<section id="H735DC6D13FBE4C9CBC843C212CBCF5F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hamas International Financing Prevention Act</short-title></quote>.</text></section> <section id="HA0A02954C1234866BC4F79493DC09B94"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States—</text>
<paragraph id="H94548DC2DDE64293A0A0C2BD907C9EC2"><enum>(1)</enum><text>to prevent Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof from accessing its international support networks; and</text></paragraph> <paragraph id="HD46FC0B65F784B528415EE3C6F427493"><enum>(2)</enum><text display-inline="yes-display-inline">to oppose Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof from attempting to use goods, including medicine and dual use items, to smuggle weapons and other materials to further acts of terrorism.</text></paragraph></section>
<section id="HE2FD39E9A1FE41FA9D6A9E5A34B6B675"><enum>3.</enum><header>Imposition of sanctions with respect to foreign persons and agencies and instrumentalities of foreign states supporting Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof</header>
<subsection id="H97EC70D10CE64B16B67359EBBF5C980A"><enum>(a)</enum><header>Identification</header>
<paragraph id="HF3E4DA5C11C64BECAE11BD05CBACDF4E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter for a period not to exceed 3 years, the President shall submit to the appropriate congressional committees a report that identifies each foreign person or agency or instrumentality of a foreign state that the President determines—</text> <subparagraph id="H8E592EEEA1CD4755B191E468E274B41D"><enum>(A)</enum><text display-inline="yes-display-inline">knowingly assists in, sponsors, or provides significant financial or material support for, or financial or other services to or in support of, the terrorist activities of any person described in paragraph (2); or</text></subparagraph>
<subparagraph id="H179EDE0FBB2F4A709D18565BBA3469EE"><enum>(B)</enum><text>directly or indirectly, knowingly and materially engaged in a significant transaction with any person described in paragraph (2).</text></subparagraph></paragraph> <paragraph commented="no" id="H0A390BDEC9D54CEEA546B80956457CD9"><enum>(2)</enum><header>Person described</header><text>A person described in this paragraph is a foreign person that the President determines—</text>
<subparagraph commented="no" id="H46A12413F73A42F48237FB36545CEF4A"><enum>(A)</enum><text display-inline="yes-display-inline">is a senior member of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof;</text></subparagraph> <subparagraph commented="no" id="H12697B7C7BD942AD8CA14A9B9D64E42F"><enum>(B)</enum><text display-inline="yes-display-inline">is a senior member of a foreign terrorist organization designated pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>) whose members directly or indirectly support the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof by knowingly engaging in a significant transaction with, or providing financial or material support for Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, or any person described in subparagraph (A); or</text></subparagraph>
<subparagraph commented="no" id="HD81C7227A364465EB083A7EA41D4D93B"><enum>(C)</enum><text display-inline="yes-display-inline">directly or indirectly, supports the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof by knowingly and materially assisting, sponsoring, or providing financial or material support for, or goods or services to or in support of, Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, or any person described in subparagraph (A) or (B).</text></subparagraph></paragraph> <paragraph id="H6D52233614E74498B6C7F960BCDEC95E"><enum>(3)</enum><header>Form of report</header><text>Each report required under paragraph (1) shall be submitted in unclassified form, but may contain a classified annex.</text></paragraph>
<paragraph commented="no" id="HAD75B43FB75D4D83BCE8523A90B652A8"><enum>(4)</enum><header>Exception</header>
<subparagraph commented="no" id="H72309B963F1045449645A9D208C800B7"><enum>(A)</enum><header>In general</header><text>The President shall not be required to identify a foreign person or an agency or instrumentality of a foreign state in a report pursuant to paragraph (1)(B) if—</text> <clause commented="no" id="HEE16768864264A729505DC69A771BC90"><enum>(i)</enum><text>the foreign person or agency or instrumentality of a foreign state notifies the United States Government in advance that it proposes to engage in a significant transaction as described in paragraph (1)(B); and</text></clause>
