R. 352</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230112">January 12, 2023</action-date><action-desc><sponsor name-id="V000136">Mr. Vasquez</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reduce the pay of Members of the House of Representatives if a Speaker is not elected on the first day of a Congress.</official-title></form><legis-body id="H5E7D61C649454894986B9B76557C8589" style="OLC"><section id="H080C28A9875840DA8979BA0746AA1F41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mandating Congress Can’t Accept Remuneration for Time not Helping You Act</short-title></quote> or the <quote><short-title>McCARTHY Act</short-title></quote>. </text></section><section id="H06DEC668EB5349DBAD654F17797591E8" section-type="subsequent-section"><enum>2.</enum><header>Reduction of pay of Members of House if Speaker is not elected</header><subsection id="H1B7E0C022EE642579D41E96478D9F16E"><enum>(a)</enum><header>Reduction of pay</header><text display-inline="yes-display-inline">If, by the end of the first day of a Congress, the House of Representatives has not elected a Speaker, the annual rate of pay applicable under section 601(a) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501</external-xref>) with respect to each Member of the House of Representatives for the year shall be reduced by an amount equal to the product of—</text><paragraph id="HB4C672E46BC94BC3938DBEE1D606914F"><enum>(1)</enum><text>an amount equal to one day’s worth of pay under such annual rate; and</text></paragraph><paragraph id="H2FDBCC550738443EB2622A937B73892A"><enum>(2)</enum><text>the number of 24-hour periods during which no Speaker has been elected for the Congress.</text></paragraph></subsection><subsection id="H90D5ED4CBF954E42BB3E4DD2A2CD6D9C"><enum>(b)</enum><header>Member defined</header><text display-inline="yes-display-inline">In this section, the term <quote>Member of the House of Representatives</quote> means an individual serving in a position in the House of Representatives which is covered under subparagraph (A), (B), or (C) of section 601(a)(1) of the Legislative Reorganization Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/2/4501">2 U.S.C. 4501(1)</external-xref>).</text></subsection><subsection id="HA4D94CAFADCD40BEB556DD5A8A345282"><enum>(c)</enum><header>Effective date</header><text>This section shall apply with respect to the One Hundred Nineteenth Congress and each succeeding Congress.</text></subsection></section></legis-body></bill>
