Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Farm Security and Rural Investment Act of 2002 to expand the national organic certification cost-share program into a comprehensive opportunities in organic program, and for other purposes.</official-title></form><legis-body id="HA45F4B85E3454A7C8F21B083BFDE42BE" style="OLC"><section id="H2D2B8D9774814A3FBD2BF3EBCE287D3E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opportunities in Organic Act of 2023</short-title></quote>.</text></section><section id="H7E3B6FACE99642AD80009B22AD3B154E" section-type="subsequent-section"><enum>2.</enum><header>Opportunities in organic program</header><text display-inline="no-display-inline">Section 10606 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/6523">7 U.S.C. 6523</external-xref>) is amended— </text><paragraph id="HD7F32D95406740A39676B79F446E1F9A" commented="no"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">National organic certification cost-share</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Opportunities in organic</header-in-text></quote>;</text></paragraph><paragraph id="HDA9EAF9A30054784BA7B352EF5C9CDF0"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="H89BD2D47EF3D40E3A2708D663ECF565B"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>national organic certification cost-share program to assist</quote> and inserting </text><quoted-block style="OLC" id="HBF11AEF01A3C45478C0EBD5BE6F7B4FF" display-inline="yes-display-inline"><text>opportunities in organic program to—</text><paragraph id="H3E50B50802FF4822AA46D164C794C759"><enum>(1)</enum><text display-inline="yes-display-inline">assist</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H960DCEEE0BCE406F8DFE416142ED40C7"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H52D30A04EB1E47E895FD27CE9B5430A0"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HC638E64FA3B4459695A4E7CC38CFBA1D" style="OLC"><paragraph id="H96D625E7D12C40D8810B4A158968ED83"><enum>(2)</enum><text>provide support and technical assistance for transition to organic and organic management.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H408EFA3E1E8D4772B61C6717CC6A6F69"><enum>(3)</enum><text>by striking subsection (b);</text></paragraph><paragraph id="H3FEC84B193AF424594065BFA582E38DD"><enum>(4)</enum><text>by redesignating subsections (c) and (d) as subsections (e) and (f), respectively;</text></paragraph><paragraph id="H7330CF28F455425A94CB0F4AC7D75775"><enum>(5)</enum><text>by inserting after subsection (a) the following:</text><quoted-block id="H5471E51B4C874465BBCE85B764D61699" style="OLC"><subsection id="HF3F2B417E7B94D80879572BCB8111193"><enum>(b)</enum><header>Federal organic certification cost share</header><paragraph id="H23B3EC07D7AA4FD9BD37D4C2BA190013"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall make payments to producers and handlers to reimburse such producers or handlers for costs incurred in obtaining certification under the national organic production program.</text></paragraph><paragraph id="HC9D9319454444A9CA09DF3242B8E91E1"><enum>(2)</enum><header>Maximum amount</header><subparagraph id="HE8A1FAD29A0D4612951F2D1B9BC393C7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the maximum amount of a payment made to a producer or handler under this section shall not exceed $1,500.</text></subparagraph><subparagraph id="HFF1CA7BD42AB4F09ADACB3DDBB6FF737"><enum>(B)</enum><header>Ensuring affordability</header><text>Notwithstanding subparagraph (A), the Secretary may make payments under this section that exceed the maximum amount specified in such subparagraph—</text><clause id="H7DE00E8BDECF4710A808B4872A86A838"><enum>(i)</enum><text>in the case of such a payment made to a producer or handler who is—</text><subclause id="H530AC6084E7F48139870BA4976FE93C1"><enum>(I)</enum><text>located in a region with disproportionately high certification costs; or</text></subclause><subclause id="HC60518A5FACC4AF5BFF05F832603D1CE"><enum>(II)</enum><text>a member of a socially disadvantaged group; or</text></subclause></clause><clause id="HEBD18C78710E47C0B35130A45A053225"><enum>(ii)</enum><text>in the case of any other such payment made to a producer or handler not described in clause (i), if the Secretary determines that exceeding such amount would ensure that organic certification costs are not a barrier to organic production.