<clause commented="no" id="HF7B9971BC94A4287A5434A032036EB7F"><enum>(ii)</enum><text>the President determines and notifies the appropriate congressional committees in a classified form not less than 15 days prior to the foreign person or agency or instrumentality of a foreign state engaging in the significant transaction that the significant transaction is in the national interests of the United States.</text></clause></subparagraph> <subparagraph commented="no" id="HFDD5A93AE3724DF091925294076FF9D5"><enum>(B)</enum><header>Non-applicability</header><text>Subparagraph (A) shall not apply with respect to—</text>
<clause commented="no" id="H1D1BF880E3FC47079E069F87F43930B2"><enum>(i)</enum><text>an agency or instrumentality of a foreign state which the Secretary of State determines has repeatedly provided support for acts of international terrorism pursuant to section 1754(c) of the Export Reform Control Act of 2018, section 40 of the Arms Export Control Act, section 620A of the Foreign Assistance Act of 1961, or any other provision of law; or</text></clause> <clause commented="no" id="HC492DC4E4B6944F3BFBB05A06B85458C"><enum>(ii)</enum><text>any significant transaction described in paragraph (1)(B) that involves, directly or indirectly, a foreign state described in clause (i).</text></clause></subparagraph></paragraph></subsection>
<subsection id="HFAFAA6A7D84B4F5C9A84F65B6B05780D"><enum>(b)</enum><header>Imposition of sanctions</header>
<paragraph id="H107C7DB9C0E546AEAEDA6229ACB9C067"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall impose two or more of the sanctions described in paragraph (2) with respect to a foreign person or an agency or instrumentality of a foreign state identified pursuant to subsection (a).</text></paragraph> <paragraph id="H1EF5AE4F7E3F42E590190F65821F5DFB"><enum>(2)</enum><header>Sanctions described</header><text>The sanctions referred to in paragraph (1) are the following:</text>
<subparagraph commented="no" id="H8F0A207DB35C46629B867A64417D5C6B"><enum>(A)</enum><text display-inline="yes-display-inline">The President may direct the Export-Import Bank of the United States not to give approval to the issuance of any guarantee, insurance, extension of credit, or participation in the extension of credit in connection with the export of any goods or services to the foreign person or agency or instrumentality of the foreign state, and the Export-Import Bank of the United States shall comply with any such direction.</text></subparagraph> <subparagraph id="H2600E4A77CDA463597CC79EC048B9273"><enum>(B)</enum><text>No sales of any defense articles, defense services, or design and construction services under the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>) may be made to the foreign person or agency or instrumentality of the foreign state.</text></subparagraph>
<subparagraph id="H72D4E06D5664400787C7E17A6CD217F9"><enum>(C)</enum><text display-inline="yes-display-inline">No licenses for export of any item on the United States Munitions List that include the foreign person or agency or instrumentality of the foreign state as a party to the license may be granted.</text></subparagraph> <subparagraph id="H84D548F75D264916AD99237AC162277B"><enum>(D)</enum><text display-inline="yes-display-inline">No exports may be permitted to the foreign person or agency or instrumentality of the foreign state of any goods or technologies controlled for national security reasons under the Export Administration Regulations, except that such prohibition shall not apply to any transaction subject to the reporting requirements of title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413 et seq.</external-xref>; relating to congressional oversight of intelligence activities).</text></subparagraph>
<subparagraph id="HEFDC2FD123F64074817B4421385D65B9"><enum>(E)</enum><text display-inline="yes-display-inline">The President shall prohibit any United States financial institution from making loans or providing any credit or financing totaling more than $10,000,000 to the foreign person or agency or instrumentality of the foreign state, except that this subparagraph shall not apply—</text> <clause id="H8CE0BAB942014445BA86F98EFC840022"><enum>(i)</enum><text>to any transaction subject to the reporting requirements of title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/413">50 U.S.C. 413 et seq.</external-xref>; relating to congressional oversight of intelligence activities);</text></clause>
