which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide for coverage of dental, vision, and hearing care under the Medicare program.</official-title></form><legis-body id="H697AB2BA25044350A5A7E9F4F728FA53" style="OLC"> 
<section id="H0F565169939647CA8E006741147DFA30" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Dental, Vision, and Hearing Benefit Act of 2023</short-title></quote>.</text></section> <section id="H0D552881D4A547ACB901AE8F61FAB31C"><enum>2.</enum><header>Dental and oral health care</header> <subsection id="HA69A84D48899488E8876FF0F0C1F40A8"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> 
<paragraph id="H5ADE0C668BB84B54AFA1E9FC6B9A48BB"><enum>(1)</enum><text>in subparagraph (II), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph> <paragraph id="HA062E27CD9D242E6A0737691081A8FBE"><enum>(2)</enum><text>in subparagraph (JJ), by adding <quote>and</quote> after the semicolon at the end; and</text></paragraph> 
<paragraph id="HE46AB5AA8C6F4E27A8160B3A68CC6E56"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H1AD771B735154CAB8836345EA6E0BC7A" style="OLC"> <subparagraph id="H808ED75C57A343AC9AA38BBC394C776B" indent="up1"><enum>(KK)</enum><text>dental and oral health services (as defined in subsection (nnn));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HC0D8DA52234945CA8C0BEB770B12C928"><enum>(b)</enum><header>Dental and oral health services defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H1D2FA73525BB4FA39F55B72BAA1293E3" other-style="archaic" style="other"> <subsection commented="no" display-inline="no-display-inline" id="HCF9B25CF83C44B7EB7DCDD238D17DA9D"><enum>(nnn)</enum><header>Dental and oral health services</header><text>The term <term>dental and oral health services</term> means—</text> 
<paragraph id="H9F8BE78FA195456DBD5D1EBBADCDF146"><enum>(1)</enum><text display-inline="yes-display-inline">preventative and screening services, such as oral exams, dental cleanings, dental x-rays, and fluoride treatments;</text></paragraph> <paragraph id="H850231A1DFEF44589233E3ED08D8A3C0"><enum>(2)</enum><text display-inline="yes-display-inline">basic dental services, such as tooth restorations, basic periodontics services, tooth extractions, and oral disease management services;</text></paragraph> 
<paragraph id="HFA2B52F6AED74129A90A2FC05531B0D2"><enum>(3)</enum><text display-inline="yes-display-inline">major dental services, such as major tooth restorations, major periodontics services, bridges, crowns, root canals, and extractions;</text></paragraph> <paragraph id="H52F93000612C4B81AFF77C45C178737C"><enum>(4)</enum><text>emergency dental care; and</text></paragraph> 
<paragraph id="HDDD04C1C927A463EA04C2CB20AE0C411"><enum>(5)</enum><text>other necessary services related to dental or oral health (as defined by the Secretary).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H1885EB571DF948E8A679B86CB046EF5B"><enum>(c)</enum><header>Payment; coinsurance; and limitations</header> <paragraph id="H277BC07AE8C0401EA78AE60000B4EA92"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text> 
<subparagraph id="H84B92E3AFDCD4FB4A7BBB69022361DCF"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(GG)</quote>; and</text></subparagraph> <subparagraph id="H99546E6FD03142E595406F581D872294"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (HH) with respect to dental and oral health services (as defined in section 1861(lll)), the amount paid shall be the payment amount specified under section 1834(aa)</quote>.</text></subparagraph></paragraph> 
<paragraph id="H3D5166B9FBCC487CB4A8319AA746F971"><enum>(2)</enum><header>Payment and limits specified</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HF174C6A85FC2427E84555AF953DA580E" style="OLC"> <subsection id="HC8EC1A34CF114281A40290B21B0305DD"><enum>(aa)</enum><header>Payment and limits for dental and oral health services</header> <paragraph id="H889DED05DDE34384A1B7227091E7CAF2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for dental and oral health services (as defined in section 1861(nnn)) shall be, subject to paragraph (3), the applicable percent (specified in paragraph (2)) of the lesser of the actual charge for the services or the amount determined under the payment basis determined under section 1848.</text></paragraph> 
<paragraph id="H70CB2AA47A264E73B2FC893AB4A8B104"><enum>(2)</enum><header>Applicable percent</header> 
