R. 340</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>November 2, 2023</action-date><action-desc>Received; read the first time</action-desc></action><action><action-date>November 6, 2023</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To impose sanctions with respect to foreign support for terrorist organizations, including Hamas and the Palestinian Islamic Jihad.</official-title></form><legis-body id="HD365F1AE8CC24BDB92B630696BFB3B9E" style="OLC"><section id="H4681C345ADE74824988EED2913021D90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hamas and Other Palestinian Terrorist Groups International Financing Prevention Act</short-title></quote>. </text></section><section id="HCE864750B2EB40959B6BD3D188D7583D"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States—</text><paragraph id="HF481673F5A0A4277A47969250BE75A44"><enum>(1)</enum><text display-inline="yes-display-inline">to prevent Hamas, Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof from accessing its international support networks; and</text></paragraph><paragraph id="HB7957790048D4DDFBA21E801136F1762"><enum>(2)</enum><text display-inline="yes-display-inline">to oppose Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof from using goods, including medicine and dual use items, to smuggle weapons and other materials to further acts of terrorism, including against Israel.</text></paragraph></section><section id="H09C4DC615924462DA4B309D8426EC762"><enum>3.</enum><header>Imposition of sanctions with respect to foreign persons supporting acts of terrorism or engaging in significant transactions with senior members of Hamas, Palestinian Islamic Jihad and other Palestinian terrorist organizations</header><subsection id="HEF61CFE30CFE4EBFADBBDC0D9D04E8C8"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the President shall impose the sanctions described in subsection (c) with respect to each foreign person that the President determines, on or after the date of the enactment of this Act, engages in an activity described in subsection (b).</text></subsection><subsection id="H6C11FC58CCE84664961D8D9CA04A3773" commented="no"><enum>(b)</enum><header>Activities described</header><text>A foreign person engages in an activity described in this subsection if the foreign person knowingly—</text><paragraph id="H71BECB0538E14198A9496C612ACBA5AB" commented="no"><enum>(1)</enum><text>assists in sponsoring or providing significant financial, material, or technological support for, or goods or other services to enable, acts of terrorism; or</text></paragraph><paragraph id="H904B9534B9A64BE2948E7518E7948D41" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">engages, directly or indirectly, in a significant transaction with—</text><subparagraph id="H1EE1E9B0E4924944B5A9CB3219BEE952" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a senior member of Hamas, Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof; or </text></subparagraph><subparagraph id="HF3F7EDC7383A4EAC82850BD24A4B349F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a senior member of a foreign terrorist organization designated pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>) that is responsible for providing, directly or indirectly, support to Hamas, Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof.</text></subparagraph></paragraph></subsection><subsection id="H4B2275F25E284F8F97F821951713630B"><enum>(c)</enum><header>Sanctions described</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of a foreign person described in subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subsection><subsection id="HFC82E0E125B24883A285D64EC7BB18AC" commented="no"><enum>(d)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulations promulgated to carry out this section to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act.</text></subsection><subsection id="HCC6407538BAE4A79A58FF4EE3821C1E2" commented="no"><enum>(e)</enum><header>Implementation; regulations</header><paragraph id="H1A0CC774061E43148F6014E7034E00D1"><enum>(1)</enum><header>In general</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) for purposes of carrying out this section.</text></paragraph><paragraph id="H38A64561CA084127B882F372CADEC29B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Regulations</header><text>Not later than 60 days after the date of the enactment of this Act, the President shall issue regulations or other guidance as may be necessary for the implementation of this section.</text></paragraph></subsection><subsection id="H6F59047BDFC54564B9E730B918DE7BF6"><enum>(f)</enum><header>Waiver</header><text>The President may waive, on a case-by-case basis and for a period of not more than 180 days, the application of sanctions under this section with respect to a foreign person only if, not later than 15 days prior to the date on which the waiver is to take effect, the President submits to the appropriate congressional committees a written determination and justification that the waiver is in the vital national security interests of the United States.