<clause id="H41581971969A4C1EA9812622899F2DB9"><enum>(ii)</enum><text>to the provision of medicines, medical equipment, and humanitarian assistance; or</text></clause> <clause id="HEE1966D404E04971BB740030A5F89F9A"><enum>(iii)</enum><text>to any credit, credit guarantee, or financial assistance provided by the Department of Agriculture to support the purchase of food or other agricultural commodities.</text></clause></subparagraph>
<subparagraph commented="no" id="H9C47AC88CCA6418AA6E50371CAB5E24E"><enum>(F)</enum>
<clause commented="no" display-inline="yes-display-inline" id="HE698DD5A710C4F6E8DDE9AB8F3664A37"><enum>(i)</enum><text>The President may exercise all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person or agency or instrumentality of the foreign state if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></clause> <clause id="H1A6D4256F7524984A6358E5202DD7623" indent="up1"><enum>(ii)</enum><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that knowingly violates, attempts to violate, conspires to violate, or causes a violation of regulations promulgated under section 6(b) to carry out clause (i) to the same extent that such penalties apply to a person that knowingly commits an unlawful act described in section 206(a) of that Act.</text></clause>
<clause id="HE1D63DD6B69B4BC39985A2D51620798A" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The President may exercise all authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) for purposes of carrying out clause (i).</text></clause></subparagraph></paragraph> <paragraph commented="no" id="HBA1FBB2E147247698B99BCEAE7E59401"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">The President shall not be required to apply sanctions with respect to a foreign person or an agency or instrumentality of a foreign state identified pursuant to subsection (a) if the President certifies in writing to the appropriate congressional committees that—</text>
<subparagraph commented="no" id="H3F436A931C624D0F889AEBBAF59C021A"><enum>(A)</enum><text display-inline="yes-display-inline">the foreign person or agency or instrumentality of the foreign state—</text> <clause commented="no" id="H9F9AFCAA34804F9D8DA780DFB4B45A0A"><enum>(i)</enum><text display-inline="yes-display-inline">is no longer carrying out activities or transactions for which the sanctions were imposed pursuant to this subsection; or</text></clause>
<clause commented="no" id="H34E754140E1A49B295D14C4F441D42F8"><enum>(ii)</enum><text display-inline="yes-display-inline">has taken and is continuing to take significant verifiable steps toward terminating the activities or transactions for which the sanctions were imposed pursuant to this subsection; and</text></clause></subparagraph> <subparagraph commented="no" id="H15646950F4C44CCA86DAB50F423FD7B6"><enum>(B)</enum><text>the President has received reliable assurances from the foreign person or agency or instrumentality of the foreign state that it will not carry out any activities or transactions for which sanctions may be imposed pursuant to this subsection in the future.</text></subparagraph></paragraph></subsection>
<subsection commented="no" id="HE20B174D64AC4E08AFACE4249C6FC8B8"><enum>(c)</enum><header>Waiver</header>
<paragraph commented="no" id="H7624136563EB420FA1FA902955D9448A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive, on a case-by-case basis and for a period of not more than 180 days, a requirement under subsection (b) to impose or maintain sanctions with respect to a foreign person or agency or instrumentality of a foreign state if the President—</text> <subparagraph commented="no" id="H3FC56D70086147AF84C1AC68F09906F9"><enum>(A)</enum><text display-inline="yes-display-inline">determines that the waiver is in the national security interest of the United States; and</text></subparagraph>
<subparagraph commented="no" id="H84323EBDA942408A93B3C11D23FFCF88"><enum>(B)</enum><text>not less than 30 days before the waiver takes effect, submits to the appropriate congressional committees a report on the waiver and the justification for the waiver.</text></subparagraph></paragraph> <paragraph commented="no" id="H69EB9544488548D688DC91750DC341A7"><enum>(2)</enum><header>Renewal of waiver</header><text>The President may, on a case-by-case basis, renew a waiver under paragraph (1) for additional periods of not more than 180 days if the President—</text>
<subparagraph commented="no" id="H707C3EFFE27F42C69B47859B99D2AC01"><enum>(A)</enum><text>determines that the renewal of the waiver is in the national security interest of the United States; and</text></subparagraph> <subparagraph commented="no" id="H33769EBC38204100A29708C12239E7B7"><enum>(B)</enum><text>not less than 15 days before the waiver expires, submits to the appropriate congressional committees a report on the renewal of the waiver and the justification for the renewal of the waiver.</text></subparagraph></paragraph></subsection>