</text></clause></subparagraph></paragraph></subsection><subsection id="H549D2D4BE17C470694F7F42C7C345372"><enum>(c)</enum><header>Transition and resilience funding</header><paragraph id="HE0C5710509414D969C6A6689D13880DF"><enum>(1)</enum><header>In general</header><text>The Secretary shall award funding to eligible nonprofit organizations for any of the purposes specified in paragraphs (2), (3), and (4). </text></paragraph><paragraph id="H026FAB83E3904C158A6F73AACD5C13A2"><enum>(2)</enum><header>Capacity building</header><text>The purposes specified in this paragraph are staffing, materials, activities, and partnerships (such as with smaller nonprofit organizations) that support transition to organic and resilience of certified organic farms, including the following:</text><subparagraph id="HC36F9D7C6C4C483595CC9D2681AAA4E9"><enum>(A)</enum><text>Recruitment of producers to begin transition to organic.</text></subparagraph><subparagraph id="HADAB74E180014DBD93F400299DD245EA"><enum>(B)</enum><text>Translation and communication support, including the development of simple and culturally appropriate materials to increase understanding of the practices and processes required to become certified under the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6501">7 U.S.C. 6501 et seq.</external-xref>).</text></subparagraph><subparagraph id="H69B7108CC284472A8FC5B9421A93226D"><enum>(C)</enum><text>Assistance with applications, compliance, recordkeeping, and other aspects of the organic certification process under such Act.</text></subparagraph><subparagraph id="HD4FFCBFB3DDD46DD9F2851ACF27A8539"><enum>(D)</enum><text>Financial, business, and farm planning.</text></subparagraph><subparagraph id="H9F4E71B7311F4CCFA0C68ECEE4891821"><enum>(E)</enum><text>Support for fair contracting.</text></subparagraph><subparagraph id="HDEF5AC9A33704E70BC4520F9A46AA466"><enum>(F)</enum><text>Technical assistance with soil building, pest management, and other practices.</text></subparagraph><subparagraph id="H77150ED738B7433788B046698F0537C3"><enum>(G)</enum><text>Providing training on organic certification requirements and organic management to agricultural advisors and consultants, including agronomists, crop advisors, pest control advisors, extension agents, farm consultants, and other technical service providers.</text></subparagraph><subparagraph id="H037ED88B22FA4F36A03AD43BEE54686C"><enum>(H)</enum><text>Facilitating paid mentor-mentee relationships between organic producers and producers in transition to organic, including stipends for all participants and training to support effective mentorship.</text></subparagraph><subparagraph id="H8B56B7BADB584E779C6CFF7372182200"><enum>(I)</enum><text>Assisting producers with accessing resources and funding, including conservation programs, risk management tools, and organic support and research programs.</text></subparagraph><subparagraph id="HC18CAD063E1F4A0891867F25299B12B6"><enum>(J)</enum><text>Establishing or expanding cooperatives, organic grower groups, certified organic processing, storage, distribution facilities and equipment, food hubs, food security and sovereignty programs, organic-compliant composting services, and other regional foodshed and supply chain infrastructure.</text></subparagraph><subparagraph id="HE5F43234A88A4B45AE9DAD39FAFEB1FC"><enum>(K)</enum><text>On-farm research, including monitoring biodiversity, air, and water quality, measuring changes in soil organic carbon and indicators of soil health, developing regionally adapted seeds and breeds, and trialing and documenting effectiveness of holistic approaches to pest, weed, and disease control.</text></subparagraph><subparagraph id="H709F05F617B7482D8249E7E60DF9F639"><enum>(L)</enum><text>Recruiting and training organic certification staff and inspectors, with an emphasis on expanding opportunities for socially disadvantaged farmers and ranchers and increasing diversity in the certification process.</text></subparagraph><subparagraph id="H8E29987290A64509994028663014BDCE"><enum>(M)</enum><text>Increasing access to land for socially disadvantaged farmers and ranchers and small- and mid-sized farms and ranches and promoting long-term organic management (such as purchases of land for incubator projects, promoting and supporting lease-to-own contracts, resolving heirs property issues, and establishing easements that facilitate long-term organic stewardship).