</text></subsection><subsection id="H1A4E7E89CBB1453298C9887831ECE381"><enum>(g)</enum><header>Humanitarian exemption</header><text>The President may waive the application of any provision of this section if the President certifies in writing to the appropriate congressional committees that such a waiver is vital to facilitate the delivery of humanitarian aid and is consistent with the national security interests of the United States 15 days prior to the waiver taking effect.</text></subsection><subsection id="H2D304A5AC7B54A8EABF19DE682357D99" commented="no"><enum>(h)</enum><header>Rule of construction</header><text>The authority to impose sanctions under this section with respect to a foreign person is in addition to the authority to impose sanctions under any other provision of law with respect to a foreign person that directly or indirectly supports acts of international terrorism.</text></subsection></section><section id="H215D67C7575D4C389D14638672439E17"><enum>4.</enum><header>Imposition of measures with respect to foreign states providing support to Hamas, Palestinian Islamic Jihad and other Palestinian terrorist organizations</header><subsection id="H78A16B640D084A5F833BA1E0E3CB6BF0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the President shall impose the measures described in subsection (c) with respect to a foreign state if the President determines that the foreign state, on or after the date of the enactment of this Act, engages in an activity described in subsection (b).</text></subsection><subsection id="H50839CFEDAB2407CB7F5B7253F88EC2A"><enum>(b)</enum><header>Activities described</header><text>A foreign state engages in an activity described in this subsection if the foreign state knowingly—</text><paragraph id="H35DC9DBA1B86460B93F13F56F4C185A8"><enum>(1)</enum><text>provides significant material or financial support for acts of international terrorism, pursuant to—</text><subparagraph id="HB6CC711F32474C62A20ABE156FE0A961"><enum>(A)</enum><text>section 1754(c) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)</external-xref>);</text></subparagraph><subparagraph id="HA1CCFCA1CFA34845847C1578519209CC"><enum>(B)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>); </text></subparagraph><subparagraph id="H4CC6220D8D5A44EEA91A1A19B0BBDEB2"><enum>(C)</enum><text>section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>); or</text></subparagraph><subparagraph id="HEFFEA838423B4E3EA62144ED36599F72"><enum>(D)</enum><text>any other provision of law;</text></subparagraph></paragraph><paragraph id="H1035831657604E1285CC8D372F3538EA"><enum>(2)</enum><text display-inline="yes-display-inline">provides significant material support to Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof; or</text></paragraph><paragraph id="H4C87E604D1964B888008D11141BBA0CF"><enum>(3)</enum><text display-inline="yes-display-inline">engages in a significant transaction that materially contributes, directly or indirectly, to the terrorist activities of Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof.</text></paragraph></subsection><subsection id="HE136DC64521747819050C2B03B463D79"><enum>(c)</enum><header>Measures described</header><text display-inline="yes-display-inline">The measures described in this subsection with respect to a foreign state are the following:</text><paragraph id="H2B54DC3B07364BAF9908CB0E67F178F1" display-inline="no-display-inline"><enum>(1)</enum><text>The President shall suspend, for a period of at least 1 year, United States assistance to the foreign state.</text></paragraph><paragraph id="H7C5C312DF9444191A2E3B65ADD98EEA5" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of the Treasury shall instruct the United States Executive Director to each appropriate international financial institution to oppose, and vote against, for a period of 1 year, the extension by such institution of any loan or financial or technical assistance to the government of the foreign state. </text></paragraph><paragraph id="H437A20D0F4064655813A2EA3EB1B899C"><enum>(3)</enum><text>The President shall prohibit the export of any item on the United States Munitions List (established pursuant to section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>)) or the Commerce Control List set forth in Supplement No. 1 to part 774 of title 15, Code of Federal Regulations, to the foreign state for a period of 1 year.</text></paragraph></subsection><subsection id="H5F3C506BADA34498B8891E7E4683CEA0"><enum>(d)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulations promulgated to carry out this section to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act.</text></subsection><subsection id="H7817E5099AE546479C69C81D5AB78428"><enum>(e)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive, on a case-by-case basis and for a period of not more than 180 days, the application of measures under this section with respect to a foreign state only if, not later than 15 days prior to the date on which the waiver is to take effect, the President submits to the appropriate congressional committees a written determination and justification that the waiver is in the vital national security interests of the United States.