text> 
<subparagraph id="H3F8CA36881CB470480E8424537A2C923"><enum>(A)</enum><text>the office, bureau, division, unit, or other entity within the Federal agency responsible for each such environmental assessment and environmental impact statement;</text></subparagraph> <subparagraph id="H7BA46A5B5C134875935BB50D68EBEBB1"><enum>(B)</enum><text>the date on which—</text> 
<clause id="HD674C48E7C0341608B02ED160078C975"><enum>(i)</enum><text>such lead agency notified the applicant that the application to establish a right-of-way for the major Federal action is complete;</text></clause> <clause id="H47E48927543F47AF973C547040D90532"><enum>(ii)</enum><text>such lead agency began the scoping for the major Federal action; or</text></clause> 
<clause id="HB7B651EA70544E6298F877CFEC963E1A"><enum>(iii)</enum><text>such lead agency issued a notice of intent to prepare the environmental assessment or environmental impact statement for the major Federal action; and</text></clause></subparagraph> <subparagraph id="H1DBE8CA40D344CD69BDE4E85B5727F99"><enum>(C)</enum><text>when such environmental assessment and environmental impact statement is expected to be complete.</text></subparagraph></paragraph></subsection></section> 
<section id="H63A4DFF184E246F38DCD043FA2243BFC"><enum>108.</enum><header>Programmatic environmental document</header><text display-inline="no-display-inline">When an agency prepares a programmatic environmental document for which judicial review was available, the agency may rely on the analysis included in the programmatic environmental document in a subsequent environmental document for related actions as follows:</text> <paragraph id="H8072072D3BAA4C2EA28A2104C68B251C"><enum>(1)</enum><text>Within 5 years and without additional review of the analysis in the programmatic environmental document, unless there are substantial new circumstances or information about the significance of adverse effects that bear on the analysis.</text></paragraph> 
<paragraph id="H1FB92DC213D146709CDBE12FF8F98B0C"><enum>(2)</enum><text>After 5 years, so long as the agency reevaluates the analysis in the programmatic environmental document and any underlying assumption to ensure reliance on the analysis remains valid.</text></paragraph></section> <section id="HB134EEFB4E334C77AD9415DDE8F228D2"><enum>109.</enum><header>Adoption of categorical exclusions</header><text display-inline="no-display-inline">An agency may adopt a categorical exclusion listed in another agency’s NEPA procedures for a category of proposed agency actions for which the categorical exclusion was established consistent with this paragraph. The agency shall—</text> 
<paragraph id="H8F83457371094E01A128B4F2C1D79C84"><enum>(1)</enum><text>identify the categorical exclusion listed in another agency’s NEPA procedures that covers a category of proposed actions or related actions;</text></paragraph> <paragraph id="H9B3501D7FB6048D6A92184580C5B7A08"><enum>(2)</enum><text>consult with the agency that established the categorical exclusion to ensure that the proposed adoption of the categorical exclusion to a category of actions is appropriate;</text></paragraph> 
<paragraph id="H14D99F5DD90C4E7C8E0EC9C87FFF4B87"><enum>(3)</enum><text display-inline="yes-display-inline">identify to the public the categorical exclusion that the agency plans to use for its proposed actions; and</text></paragraph> <paragraph id="HB8EE0662C3684ABFA17BA5CAF4776A20"><enum>(4)</enum><text>document adoption of the categorical exclusion.</text></paragraph></section> 
<section id="H74F09B3240574ABDAA02063AA236E8C4"><enum>110.</enum><header>E-NEPA</header> 
<subsection id="H89F9E91DCA7843AF961375ADBC18EDC0"><enum>(a)</enum><header>Permitting portal study</header><text display-inline="yes-display-inline">The Council on Environmental Quality shall conduct a study and submit a report to Congress within 1 year of the enactment of this Act on the potential for online and digital technologies to address delays in reviews and improve public accessibility and transparency under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) including, but not limited to, a unified permitting portal that would—</text> <paragraph id="H31E1C668DB3044E2A073B042D56184CF"><enum>(1)</enum><text display-inline="yes-display-inline">allow applicants to—</text> 