<subsection id="H032CCF5165384B1A90A0D107534464C0"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">The authority to impose sanctions under subsection (b) with respect to a foreign person or an agency or instrumentality of a foreign state identified pursuant to subsection (a) is in addition to the authority to impose sanctions under any other provision of law with respect to foreign persons or agencies or instrumentalities of foreign states that directly or indirectly support international terrorism.</text></subsection> <subsection id="H03AFCE5E65D34C69A066F0219EDFFCC0"><enum>(e)</enum><header>Definitions</header><text>In this section:</text>
<paragraph commented="no" id="H0EC60A0674E6467B9036A8D0B5DDAC63"><enum>(1)</enum><header>Foreign state</header><text>The term <term>foreign state</term> has the meaning given such term in section 1603(a) of title 28, United States Code.</text></paragraph> <paragraph id="HC980436254054D10859AF11FBEF184B7"><enum>(2)</enum><header>Agency or instrumentality</header><text display-inline="yes-display-inline">The term <term>agency or instrumentality</term> has the meaning given such term in section 1603(b) of title 28, United States Code.</text></paragraph></subsection>
<subsection commented="no" id="HB0E877BA532F4FE5B5AB8C0A9CC73E06"><enum>(f)</enum><header>Effective date</header><text>This section shall take effect on the date of the enactment of this Act and apply with respect to activities and transactions described in subsection (a) that are carried out on or after such date of enactment.</text></subsection></section> <section id="HC9598EADF385478787271D917E948F73"><enum>4.</enum><header>Imposition of sanctions with respect to foreign governments that provide material support for the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof</header> <subsection id="HE65CD05101D94CDB89AAC3D53F86D052"><enum>(a)</enum><header>Identification</header> <paragraph id="HCF74796A0D4948DA8E8B8F38384F75FB"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the President shall submit to the appropriate congressional committees a report that identifies the following:</text>
<subparagraph id="H313E6F0FAAF1402B9A6A75D43D7A215F"><enum>(A)</enum><text>Each government of a foreign country—</text> <clause id="HB6AA143A65B544F6A52A801B2BD5226E"><enum>(i)</enum><text>with respect to which the Secretary of State determines has repeatedly provided support for acts of international terrorism pursuant to section 1754(c) of the Export Control Reform Act of 2018, section 40 of the Arms Export Control Act, section 620A of the Foreign Assistance Act of 1961, or any other provision of law; and</text></clause>
<clause id="H1218968CC1094BB887A3F94C4421B01C"><enum>(ii)</enum><text>with respect to which the President determines has provided direct or indirect material support for the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof.</text></clause></subparagraph> <subparagraph id="H2B9772FE25594CC8A19C6920F9A607FA"><enum>(B)</enum><text>Each government of a foreign country that—</text>
<clause id="H0689E9CD46F5496E8BEFDB3A8699BF15"><enum>(i)</enum><text>is not identified under subparagraph (A); and</text></clause> <clause id="HCA34A4E44C8840FE9A09D6BDA3BB06A7"><enum>(ii)</enum><text display-inline="yes-display-inline">the President determines engaged in a significant transaction so as to contribute knowingly and materially to the efforts by the government of a foreign country described in subparagraph (A)(i) to provide direct or indirect material support for the terrorist activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof.</text></clause></subparagraph></paragraph>
<paragraph id="H11A6EEBEBA9A4C3C9628CF531F139B26"><enum>(2)</enum><header>Form of report</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall be submitted in unclassified form but may contain a classified annex.</text></paragraph></subsection> <subsection id="HBA4BE1A74C324BEA9DD233B3CB45FBC7"><enum>(b)</enum><header>Imposition of sanctions</header> <paragraph id="H575E7F8820FB4F86BDEFBD9D63B1041C"><enum>(1)</enum><header>In general</header><text>The President shall impose the following sanctions with respect to each government of a foreign country identified pursuant to subparagraph (A) or (B) of subsection (a)(1):</text>