</text></subsection><subsection id="H142501A9F7B044BCB59193583A07FD7F"><enum>(f)</enum><header>Implementation; regulations</header><paragraph id="H897420EFD28F4B119A52B3AEBE41037C"><enum>(1)</enum><header>In general</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) for purposes of carrying out this section.</text></paragraph><paragraph id="H96174E6513FB4F07868C84AAC8D43188" display-inline="no-display-inline"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the President shall issue regulations or other guidance as may be necessary for the implementation of this section.</text></paragraph></subsection><subsection id="H1ECC5ABD3AA64EB28DFB043D699ABA71" commented="no"><enum>(g)</enum><header>Additional exemptions</header><paragraph id="H5E6253FA49504A4F8B3AB679D3588BCF"><enum>(1)</enum><header>Status of forces agreements</header><text display-inline="yes-display-inline">The President may exempt the application of measures under this section with respect to a foreign state if the application of such measures would prevent the United States from meeting the terms of any status of forces agreement to which the United States is a party.</text></paragraph><paragraph id="HB8C4BC5D049242FB8B71844B4EDF91F8" commented="no"><enum>(2)</enum><header>Authorized intelligence activities</header><text>Measures under this section shall not apply with respect to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></paragraph><paragraph id="HA7B3978E64054F8ABE67152DC98F17E4"><enum>(3)</enum><header>Humanitarian exemption</header><text>The President may waive the application of any provision of this section if the President certifies in writing to the appropriate congressional committees that such a waiver is vital to facilitate the delivery of humanitarian aid and is consistent with the national security interests of the United States 15 days prior to the waiver taking effect. </text></paragraph></subsection><subsection id="H4C637710DEBC49FFA37DFDF13070F45E"><enum>(h)</enum><header>Rule of construction</header><text>The authority to impose measures under this section with respect to a foreign state is in addition to the authority to impose measures under any other provision of law with respect to foreign states that directly or indirectly support acts of international terrorism.</text></subsection></section><section id="H1D9C08D8A9364DACB3D3C85E1D8047C3"><enum>5.</enum><header>Reports on activities to disrupt global fundraising, financing, and money laundering activities of Hamas, Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den or any affiliate or successor thereof</header><subsection id="HF01FF2DBA8994422A139ED904DD2CD31"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, and every 180 days thereafter, the President shall submit to the appropriate congressional committees a report that includes—</text><paragraph id="H8F9BBBB546D14F568D71B912A82A48E2"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the disposition of the assets and activities of Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof related to fundraising, financing, and money laundering worldwide;</text></paragraph><paragraph id="HEA5B510C87AA465FA43D5075CB5BA839"><enum>(2)</enum><text display-inline="yes-display-inline">a list of foreign states that knowingly providing material, financial, or technical support for, or goods or services to Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof;</text></paragraph><paragraph id="H829940F25456469F83969F617975165B"><enum>(3)</enum><text display-inline="yes-display-inline">a list of foreign states in which Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof conducts significant fundraising, financing, or money laundering activities;</text></paragraph><paragraph id="H7E95BCC311E84A5DB1080358B746A255"><enum>(4)</enum><text display-inline="yes-display-inline">a list of foreign states from which Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliate or successor thereof knowingly engaged in the transfer of surveillance equipment, electronic monitoring equipment, or other means to inhibit communication or the free flow of information in Gaza; and</text></paragraph><paragraph id="H0C51C74765984423A5A6DEBBD49565A3"><enum>(5)</enum><text>with respect to each foreign state listed in paragraph (2), (3), or (4)—</text><subparagraph id="H32126C732DE7441F8FB60BE5453FB85C"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the steps the foreign state identified is taking adequate measures to restrict financial flows to Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, or any affiliates or successors thereof; and</text></subparagraph><subparagraph id="HBAE450C399C743FB91F338033CB07ADC"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a foreign state failing to take adequate measures to restrict financial flows