</text></subparagraph><subparagraph id="HA6A05446DCB34FD5871595AE3D5327D8"><enum>(N)</enum><text>Hosting or supporting regional convenings, conferences, farmer-led trainings, field days, teach-ins, and other educational opportunities focused on organic production.</text></subparagraph><subparagraph id="HAAF164C1718D452A96FBC12103736A30"><enum>(O)</enum><text>Establishing infrastructure for inter-farmer skills share and exchanges, including virtual forums.</text></subparagraph></paragraph><paragraph id="HE40D9D41E6AE48AEAD967E25EBE292C5"><enum>(3)</enum><header>Producer transition and resilience</header><text display-inline="yes-display-inline">The purpose specified in this paragraph is to provide one-time, 4-year, transition and resilience funding to socially disadvantaged farmers or ranchers or small or mid-sized farms or ranches to offset costs of, and reduce barriers to, becoming or expanding a certified organic farm, including through the following: </text><subparagraph id="H5006B78D115A4D6EAEAA7D5D26A574E9"><enum>(A)</enum><text>Creating or expanding an organic system plan (as defined in section 205.2 of title 7, Code of Federal Regulations, as in effect on the date of the enactment of the Opportunities in Organic Act of 2023), including the following:</text><clause id="H27D85C5F644146B9A37E1EFCEFFC6F37"><enum>(i)</enum><text>Completing organic certification documents, planning, and recordkeeping.</text></clause><clause id="H8FD3781039C94526991D0B392FAB6FDB"><enum>(ii)</enum><text>Developing a plan to build soil health.</text></clause></subparagraph><subparagraph id="HE88E476BD1934EF29FD302DC22A73E7B"><enum>(B)</enum><text>Adopting, improving, or expanding organic management, including:</text><clause id="HDE6541EA0DD44280A8C830DEDBEF78D1"><enum>(i)</enum><text>Eliminating use of synthetic pesticides, synthetic fertilizers, or antibiotics.</text></clause><clause id="HFD19BC7DB55E456E95BBB63C7C6B2039"><enum>(ii)</enum><text>Cover cropping, crop rotation, or rotational grazing.</text></clause><clause id="H2313195EBBAB4476A3ECCE7DA035BC7D"><enum>(iii)</enum><text>Production and use of compost and manure (including purchasing tools, supplies, or storage).</text></clause><clause id="H78A2337C58A14003A638CB7523F958DF"><enum>(iv)</enum><text>Sourcing or producing organic seed and feed.</text></clause><clause id="H9D2E0B4FF0954C70A1FC837587B02888"><enum>(v)</enum><text>Hedgerow and ecosystem enhancement planting and design.</text></clause><clause id="H9C13F0AF01FA4E3EBAEB2C60D503D138"><enum>(vi)</enum><text>Purchasing supplies for intercropping and polycropping or other specialized equipment.</text></clause><clause id="HCE83646C0995468EB8CF4124925BFF66"><enum>(vii)</enum><text>Supporting beneficial predators, pollinator habitats, erosion prevention, or watershed restoration.</text></clause></subparagraph><subparagraph id="HF8DF14C389D44F369EE47CA94465744B"><enum>(C)</enum><text>Costs associated with processing, storage, and distribution equipment and facilities.</text></subparagraph><subparagraph id="HA383A6CFEA6645CC9486737F222E9E65"><enum>(D)</enum><text>Carrying out on-farm research to monitor and document the impacts of transition to organic, including in partnership with another entity.</text></subparagraph><subparagraph id="H8D3F1E9EB4DC4F56BA4699750E1F49BE"><enum>(E)</enum><text>Soil testing.</text></subparagraph><subparagraph id="HB1474938E12E49BD9E866CFAE9901307"><enum>(F)</enum><text>Debt relief to improve access to capital and financial stability.</text></subparagraph><subparagraph id="H9E76E345A3EE4C42B77345363730007A"><enum>(G)</enum><text>Forming a cooperative or farmer-to-farmer network.</text></subparagraph><subparagraph id="H2DDB08A0B0454B9697A254830A55A7F8"><enum>(H)</enum><text>Training to become an organic inspector to expand revenue and regional inspection capacity.</text></subparagraph><subparagraph id="H15D4A1EE12F949978722865F5E281EE7"><enum>(I)</enum><text>Covering costs associated with overcoming barriers to land access, including payments to secure longer leases and to cover costs associated with—</text><clause id="H2E31C4C22B4D49568EF27D20260BF0F7"><enum>(i)</enum><text>accessing land that has not been treated with materials prohibited for use on a certified organic farm; or</text></clause><clause id="H8D25004BBC9A4003A4EE569D76CC9926"><enum>(ii)</enum><text>transitioning land to organic management.