<subparagraph id="HD20CF0F9A97B47F8B3BE48098E2534BB"><enum>(A)</enum><text>The United States Government shall suspend, for a period of 1 year, United States assistance to the government of the foreign country.</text></subparagraph> <subparagraph id="H562FBFD09C1845AC96EEA300633A3DFA"><enum>(B)</enum><text>The Secretary of the Treasury shall instruct the United States Executive Director to each appropriate international financial institution to oppose, and vote against, for a period of 1 year, the extension by such institution of any loan or financial or technical assistance to the government of the foreign country.</text></subparagraph>
<subparagraph commented="no" id="H0C312387661F4BFCA89F1C9F4400C384"><enum>(C)</enum><text display-inline="yes-display-inline">No item on the United States Munitions List (established pursuant to section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>)) or the Commerce Control List set forth in Supplement No. 1 to part 774 of title 15, Code of Federal Regulations, may be exported to the government of the foreign country for a period of 1 year.</text></subparagraph></paragraph> <paragraph id="H7E16867D8FF4404795A8A73E282A32BB"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The President shall not be required to apply sanctions with respect to the government of a foreign country pursuant to paragraph (1)—</text>
<subparagraph id="H7CB74B485F204C5EB7079D714C611171"><enum>(A)</enum><text>with respect to materials intended to be used by United States military or civilian personnel at military facilities in the country; or</text></subparagraph> <subparagraph id="HB74124878D29489098EED27FA44A2B11"><enum>(B)</enum><text>if the application of such sanctions would prevent the United States from meeting the terms of any status of forces agreement to which the United States is a party.</text></subparagraph></paragraph></subsection>
<subsection id="H04A9E2A2C068422BA33E920A2E2D0B8E"><enum>(c)</enum><header>Imposition of additional sanctions with respect to foreign governments identified under subsection <enum-in-header>(a)(1)(A)</enum-in-header></header><text>The President shall impose the following additional sanctions with respect to each government of a foreign country identified pursuant to subsection (a)(1)(A):</text> <paragraph id="H99C63D0C367D4BCC8B4499FD2A6620EC"><enum>(1)</enum><text display-inline="yes-display-inline">The President shall, pursuant to such regulations as the President may prescribe, prohibit any transactions in foreign exchange that are subject to the jurisdiction of the United States and in which the government of the foreign country has any interest.</text></paragraph>
<paragraph id="HEF2EEA045B5B4F96854BB197151664AB"><enum>(2)</enum><text>The President shall, pursuant to such regulations as the President may prescribe, prohibit any transfers of credit or payments between one or more financial institutions or by, through, or to any financial institution, to the extent that such transfers or payments are subject to the jurisdiction of the United States and involve any interest of the government of the foreign country.</text></paragraph></subsection> <subsection commented="no" id="HE55CCFFE1F804E18B1ECEA966B475838"><enum>(d)</enum><header>Waiver</header> <paragraph commented="no" id="H8C760CC745064BA496CC9AEF4422D372"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive, on a case-by-case basis and for a period of not more than 180 days, a requirement under subsection (b) or (c) to impose or maintain sanctions with respect to a foreign government identified pursuant to subparagraph (A) or (B) of subsection (a)(1) if the President—</text>
<subparagraph commented="no" id="H494C5C84D32946E88379DEF0C1EBB12B"><enum>(A)</enum><text display-inline="yes-display-inline">determines that the waiver is in the national security interest of the United States; and</text></subparagraph> <subparagraph commented="no" id="HF2211830D29A4B98A6A1F0FA2BA04078"><enum>(B)</enum><text>not less than 30 days before the waiver takes effect, submits to the appropriate congressional committees a report on the waiver and the justification for the waiver.</text></subparagraph></paragraph>
<paragraph commented="no" id="HBC3277B0FBEC46D5AB7CEE9B3D3553C9"><enum>(2)</enum><header>Renewal of waiver</header><text>The President may, on a case-by-case basis, renew a waiver under paragraph (1) for additional periods of not more than 180 days if the President—</text> <subparagraph commented="no" id="H02CE4552DC934CF1BEF3F66CBB9D295C"><enum>(A)</enum><text>determines that the renewal of the waiver is in the national security interest of the United States; and</text></subparagraph>