<subparagraph id="HC8F1118BCD78486997ADC5F5827F0F07"><enum>(A)</enum><text display-inline="yes-display-inline">submit required documents or materials for their project in one unified portal;</text></subparagraph> <subparagraph id="H7292B47842904D80A4EB23398925C9BA"><enum>(B)</enum><text display-inline="yes-display-inline">upload and collaborate with the applicable agencies to edit documents in real-time, as required; </text></subparagraph> 
<subparagraph id="H5EF58F8BEBB94F5386D89C251F00DC12"><enum>(C)</enum><text display-inline="yes-display-inline">upload and display visual features such as video, animation, geographic information system displays, and three-dimensional renderings; and</text></subparagraph> <subparagraph id="HFF22FF06FF284F68B434EF6D5B5C4CCE"><enum>(D)</enum><text display-inline="yes-display-inline">track the progress of individual applications;</text></subparagraph></paragraph> 
<paragraph id="HC2CDF1ACAF9C4E3BA4D0E42C0664D02C"><enum>(2)</enum><text display-inline="yes-display-inline">include a cloud based, digital tool for more complex reviews that would enhance interagency coordination in consultation by—</text> <subparagraph id="H53BCE050E8874F65814F30F36CB1058E"><enum>(A)</enum><text display-inline="yes-display-inline">centralizing, across all necessary agencies, the data, visuals, and documents, including but not limited to geographic information system displays, other visual renderings, and completed reports and analyses necessary for reviews;</text></subparagraph> 
<subparagraph id="H74A97CCEF84541779DAA35AA317D5FBD"><enum>(B)</enum><text display-inline="yes-display-inline">streamlining communications between all necessary agencies and the applicant;</text></subparagraph> <subparagraph id="H5F198E9C58DC4240AA5C8736779B2E65"><enum>(C)</enum><text display-inline="yes-display-inline">allowing for comments and responses by and to all necessary agencies in one unified portal;</text></subparagraph> 
<subparagraph id="H5508863FEAF44C359A35FC735797774E"><enum>(D)</enum><text display-inline="yes-display-inline">generating analytical reports to aid in organizing and cataloguing public comments; and</text></subparagraph> <subparagraph id="H297B205060C14B78AB1ECF521902BC53"><enum>(E)</enum><text display-inline="yes-display-inline">be accessible on mobile devices;</text></subparagraph></paragraph> 
<paragraph id="HC45847F86D004F78840F461BEAA8E5D2"><enum>(3)</enum><text display-inline="yes-display-inline">boost transparency in agency processes and present information suitable for a lay audience, including but not limited to—</text> <subparagraph id="H96D9BDCCAEF6492E9CAA1769F7E7700A"><enum>(A)</enum><text display-inline="yes-display-inline">scientific data and analysis; and</text></subparagraph> 
<subparagraph id="H1AC3DF489D6440ABAC79034C960FA9DF"><enum>(B)</enum><text display-inline="yes-display-inline">anticipated agency process and timeline; and</text></subparagraph></paragraph> <paragraph id="H2EA50377DEC64B9E9440AD6A6BEA861F"><enum>(4)</enum><text display-inline="yes-display-inline">include examples describing how at least five permits would be reviewed and processed through this portal.</text></paragraph></subsection> 
<subsection id="H167EABBDB062461981EBB6A76189AAF9"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $500,000 for the Council on Environmental Quality to carry out the study directed by this section.</text></subsection></section> <section id="H6F1F8A6502C5477EA3555C42DE8AD798"><enum>111.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H8ED14CA7A6F94FA39E99EE1291F633EA"><enum>(1)</enum><header>Categorical exclusion</header><text>The term <quote>categorical exclusion</quote> means a category of actions that a Federal agency has determined normally does not significantly affect the quality of the human environment within the meaning of section 102(2)(C).</text></paragraph> <paragraph id="HD5CDAD518BFA47D2ADDDC1A60A1620B5"><enum>(2)</enum><header>Cooperating agency</header><text>The term <quote>cooperating agency</quote> means any Federal, State, Tribal, or local agency that has been designated as a cooperating agency under section 107(a)(3).</text></paragraph> 