<subparagraph id="H53723BDD25444F70A4786C543AF2ECF7"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), except as provided in subparagraph (B), the applicable percent specified in this paragraph is—</text> <clause id="H38A402B3BE4A4A28A76D5007FD6CC23A"><enum>(i)</enum><text>with respect to services described in section 1861(nnn)(1) furnished during 2024 or a subsequent year, 100 percent; and</text></clause> 
<clause id="H540495AAE4744C929656DFE1F580DC79"><enum>(ii)</enum><text>with respect to services not described in clause (i)—</text> <subclause id="H47009E97E66D410A8A311083511B09FF"><enum>(I)</enum><text>for a year before 2025, 0 percent;</text></subclause> 
<subclause id="H5B97C00802D8471684D7C5EB0F60F61D"><enum>(II)</enum><text>for 2025, 30 percent;</text></subclause> <subclause id="H6F88B2C112F74BD28002C0003DD978D1"><enum>(III)</enum><text>for 2026, 60 percent; and</text></subclause> 
<subclause id="H3A642146BB1E425FA9E9D544FC6B20FA"><enum>(IV)</enum><text>for 2027 and each subsequent year, 80 percent.</text></subclause></clause></subparagraph> <subparagraph id="H70D3E8FA6A73484CB9DF09B123F0AB6A"><enum>(B)</enum><header>Special rule for certain low-income individuals</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the applicable percent specified in this paragraph is, with respect to services furnished to an individual who is a subsidy eligible individual (as defined in section 1860D–14(a)(3)), or who would be a subsidy eligible individual if the individual were enrolled in a prescription drug plan or MA–PD plan—</text> 
<clause id="H660F2B284AB549029336EEF882A20786"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to services described in section 1861(nnn)(1), for 2024 and each subsequent year, 100 percent; and</text></clause> <clause id="H0A86AC60A4594E5B9F6042BADFC5E8DE"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to services not described in clause (i), for 2025 and each subsequent year, 80 percent.</text></clause></subparagraph></paragraph> 
<paragraph id="HA7C80CB6BC324672B8210306CED5E53A"><enum>(3)</enum><header>Limitations and Secretarial authority</header> 
<subparagraph id="H3DDD7613A33948ECB9C3E9C4492B5FF1"><enum>(A)</enum><header>Frequency</header><text>With respect to dental and oral health services that are—</text> <clause id="H97BA2AC79BCF4C4081BC4976B50EE9AF"><enum>(i)</enum><text display-inline="yes-display-inline">routine dental cleanings, payment may be made under this part for only two such cleanings during a 12-month period; and</text></clause> 
<clause id="H3CBB48EE84AD44CEBD483DA2B87034A5"><enum>(ii)</enum><text>routine exams, payment may be made under this part for only two such exams during a 12-month period.</text></clause></subparagraph> <subparagraph id="H6A4E073385314998AD47530D18A4CE35"><enum>(B)</enum><header>Secretarial authority</header> <clause id="HAA043B5F328A4A3CBA2BDA06F39DEA51"><enum>(i)</enum><header>Authority to apply additional limitations</header><text display-inline="yes-display-inline">The Secretary may apply such other reasonable limitations on the extent to which dental and oral services are covered under this part, including through application of a prior authorization requirement.</text></clause> 
<clause id="HC9157026036743538BCEFAB71D94425C"><enum>(ii)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of dental and oral health services to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></clause> <clause id="HD65B262F2E10411E8A18A0E3B5D5C95E"><enum>(iii)</enum><header>Authority to waive frequency limitations</header><text>Notwithstanding subparagraph (A), the Secretary may waive any frequency limitation under such subparagraph for an individual (or category of individuals) if determined appropriate by the Secretary. </text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFCD392B406F14270BF4DC03B20AC44A5"><enum>(d)</enum><header>Payment under physician fee schedule</header><text>Section 1848(j)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(j)(3)</external-xref>) is amended by inserting <quote>(2)(KK),</quote> before <quote>(3)</quote>.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HBEEE1FCC1D274036B13DA0507512DC78"><enum>(e)</enum><header>Dentures</header> <paragraph id="HA583A9FF7EC842B49EA3D44A2484D336"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(s)(8) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(8)</external-xref>) is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H305CE01970BB45F591171A0666C41912"><enum>(A)</enum><text>by striking <quote>(other than dental)</quote> and inserting <quote>(including dentures)</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB4E6F8AF22AB47269AE01C2BCB82265C"><enum>(B)</enum><text>by striking <quote>internal body</quote>.