<subparagraph commented="no" id="HDE9D786D0378400181AC17DEC0F6C749"><enum>(B)</enum><text>not less than 15 days before the waiver expires, submits to the appropriate congressional committees a report on the renewal of the waiver and the justification for the renewal of the waiver.</text></subparagraph></paragraph></subsection> <subsection display-inline="no-display-inline" id="H5F242E7C0CE946C2AEC002BA7DA7647F"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">The authority to impose sanctions under subsection (b) or (c) with respect to each government of a foreign country identified pursuant to subparagraph (A) or (B) of subsection (a)(1) is in addition to the authority to impose sanctions under any other provision of law with respect to governments of foreign countries that provide material support to foreign terrorist organizations designated pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></subsection>
<subsection id="HAE48210297BA48C6925844244744D642"><enum>(f)</enum><header>Termination</header><text display-inline="yes-display-inline">The President may terminate any sanctions imposed with respect to the government of a foreign country pursuant to subsection (b) or (c) if the President determines and notifies the appropriate congressional committees that the government of the foreign country is no longer carrying out activities or transactions for which the sanctions were imposed and has provided assurances to the United States Government that it will not carry out the activities or transactions in the future.</text></subsection> <subsection id="H142C016FD73B4DD3B30D18B95388EC32"><enum>(g)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on the date of the enactment of this Act and apply with respect to activities and transactions described in subparagraph (A) or (B) of subsection (a)(1) that are carried out on or after such date of enactment.</text></subsection></section>
<section id="H26C40AF25C9D4A1D9BE1E013142BAA84"><enum>5.</enum><header>Exemptions from sanctions under sections 3 and 4 relating to provision of humanitarian assistance</header>
<subsection id="HF6874D97DDCF46DFA6B0AC180C69C6FB"><enum>(a)</enum><header>Sanctions under section <enum-in-header>3</enum-in-header></header><text display-inline="yes-display-inline">The following activities shall be exempt from sanctions under section 3:</text> <paragraph display-inline="no-display-inline" id="HB54E4A5597AA412987FBC9B04A0C85C0"><enum>(1)</enum><text>The conduct or facilitation of a transaction for the sale of agricultural commodities, food, medicine, or medical devices to a foreign person described in section 3(a)(2).</text></paragraph>
<paragraph id="HB8C57875D37844CAA8792AA1EF186FFC"><enum>(2)</enum><text display-inline="yes-display-inline">The provision of humanitarian assistance to a foreign person described in section 3(a)(2), including engaging in a financial transaction relating to humanitarian assistance or for humanitarian purposes or transporting goods or services that are necessary to carry out operations relating to humanitarian assistance or humanitarian purposes.</text></paragraph></subsection> <subsection id="H782F7C165598474686B2710F5EE3F8E4"><enum>(b)</enum><header>Sanctions under section <enum-in-header>4</enum-in-header></header><text display-inline="yes-display-inline">The following activities shall be exempt from sanctions under section 4:</text>
<paragraph id="H6E4FB2C7A24947C8B516FC3B84081F43"><enum>(1)</enum><text display-inline="yes-display-inline">The conduct or facilitation of a transaction for the sale of agricultural commodities, food, medicine, or medical devices to Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof described in section 4(a)(1).</text></paragraph> <paragraph id="HFE28FD2B0F024242A8C50C10DC7A16E2"><enum>(2)</enum><text display-inline="yes-display-inline">The provision of humanitarian assistance to Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof described in section 4(a)(1), including engaging in a financial transaction relating to humanitarian assistance or for humanitarian purposes or transporting goods or services that are necessary to carry out operations relating to humanitarian assistance or humanitarian purposes.</text></paragraph></subsection></section>
<section id="H7963C5B67BD342A3BC3186E5F28A924C"><enum>6.</enum><header>Report on activities of foreign countries to disrupt global fundraising, financing, and money laundering activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof</header>
<subsection id="H88644872E764437DA7A9C022653B970F"><enum>(a)</enum><header>Report</header>