</text></clause></subparagraph><subparagraph id="HB1D77CA5430E4652A5157A358B7288FD"><enum>(J)</enum><text>Covering labor costs, including improvements to workplace safety, compensation, professional development, and staff training on organic transition implementation.</text></subparagraph><subparagraph id="H2EE69EDCDF254CEB96C459F85345EFD3"><enum>(K)</enum><text>Improving food safety practices and obtaining related certifications.</text></subparagraph><subparagraph id="H1B8B1D70556C4356A1A057A7797D0B34"><enum>(L)</enum><text>Providing or participating in organic agriculture educational opportunities.</text></subparagraph><subparagraph id="H0F4340EC3AD045CAA98E67820B844F8F"><enum>(M)</enum><text>Replacing foregone income during transition to organic due to short-term changes in yield and limited market options.</text></subparagraph><subparagraph id="HD4653B8A5A734656ADED741BDF4E48B8"><enum>(N)</enum><text>Construction or improvement of housing for apprentices, trainees, or volunteers or other on-farm infrastructure.</text></subparagraph><subparagraph id="H6F25C180B2404084BBFA9600939C56B8"><enum>(O)</enum><text>Financial, business, and farm planning.</text></subparagraph></paragraph><paragraph id="H91BE3E5748AC4089AA3411FA44C9CA9A"><enum>(4)</enum><header>Organic supply chain</header><text display-inline="yes-display-inline">The purposes specified in this paragraph are to provide funding to other entities—</text><subparagraph id="H9A6E3C2917BD4407934A7FA05A520F42"><enum>(A)</enum><text>to strengthen organic capacity or expand access to certified organic handling operations, including—</text><clause id="H5CCBA01EF344482182C00BACC3F4FA1D"><enum>(i)</enum><text>constructing, expanding, or improving access to a certified organic handling operation;</text></clause><clause id="HE6519AB72DAF425891A823B6E1353A7D"><enum>(ii)</enum><text>purchasing farm equipment, value added supplies, and other materials that improve market access; and</text></clause><clause id="H2DDB3785A2394602B6AAEE705D762D77"><enum>(iii)</enum><text>pursuing organic certification for an existing handling operation; and</text></clause></subparagraph><subparagraph id="HAE125F8BD1524620AECA6E10CC8F192B"><enum>(B)</enum><text display-inline="yes-display-inline">to strengthen opportunities in organic production for socially disadvantaged farmers or ranchers, small or mid-sized farms or ranches, or vulnerable agricultural regions (such as farms near schools, childcare providers, residential areas, sensitive ecosystems) or under-resourced agricultural regions.</text></subparagraph></paragraph><paragraph id="HC2863605484C40EA8897894B5F118369"><enum>(5)</enum><header>Meetings</header><text>An eligible nonprofit organization that receives funds under this subsection shall—</text><subparagraph id="H0605A9C61BCD44178F9F658D10777F44"><enum>(A)</enum><text>communicate not less than once per calendar quarter with each entity awarded funding for the purposes specified in paragraphs (3) and (4) to—</text><clause id="H12290C968503468389AA7EA22EA7B522"><enum>(i)</enum><text>monitor progress with respect to transition to organic and organic supply chain development;</text></clause><clause id="HF93C61828AD14BB4857EBB09671916AA"><enum>(ii)</enum><text>address the improvement to, and impact of, the transition to organic production, including observed changes in biodiversity, soil health, pests, weeds, and disease occurrence, crop yield, and resilience;</text></clause><clause id="H7317FB4E5B0046ABBCC0A0D8FCDAC8EC"><enum>(iii)</enum><text display-inline="yes-display-inline">address challenges in transitioning to organic and program participation;</text></clause><clause id="H68E25E1ABCDC4D6EAFF845AE75D342F5"><enum>(iv)</enum><text display-inline="yes-display-inline">consider market opportunities for organic products and the adoption of additional practices that reduce the use of synthetic chemicals and foster soil fertility; and</text></clause><clause id="H7CAE5827793846799899E43182954EAE"><enum>(v)</enum><text>explore opportunities for coordinated farm team meetings with staff from relevant agencies and other organizations, to streamline agricultural assistance and improve farm viability, while increasing adoption of on-farm conservation practices; and</text></clause></subparagraph><subparagraph id="HF346E7917165432AA1864CFB94BD9628"><enum>(B)</enum><text>meet not less than once per year with staff of the Department of Agriculture (as determined by the Secretary) for the duration of the funding period to discuss program participation and impacts, demographics and scale of participants, transition success rates, market opportunities, research results, and challenges identified.