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9551CB2CE2884102AFD39D8B7CB5746F"><enum>(2)</enum><header>Special payment rules</header><text>Section 1834(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="HA39633E5C0D84DB0B72FF44695138608" style="OLC"> <paragraph id="HB7E601BE61994E6A876BB4BA07DF28B7"><enum>(23)</enum><header>Payment and limits for dentures</header> <subparagraph id="HF4210C07AD4F412C854528F96D793F29"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for dentures shall be, subject to subparagraph (C), the applicable percent (specified in subparagraph (B)) of the amount otherwise payable for such dentures under this section.</text></subparagraph> 
<subparagraph id="H70DB0E32249D428BA0F82F73E194054F"><enum>(B)</enum><header>Applicable percent</header><text>For purposes of subparagraph (A), the applicable percent specified in this subparagraph is—</text> <clause id="H0A126D3123C945FAAFEC197DA8ED1524"><enum>(i)</enum><text>for a year before 2025, 0 percent; and</text></clause> 
<clause id="HBB5B71D0608B422E90B3C1C50E7035B4"><enum>(ii)</enum><text>for 2025 and each subsequent year, 80 percent.</text></clause></subparagraph> <subparagraph id="H8CFF29D0A1F546C5B829438567564840"><enum>(C)</enum><header>Limitations and Secretarial authority</header> <clause id="H05F198BECC114682BAE095A4BC9B2B66"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Payment may be made under this part for an individual for—</text> 
<subclause id="HEFB3ECB59419495D895B4284F671D15E"><enum>(I)</enum><text display-inline="yes-display-inline">not more than one full upper and one full lower denture once every five years; and</text></subclause> <subclause id="HF4969B07788E4427B5B7C63A4802707A"><enum>(II)</enum><text display-inline="yes-display-inline">not more than one partial upper denture and one partial lower denture once every five years.</text></subclause></clause> 
<clause id="H5B027A84877849FAAE168FD2E610BB53"><enum>(ii)</enum><header>Secretarial authority</header> 
<subclause id="HF23CB920CB8B43EFB886A61EBF558FC7"><enum>(I)</enum><header>Authority to apply additional limitations</header><text display-inline="yes-display-inline">The Secretary may apply such other reasonable limitations on the extent to which dentures are covered under this part, including through application of a prior authorization requirement.</text></subclause> <subclause display-inline="no-display-inline" id="H4CAF0101BD754773BA03D338FC1E4EF3"><enum>(II)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of dentures to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></subclause> 
<subclause id="HEAAD31569E00445A91FE6E1E114891B0" display-inline="no-display-inline"><enum>(III)</enum><header>Authority to waive frequency limitations</header><text>Notwithstanding clause (i), the Secretary may waive any frequency limitation under such clause for an individual (or category of individuals) if determined appropriate by the Secretary. </text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H591439B9E2504234B95E7241E5603C44"><enum>(f)</enum><header>Repeal of ground for exclusion</header><text>Section 1862(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y</external-xref>) is amended by striking paragraph (12).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HCD4F93617B8D4ACAA053082FA5D76883"><enum>(g)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to services furnished on or after January 1, 2024.</text></subsection></section> <section id="H0E33ED1B5F05446A91018D45B089F812"><enum>3.</enum><header>Vision care</header> <subsection id="H139C69A2657347068003C428A290A718"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>), as amended by section 2, is further amended—</text> 
<paragraph id="HD74081972C1A4BB48EF9ED2DDAE188BB"><enum>(1)</enum><text>in subparagraph (JJ), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph> <paragraph id="H84A1F295E0254DF488A30016BE043F76"><enum>(2)</enum><text>in subparagraph (KK), by adding <quote>and</quote> after the semicolon at the end; and</text></paragraph>

<subclause id="H92CDB35C281A440B822734C161FDCFBF"><enum>(II)</enum><text display-inline="yes-display-inline">not more than one set of eyeglass frames during any 24-month period in an amount not exceeding $100; and</text></subclause> <subclause id="H0B23B65604AD4326BD1F19962AF2FB6F"><enum>(III)</enum><text display-inline="yes-display-inline">contact lenses, only to the extent that the sum of such payments for contact lenses does not exceed a limitation of $200 during any 24-month period beginning during the first year beginning at least six months after the date of the enactment of this paragraph (or, beginning during a subsequent year, such limitation for a 24-month period beginning in the previous year increase by an appropriate inflation adjustment specified by the Secretary).</text></subclause></clause>