<paragraph id="H0F451F141AF44C958A75D0A173A8963E"><enum>(3)</enum><header>Council</header><text>The term <quote>Council</quote> means the Council on Environmental Quality established in title II.</text></paragraph> <paragraph id="H261BA15203714C709A35C61CD4A92142"><enum>(4)</enum><header>Environmental assessment</header><text>The term <quote>environmental assessment</quote> means an environmental assessment prepared under section 106(b)(2).</text></paragraph> 
<paragraph id="H16F9F9AA2A1849BBA71B5BD9B6714A4E"><enum>(5)</enum><header>Environmental document</header><text>The term <quote>environmental document</quote> means an environmental impact statement, an environmental assessment, or a finding of no significant impact.</text></paragraph> <paragraph id="H4F189C37627C4229A5D6EEB6556F8258"><enum>(6)</enum><header>Environmental impact statement</header><text>The term <quote>environmental impact statement</quote> means a detailed written statement that is required by section 102(2)(C).</text></paragraph> 
<paragraph id="HCE7CBEAFC2BF41D490F8863C7B824D7E"><enum>(7)</enum><header>Finding of no significant impact</header><text>The term <quote>finding of no significant impact</quote> means a determination by a Federal agency that a proposed agency action does not require the issuance of an environmental impact statement.</text></paragraph> <paragraph id="HE0087822D92F42BCB6627A9A534515D7"><enum>(8)</enum><header>Participating federal agency</header><text>The term <quote>participating Federal agency</quote> means a Federal agency participating in an environmental review or authorization of an action.</text></paragraph> 
<paragraph id="H441C8BF948AB4A248ECDE1969853394B"><enum>(9)</enum><header>Lead agency</header><text display-inline="yes-display-inline">The term <quote>lead agency</quote> means, with respect to a proposed agency action—</text> <subparagraph id="HF7BB703BA59940E7909F89117005BC0B"><enum>(A)</enum><text display-inline="yes-display-inline">the agency that proposed such action; or</text></subparagraph> 
<subparagraph id="H5F66CC6E9F5548178B7AE3EA869A2C93"><enum>(B)</enum><text>if there are 2 or more involved Federal agencies with respect to such action, the agency designated under section 107(a)(1).</text></subparagraph></paragraph> <paragraph id="HE4DE07F113A3493DA1432E5072536850"><enum>(10)</enum><header>Major federal action</header> <subparagraph id="H35113CF27D314DCC9D600E2361441F9D"><enum>(A)</enum><header>In general</header><text>The term <quote>major Federal action</quote> means an action that the agency carrying out such action determines is subject to substantial Federal control and responsibility.</text></subparagraph> 
<subparagraph id="HF97AD1FDEE8742D7B046CC06E8226080"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>major Federal action</quote> does not include—</text> <clause id="HD6CA4C7BBAAC4A87B42E6FDBBC9A4A49"><enum>(i)</enum><text>a non-Federal action—</text> 
<subclause id="H0376B941B21B4137B505AA7B52F025D0"><enum>(I)</enum><text>with no or minimal Federal funding; or</text></subclause> <subclause id="H5B4716F7A99541E7A32041E9267C079D"><enum>(II)</enum><text>with no or minimal Federal involvement where a Federal agency cannot control the outcome of the project;</text></subclause></clause> 
<clause id="H2B40B2441D6349C1B4AB54C56CDC0404"><enum>(ii)</enum><text>funding assistance solely in the form of general revenue sharing funds which do not provide Federal agency compliance or enforcement responsibility over the subsequent use of such funds;</text></clause> <clause id="H3475EE9A3D3A42C5AC4A455F3088F137"><enum>(iii)</enum><text display-inline="yes-display-inline">loans, loan guarantees, or other forms of financial assistance where a Federal agency does not exercise sufficient control and responsibility over the subsequent use of such financial assistance or the effect of the action;</text></clause> 
