R. 3505</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230518">May 18, 2023</action-date><action-desc><sponsor name-id="K000401">Mr. Kiley</sponsor> (for himself and <cosponsor name-id="O000086">Mr. Owens</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to require public institutions of higher education, as a condition of participating in programs under title IV of such Act, to provide a written statement and educational programming to new students on the rights of students under the first amendment to the Constitution.</official-title></form><legis-body id="HD788D191F1E84799A5425EE30F18660A" style="OLC"><section id="H7B3B97A9E5C24339AE747FA5B93318F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Free Speech On Campus Act</short-title></quote>.</text></section><section id="H8C47EED83398455CABD4281BDA3DE14A"><enum>2.</enum><header>Program participation agreement on freedom of expression</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H15BAE91571CC477C9513895BDE1EBBAE" display-inline="no-display-inline"><paragraph id="H9EF59629C3F94293A3DD86B93CC59C1C"><enum>(30)</enum><text display-inline="yes-display-inline">In the case of a public institution, the institution will carry out each of the following:</text><subparagraph id="H5CADEEBBD754475CB50583951C2EFF5C"><enum>(A)</enum><text>At each orientation for new and transfer students, provide students attending the orientation—</text><clause id="H18675094B2DD4955811674C4C2E4AD7E"><enum>(i)</enum><text>a written statement that—</text><subclause id="HA3580874054D4374B9FFB999FD07752C"><enum>(I)</enum><text>explains the rights of students under the first amendment to the Constitution;</text></subclause><subclause id="H642FD63AE8244759B1E47BA377B20D42"><enum>(II)</enum><text>affirms the importance and the commitment of the institution to freedom of expression; and</text></subclause><subclause id="HA12AA1268D35488A8CA5813CCA70E3AA"><enum>(III)</enum><text>includes assurances that students, and individuals invited by students to speak at the institution, will not be treated in a manner that violates the freedom of expression of such students or individuals; and</text></subclause></clause><clause id="H45F300DA5644477ABD3E0D52AA4E8B29"><enum>(ii)</enum><text>educational programming (including online resources) that include each of the following:</text><subclause id="H1A2F8C2DA7ED47D4AA3CFA227588C5D2"><enum>(I)</enum><text>Descriptions of policies, procedures, and protocols of the institution that protect freedom of expression and prohibit exclusionary behavior.</text></subclause><subclause id="HD098A1ABD35C4DCEACBCA95006AF99F6"><enum>(II)</enum><text>Lessons that—</text><item id="HE4F1E68666364CFE87FFD7E4BB133B59"><enum>(aa)</enum><text>teach and encourage the expression of a wide range of views in a productive and respectful manner; and</text></item><item id="HBEB94445B5E24C0482E2AEAE9E573522"><enum>(bb)</enum><text>include an understanding of the first amendment to the Constitution and its role in supporting the commitment of the institution to freedom of expression.</text></item></subclause></clause></subparagraph><subparagraph id="HAF9077CB4DCA4D66A5FF731B9ECA190F"><enum>(B)</enum><text>Post on the publicly accessible website of the institution the statement described in subparagraph (A)(i).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