<paragraph id="H14BFEC36FDFC4975BFBCB113A691F3EE"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report that includes—</text> <subparagraph id="H2AB595D59DF248CEAE6769582917B4BB"><enum>(A)</enum><text>a list of foreign countries that support Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, or in which Hamas maintains important portions of its financial networks;</text></subparagraph>
<subparagraph id="H124AB654E9EC415DADD5C048BCDE4FF2"><enum>(B)</enum><text>with respect to each foreign country on the list required by subparagraph (A)—</text> <clause id="HE5886B3029A94A32B8626D1CCDAA6839"><enum>(i)</enum><text>an assessment of whether the government of the country is taking adequate measures to freeze the assets of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof within the territory of the country; and</text></clause>
<clause id="H0BEBAED93D254828BBAB52E635E36405"><enum>(ii)</enum><text>in the case of a country the government of which is not taking adequate measures to freeze the assets of Hamas—</text> <subclause id="HE29765ED5CEB44D4A993B3891D70C881"><enum>(I)</enum><text>an assessment of the reasons that government is not taking adequate measures to freeze those assets; and</text></subclause>
<subclause id="H8591A4B307464E7FA13F5DA1065DB062"><enum>(II)</enum><text>a description of measures being taken by the United States Government to encourage that government to freeze those assets;</text></subclause></clause></subparagraph> <subparagraph id="HB49BFB7A8592480B965CDA4FA7AF4228"><enum>(C)</enum><text>a list of foreign countries in which Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, conducts significant fundraising, financing, or money laundering activities;</text></subparagraph>
<subparagraph id="H6F61B96A3DD14924A1AAE4C44F463473"><enum>(D)</enum><text>with respect to each foreign country on the list required by subparagraph (C)—</text> <clause id="HAB2C68E3983D4ED38DD1C3EFA3A68676"><enum>(i)</enum><text display-inline="yes-display-inline">an assessment of whether the government of the country is taking adequate measures to disrupt the fundraising, financing, or money laundering activities of Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof within the territory of the country; and</text></clause>
<clause id="H08F341BB97634E99A3C2006B3000D91D"><enum>(ii)</enum><text>in the case of a country the government of which is not taking adequate measures to disrupt those activities—</text> <subclause id="H5231668DF4A94ACF978359846F20D9FF"><enum>(I)</enum><text>an assessment of the reasons that government is not taking adequate measures to disrupt those activities; and</text></subclause>
<subclause id="H8DCB31AF8A7C4B1AA03006969DE11B73"><enum>(II)</enum><text>a description of measures being taken by the United States Government to encourage that government to improve measures to disrupt those activities; and</text></subclause></clause></subparagraph> <subparagraph id="H0617CB9F1D1C49E1B0CD1D2BFC8A36E5"><enum>(E)</enum><text display-inline="yes-display-inline">a list of foreign countries from which Hamas, the Palestinian Islamic Jihad, or any affiliate or successor thereof, acquires surveillance equipment, electronic monitoring equipment, or other means to inhibit communication or political expression in Gaza.</text></subparagraph></paragraph>
<paragraph id="H4D4C86D3B1AB4245B07E6ABF2B878649"><enum>(2)</enum><header>Form</header><text>The report required by paragraph (1) shall be submitted in unclassified form to the greatest extent possible, and may contain a classified annex.</text></paragraph></subsection> <subsection id="HE801FBD76D77494A81E06C01BD7ABF44"><enum>(b)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter for a period not to exceed 3 years, the Secretary of State, the Secretary of the Treasury, and the heads of other applicable Federal departments and agencies (or their designees) shall provide to the appropriate congressional committees a briefing on the disposition of the assets and activities of Hamas, the Palestinian Islamic Jihad, or any successor or affiliate thereof related to fundraising, financing, and money laundering worldwide.</text></subsection>
<subsection id="H5C8F89C4543F41A996AD229093284C18"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="HCB3648E5404E4398B4379633DB285FFB"><enum>(1)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></paragraph>
<paragraph id="HAAA7AC5B604B425E98748393071C540B"><enum>(2)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate.</text></paragraph></subsection></section> <section id="HE793BDB8FA1C42369086A55E45C5EFE4"><enum>7.</enum><header>Miscellaneous provisions</header> <subsection id="HE3718E5DB1924BE39288FBAF13D3EFD2"><enum>(a)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to apply to the authorized intelligence activities of the United States.</text></subsection>