</text></subparagraph></paragraph></subsection><subsection id="H90B6EA379EF44310B2D6F5B4D69B0FA6"><enum>(d)</enum><header>Technical assistance</header><paragraph id="HA0E1D6C80F9A4CF8BF8E5A10240B8E79"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall increase regional resources to support organic management, including technical assistance, outreach, supply chain coordination, and activities specified in paragraph (2), through expanded organic-related capacity and partnerships at—</text><subparagraph id="H54143FD7F2CE41288F56D2E5B874E3E7"><enum>(A)</enum><text>the Department of Agriculture, including within the Agricultural Marketing Service, the Farm Service Agency, the Natural Resources Conservation Service, the Risk Management Agency, the offices under the Undersecretary of Rural Development, the Food and Nutrition Service, and climate hubs, with an emphasis on local and regional offices;</text></subparagraph><subparagraph id="H023C01A3AD304268B0FF4ECAD37ED66B"><enum>(B)</enum><text>universities and educational institutions, with an emphasis on institutions serving socially disadvantaged farmers and ranchers;</text></subparagraph><subparagraph id="H64475FE2276E4653A8A786B24932FB43"><enum>(C)</enum><text>the cooperative extension programs of the Secretary, including the federally recognized Tribes extension program under section 3(d) of the Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/343">7 U.S.C. 343(d)</external-xref>);</text></subparagraph><subparagraph id="HD67243F7A99C491AB46890288DD5D111"><enum>(D)</enum><text>State, regional, and Tribal departments of agriculture; and</text></subparagraph><subparagraph id="H023FE0C17A74420DAA85B9726E27506B"><enum>(E)</enum><text>eligible nonprofit organizations.</text></subparagraph></paragraph><paragraph id="H58CC421415024F5691CA6265AAC16CFD"><enum>(2)</enum><header>Activities</header><text display-inline="yes-display-inline">Activities specified in this paragraph include—</text><subparagraph id="HB5DBC805E1504EF493CCAAFE6BCD3ACB"><enum>(A)</enum><text>providing regional education sessions on organic management;</text></subparagraph><subparagraph id="H5F1EB7F9272A47BD842ED43643A123B4"><enum>(B)</enum><text>developing regionally-tailored resources, technical assistance programs, and teaching farms for organic producers and producers in transition to organic, including tools to promote and facilitate participation of socially disadvantaged farmers and ranchers and small- and mid-sized farms and ranches in organic and complementary support programs;</text></subparagraph><subparagraph id="H6675C215EAAC486395DC56749EF0D880"><enum>(C)</enum><text>conducting ongoing outreach to, and needs assessment of, producers in transition to organic to identify barriers to organic production and mechanisms to address such barriers;</text></subparagraph><subparagraph id="H858C8C8BF83542A8855676E65EFE4429"><enum>(D)</enum><text>identifying priority locations to promote transition to organic, including near schools and childcare providers, residential areas, and sensitive ecosystems;</text></subparagraph><subparagraph id="H240F271D892B4DEEB32F9739D2D6B064"><enum>(E)</enum><text>developing organic supply chain and infrastructure;</text></subparagraph><subparagraph id="H4DCE3A7869FD4FC49D92C80D4E23C468"><enum>(F)</enum><text>expanding organic and local supply chains and market opportunities, including establishing channels for producers to offer products to institutional buyers and supporting purchases through nutrition programs; and</text></subparagraph><subparagraph id="H3F6789FA1BA3455A9F746C243EF5431B"><enum>(G)</enum><text>advancing food waste reduction strategies that support producer income and