<clause id="H3387599D51FC43C99D2B4BF64E71C1C8"><enum>(iv)</enum><text>business loan guarantees provided by the Small Business Administration pursuant to section 7(a) or (b) and of the Small Business Act ( U.S.C. 636(a)), or title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>);</text></clause> <clause id="H3C2F12EC98FC407294DE061D568BEA51"><enum>(v)</enum><text>bringing judicial or administrative civil or criminal enforcement actions;</text></clause> 
<clause id="H779A131919C340FE85D362898AA6966C"><enum>(vi)</enum><text>extraterritorial activities or decisions, which means agency activities or decisions with effects located entirely outside of the jurisdiction of the United States; or</text></clause> <clause id="HA186BD3958CD4475AB5CEF9E87BE1877"><enum>(vii)</enum><text>activities or decisions that are non-discretionary and made in accordance with the agency’s statutory authority. </text></clause></subparagraph></paragraph> 
<paragraph id="H1A71D49D03374E91BF0E2A4757F0C96C"><enum>(11)</enum><header>Programmatic environmental document</header><text>The term <quote>programmatic environmental document</quote> means an environmental impact statement or environmental assessment analyzing all or some of the environmental effects of a policy, program, plan, or group of related actions.</text></paragraph> <paragraph id="HCB135B3872D6473FBFFD123F0BBE3BBA"><enum>(12)</enum><header>Proposal</header><text>The term <quote>proposal</quote> means a proposed action at a stage when an agency has a goal, is actively preparing to make a decision on one or more alternative means of accomplishing that goal, and can meaningfully evaluate its effects.</text></paragraph> 
<paragraph id="H605DA21A310B4834B9EBA1233B6C6ED9"><enum>(13)</enum><header>Special expertise</header><text>The term <quote>special expertise</quote> means statutory responsibility, agency mission, or related program experience.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H22A39D70A7984C9AB3A6255AF04351A1"><enum>322.</enum><header>Interregional Transfer Capability Determination Study</header> <subsection id="H1293F5BFC8694535A0FB7E7AE629D6FD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Electric Reliability Organization (as that term is defined in section 215(a)(2) of the Federal Power Act), in consultation with each regional entity (as that term is defined in section 215(a)(7) of such Act) and each transmitting utility (as that term is defined in section 3(23) of such Act) that has facilities interconnected with a transmitting utility in a neighboring transmission planning region, shall conduct a study of total transfer capability as defined in section 37.6(b)(1)(vi) of title 18, Code of Federal Regulations, between transmission planning regions that contains the following:</text> 
<paragraph id="HD95906621E6245D28D2BE2B325F52E2A"><enum>(1)</enum><text display-inline="yes-display-inline">Current total transfer capability, between each pair of neighboring transmission planning regions.</text></paragraph> <paragraph id="HC5A8D06C0D8E423CB6170BCA621397A7"><enum>(2)</enum><text display-inline="yes-display-inline">A recommendation of prudent additions to total transfer capability between each pair of neighboring transmission planning regions that would demonstrably strengthen reliability within and among such neighboring transmission planning regions.</text></paragraph> 
<paragraph id="HD27DF55A13D4461FADF2531B33F31E08"><enum>(3)</enum><text display-inline="yes-display-inline">Recommendations to meet and maintain total transfer capability together with such recommended prudent additions to total transfer capability between each pair of neighboring transmission planning regions.</text></paragraph></subsection> <subsection id="H99DE0DDB6F6040E1B2C0279BEC4A80B6"><enum>(b)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the North American Electric Reliability Corporation shall deliver a study to Federal Energy Regulatory Commission, which shall publish the study required in subsection (a) in the Federal Register and seek public comments.</text></subsection> 