<subsection id="H327D7A3728EB4C61B67DCC83A0CD09B0"><enum>(b)</enum><header>Regulatory authority</header><text display-inline="yes-display-inline">The President shall, not later than 180 days after the date of the enactment of this Act, promulgate regulations as are necessary for the implementation of this Act.</text></subsection> <subsection id="H90A0F012D19F4D67825E350FE93D4DD8"><enum>(c)</enum><header>Exception relating to importation of goods</header> <paragraph id="H931DDB605170403D9CCB54385929C467"><enum>(1)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph>
<paragraph id="H04BE9AAE6FE5400396EED377C33EC5EE"><enum>(2)</enum><header>Good defined</header><text>In this subsection, the term <term>good</term> means any article, natural or man-made substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection> <subsection commented="no" id="H3610A3AB9D3242688BF287BE31FBEC22"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">This Act shall terminate beginning—</text>
<paragraph commented="no" id="H21F21F50A56D4EDA8147FF8C2C8DEB8F"><enum>(1)</enum><text>30 days after the date on which the President certifies to the appropriate congressional committees that Hamas and the Palestinian Islamic Jihad, or any successor or affiliate thereof—</text> <subparagraph commented="no" id="H6C6E27DEDE854DDE927DCA18F19D7AD8"><enum>(A)</enum><text>are no longer designated as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>);</text></subparagraph>
<subparagraph commented="no" id="H79723354D83F430487F5C29DA3237B4F"><enum>(B)</enum><text>are no longer subject to sanctions pursuant to—</text> <clause id="H1AF25BFD87744810BE10F26248E8DA95"><enum>(i)</enum><text>Executive Order No. 12947 (January 23, 1995; relating to prohibiting transactions with terrorists who threaten to disrupt the Middle East peace process); and</text></clause>
<clause id="HC4F05AE805694DFBA14F00A47517B81D"><enum>(ii)</enum><text>Executive Order No. 13224 (September 23, 2001; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism); and</text></clause></subparagraph> <subparagraph commented="no" id="HAF7B03479BA34522BDFE703138285BEC"><enum>(C)</enum><text display-inline="yes-display-inline">meet the criteria described in paragraphs (1) through (4) of section 9 of the Palestinian Anti-Terrorism Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/22/2378b">22 U.S.C. 2378b</external-xref> note); or</text></subparagraph></paragraph>
<paragraph commented="no" id="H11EAF98F1B04472F90487DD8892C4A73"><enum>(2)</enum><text>3 years after the date of the enactment of this Act,</text></paragraph><continuation-text commented="no" continuation-text-level="subsection">whichever occurs earlier. </continuation-text></subsection></section> <section id="H993390CED00A42BE99C2C5660957A828"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">Except as otherwise provided, in this Act:</text>
<paragraph id="HA5B67D11439445FD89BEFB99B299D7A7"><enum>(1)</enum><header>Admitted</header><text>The term <term>admitted</term> has the meaning given such term in section 101(a)(13)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(13)(A)</external-xref>).</text></paragraph> <paragraph id="H0E1658C54B1047F9B221B2467E4C0F0C"><enum>(2)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate.</text></paragraph>
<paragraph id="HB04F92464AA74D49AF881CA8940D0615"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means—</text> <subparagraph id="H33086FEB21404661B410666D1BE12792"><enum>(A)</enum><text>an individual who is not a United States person; or</text></subparagraph>
<subparagraph id="H8587628124244C87BD3E145E7BB8472F"><enum>(B)</enum><text>a corporation, partnership, or other nongovernmental entity which is not a United States person.</text></subparagraph></paragraph> <paragraph commented="no" id="HD0125D1D55834791B678A72E5E069B13"><enum>(4)</enum><header>Material support</header><text>The term <term>material support</term> has the meaning given the term <term>material support or resources</term> in section 2339A of title 18, United States Code.</text></paragraph>
<paragraph id="H0D126F35C7054B06A5898255AB3F104E"><enum>(5)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph> <paragraph commented="no" id="HA1A3A5417F584BDA84F8F60CF420435E"><enum>(6)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text>
<subparagraph commented="no" id="HC517800780A445618271A884A4425CAB"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph> <subparagraph commented="no" id="HC2DC4880D0C945EDA8A3A7BDBEA3D0A5"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph></section>