soil health, including—</text><clause id="HA95818A67935401D98CAB03DD1A403E2"><enum>(i)</enum><text display-inline="yes-display-inline">closed-loop programs that connect community composting and food scrap collection operations with farms; and</text></clause><clause id="H05D9A67936524AE8ABC20ECFF6A83997"><enum>(ii)</enum><text display-inline="yes-display-inline">coordination to maximize use of farm products, composting, and waste reduction;</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H8189298C15084E93B130010EBDE2EA9C"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (e), as so redesignated—</text><subparagraph id="H18ACAE42CD974EF2BC2F0966BEBDB7D4"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>including the</quote> and inserting the following: </text><quoted-block style="OLC" id="HD5B8FF42B75D43F084126C828A990AA7"><enum>(B)</enum><text>by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H30077708644345188077D80033C3BE6E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H3EB3D3CF5B58402B98C7AC07CE951C07" style="OLC"><paragraph id="H2CAA4CAD421F45E09CFC0F404CDFAB04"><enum>(2)</enum><text>the demographics, acreage, and sales of producer participants, aggregated by region;</text></paragraph><paragraph id="HB81AEC3F72D74E59AC1D83C125E99E26"><enum>(3)</enum><text>the number of producers and handlers that received support from the program in the previous fiscal year who—</text><subparagraph id="HE70F1089FD3E412EA40F24255933A33D"><enum>(A)</enum><text>began transition to organic; and</text></subparagraph><subparagraph id="H648613A52F894F09935077541C5FEFA0"><enum>(B)</enum><text>achieved new organic certification;</text></subparagraph></paragraph><paragraph id="HA3E9F3722CDA413A9ED262D050F35AE4"><enum>(4)</enum><text>any barriers to achieving organic certification;</text></paragraph><paragraph id="H8865A050E3A7403E8AE2F3D02DA3A6EE"><enum>(5)</enum><text>the transition activities carried out by eligible nonprofit organizations and the measures of success of such activities;</text></paragraph><paragraph id="H544EDAA01E9C4286B3907434B6EDE4CD"><enum>(6)</enum><text>research findings and best practices to support transition to organic;</text></paragraph><paragraph id="HE457BDCDCF7B4006BE17DAF8F97D826D"><enum>(7)</enum><text>changes in organic-relevant capacity at public institutions and eligible nonprofit organizations; and</text></paragraph><paragraph id="H7952570E141A4A5CB8F482AD844D58FE"><enum>(8)</enum><text>changes in availability of organic-relevant technical assistance.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB3B1095C6A7B4B699843039BBB099301"><enum>(7)</enum><text>in subsection (f)(1), as so redesignated, by striking subparagraphs (A) through (C) and inserting the following:</text><quoted-block id="H0B3B3D0922B64B648BBDE2CB6A83A45B" style="OLC"><subparagraph disadvantaged farmer or rancher</term> and <term>socially disadvantaged group</term> have the meanings given those terms in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>).</text></paragraph><paragraph id="H3A9E43B1F8BE4C828443FCE8B84BF3BF"><enum>(2)</enum><header>Eligible nonprofit organization</header><text>The term <term>eligible nonprofit organization</term> means a nonprofit organization (as defined in section 1619(b) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5801">7 U.S.C. 5801(b)</external-xref>) that primarily serves at least one of the following:</text><subparagraph id="H73FC2E8FDABF4C7D8133F390C6322419"><enum>(A)</enum><text>Socially disadvantaged farmers and ranchers.</text></subparagraph><subparagraph id="H7593F9074587414FB128265E267D3602"><enum>(B)</enum><text>Organic producers and handlers.</text></subparagraph><subparagraph id="HA7DF57D3781A47B5B0BC96BE225E85F6"><enum>(C)</enum><text>One or more vulnerable (e.g., farms near schools, childcare providers, residential areas, sensitive ecosystems) or under-resourced agricultural regions.</text></subparagraph><subparagraph id="H214F156CF6074EB5BD691312D15A9934"><enum>(D)</enum><text>Smaller nonprofit organizations that primarily serve (A), (B), or (C).</text></subparagraph></paragraph><paragraph id="H211A791624B243858D2AB215CF543F9F"><enum>(3)</enum><header>Organic</header><text>The term <term>organic</term> has the meaning given such term in section 205.2 of title 7, Code of Federal