<subsection id="HE87766FA136747C3BD8486DB86BF06D1"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the end of the public comment period in subsection (b), the Federal Energy Regulatory Commission shall submit a report on its conclusions to Congress and include recommendations, if any, for statutory changes.</text></subsection></section> <section id="HA48318962EFF49A99C8F10262014567F"><enum>323.</enum><header>Permitting streamlining for energy storage</header><text display-inline="no-display-inline">Section 41001(6)(A) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(6)(A)</external-xref>) is amended by inserting <quote>energy storage,</quote> before <quote>or any other sector</quote>.</text></section> 
<section id="H985D8C024409446986065BD496DEA7E0"><enum>324.</enum><header>Expediting completion of the Mountain Valley Pipeline</header> 
<subsection id="H38FF55CC59E0475997445BA1E2714C55"><enum>(a)</enum><header>Definition of mountain valley pipeline</header><text display-inline="yes-display-inline">In this section, the term <quote>Mountain Valley Pipeline</quote> means the Mountain Valley Pipeline project, as generally described and approved in Federal Energy Regulatory Commission Docket Nos. CP16–10, CP19–477, and CP21–57.</text></subsection> <subsection id="HBAF19D63FD4C4AD5B496B0DB68530829"><enum>(b)</enum><header>Congressional findings and declaration</header><text>The Congress hereby finds and declares that the timely completion of construction and operation of the Mountain Valley Pipeline is required in the national interest. The Mountain Valley Pipeline will serve demonstrated natural gas demand in the Northeast, Mid-Atlantic, and Southeast regions, will increase the reliability of natural gas supplies and the availability of natural gas at reasonable prices, will allow natural gas producers to access additional markets for their product, and will reduce carbon emissions and facilitate the energy transition.</text></subsection> 
<subsection id="H175BC552F8D34A5B9117FC402D3B86E8"><enum>(c)</enum><header>Approval and ratification and maintenance of existing authorizations</header><text>Notwithstanding any other provision of law—</text> <paragraph id="HACA47D1A9D894A768AFE264E688C81F5"><enum>(1)</enum><text>Congress hereby ratifies and approves all authorizations, permits, verifications, extensions, biological opinions, incidental take statements, and any other approvals or orders issued pursuant to Federal law necessary for the construction and initial operation at full capacity of the Mountain Valley Pipeline; and</text></paragraph> 
<paragraph id="HB232587EF732405CA18067C8F1AE1D85"><enum>(2)</enum><text display-inline="yes-display-inline">Congress hereby directs the Secretary of the Army, the Federal Energy Regulatory Commission, the Secretary of Agriculture, and the Secretary of the Interior, and other agencies as applicable, as the case may be, to continue to maintain such authorizations, permits, verifications, extensions, biological opinions, incidental take statements, and any other approvals or orders issued pursuant to Federal law necessary for the construction and initial operation at full capacity of the Mountain Valley Pipeline.</text></paragraph></subsection> <subsection id="HBFF8C28A196E41078ED857E67AEDD9C3"><enum>(d)</enum><header>Expedited approval</header><text>Notwithstanding any other provision of law, not later than 21 days after the date of enactment of this Act and for the purpose of facilitating the completion of the Mountain Valley Pipeline, the Secretary of the Army shall issue all permits or verifications necessary—</text> 
<paragraph id="HCF1E702CE1DA44799BCEC64950970445"><enum>(1)</enum><text>to complete the construction of the Mountain Valley Pipeline across the waters of the United States; and</text></paragraph> <paragraph id="HE5D230935DD742B2814A0D6104ABC243"><enum>(2)</enum><text>to allow for the operation and maintenance of the Mountain Valley Pipeline.</text></paragraph></subsection> 
<subsection id="H892D6546EA3E489D8C87C304D094534E"><enum>(e)</enum><header>Judicial review</header> 