to Hamas, Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den or any other designated entity engaged in significant act of terrorism threatening the peace and security of Israel—</text><clause id="HE07CC4AEEEEF40899A2DDA6884026F98"><enum>(i)</enum><text>an assessment of the reasons that government is not taking adequate measures to restrict financial flows to those entities; and</text></clause><clause id="HB70C9200DB764188AB2C2BEFC4E9813C"><enum>(ii)</enum><text>a description of measures being taken by the United States Government to encourage the foreign state to restrict financial flows to those entities; and</text></clause></subparagraph></paragraph></subsection><subsection id="H7297E31EE86749DCAE7A7741C4A34EA8"><enum>(b)</enum><header>Form</header><text>Each report required by subsection (a) shall be submitted in unclassified form to the greatest extent possible, and may contain a classified annex.</text></subsection></section><section id="H9F2E9471499C4FCE9C2DD43AC6FCFFD1"><enum>6.</enum><header>Exception relating to importation of goods</header><subsection id="H050E365AC75B4FA28D063AD5B1DE04E1" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text></subsection><subsection id="HC62F31AEF1724E78ACD3C906B5B985A6"><enum>(b)</enum><header>Good defined</header><text>In this section, the term <quote>good</quote> means any article, natural or man-made substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></subsection></section><section id="HF22334229F7248F9BB28E17AF4F6D395" commented="no"><enum>7.</enum><header>Termination</header><text display-inline="no-display-inline">This Act shall terminate on the earlier of—</text><paragraph id="HDF876FA615E54107970FE8EFDCEE2074"><enum>(1)</enum><text>the date that is 7 years after the date of the enactment of this Act; or</text></paragraph><paragraph id="HB222815E405A4FC6922E56C6A9D59EF8"><enum>(2)</enum><text>the date that is 30 days after the date on which the President certifies to the appropriate congressional committees that—</text><subparagraph id="HBB48B92DE5B34FA28A7F5442D0BE6E3E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Hamas or any successor or affiliate thereof is no longer designated as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>);</text></subparagraph><subparagraph id="H63F2D243DEF64045A619D8E7B483A10C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, and any successor or affiliate thereof are no longer subject to sanctions pursuant to—</text><clause id="HDCC56F65D36F4D3EA0BD847E235A3185" commented="no"><enum>(i)</enum><text>Executive Order No. 12947 (January 23, 1995; relating to prohibiting transactions with terrorists who threaten to disrupt the Middle East peace process); and</text></clause><clause id="H73503D848629459F8B3E03F510CBA70E" commented="no"><enum>(ii)</enum><text>Executive Order No. 13224 (September 23, 2001; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism); and</text></clause></subparagraph><subparagraph id="H28C84C72DADB4E09BA6A3A2C90E2BC04" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Hamas, the Palestinian Islamic Jihad, Al-Aqsa Martyrs Brigade, the Lion’s Den, and any successor or affiliate thereof meet the criteria described in paragraphs (1) through (4) of section 9 of the Palestinian Anti-Terrorism Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/22/2378b">22 U.S.C. 2378b</external-xref> note).</text></subparagraph></paragraph></section><section id="HD57EB431051B4C29AADEB1125B7985AB"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7EBE11B3DCB245FB8694CAFD6682B442"><enum>(1)</enum><header>Act of terrorism</header><text>The term <quote>act of terrorism</quote> means an activity that—</text><subparagraph id="H232DB202D014447DB3CCB6CE0301FF61"><enum>(A)</enum><text>involves a violent act or an act dangerous to human life, property, or infrastructure; and</text></subparagraph><subparagraph id="HC185061ADFD44BBFB96293E143DC9931"><enum>(B)</enum><text>appears to be intended to—</text><clause id="H711228134FBC41AD80F8D73573C25930"><enum>(i)</enum><text>intimidate or coerce a civilian population;</text></clause><clause id="H7812CAA267FA490B9563FFAE16589C62"><enum>(ii)</enum><text>influence the policy of a government by intimidation or coercion; or</text></clause><clause id="H4140F2FBA7974D028A4A1C5E0C7DAEE6"><enum>(iii)</enum><text>affect the conduct of a government by mass destruction, assassination, kidnapping, or hostage-taking.</text></clause></subparagraph></paragraph><paragraph id="H8AC004050572487BB8473204689BA12A"><enum>(2)</enum><header>Admitted</header><text>The term <quote>admitted</quote> has the meaning given such term in section 101(a)(13)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(13)(A)</external-xref>).</text></paragraph><paragraph id="HE3B7D2B7E03B4B56897A9B3E727F6FDB"><enum>(3)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph id="H5A15B681BBCC46ECB7B462606AE7E063"><enum>(A)</enum><text>the Committee on Foreign Affairs and the Committee on Financial Services of the House of Representatives;