<paragraph id="HE77977FD44174BB2A2058E5A15CAEF9F"><enum>(25)</enum><header>Payment and limits for low vision devices</header> 
<subparagraph display-inline="no-display-inline" id="HAB25BFB6649349AA8EAEDCF5AF1F1CCE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The payment amount under this part for low vision devices shall be 80 percent of the amount otherwise payable for low vision devices under this section.</text></subparagraph> <subparagraph commented="no" id="H80BF0AEFA0EB49109457B0943304EAB4"><enum>(B)</enum><header>Secretarial authority</header> <clause id="HEC3C28936E7A41A1A17358AA6D364F68"><enum>(i)</enum><header>Authority to apply limitations</header><text display-inline="yes-display-inline">The Secretary may apply reasonable limitations on the extent to which low vision devices are covered under this part, including through application of a prior authorization requirement.</text></clause> 
<clause id="HC0A60DF1A2AF48AE8E0192811534504D"><enum>(ii)</enum><header>Authority to modify coverage</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, if the Secretary determines appropriate, the Secretary may modify the coverage under this part of low vision devices to the extent that such modification is consistent with the recommendations of the United States Preventive Services Task Force.</text></clause></subparagraph> <subparagraph id="H6BAF1C11438445F78FCB4B4DD01014EC"><enum>(C)</enum><header>Low vision device defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>low vision device</term> means a device, prescribed by a physician, that magnifies, enhances, or otherwise augments or interprets visual images irrespective of the size, form, or technological features of such device and does not include ordinary eyeglasses or contact lenses. In the previous sentence, the term <term>ordinary eyeglasses or contact lenses</term> means lenses that are intended to fully correct visual acuity or fully eliminate refractive error.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H63CD2E9B47F84D1B8A03852668C1A0B4"><enum>(f)</enum><header>Definition of durable medical equipment To include eyeglasses, contact lenses, and low vision devices</header><text>Section 1861(n) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(n)</external-xref>) is amended—</text> <paragraph id="H4354CD82DCE1473DBD4B05633C297DA4"><enum>(1)</enum><text>by striking <quote>and</quote> before <quote>eye tracking</quote> and inserting a comma; and</text></paragraph>

<subsection id="HE89240C0C80F4ECB9A1656ACE3416C4A"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to services furnished on or after January 1, 2024.</text></subsection></section> <section id="HF89EAF2EA0AF411596D9A09EB5ACA1C5"><enum>5.</enum><header>Nonapplication of competitive acquisition to certain items</header><text display-inline="no-display-inline">Section 1847(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)(2)</external-xref>) is amended—</text> 
<paragraph id="HDFDD3723A97E4E9EB13BA167E9818A8B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and excluding</quote> and inserting <quote>excluding</quote>; and</text></paragraph> <paragraph id="HAE570ACEF17A43188ACF44072507EA8D"><enum>(2)</enum><text>by inserting <quote>, and excluding dentures, eyeglass lenses, contact lenses, and hearing aids</quote> before the period at the end. </text></paragraph></section> 
<section id="HA4CCBB857E234B679F95CE76844F2913"><enum>6.</enum><header>Inclusion of an oral health professional on the United States Preventive Services Task Force</header> 
<subsection id="HC57793F6F54041FEA41177E4BA50F4E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The first sentence of section 915(a)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/299b-4">42 U.S.C. 299b–4(a)(1)</external-xref>) is amended by inserting <quote>, including at least 1 oral health professional</quote> before the period at the end.</text></subsection> <subsection id="H691B7D572F94467A9467F568F1F134DA"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply beginning on January 1 of the first year beginning at least 6 months after the date of the enactment of this Act.</text></subsection></section>