<paragraph id="H8B3B5D5179F646268EF7F489BD7083CF"><enum>(1)</enum><text>Notwithstanding any other provision of law, no court shall have jurisdiction to review any action taken by the Secretary of the Army, the Federal Energy Regulatory Commission, the Secretary of Agriculture, the Secretary of the Interior, or a State administrative agency acting pursuant to Federal law that grants an authorization, permit, verification, biological opinion, incidental take statement, or any other approval necessary for the construction and initial operation at full capacity of the Mountain Valley Pipeline, including the issuance of any authorization, permit, extension, verification, biological opinion, incidental take statement, or other approval described in subsection (c) or (d) of this section for the Mountain Valley Pipeline, whether issued prior to, on, or subsequent to the date of enactment of this section, and including any lawsuit pending in a court as of the date of enactment of this section.</text></paragraph> <paragraph id="HDDB977C856824FCC962B642D9D91253B"><enum>(2)</enum><text>The United States Court of Appeals for the District of Columbia Circuit shall have original and exclusive jurisdiction over any claim alleging the invalidity of this section or that an action is beyond the scope of authority conferred by this section.</text></paragraph></subsection> 
<subsection id="H01EE08C0553F48BE884F7E63A6EB9050"><enum>(f)</enum><header>Effect</header><text>This section supersedes any other provision of law (including any other section of this Act or other statute, any regulation, any judicial decision, or any agency guidance) that is inconsistent with the issuance of any authorization, permit, verification, biological opinion, incidental take statement, or other approval for the Mountain Valley Pipeline.</text></subsection></section></title></division> <division id="H3D3F54F8A8EF4A10BC52C01C53E7F580"><enum>D</enum><header>Increase in Debt Limit</header> <section id="H0CAFEDDCFF814B4E960CBB28005A5F64"><enum>401.</enum><header>Temporary extension of public debt limit</header> <subsection id="H50E3CCAF5C394F67AEBEA607DE4064A3"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 3101(b) of title 31, United States Code, shall not apply for the period beginning on the date of the enactment of this Act and ending on January 1, 2025.</text></subsection> 
<subsection id="H41832095E57349A8A98FFC9D106E5503"><enum>(b)</enum><header>Special Rule Relating to Obligations Issued During Extension Period</header><text display-inline="yes-display-inline">Effective on January 2, 2025, the limitation in effect under section 3101(b) of title 31, United States Code, shall be increased to the extent that—</text> <paragraph id="H94155A66CB4F4581B0BE6F1177DAFCC5"><enum>(1)</enum><text display-inline="yes-display-inline">the face amount of obligations issued under chapter 31 of such title and the face amount of obligations whose principal and interest are guaranteed by the United States Government (except guaranteed obligations held by the Secretary of the Treasury) outstanding on January 2, 2025, exceeds </text></paragraph> 
<paragraph id="H8C6B7FE8A84A4E9D8FC64F40E4B42B0E"><enum>(2)</enum><text>the face amount of such obligations outstanding on the date of the enactment of this Act. </text></paragraph></subsection> <subsection id="HEF0BBB4A99894325A8049D0F695EB0B3"><enum>(c)</enum><header>Restoring Congressional Authority Over the National Debt</header> <paragraph id="H8EA5873AD5DE4CAA8EFEA76CC3B59E8D"><enum>(1)</enum><header>Extension Limited to Necessary Obligations</header><text>An obligation shall not be taken into account under subsection (b)(1) unless the issuance of such obligation was necessary to fund a commitment incurred pursuant to law by the Federal Government that required payment before January 2, 2025.</text></paragraph> 
<paragraph id="HF89E6ED61C284F3FAB7C440BC9924B7E"><enum>(2)</enum><header>Prohibition on creation of cash reserve during extension period</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall not issue obligations during the period specified in subsection (a) for the purpose of increasing the cash balance above normal operating balances in anticipation of the expiration of such period.</text></paragraph></subsection></section></division> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
